which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/37">chapter 37</external-xref> of title 18, United States Code, to authorize appropriate disclosure of classified information, to appropriately limit the scope of the offense of disclosing classified information, and for other purposes.</official-title></form><legis-body id="H8E81E02D82324C9085C8549233CB90AF" style="OLC"><section id="HC496A641E04A46619E0166C090CFEEC9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Espionage Act Reform Act of 2022</short-title></quote>.</text></section><section id="HFA50C2506222494DB404F9C625300736" section-type="subsequent-section"><enum>2.</enum><header>Disclosure of classified information related to signals intelligence</header><subsection id="HC1F5B97DD32B4F35ACDC0DAA959ACA8E"><enum>(a)</enum><header>Authority To disclose information</header><text display-inline="yes-display-inline">Section 798(c) of title 18, United States Code, is amended by striking <quote>furnishing,</quote> and all that follows and inserting the following: “furnishing of information to—</text><quoted-block display-inline="no-display-inline" id="HABD55CFC3882436B9E8CC7B83BED73F2" style="OLC"><paragraph id="HC89BF63B6F45432A8F66239232AF4CA5"><enum>(1)</enum><text display-inline="yes-display-inline">any Member of the Senate or the House of Representatives;</text></paragraph><paragraph id="H9EA2092CCAEA49B6978DD4934B818E8B"><enum>(2)</enum><text display-inline="yes-display-inline">a Federal court, in accordance with such procedures as the court may establish;</text></paragraph><paragraph id="H5F6445675C07409F9604E3DB24CB3683"><enum>(3)</enum><text>the inspector general of an element of the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)), including the Inspector General of the Intelligence Community;</text></paragraph><paragraph id="H917D481DF35C4FB7BAF7DB60A7DC1B69"><enum>(4)</enum><text>the Chairman or a member of the Privacy and Civil Liberties Oversight Board or any employee of the Board designated by the Board, in accordance with such procedures as the Board may establish;</text></paragraph><paragraph id="HF60CB5C1F39449D187EAB799FE275241"><enum>(5)</enum><text>the Chairman or a commissioner of the Federal Trade Commission or any employee of the Commission designated by the Commission, in accordance with such procedures as the Commission may establish; </text></paragraph><paragraph id="H306FE7EBC5D74782AF260B3A2BD4F240"><enum>(6)</enum><text>the Chairman or a commissioner of the Federal Communications Commission or any employee of the Commission designated by the Commission, in accordance with such procedures as the Commission may establish; or</text></paragraph><paragraph id="HA5B844CDDCB54AAE8C9A29FC21F4F851"><enum>(7)</enum><text>any other person or entity authorized to receive disclosures containing classified information pursuant to any applicable law, regulation, or executive order regarding the protection of whistleblowers.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7C38D8468C844A698CAA6A8459A2FE66"><enum>(b)</enum><header>Authorized persons</header><text>Section 798(b) of title 18, United States Code, is amended—</text><paragraph id="HCDE004CEF39D4304A124870C843C2069"><enum>(1)</enum><text>in the matter preceding the first undesignated paragraph, by striking <quote>this section—</quote> and inserting <quote>this section:</quote>;</text></paragraph><paragraph id="HFC4B3617EA7247AB9A2F37907FE7E213"><enum>(2)</enum><text>by striking <quote>The term <term>classified information</term> means information which, at the time of a violation of this section, is,</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H65DCD82021C44D04AB71555EA6DD07E9" style="OLC"><paragraph id="HA9A694BBFB29435A9754E02B178CFFF4"><enum>(1)</enum><text>The term <term>classified information</term>—</text><subparagraph id="HDE19374D897C4C62A124329D2EC646C1"><enum>(A)</enum><text>means information which, at the time of a violation of this section, is known to the person violating this section to be,</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="H02F4B46433D64968B827B63D60FD77A9"><enum>(3)</enum><text>in paragraph (1), as so designated—</text><subparagraph id="HF47975A26A37401DA9A3319BFE67A7B5"><enum>(A)</enum><text>by inserting <quote>and</quote> after <quote>distribution;</quote>; and</text></subparagraph><subparagraph id="HD8480CB264224BF19719214F58DE708F"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HFB683FD8A87C4AB4B530B3A8C21DF4D4" style="OLC"><subparagraph id="HC2BF139CDDF34DDBBB149FE15C989AA7"><enum>(B)</enum><text>does not include any information that is specifically designated as <quote>Unclassified</quote> under any Executive Order, Act of Congress, or action by a committee of Congress in accordance with the rules of its House of Congress.