R. 8543</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220727">July 27, 2022</action-date><action-desc><sponsor name-id="S001176">Mr. Scalise</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require notice regarding the collection of ambient noise by certain internet-connected devices, to limit the disclosure and retention of information collected through such noise, and to require a mechanism by which such collection may be deactivated and reactivated, and for other purposes.</official-title></form><legis-body id="H7078AB3BB1404C3D924E54984F306009" style="OLC"><section id="H4961F3EB06EC42B8BE83B89E34A12E3C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Earning Approval of Voice External Sound Databasing Retained on People Act</short-title></quote> or the <quote><short-title>EAVESDROP Act</short-title></quote>.</text></section><section id="H5664E530710348F7A30EA1AE82209377"><enum>2.</enum><header>Notices required for collection of ambient noise by covered device</header><subsection id="HE420884672F240E094DD15C076EB3CA7"><enum>(a)</enum><header>One-Time notice at first power-On</header><text>A manufacturer of a covered device shall provide to the user who powers on the device for the first time a notice that contains—</text><paragraph id="H956CD21D57724C35B90CBCFFE1B81AB3"><enum>(1)</enum><text>a description of how and under what circumstances covered information is collected by the manufacturer through the covered device; and</text></paragraph><paragraph id="HA6D9D757B2B5470EA94A5BC2BA1F661E"><enum>(2)</enum><text>a description of the purposes for which the manufacturer processes such covered information, including—</text><subparagraph id="H46BA2A62784C4F8C93C48FB87C262D28"><enum>(A)</enum><text>a description of how long and the circumstances under which the manufacturer retains such covered information; and</text></subparagraph><subparagraph id="H5094BC273D934446BDC598C3D2341556"><enum>(B)</enum><text display-inline="yes-display-inline">whether the manufacturer discloses such covered information to third parties or processes such covered information for targeted advertising.</text></subparagraph></paragraph></subsection><subsection id="HC2BDE1503E394AF888E0895EFF0773C1"><enum>(b)</enum><header>Notice when material change to operating system or firmware</header><text>When there is a material change to the operating system or firmware of a covered device, the manufacturer of the covered device shall provide a notice that the covered device collects covered information. Such notice shall include—</text><paragraph id="H7A144B32530B4D33BEAC2B97DFF83998"><enum>(1)</enum><text>a statement informing the user that the covered device is collecting covered information;</text></paragraph><paragraph id="H60B6E13EA573428589B4A4274B318B9D"><enum>(2)</enum><text>a description of—</text><subparagraph id="HBA69154B28974330A0D4D3DBC74CFDF4"><enum>(A)</enum><text>the covered information collected by the manufacturer through the covered device; and</text></subparagraph><subparagraph id="H37448E1A3ED443219EE0ECC683F6A0AA"><enum>(B)</enum><text>the covered information collected by the manufacturer through the covered device that the manufacturer processes; and</text></subparagraph></paragraph><paragraph id="H45F11B28CE984ED3865EA9C9C7B3E959"><enum>(3)</enum><text>instructions on how an owner of the covered device can deactivate the collection of covered information by the covered device using the mechanism required by section 3.</text></paragraph></subsection><subsection id="HFD4BB29C69804BF1B6CFD65FFF3645CC"><enum>(c)</enum><header>Form</header><text>The notices required by subsections (a) and (b)—</text><paragraph id="HAD5BD50EA5E447E38C7787F773CE5458"><enum>(1)</enum><text>shall be provided electronically in—</text><subparagraph id="H95C40B5166DD418BB835930C467B5E6B"><enum>(A)</enum><text>audio format; and</text></subparagraph><subparagraph id="H2FBF5F26CF684AC2916F55C6D1CAE0B5"><enum>(B)</enum><text>text format, which may include providing a link to a website or other means for accessing the notices online;</text></subparagraph></paragraph><paragraph id="H530C93A8C7AA48348B64D29F13364556"><enum>(2)</enum><text>shall be clear, easily understood, and provided in plain and concise language; and</text></paragraph><paragraph id="HFD1B6EACDA56492BB2104B8F539C1F91"><enum>(3)</enum><text>when a covered device is powered on for the first time, may be provided to the user as a single, combined notice.