<section id="H6DFF0F70735148D49447481725E6895B" section-type="section-one"><enum>1.</enum><header>Impairment prevention, recognition and response training</header><text display-inline="no-display-inline">Part P of title III of the Public Health Service Act is amended by inserting after section 399Q (<external-xref legal-doc="usc" parsable-cite="usc/42/280g-4">42 U.S.C. 280g–4</external-xref>) the following:</text> <quoted-block style="OLC" id="H1080333D2C1A447CAEF84C7A34666A8C" display-inline="no-display-inline"> <section id="H0755251BAAFA41CF97060177A4D101CB"><enum>399Q–1.</enum><header>Impairment prevention, recognition and response training</header> <subsection id="HD664C230C2954623A8CB8D6EEF296C21"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 12 months after the date of the enactment of this section, the Secretary, acting through the Director of the National Institute for Occupational Safety and Health (referred to in this section as the <quote>Secretary</quote>), shall conduct research on programs that includes the elements specified in subsection (b) to educate employers, workers, and relevant workplace populations on—</text> 
<paragraph id="HD3616233A4CD4CF6B7869CE55599A205"><enum>(1)</enum><text display-inline="yes-display-inline">the prevention of impairment from the use of cannabis, opioids, and other drugs; and</text></paragraph> <paragraph id="H0AD13D4C37B144389D75E2DF286EEFF9"><enum>(2)</enum><text display-inline="yes-display-inline">the safety risks resulting from individuals working while impaired from the use of cannabis, opioids, and other drugs.</text></paragraph></subsection> 
<subsection id="HDF6CC5070294447A90D6C00117953A0D"><enum>(b)</enum><header>Workplace training program</header><text display-inline="yes-display-inline">Not later than 12 months after the date of the enactment of this section, the Secretary shall, in consultation with a national nonprofit organization with relevant expertise, develop a workplace training program to be made available to full-time and part-time employees and individuals employed by a State or the Federal Government, which covers the following elements of impairment from the use of cannabis, opioids, and other drugs: </text> <paragraph id="HB15AA77DA7144C0FAD4EA4556D962749"><enum>(1)</enum><text display-inline="yes-display-inline">The impact of impairment from the use of cannabis, opioids, and other drugs on safety on the job.</text></paragraph> 
<paragraph id="HF65E0C7B477F4EB3A49914853E6543DD"><enum>(2)</enum><text>The importance of preventing, recognizing and responding to impairment.</text></paragraph> <paragraph id="H5488DA884FA24B2D985DCD16210A4CD6"><enum>(3)</enum><text display-inline="yes-display-inline">The role of various workplace professionals when recognizing and responding to perceived impairment from the use of cannabis, opioids, and other drugs.</text></paragraph> 
<paragraph id="H593E3C6F326C434E9EB289B0D9A2ED04"><enum>(4)</enum><text display-inline="yes-display-inline">Common signs and symptoms of impairment from the use of cannabis, opioids, and other drugs.</text></paragraph> <paragraph id="H5D02CF374D0A46A2AEAC6BC668956F88"><enum>(5)</enum><text>The steps to respond to perceived impairment.</text></paragraph> 
<paragraph id="H85EBCE2ADC994F8886736525FEA10CF6"><enum>(6)</enum><text>Common workplace impairment prevention measures.</text></paragraph> <paragraph id="HCEDC00D901F04205880659EDCB0B945E"><enum>(7)</enum><text>Guidance on related workplace policies and information on relevant laws and regulations.</text></paragraph></subsection> 
<subsection id="HA8A6077F30E840F789A42B7D97091972"><enum>(c)</enum><header>Employee and employer defined</header><text display-inline="yes-display-inline">In this section, the terms <term>employee</term> and <term>employer</term> have the meanings given such terms in section 3 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/652">29 U.S.C. 652</external-xref>).</text></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block> </section> </legis-body></bill>