</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H0E28515D8F9A4D0C942A7EE93CC878C3"><enum>(4)</enum><text>by striking <quote>The terms <term>code,</term><quote>cipher,</quote> and <quote>cryptographic system</quote> include</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H6089F65F804743C18E1369B0F336B1FA" style="OLC"><paragraph id="HE2404FA0A5D94BE4940FC3531E51DB6E"><enum>(2)</enum><text>The terms <term>code</term>, <term>cipher</term>, and <term>cryptographic system</term> include</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="H5FCA7CDBE4C149D7A6B569F5B00341CB"><enum>(5)</enum><text>in paragraph (2), as so designated, by striking <quote>communications;</quote> and inserting <quote>communications.</quote>;</text></paragraph><paragraph id="H20435C5B66374592BE0178CBB87366BF"><enum>(6)</enum><text>by striking <quote>The term ‘foreign</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HDD75F0DB83644A048FC3386781E54DEA" style="OLC"><paragraph id="HF765F8CCA61041FF81C07B3617642917"><enum>(5)</enum><text>The term ‘foreign</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H30111DA62E314BF8B97501672EB1465E"><enum>(7)</enum><text>in paragraph (5), as so designated, by striking <quote>United States;</quote> and inserting <quote>United States.</quote>;</text></paragraph><paragraph id="H9B5339A8F23745DF8C9C26D02FE82546"><enum>(8)</enum><text>by striking <quote>The term ‘communication</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H6F32745B8AFF4974902200443C6FD512" style="OLC"><paragraph id="H9D359F70DA59434DA75888DA333F0151"><enum>(3)</enum><text>The term ‘communication</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H463F483D6DD14871A4EA231C457E5EAF"><enum>(9)</enum><text>in paragraph (3), as so designated, by striking <quote>recipients;</quote> and inserting <quote>recipients.</quote>;</text></paragraph><paragraph id="H6D539BF2D5F04CE18A74C5ABEC4A7FB2"><enum>(10)</enum><text>by transferring paragraph (3), as so designated, to appear after paragraph (2), as so designated; and</text></paragraph><paragraph id="H3CF3F7C5F8F244A6958EC4F2E08C7152"><enum>(11)</enum><text>by striking <quote>The term ‘unauthorized</quote> and all that follows through <quote>for the United States.</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H2B0C015715744DE89B4EA0507C759146" style="OLC"><paragraph id="HFE9EFE88C9094E0E8FC43E2A7D52B1F1"><enum>(6)</enum><text>The term <term>unauthorized person</term> means any person who, or agency which, is not authorized to receive information of the categories set forth in subsection (a) of this section by—</text><subparagraph id="H3373031A062B47D99DA4E0B5107D7BAC"><enum>(A)</enum><text>the President;</text></subparagraph><subparagraph id="HF52C5AE15A2C497EA33C914F1172CB5A"><enum>(B)</enum><text>the head of a department or agency of the United States Government which is expressly designated by the President to engage in communication intelligence activities for the United States; or</text></subparagraph><subparagraph id="H9E2015B707C94FA3AD1A5ACA04D85B57"><enum>(C)</enum><text>an Act of Congress.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HDDEF59CF059A4AA3ADFABE077B675FC9"><enum>(c)</enum><header>Scope of prohibition</header><text>Section 798 of title 18, United States Code, is amended—</text><paragraph id="HE71530F50CFA4A289FA4423942BB70D3"><enum>(1)</enum><text>in subsection (a), in the matter preceding paragraph (1)—</text><subparagraph id="H6BE8A681720E4FEAA1F583612ABD1B2B"><enum>(A)</enum><text>by striking <quote>Whoever</quote> and inserting <quote>Any individual who</quote>; and</text></subparagraph><subparagraph id="HFAE8C81B3EA344388585EF7995D486D4"><enum>(B)</enum><text>by inserting <quote>obtained by the individual while the individual was a covered person and acting within the scope of his or her activities as a covered