which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a Good Steward Cover Crop Program, and for other purposes.</official-title></form><legis-body id="H06A8BBDB1F584FB6A2B9F1ABCB580C91" style="OLC"><section id="H4D019841DD80436B94B2BB579E09918B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Conservation Opportunity and Voluntary Environment Resilience Program Act</short-title></quote> or the <quote>COVER Act</quote>.</text></section><section id="HD88AE256C5284DE88000B17947E57F19"><enum>2.</enum><header>Good Steward Cover Crop Program</header><text display-inline="no-display-inline">Subtitle A of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H93DE624545814C8AA9194F83EFF753A2" style="OLC"><section id="H341693C5B2ED41FEB750B8C4191924A6"><enum>525.</enum><header>Good Steward Cover Crop Program</header><subsection id="HC9759A13929C416AB13DB673338628DD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning with crop year 2023, the Secretary shall carry out a program (to be known as the <quote>Good Steward Cover Crop Program</quote>) to provide additional premium subsidies to producers for each acre—</text><paragraph id="H043896D1B8C245E1992C06BBCC11C5EB"><enum>(1)</enum><text>on which qualifying cover crops are planted during a crop year; and</text></paragraph><paragraph id="H5E7B77B669C74A53B95C1F8966AEF0BC"><enum>(2)</enum><text>for which the producers—</text><subparagraph id="H090F9131C9D1405AB52CD97298D07BBC"><enum>(A)</enum><text>during such crop year—</text><clause id="H04A166D78B6D4A7CBB80624F2C64C649"><enum>(i)</enum><text>plant crops other than the qualifying cover crops; and</text></clause><clause id="HCDD79C0CA28341299C479CECC8AC8912"><enum>(ii)</enum><text>purchase insurance under a covered insurance program with respect to such planted crops; and</text></clause></subparagraph><subparagraph id="H6A0CD4B40FEF4B35A57FC79BA62BCA48"><enum>(B)</enum><text>file a report of acreage form to the Secretary with respect to such crop year. </text></subparagraph></paragraph></subsection><subsection id="HE13EBDA016B54932B79F481BC6D4E0F6"><enum>(b)</enum><header>Premium subsidy amount</header><paragraph id="H0BC421A9E4F44C23B0FC71B9D8E4DF59"><enum>(1)</enum><header>In general</header><text>Except as provided paragraph (2), an additional premium subsidy to a producer under subsection (a) shall be—</text><subparagraph id="HFA8EB13D3AF84F36A410DFE588E8E5AA"><enum>(A)</enum><text>calculated on a common land unit or equivalent or more precise basis; and</text></subparagraph><subparagraph id="H6FDC01E495534D51AAF5C74DE01968AE"><enum>(B)</enum><text>be in an amount equal to—</text><clause id="H2F93BE9456F54C8AAC6A35DC7D6EB7C2"><enum>(i)</enum><text>$5, multiplied by</text></clause><clause id="H96D8620E0ACC4C7DABEEEE506959AD18"><enum>(ii)</enum><text>the number of acres of the producer described in such subsection.</text></clause></subparagraph></paragraph><paragraph id="HB27C245733E7479198CEEE5B7B5B79D8"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">An additional premium subsidy under paragraph (1) shall not exceed the amount of the premium owed by the producer with respect to the acres described in subsection (a).</text></paragraph><paragraph id="HAEF96F125B07459F8CFE125042EE0EA3"><enum>(3)</enum><header>Rule with respect to a producer-share</header><text>For purposes of the limitation under paragraph (2), an additional premium subsidy shall be modified to reflect the individual producer share of such acres. </text></paragraph></subsection><subsection id="HF1F6170046824EC98616A1680E04E3AE"><enum>(c)</enum><header>Outreach with respect to program</header><paragraph id="H678F1B88F5084B4A95B37BEE30A5E198"><enum>(1)</enum><header>Coordination with FSA and NRCS</header><text>The Secretary shall, in coordination with the Administrator of the Farm Service Agency and the Chief of the Natural Resources Conservation Service, carry out outreach to producers, including underserved producers, to provide information with respect to—</text><subparagraph id="HA29D35C62AEE4DB7BE9572D84D2AF634"><enum>(A)</enum><text>the program under this section, including eligibility for the program and the additional premium subsidies under the program; and</text></subparagraph><subparagraph id="HC61B6A9A12DD490E828C88846CBE0FA5"><enum>(B)</enum><text>qualifying cover crops.</text></subparagraph></paragraph><paragraph id="H34FAD38ECC7541BF867FC073457E5ECF"><enum>(2)</enum><header>Cooperative agreements for outreach</header><text>The Secretary shall enter into one or more cooperative agreements with organizations capable of assisting with outreach with respect to the program under this section to—</text><subparagraph id="HAAF9AA60F91B488CA1E48CEF1AF3EB95"><enum>(A)</enum><text>carry out such outreach; and</text></subparagraph><subparagraph id="HF8E5ADFB516F4A8D98D8BEE8037F7E5B"><enum>(B)</enum><text>coordinate with soil and water conservation districts to encourage the adoption of qualifying cover crop practices.