</text></paragraph></subsection><subsection id="HDACA42995A904578B0D57F869EB2CE7F"><enum>(d)</enum><header>Subsequent availability of information provided in notices</header><text>The manufacturer of a covered device shall ensure that the notices required by subsections (a) and (b) are accessible at any time after being provided under such subsections.</text></subsection></section><section id="H18066472C96C4BEC885079DB572FE43B"><enum>3.</enum><header>Deactivation and reactivation of collection of ambient noise</header><text display-inline="no-display-inline">A manufacturer of a covered device shall provide a reasonable and easy mechanism by which an owner of the device may—</text><paragraph id="H559ED3F632D7429B8796587994086C4C"><enum>(1)</enum><text>deactivate the ability of the device to collect covered information; and</text></paragraph><paragraph id="H9A5FD826A9A64E0996D276C59CC11E95"><enum>(2)</enum><text>if the ability of the device to collect covered information has been deactivated under paragraph (1), reactivate such ability.</text></paragraph></section><section id="H5D10F9682694473D935C5E77E09CDB47"><enum>4.</enum><header>Authorized disclosures of covered information</header><subsection id="H740BB38A4F5C4108B86EC6BB6E4DD884"><enum>(a)</enum><header>In general</header><text>A manufacturer of a covered device may disclose covered information to a third party only if the manufacturer is acting in good faith and only for the following purposes:</text><paragraph id="H13AAD8EA2C0348DD98F1D03813ABF02F"><enum>(1)</enum><text>To respond to or comply with a valid subpoena, court order, or warrant (including a subpoena or court order obtained by a person that is not a government entity), or to provide information as otherwise required by law.</text></paragraph><paragraph id="HE4C640DF8BD54268A16993A190C6E179"><enum>(2)</enum><text>To respond to a circumstance that would cause a reasonable person to believe that disclosure of the covered information to the third party is necessary to prevent physical harm to an individual.</text></paragraph></subsection><subsection id="HB982CBBBB8F6472C916173DB0E27CE66"><enum>(b)</enum><header>Notice of disclosure</header><paragraph id="HBA18A134F70B46FFBE480757814A3005"><enum>(1)</enum><header>Requirement</header><text>Unless prohibited by law, a manufacturer of a covered device shall notify a user of such device whose covered information is disclosed to a third party by such manufacturer.</text></paragraph><paragraph id="H2D274E456A694E5C8264C51B4835B8B4"><enum>(2)</enum><header>Contents</header><text>The notice required by paragraph (1) shall include—</text><subparagraph id="H56270C2994B547CCB540078ED9D0C2CF"><enum>(A)</enum><text>a description of the covered information disclosed;</text></subparagraph><subparagraph id="H155A0AF1ADFB47FD9728F42D3D6511EE"><enum>(B)</enum><text>a justification for the necessity of the disclosure; and</text></subparagraph><subparagraph id="H16CD778380964795A6E899777A9A199A"><enum>(C)</enum><text>the name of the third party to which the manufacturer disclosed the covered information.</text></subparagraph></paragraph><paragraph id="H1668CCE6702E4AD5BEC4E61195291541"><enum>(3)</enum><header>Timing</header><text>The notice required by paragraph (1) shall be provided to the user not later than 7 days after such notice can be legally, safely, and practicably provided.</text></paragraph><paragraph id="H3129F62AF2E643DFB4F15AEA8FD7492B"><enum>(4)</enum><header>Form</header><text display-inline="yes-display-inline">The notice required by paragraph (1) shall be provided to the user in a written form (such as by mail or e-mail), if the manufacturer has the necessary contact information for the user. If the manufacturer does not have such contact information, the manufacturer shall provide such notice in a manner consistent with how a typical user interacts with the covered device.