person</quote> after <quote>any classified information</quote>; and</text></subparagraph></paragraph><paragraph id="HFEFBB60442DE4E20BB629009DAAE1BA8"><enum>(2)</enum><text>in subsection (b), by inserting after paragraph (3), as so designated and transferred by subsection (b) of this section, the following:</text><quoted-block display-inline="no-display-inline" id="H39DD5C9575A24035B7CF497FE33FB572" style="OLC"><paragraph id="H724F4DF4EB7249FC880D20CBC464F6C4"><enum>(4)</enum><text>The term <term>covered person</term> means an individual who—</text><subparagraph id="H398530E45E6D40E9B08A2E4FB840A0E1"><enum>(A)</enum><text>receives official access to classified information granted by the United States Government; </text></subparagraph><subparagraph id="HD3C53C17371D459289525C0142921616"><enum>(B)</enum><text>signs a nondisclosure agreement with regard to such classified information; and </text></subparagraph><subparagraph id="HEBA0EA4052584292B63F672E2F4997E6"><enum>(C)</enum><text>is authorized to receive information of the categories set forth in subsection (a) of this section—</text><clause id="HBEFA5F6A28174DAEB643DFA9EA8875CB"><enum>(i)</enum><text>by the President; or</text></clause><clause id="H1A588A434FF84500AED96CEC1298F8B5"><enum>(ii)</enum><text>the head of a department or agency of the United States Government which is expressly designated by the President to engage in communication intelligence activities for the United States.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H39200B9C45E64FDDABAC18F44A62F6FB"><enum>(d)</enum><header>Limitation on scope</header><text>Section 798 of title 18, United States Code, is amended—</text><paragraph id="H40339849267D4D72A3993E4BC174ED16"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (e); and</text></paragraph><paragraph id="HFAE4B7D6E4594612A4ED57B490C08C21"><enum>(2)</enum><text>by inserting after subsection (c) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7CA1D572273C4419930DA7EECE5126DB"><subsection id="HDDCCB8CADF874A2CBCF0756AB392605B"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H67E041022F4B47FB9EB33B059A4CFECE"><enum>(1)</enum><text>In this subsection, the term <term>foreign agent</term>— </text><subparagraph id="H4DF5E680959346998A84B4D4F6474AE4" indent="up1"><enum>(A)</enum><text>has the meaning given the term <term>agent of a foreign power</term> under section 101 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801</external-xref>); and</text></subparagraph><subparagraph indent="up1" id="H74FF524DA9D349AFA53F32CAE3295C46"><enum>(B)</enum><text>does not include a person who is an agent of a foreign power (as so defined) with respect to a foreign power described in section 101(a)(5) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801(a)(5)</external-xref>). </text></subparagraph></paragraph><paragraph id="HA7DC4019136C45B9B04067C993718367" indent="up1"><enum>(2)</enum><text>A foreign agent who—</text><subparagraph id="H2271288F7B8643128E8E30E170EBEE68"><enum>(A)</enum><text>aids, abets, counsels, commands, induces, or procures the commission of an offense under this section shall be subject to prosecution under this section by virtue of section 2 of this title; </text></subparagraph><subparagraph id="H25846418D5AD4CC08157DE75A5D41DC7"><enum>(B)</enum><text>knowing that an offense under this section has been committed by another person, receives, relieves, comforts, or assists such other person in order to hinder or prevent the apprehension, trial, or punishment of such other person shall be subject to prosecution under section 3 of this title; </text></subparagraph><subparagraph id="HFFC3E76BB89C49498A8348AFE6BEDDA4"><enum>(C)</enum><text>having knowledge of the actual commission of an offense under this section, conceals and does not as soon as possible make known the same to some judge or other person in civil or military authority under the United States shall be subject to prosecution under section 4 of this title; or</text></subparagraph><subparagraph id="H624FC81659124947953234710EA541D1"><enum>(D)</enum><text>conspires to commit an offense under this section shall be subject to prosecution under section 371 of this title.