</text></subparagraph></paragraph></subsection><subsection id="H0319CF9165AF403FB33B853647429A32"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, and annually thereafter, the Secretary shall, in coordination with the Administrator of the Risk Management Agency, the Administrator of the Farm Service Agency, and the Chief of the Natural Resources Conservation Service, submit to Congress a report that includes—</text><paragraph id="HE1C0F92DF909455683B353E63E8C336B"><enum>(1)</enum><text>a summary of the activities carried out under this section, including—</text><subparagraph id="H00EDBEC8A4674B348FE28308DD5DEB06"><enum>(A)</enum><text>the number and amount of premium subsidies provided to producers under this section;</text></subparagraph><subparagraph id="HF9C8A756E91346F6B6CAB8B1227C6597"><enum>(B)</enum><text>the number of acres of cover crops planted for which a premium subsidy was received; and</text></subparagraph><subparagraph id="H0DB38A2FD4CA4BABBACADDB322E96A7F"><enum>(C)</enum><text>the outreach carried out under subsection (c); and</text></subparagraph></paragraph><paragraph id="H6D92703EFC6C4E358EF4EAC8BAFF0451"><enum>(2)</enum><text>recommendations to increase the number of producers that qualify for the additional premium subsidies under the program under this section. </text></paragraph></subsection><subsection id="HF436B2F665BF4330811616A9D81C0D7F"><enum>(e)</enum><header>Funding</header><paragraph id="H134BF2EC7C95421EB63FF0ACE1414B37" commented="no"><enum>(1)</enum><header>Mandatory funding</header><text>Of the funds of the Corporation, the Secretary shall use such sums as are necessary to carry out this section.</text></paragraph><paragraph id="H07B288E40A6A4125A2320D24C8970660"><enum>(2)</enum><header>Reservation for technical assistance, outreach, and program support</header><text>Of the amounts made available under paragraph (1) for a fiscal year, the Secretary shall reserve $5,000,000 to carry out technical assistance, outreach, and program support with respect to the program under this section. </text></paragraph></subsection><subsection id="HE07A21FC5A974BF0958106FF66B5F3B1"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HD752D24DF3FB41319A71DFBF8797EB2F"><enum>(1)</enum><header>Covered insurance program</header><text>The term <term>covered insurance program</term> means a plan of insurance offered by the Corporation, as determined by the Secretary.</text></paragraph><paragraph id="H44726F7A5ECD416485A5ABB8EC2378A5"><enum>(2)</enum><header>Qualifying cover crop</header><text>The term <term>qualifying cover crop</term> means cereals or other grasses, legumes, brassicas, non-legume broadleaves, or any combination thereof that are planted for conservation purposes in accordance with—</text><subparagraph id="HCBDAAD95F30C4CE89DA89F8DAD78555F"><enum>(A)</enum><text>Natural Resources Conservation Service guidance; and</text></subparagraph><subparagraph id="H99210F750F5B498F984AAB23CEF6A784"><enum>(B)</enum><text>additional expert guidance, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="H964A7379B82647A2B96F03CDC2708424"><enum>(3)</enum><header>Underserved producer</header><text>The term <quote>underserved producer</quote> has the meaning given the term in section 508(a)(7)(A)(ii). </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H8DF19ABF86F742F7885B5790A621BDF2"><enum>3.</enum><header>Soil health pilot program</header><text display-inline="no-display-inline">Section 523 of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1523">7 U.S.C. 1523</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H09CD50DE025C420985BD69AD02E05372" display-inline="no-display-inline"><subsection id="H9672D41A2F0A465DACB62386D7F91588"><enum>(j)</enum><header>Soil health pilot program</header><paragraph id="HA2C77B3026C74E9FB4186CB2F186F8FE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to any other authority of the Corporation, the Corporation shall establish and carry out a pilot program under which a producer who uses innovative soil health practices may receive additional premium subsidies on multiperil crop insurance, as determined by the Corporation. </text></paragraph><paragraph id="H57AACA6AC8E64D2FA51F7A98BBC6DE66"><enum>(2)</enum><header>Terms and conditions</header><text>The additional premium subsidies offered under the soil health pilot program under this subsection shall— </text><subparagraph id="HA544BB8FDEE7493F8BB0A967584BF183"><enum>(A)</enum><text>be offered through reinsurance arrangements with private insurance companies; </text></subparagraph><subparagraph id="HEACCC472DC864570A3CC2C3B040FA03C"><enum>(B)</enum><text>be actuarially sound; and </text></subparagraph><subparagraph id="H6862113195514F799ABAEAEAE9824461"><enum>(C)</enum><text>require the payment of premiums and administrative fees by a producer obtaining the insurance. </text></subparagraph></paragraph><paragraph id="HF75EC9B869C44F08801DB2C98169D000"><enum>(3)</enum><header>Location</header><text>The Corporation shall conduct the soil health pilot program under this subsection in a number of counties that is determined by the Corporation to be adequate to provide a comprehensive evaluation of the feasibility, effectiveness, and demand among producers for the risk management tools evaluated in the pilot program. </text></paragraph><paragraph id="H8F07810CF4AE466C9B7D0AAAB501BEF3"><enum>(4)</enum><header>Duration</header><text>The Corporation shall commence the soil health pilot program under this subsection as soon as practicable after the date of the enactment of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
