which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To ensure body armor complies with safety standards, and for other purposes.</official-title></form><legis-body id="HCB0B8207E7784C858E8E9ED8D5F77A5C" style="OLC"><section id="H69FBC7E74FA24C3D8ADE6F0FADCE0754" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Body Armor Safety Act of 2022</short-title></quote>.</text></section><section id="H4E43A486C2054CD3A3F5556EF89476C3"><enum>2.</enum><header>Limitation on importation</header><subsection id="H69471837B62F45089EB760770EA87318"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall take such steps as may be necessary to ensure that no body armor for law enforcement use may be imported into the customs territory of the United States unless it meets the applicable requirements of and receives recognition of compliance from the Compliance Testing Program of the National Institute of Justice as described in section 232 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/162">6 U.S.C. 162</external-xref>).</text></subsection><subsection id="H9A547613917C44E6B96462E614DFACB4"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H4C4AAC47FA054B40BE8D158BD1276010"><enum>(1)</enum><text>The term <quote>customs territory of the United States</quote> has the meaning given the term in General Note 2 of the Harmonized Tariff Schedule of the United States.</text></paragraph><paragraph id="H6EAE7E36039E4B5C87E8462499A729EC"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>body armor</quote> means ballistic-resistant or stab-resistant panels or plates designed to protect the torso and worn in a carrier against the body.</text></paragraph></subsection></section><section id="HCAD9AF0B3B134C22BDF42BAE5926ADE0"><enum>3.</enum><header>Criminal penalty</header><subsection id="H0A81B7108B81461FBA1167340B795014"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">Chapter 47</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H2E38EB14F39E45258063449FD1223949" display-inline="no-display-inline"><section id="H061C1665274743BC9F26E2298114BDB5"><enum>1041.</enum><header>Fraud in connection with body armor</header><subsection id="H7A2C7B4AB356476A98D664ABD87820AB"><enum>(a)</enum><header>Forgery</header><text display-inline="yes-display-inline">Whoever forges, counterfeits, or falsely alters any National Institute of Justice Standard certificate, validation, mark, or any other recognition of compliance with respect to any body armor shall be fined under this title, imprisoned not more than 5 years, or both.</text></subsection><subsection id="H1CF30087DF66448C90C95346289840B0"><enum>(b)</enum><header>Misleading claims of compliance</header><text display-inline="yes-display-inline">Whoever engages in any conduct with intent to convey false or misleading claims of compliance with respect to any body armor such that recognition of compliance may reasonably be believed to have been issued by the National Institute of Justice or its Compliance Testing program shall be fined under this title, imprisoned not more than 5 years, or both.</text></subsection><subsection id="H8DF24630218E4410802062FC3E620310"><enum>(c)</enum><header>Body armor defined</header><text>In this section, the term <quote>body armor</quote> means ballistic-resistant or stab-resistant panels or plates designed to protect the torso and worn in a carrier against the body.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5D6EBB0436C34166986B5280767FBB57"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">chapter 47</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H5B6132CF16884145AF063A5B691A8C8D" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">1041. Fraud in connection with body armor.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H7C7D81267BF14E64A4DAA91269B3BA3F"><enum>4.</enum><header>Limitation on evaluations and testing</header><text display-inline="no-display-inline">Section 232 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/162">6 U.S.C. 162</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H706A4E2DDA294CE68F40DF4A79E1B938" display-inline="no-display-inline"><subsection id="H74A2A90FEF1B477FB5C94B4C435FE4EC"><enum>(h)</enum><header>Limitation</header><text display-inline="yes-display-inline">Law enforcement technology products manufactured at any company on the Entity List of the Export Administration Regulations of the Bureau of Industry Security may not be tested or evaluated or otherwise certified, validated, marked, or recognized as in compliance with standards established and maintained by the Office in accordance with the National Technology Transfer and Advancement Act of 1995 (<external-xref legal-doc="public-law" parsable-cite="pl/104/113">Public Law 104–113</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
