<section display-inline="no-display-inline" id="H78759EC20F1444A898EC0B276C780F9A" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Oversight for Members And Relatives Act</short-title></quote> or the <quote><short-title>OMAR Act</short-title></quote>.</text></section> <section display-inline="no-display-inline" id="HCAA716AC88744389A0B999B31BA87800" section-type="subsequent-section"><enum>2.</enum><header>Prohibiting Use of Campaign Funds to Compensate Spouses of Candidates; Disclosure of Payments Made to Spouses and Family Members</header> <subsection id="H49CAC3A40C164A79877EDE307282FEE3"><enum>(a)</enum><header>Prohibition; Disclosure</header><text>Section 313 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30114">52 U.S.C. 30114</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H348372AECFFC4DF79167D95B8973D960" style="OLC"> 
<subsection id="H266D9064892F4B7996F2132FE7ECE1DC"><enum>(c)</enum><header>Prohibiting Compensation of Spouses; Disclosure of Payments to Spouses and Family Members</header> 
<paragraph id="HBEC694B04CB54B54AD851848EB43CEC9"><enum>(1)</enum><header>Prohibiting compensation of spouses</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, no authorized committee of a candidate or any other political committee established, maintained, or controlled by a candidate or an individual holding Federal office (other than a political committee of a political party) shall directly or indirectly compensate the spouse of the candidate or individual (as the case may be) for services provided to or on behalf of the committee.</text></paragraph> <paragraph id="H4952A05E2E224C83BABD3752874BBACF"><enum>(2)</enum><header>Disclosure of payments to spouses and immediate family members</header><text display-inline="yes-display-inline">In addition to any other information included in a report submitted under section 304 by a committee described in paragraph (1), the committee shall include in the report a separate statement of any payments, including direct or indirect compensation, made to the spouse or any immediate family member of the candidate or individual involved during the period covered by the report.</text></paragraph> 
<paragraph id="H53C1052F768B4CDEBFAF6194C9E6950D"><enum>(3)</enum><header>Immediate family member defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>immediate family member</term> means the son, daughter, son-in-law, daughter-in-law, mother, father, brother, sister, brother-in-law, sister-in-law, or grandchild of the candidate or individual involved.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H9FDDDAA0234C4582BAB593AA8A791828"><enum>(b)</enum><header>Conforming Amendment</header><text>Section 313(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30114">52 U.S.C. 30114(a)(1)</external-xref>) is amended by striking <quote>for otherwise</quote> and inserting <quote>subject to subsection (c), for otherwise</quote>.</text></subsection></section> 
<section id="H7C070200D1B74CE495A162C498881536"><enum>3.</enum><header>Imposition of Penalty Against Candidate or Officeholder</header> 
<subsection id="H795472D72EA647C88F71BA14A53837CB"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Section 309 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30109">52 U.S.C. 30109</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H0DB51EAC475E4BD49AAFDAE800472E4F" style="traditional"> <subsection id="HD9034C6800774732BEF48D2FDD0CA157"><enum>(e)</enum><text>In the case of a violation of section 313(c) committed by a committee described in such section, if the candidate or individual involved knew of the violation, any penalty imposed under this section shall be imposed on the candidate or individual and not on the committee.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2C418188DCE14C1E8244B6D330274907"><enum>(b)</enum><header>Prohibiting Reimbursement by Committee</header><text>Section 313(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30114">52 U.S.C. 30114(c)</external-xref>), as added by section 2(a), is amended—</text> <paragraph id="HFCEDF2A1ACB24C18A10E12EC5D42E1C6"><enum>(1)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></paragraph> 
<paragraph id="HAFCD9B9E46F1402B926DF898F6B004BF"><enum>(2)</enum><text>by inserting after paragraph (2) the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H2254411C53FF4ED4A0B9F620587A527F" style="OLC"> <paragraph id="HA0E9F131743A4B079667DDD720381CE6"><enum>(3)</enum><header>Prohibiting reimbursement by committee of penalty paid by candidate for violations</header><text display-inline="yes-display-inline">A committee described in paragraph (1) may not make any payment to reimburse the candidate or individual involved for any penalty imposed for a violation of this subsection which is required to be paid by the candidate or individual under section 309(e).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section display-inline="no-display-inline" id="H4A39C63B51284DE19325D319CA04510E"><enum>4.</enum><header>Effective Date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply with respect to compensation and payments made on or after the date of enactment of this Act.</text></section> </legis-body></bill>