</text></paragraph><paragraph id="H587B68A70CCC48D6942704ABE57CE360"><enum>(5)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to require a manufacturer of a covered device to—</text><subparagraph id="H81797A59DA8E4F55A639D745457C6A01"><enum>(A)</enum><text>take an action that would convert information that is not covered information into covered information;</text></subparagraph><subparagraph id="H2164A49816144D07A626371AE868625B"><enum>(B)</enum><text>collect or retain information that the manufacturer would otherwise not collect or retain; or</text></subparagraph><subparagraph id="HBBFECE5B6FBB4273B1E4C4FBAEF65EAC"><enum>(C)</enum><text>retain covered information longer than the manufacturer would otherwise retain such information.</text></subparagraph></paragraph></subsection></section><section id="HF730029985DD44C8BC96C5A3E4EF7FB9"><enum>5.</enum><header>Retention of covered information</header><text display-inline="no-display-inline">A manufacturer of a covered device may not retain covered information for longer than is reasonably necessary for the express purposes for which the covered information is collected.</text></section><section id="H43E7BFB5F76943339150C07E6453541D"><enum>6.</enum><header>Safe harbor</header><subsection id="HA69A6D2508D54A19B9A7AAC0E7FE0AFA"><enum>(a)</enum><header>Deemed compliance</header><text display-inline="yes-display-inline">A manufacturer of a covered device shall be deemed to be in compliance with the requirements of this Act if such manufacturer complies with a set of self-regulatory guidelines, issued by representatives of the marketing or covered devices industries, or by other persons, that is approved under subsection (b).</text></subsection><subsection id="H0A6ED25DBE944B55B4CFE9AC7F6B9175"><enum>(b)</enum><header>Approval of guidelines</header><paragraph id="HAF84A6808D68490E8402E127FA67C11B"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after receiving a request for approval of a set of self-regulatory guidelines described in subsection (a), after notice and comment, the Commission shall—</text><subparagraph id="H66AF7FB555944B638278C3D34CCA4E24"><enum>(A)</enum><text>if the Commission determines that such set of guidelines meets the requirements of this Act, approve such set of guidelines; and</text></subparagraph><subparagraph id="HAE630A599AEF47EE92FF897EE480729E"><enum>(B)</enum><text>if the Commission determines that such set of guidelines does not meet the requirements of this Act, deny approval of such set of guidelines.</text></subparagraph></paragraph><paragraph id="H97EF03FBD28C42A3B7DDE30A3A6B7822"><enum>(2)</enum><header>Written conclusions</header><text>The Commission shall set forth in writing its conclusions relating to a determination under paragraph (1).</text></paragraph></subsection><subsection id="H986DB805C8B1433C8FAA9D8975B47B07"><enum>(c)</enum><header>Appeals</header><text>Final action by the Commission on a request for approval of a set of self-regulatory guidelines described in subsection (a), or the failure of the Commission to act on such a request by the time required by subsection (b)(1), may be appealed to a district court of the United States of appropriate jurisdiction as provided for in section 706 of title 5, United States Code.</text></subsection></section><section id="HF711B2F3F3504D26A484E50E1EAE999C"><enum>7.</enum><header>Enforcement</header><subsection id="HAF940668E0164385B069D61FF00EFA2F"><enum>(a)</enum><header>Enforcement by Federal Trade Commission</header><paragraph id="HB5D35D8CBEA54395A3B415146C47EA2F"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of this Act shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="HFCA3939394BA4F62BD7AFCCEFB2E96FE"><enum>(2)</enum><header>Actions by the Commission</header><text>The Commission shall enforce this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act, and any person who violates this Act shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></paragraph></subsection><subsection id="H2A7A894DECE84D9BA2F9C678F3F42295"><enum>(b)</enum><header>Enforcement