</text></subparagraph></paragraph><paragraph indent="up1" id="H1C3AF7E7173C4694B311811D88378E8B"><enum>(3)</enum><text>Any person who is not a foreign agent shall not be subject to prosecution under this section by virtue of section 2 of this title or under section 3, 4, or 371 of this title, unless the person—</text><subparagraph id="H9AFA4A95AB7C40EDA3E9D92C8B422D2A"><enum>(A)</enum><text>commits a felony under Federal law in the course of committing an offense under this section (by virtue of section 2 of this title) or under section 3, 4, or 371 of this title;</text></subparagraph><subparagraph id="H96707653E0784E58B2F45FCC971418DA"><enum>(B)</enum><text>was a covered person at the time of the offense; or</text></subparagraph><subparagraph id="HF0140AEDB76F411DAB7B632E617DE665"><enum>(C)</enum><text>subject to paragraph (4), directly and materially aids, or procures in exchange for anything of monetary value, the commission of an offense under this section with the specific intent to— </text><clause id="H562CBBFE892E49C799A73C528024AC50"><enum>(i)</enum><text>harm the national security of the United States; or</text></clause><clause id="H82FF98180C664668985C1A1C8419A0A7"><enum>(ii)</enum><text>benefit any foreign government to the detriment of the United States.</text></clause></subparagraph></paragraph><paragraph id="HD4ED4436853946C69D68559041740C24" indent="up1" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">Paragraph (3)(C) shall not apply to direct and material aid that consists of— </text><subparagraph commented="no" display-inline="no-display-inline" id="HDD892939A8494ED8B907A672E072F6B6"><enum>(A)</enum><text display-inline="yes-display-inline">counseling, education, or other speech activity; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB1759A68D93E414DA7A670F0193E75AF"><enum>(B)</enum><text display-inline="yes-display-inline">providing an electronic communication service to the public or a remote computing service (as such terms are defined in section 2510 and 2711, respectively).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HF36F228554AF49CAA87224B34CAE4EA3"><enum>3.</enum><header>Gathering, transmitting, or losing defense information</header><subsection id="H56201549C2204BF8A18428B52B3AE680"><enum>(a)</enum><header>Definitions</header><text>Section 793 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H3C1C71C1A5C9492596D0210286F8E262" style="OLC"><subsection id="H4EF4B1D68D28476B93F49E5BB7193CC2"><enum>(i)</enum><text>In this section— </text><paragraph id="H5D6598BACA7445A1A8AF34D99EE21C57"><enum>(1)</enum><text>the term <term>covered person</term> means an individual who—</text><subparagraph id="H0CC4F1B6E16B464294F31B260494F740"><enum>(A)</enum><text>receives official access to classified information granted by the United States Government; </text></subparagraph><subparagraph id="HB14260FA86AF465185E7062A11B057AE"><enum>(B)</enum><text>signs a nondisclosure agreement with regard to such classified information; and </text></subparagraph><subparagraph id="HEF8F36F174FA4E61834043C4603DBE44"><enum>(C)</enum><text>is authorized to receive documents, writings, code books, signal books, sketches, photographs, photographic negatives, blueprints, plans, maps, models, instruments, appliances, or notes of anything connected with the national defense by—</text><clause id="H0086D96FDA7D4057A5D724D10541EE46"><enum>(i)</enum><text>the President; or</text></clause><clause id="H329BAE9440654501A03EB9EA718FD7BB"><enum>(ii)</enum><text>the head of a department or agency of the United States Government which is expressly designated by the President to engage in activities relating to the national defense; and</text></clause></subparagraph></paragraph><paragraph id="HB3004EDD4C6B40C094A15429A3ECF581"><enum>(2)</enum><text>the term <term>foreign agent</term>— </text><subparagraph id="HE31A7B0BC5054FDFA0520D7F30E169A3"><enum>(A)</enum><text>has the meaning given the term <term>agent of a foreign power</term> under section 101 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801</external-xref>); and</text></subparagraph><subparagraph id="H02EE558CB8EE4B6DB9A17E50199C4C7E"><enum>(B)</enum><text>does not include a person who is an agent of a foreign power (as so defined) with respect to a foreign power described in section 101(a)(5) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801(a)(5)</external-xref>).