which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HAS00">Armed Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to require the disclosure of a relationship with a foreign principal by any person who is required to submit an application for an energy project to the Secretary of Transportation, and for other purposes.</official-title></form><legis-body id="H430EB126C59E49F4806A0BCCBA6A8F16" style="OLC"><section id="H92DF65BDAF2745769E0E3E62CDA9300F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Airspace Clearinghouse Enhancement Act</short-title></quote> or the <quote><short-title>ACE Act</short-title></quote>.</text></section><section id="H2830074E9D964E43995B55BE07C2871C" section-type="subsequent-section"><enum>2.</enum><header>Structures interfering with air commerce or national security</header><text display-inline="no-display-inline">Section 44718 of title 49, United States Code, is amended—</text><paragraph id="HC076CF80FB4A4B7EB304EC3B2BC45109"><enum>(1)</enum><text>in subsection (f)—</text><subparagraph id="HE229A3CBC2024EF28F935B965D6D39B4"><enum>(A)</enum><text>by striking <quote>As part of an aeronautical study</quote> and inserting the following: </text><quoted-block style="USC" id="HBE34FE930AF44B28921644BB7072A5B9" display-inline="no-display-inline"><paragraph id="H9BD12796002F497F8F371789023B8BDA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">As part of an aeronautical study</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HEC7CE4A444B542F496D330211E94403F"><enum>(B)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively; and</text></subparagraph><subparagraph id="H2EC2FAA79A6C4652A77AB6866DF0425D"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H5B8D3CC6B5AB4CE997114D28FF01560F" display-inline="no-display-inline"><paragraph id="H5BA8EFA7D2404C19B37BD9489323EEFB"><enum>(2)</enum><header>Written testimony required</header><subparagraph id="H0A22CD24D59D43C7902982F9AFE81F5F"><enum>(A)</enum><header>In general</header><text>In making the finding required under paragraph (1)(A), the Secretary of Defense shall—</text><clause id="HCE3A2799A34548D4A270B89FD59E8D3C"><enum>(i)</enum><text display-inline="yes-display-inline">elicit written testimony from the base commander of each military installation—</text><subclause id="HA6491D6B71874F3CAA8A0E4DEA47D9B0"><enum>(I)</enum><text display-inline="yes-display-inline">located within a 25-mile radius of the structure or sanitary landfill described in such paragraph; and</text></subclause><subclause id="H39E5A22901AE4C3D95D6B846B9ACAEB9"><enum>(II)</enum><text>that has a flight route within a 10-mile radius of such structure or sanitary landfill; and </text></subclause></clause><clause id="H04666547A9924A97916978798E6D21BC"><enum>(ii)</enum><text>consider such written testimony in making such finding.</text></clause></subparagraph><subparagraph id="HA541F00CEA134C039CFE31A5476CE762"><enum>(B)</enum><header>Contents</header><text display-inline="yes-display-inline">Each base commander of a military installation who submits written testimony under subparagraph (A) shall describe the extent to which the proposed construction, alteration, establishment, or expansion of a structure or sanitary landfill would impact the operations, military readiness, and military training routes of such military installation.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HD53B3542CFB54559937C3CD49E8D8F21"><enum>(2)</enum><text>in subsection (h) by adding at the end the following:</text><quoted-block style="USC" id="H4B23A6B7B96041F195E0D4523B60591D" display-inline="no-display-inline"><paragraph id="HEEEDB77D0F7C44BCB4B7EA920DC786C9"><enum>(3)</enum><header>Energy project</header><text display-inline="yes-display-inline">The term <quote>energy project</quote> has the meaning given such term in section 183a(h) of title 10.</text></paragraph><paragraph id="H766542DC0ACB415F95BBB91A9CF9D50C"><enum>(4)</enum><header>Foreign principal; agent of a foreign principal</header><text>The terms <quote>foreign principal</quote> and <quote>agent of a foreign principal</quote> have the meaning given such terms in section 1 of the Foreign Agents Registration Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611</external-xref>).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H648E77CAA4BA400AAF7CFE0C099AE18B"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H526914A9BDA44236B3D2CCA028A6E6F6" display-inline="no-display-inline"><subsection id="H205FDBE137604766B9EF9FEB3DCA0CF9"><enum>(i)</enum><header>Special rule for energy projects</header><paragraph id="H00886E5DDE1A413F94F33DA9C56B5C1C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Any person who is required to submit an application for an energy project under this section shall include in such application a disclosure of any relationship such person has with a foreign principal or with an agent of a foreign principal.</text></paragraph><paragraph id="H60AD68D41BCD4982B2477FF25185E5E9"><enum>(2)</enum><header>Inaccurate disclosure of relationship with foreign principal</header><subparagraph id="H8CE3F82475924C33B0EB0B3521517DB7"><enum>(A)</enum><header>In general</header><text>The Secretary of Transportation, in consultation with the Attorney General of the United States, shall establish a process to evaluate the accuracy of a disclosure made under paragraph (1) and determine whether a person has violated such paragraph.</text></subparagraph><subparagraph id="H2F393F61807146E384FC7AB1C4459377"><enum>(B)</enum><header>Initial penalty for inaccurate disclosure</header><text display-inline="yes-display-inline">If the Secretary determines that a person has violated paragraph (1), such person shall be prohibited from submitting an application for an energy project under this section during the period beginning on the date on which the Secretary made the determination under subparagraph (A) and ending on the date that is 2 years after such determination.</text></subparagraph><subparagraph id="H5D296864D04B41FE961BDFCF886A711D"><enum>(C)</enum><header>Penalties for subsequent inaccurate disclosures</header><text display-inline="yes-display-inline">If the Secretary determines that a person violates paragraph (1) after an initial violation under subparagraph (B), such person shall be permanently prohibited from submitting an application for an energy project under this section. </text></subparagraph></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