by State attorneys general</header><paragraph id="HF1B5DD6DBA714B9F9DAFB6FC82A438A0"><enum>(1)</enum><header>In general</header><text>If the attorney general of a State has reason to believe that any person has committed or is committing a violation of this Act that affects one or more residents of such State, such attorney general may bring a civil action exclusively in an appropriate district court of the United States to—</text><subparagraph id="H87734B4DA68F48B7B842F7E85A643D0E"><enum>(A)</enum><text>enjoin further such violation by the defendant;</text></subparagraph><subparagraph id="H689124D4CA3347C98FCD9762CBCE9F9F"><enum>(B)</enum><text>enforce compliance with this Act;</text></subparagraph><subparagraph id="H667977886DBF4DE7A9D57ABE621076A3"><enum>(C)</enum><text>obtain civil penalties in the amount provided for under subsection (a);</text></subparagraph><subparagraph id="HA41DEE5E9BD64D10AAB6EA553C5DBABF"><enum>(D)</enum><text>obtain other remedies permitted under State law; or</text></subparagraph><subparagraph id="H9D314B34CC204E0596D39422F135AF39"><enum>(E)</enum><text>obtain damages, restitution, or other compensation on behalf of residents of such State.</text></subparagraph></paragraph><paragraph id="HF500299D1B104EA8986CA44FB6B7732C"><enum>(2)</enum><header>Rule of construction</header><text>For purposes of bringing a civil action under paragraph (1), nothing in this subsection may be construed to prevent the attorney general of a State from exercising the powers conferred on such attorney general by the laws of such State to conduct investigations, administer oaths or affirmations, or compel the attendance of witnesses or the production of documentary and other evidence.</text></paragraph><paragraph id="HB4E1ED8A97CB405CB11554000D79C205"><enum>(3)</enum><header>Actions by other State officials</header><subparagraph id="H88B279C44F604AAC8E13532A36BC1883"><enum>(A)</enum><header>In general</header><text>In addition to civil actions brought by attorneys general under paragraph (1), any other officer of a State who is authorized by such State to do so, except for any private person on behalf of such State, may bring a civil action under paragraph (1), subject to the same requirements and limitations that apply under this subsection to civil actions brought by attorneys general.</text></subparagraph><subparagraph id="H6CE4214EDF5F44ECB859E50BD7B212BB"><enum>(B)</enum><header>Savings provision</header><text>Nothing in this subsection may be construed to prohibit an authorized official of a State from initiating or continuing any proceeding in a court of such State for a violation of any civil or criminal law of such State.</text></subparagraph></paragraph></subsection></section><section id="HAEED90F85B8A42C699A57BABE747DE53"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HEF50B7EF77494532802FB116490AF2BF"><enum>(1)</enum><header>Ambient noise</header><text>The term <quote>ambient noise</quote> means human dialogue or any other sound that occurs in the range of the microphone of a covered device, other than during a period that—</text><subparagraph id="H0860B9A8997441209C8BA544E4E77951"><enum>(A)</enum><text display-inline="yes-display-inline">begins when a user of the device says a wake word or uses another mechanism (such as pressing a button on the device) to activate any electronic function of the device; and</text></subparagraph><subparagraph id="HA30943DC862B457F9B88E34C7AF2145E"><enum>(B)</enum><text>ends—</text><clause id="H284AE20572D649FFA07FF48A3B295208"><enum>(i)</enum><text>when the performance of the task or assistance requested by the user has been completed; or</text></clause><clause id="HC213B8B2847B4612939D096834E2DFD8"><enum>(ii)</enum><text>if the user activates an electronic function of the device as described in subparagraph (A) but does not request the performance of a task or assistance within a reasonable time thereafter, at the expiration of such reasonable time.