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3910D1EF0C9B441FAC9224BC8341E10A"><enum>(b)</enum><header>Obtaining or receiving defense information</header><text>Section 793(c) of title 18, United States Code, is amended—</text><paragraph id="HFCF86C1B3C4D448C8171EDFC4F9C69C5"><enum>(1)</enum><text>by striking <quote>Whoever</quote> and inserting <quote>A foreign agent who</quote>; </text></paragraph><paragraph id="HEC39E3DE48474C178580AC4FA1E1F0BC"><enum>(2)</enum><text>by inserting <quote>and with like intent or reason to believe,</quote> after <quote>aforesaid,</quote>; and</text></paragraph><paragraph id="HE35EC498EC294472ABEFE278EA187260"><enum>(3)</enum><text>by striking <quote>he</quote> and inserting <quote>the foreign agent</quote>.</text></paragraph></subsection><subsection id="H2226A415C2644CA1954CD176A73161D1"><enum>(c)</enum><header>Transmission of lawfully possessed defense information to unauthorized persons</header><text>Section 793(d) of title 18, United States Code, is amended by striking <quote>or note relating to the national defense, or information relating to the national defense which information</quote> and inserting <quote>note, or information relating to the national defense, which document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information</quote>. </text></subsection><subsection id="H9FA6CF9110D341C0AB602FAF2367D9CF"><enum>(d)</enum><header>Transmission of unlawfully possessed defense information to unauthorized persons</header><text>Section 793(e) of title 18, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H4811F95C8EAA4247AAA5C7CABC726F44" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="HD31E09C25670477CA2B2FEE29D4EAEEE"><enum>(e)</enum><text display-inline="yes-display-inline">An individual who—</text><paragraph commented="no" display-inline="no-display-inline" id="H150D5BF655C04BC4AB0A9A108FEBEA8E"><enum>(1)</enum><text display-inline="yes-display-inline">while a covered person, gains unauthorized possession of, access to, or control over any nonpublic document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, or note of anything connected with the national defense; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4ABE7421CE5F4DE899DBB4DCF71E524F"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HB8EC86ACCA4C4DE5B522A73C265C9A83"><enum>(A)</enum><text display-inline="yes-display-inline">with reason to believe such information could be used to the injury of the United States or to the advantage of any foreign nation, willfully communicates, delivers, transmits, or causes to be communicated, delivered, or transmitted, or attempts to communicate, deliver, transmit, or cause to be communicated, delivered, or transmitted, the same to any person not entitled to receive it; or</text></subparagraph><subparagraph id="H3731FF74AE674ABD87D7A6F6BE39A709" indent="up1"><enum>(B)</enum><text>willfully—</text><clause id="H0DB856C2627A4AAAB5494BED7D1E037C"><enum>(i)</enum><text>retains the same at an unauthorized location; and</text></clause><clause id="HE5AB1E7E59904F1D9BA517A9EEDBD4A6"><enum>(ii)</enum><text>fails to deliver the same to the officer or employee of the United States entitled to receive it; or</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF30155183D0E4D049859C12B5A44CE16"><enum>(e)</enum><header>Obtaining information from places connected with the national defense</header><text>Section 793(a) of title 18, United States Code, is amended by striking <quote>otherwise obtains information concerning</quote> and inserting <quote>otherwise unlawfully obtains nonpublic information concerning</quote>.</text></subsection><subsection id="HC5B6927F51B14FADB37A1FA555325FBC"><enum>(f)</enum><header>Copying and taking defense information</header><text>Section 793(b) of title 18, United States Code, is amended—</text><paragraph id="H46BD458C674C450784D69FE19DE84B84"><enum>(1)</enum><text>by striking <quote>Whoever,</quote> and inserting <quote>An individual who, while a covered person,</quote>; and</text></paragraph><paragraph id="H33168E2675304A06A31AB2780C5B5CC8"><enum>(2)</enum><text>by inserting <quote>nonpublic</quote> before <quote>sketch,</quote>.