</text></clause></subparagraph></paragraph><paragraph id="HE689EC5DE710437EB0096919E64BEE7D"><enum>(2)</enum><header>Collect</header><text>The term <quote>collect</quote> means, with respect to covered information, obtaining such information in any manner, except when solely transmitting, routing, providing intermediate storage for, or providing connections for such covered information through a system or network.</text></paragraph><paragraph id="HF9EFF5507BC1460EA36A6BB0EEED520D"><enum>(3)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Federal Trade Commission.</text></paragraph><paragraph id="H089A14E592A3478AB75ED47143145DFF" commented="no"><enum>(4)</enum><header>Contents</header><text display-inline="yes-display-inline">The term <quote>contents</quote>, when used with respect to a communication, has the meaning given such term in section 2510 of title 18, United States Code.</text></paragraph><paragraph id="HD734CEE79AD742808D5FE1562483340D"><enum>(5)</enum><header>Covered device</header><text>The term <quote>covered device</quote>—</text><subparagraph id="H98EE0B395A454282AEE18A19AA7519AD"><enum>(A)</enum><text>means an internet-connected device—</text><clause id="H9D8DB7DDF2E948F583E68324839CB5E1"><enum>(i)</enum><text>a component of which is a microphone; and</text></clause><clause id="HBDB27E6AE9BD4537A19BF37BE43D49B3"><enum>(ii)</enum><text>that collects covered information; and</text></clause></subparagraph><subparagraph id="HADF7B4599B574764BBB934FEDC1C904A"><enum>(B)</enum><text>does not include any device that is solely marketed as a microphone.</text></subparagraph></paragraph><paragraph id="H21038B81E8E5480EA0C6C3FFF96C7992"><enum>(6)</enum><header>Covered information</header><text>The term <quote>covered information</quote> means any information (including contents of a communication, date of birth, sex, height, weight, and geolocation information) that—</text><subparagraph id="H8926BB5D985946C7BAA5D205B9CA1B0B"><enum>(A)</enum><text>is obtained through the collection of ambient noise by a covered device; and</text></subparagraph><subparagraph id="H1382D7E83A8D45E69B0039E80EE0208D" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">is linked or reasonably linkable to an individual.</text></subparagraph></paragraph><paragraph id="H50DFA00369F9462A99C5E4568C27EF29"><enum>(7)</enum><header>Data broker</header><text display-inline="yes-display-inline">The term <quote>data broker</quote> means a person whose principal source of revenue is derived from processing or transferring the covered information of individuals with whom the person does not have a direct relationship on behalf of third parties and for the use of third parties.</text></paragraph><paragraph id="H7DB37389F44B41CCA21C489063806462"><enum>(8)</enum><header>Disclose</header><text>The term <quote>disclose</quote> means, with respect to covered information, to sell, release, transfer, share, disseminate, make available, or otherwise communicate or cause to be communicated such information to a third party.</text></paragraph><paragraph id="H1850D814EE6740C29B6FB5C9E16C0AB8"><enum>(9)</enum><header>Government entity</header><text>The term <quote>government entity</quote> means a Federal agency, State, local government, or other organization, as such terms are defined in section 3371 of title 5, United States Code.</text></paragraph><paragraph id="H2BB64350B4464E628D1AB58CFA99419B"><enum>(10)</enum><header>Material</header><text display-inline="yes-display-inline">The term <quote>material</quote> means, with respect to a change to the operating system or firmware of a covered device, that—</text><subparagraph id="H0899BCB4ED4E400B89678C6E57D7C067" commented="no"><enum>(A)</enum><text>the change affects the treatment of covered information by the covered device or the manufacturer; and</text></subparagraph><subparagraph id="HD789C1E9433E4396BCAA323168E9B30E"><enum>(B)</enum><text>knowledge of the change may affect the decision of an average consumer of whether or not to continue using the device. </text></subparagraph></paragraph><paragraph id="HA2711016CDE643BBB95DC308CC751B41"><enum>(11)</enum><header>Owner</header><text>The term <quote>owner</quote> means, with respect to a covered device, any individual who is in possession of the device.