</text></paragraph></subsection><subsection id="H0A8EA78411A841049DE9C6A11F3E4184"><enum>(g)</enum><header>Limitation on scope</header><text>Section 793 of title 18, United States Code, is amended by striking subsection (g) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC8ED02C14E274C108F108EAFB076FD86"><subsection id="H295971FE1BB64AEDB79E34F2FB1155BC"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H14581788D4C54DBC88B72D1F7EC9EE32"><enum>(1)</enum><text>A foreign agent who—</text><subparagraph id="H03D72751CB424FDCA87CF43ECC6202A1" indent="up1"><enum>(A)</enum><text>aids, abets, counsels, commands, induces, or procures the commission of an offense under this section shall be subject to prosecution under this section by virtue of section 2 of this title; </text></subparagraph><subparagraph indent="up1" id="H75A5C1301FD242999C9ACF8C870C8D3C"><enum>(B)</enum><text>knowing that an offense under this section has been committed by another person, receives, relieves, comforts, or assists such other person in order to hinder or prevent the apprehension, trial, or punishment of such other person shall be subject to prosecution under section 3 of this title; </text></subparagraph><subparagraph id="H6D6D6087F67948AEBA5E5672CC3ECFA1" indent="up1"><enum>(C)</enum><text>having knowledge of the actual commission of an offense under this section, conceals and does not as soon as possible make known the same to some judge or other person in civil or military authority under the United States shall be subject to prosecution under section 4 of this title; or</text></subparagraph><subparagraph indent="up1" id="HA9DFDE021D894258A300B17B9B4ACA88"><enum>(D)</enum><text>conspires to commit an offense under this section shall be subject to prosecution under section 371 of this title. </text></subparagraph></paragraph><paragraph indent="up1" id="HDEC4828493AC4AB2BD73EF4B1BA71F80"><enum>(2)</enum><text>Any person who is not a foreign agent shall not be subject to prosecution under this section by virtue of section 2 of this title or under section 3, 4, or 371 of this title, unless the person—</text><subparagraph id="H38AB085E4B064D48A81F5AABEDC30525"><enum>(A)</enum><text>commits a felony under Federal law in the course of committing an offense under this section (by virtue of section 2 of this title) or under section 3, 4, or 371 of this title;</text></subparagraph><subparagraph id="HE648C5A49421491BB4A3D68D3B6FBD5E"><enum>(B)</enum><text>was a covered person at the time of the offense; or</text></subparagraph><subparagraph id="HE3435F42ACBA49778D2468BF7AFC6EB8"><enum>(C)</enum><text>subject to paragraph (3), directly and materially aids, or procures in exchange for anything of monetary value, the commission of an offense under this section with the specific intent to— </text><clause id="H35E826B1564D49D691105BA6117D0C37"><enum>(i)</enum><text>harm the national security of the United States; or</text></clause><clause id="H599955DCDE3E466BAD2036AA10579E2E"><enum>(ii)</enum><text>benefit any foreign government to the detriment of the United States.</text></clause></subparagraph></paragraph><paragraph id="HD8C8935F4CC8469CBED3DAEF439DD570" indent="up1" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">Paragraph (2)(C) shall not apply to direct and material aid that consists of— </text><subparagraph commented="no" display-inline="no-display-inline" id="HBD64C3306C4C4799B3EAC83B25050D80"><enum>(A)</enum><text display-inline="yes-display-inline">counseling, education, or other speech activity; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFB80E1D0EE3B4FF6B8FED1DE39E238C7"><enum>(B)</enum><text display-inline="yes-display-inline">providing an electronic communication service to the public or a remote computing service (as such terms are defined in section 2510 and 2711, respectively).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H5D0F3EA501A843A1B52C9AB2E77A9FDC"><enum>4.</enum><header>Public money, property, or records</header><text display-inline="no-display-inline">Section 641 of title 18, United States Code, is amended in the first undesignated paragraph by inserting <quote>tangible</quote> before <quote>thing of value</quote>.</text></section><section id="H6A1E78AE887E4D99B5AFA2A2A89F6BCB"><enum>5.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in section 793 or 798 of title 18, United States Code, shall be construed to supersede or limit the protections under the speech or debate clause of the Constitution of the United States. </text></section></legis-body></bill>