</text></paragraph><paragraph id="H62BC9E9256C44FD6BECC9169CB91148E"><enum>(12)</enum><header>Process</header><text>The term <quote>process</quote> means to perform or cause to be performed any operation or set of operations on covered information, whether or not by automated means.</text></paragraph><paragraph id="HF87B8127D1BB4952B2C89D9A15CF951E"><enum>(13)</enum><header>Retain</header><text>The term <quote>retain</quote> means, with respect to covered information, to store, secure, or otherwise maintain or cause the maintenance of such information.</text></paragraph><paragraph id="HA0571F082F9C40C29A909D414477F0A1"><enum>(14)</enum><header>Service provider</header><subparagraph id="H8B93B11CF662439DAFBB74CDF2EFE965"><enum>(A)</enum><header>In general</header><text>The term <quote>service provider</quote> means a person who collects, uses, or discloses covered information for the sole purpose of, and only to the extent that such person is, conducting business activities on behalf of, for the benefit of, under instruction of, and under contractual agreement with another person.</text></subparagraph><subparagraph id="HB162C7A935E84880BDCEC26C3B0C9305"><enum>(B)</enum><header>Limitation of application</header><text>A person shall only be considered a service provider in the course of activities described in subparagraph (A).</text></subparagraph><subparagraph id="H8C605B6B893F4BC784A875829AD9B502" commented="no"><enum>(C)</enum><header>Exclusion</header><text>The term <quote>service provider</quote> does not include a data broker. </text></subparagraph></paragraph><paragraph id="HE4CF1319B78A4A229F1949042CA33485" commented="no"><enum>(15)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means each State of the United States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian Tribe.</text></paragraph><paragraph id="HD7B2E6C76683430AA1FBD08908BC6A31"><enum>(16)</enum><header>Third party</header><text>The term <quote>third party</quote> means, with respect to a person, another person (including a government entity) that—</text><subparagraph id="HB949FA249AA64DC1BF3BFE224621E3E3"><enum>(A)</enum><text display-inline="yes-display-inline">does not (directly or indirectly) control, is not (directly or indirectly) controlled by, and is not (directly or indirectly) under common control with the first person; and</text></subparagraph><subparagraph id="H610479DF0FD14000AB6D297CF6926135"><enum>(B)</enum><text>is not a service provider of the first person.</text></subparagraph></paragraph><paragraph id="HF70B53C58292492583C5F9696A2A0545"><enum>(17)</enum><header>Wake word</header><text display-inline="yes-display-inline">The term <quote>wake word</quote> means a word or phrase used to initiate an electronic function of a covered device.</text></paragraph></section><section id="H5F470126E2584CD5AEDDEE355C9E9637"><enum>9.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act (except for section 6) shall take effect—</text><paragraph id="H2D16BECA5EB84F798C726E595A07830B"><enum>(1)</enum><text display-inline="yes-display-inline">if the Commission first approves a set of self-regulatory guidelines under section 6 before the date that is 1 year after the date of the enactment of this Act, on the date that is 1 year after the date of the enactment of this Act;</text></paragraph><paragraph id="HDDE6FA51B1B946FCB161D309FEFAB776"><enum>(2)</enum><text display-inline="yes-display-inline">if the Commission first approves a set of self-regulatory guidelines under section 6 on or after the date that is 1 year after the date of the enactment of this Act but before the date that is 2 years after the date of the enactment of this Act, on the date on which the Commission approves such set of guidelines; or</text></paragraph><paragraph id="H0CAFEF33152441ABB6D6F146ABCE4B47"><enum>(3)</enum><text display-inline="yes-display-inline">if the Commission does not approve a set of self-regulatory guidelines under section 6 before the date that is 2 years after the date of the enactment of this Act, on the date that is 2 years after the date of the enactment of this Act.</text></paragraph></section></legis-body></bill>
