<section id="HFC4E640276B54E3A853B86B516CB28FE" section-type="section-one"><enum>1.</enum><header>Short title; findings</header>
<subsection id="HC37BE8D3366E4A138B72B256A17AF9BD"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Prevent Restrictions On Volunteers’ Incomes During Emergencies Act</short-title></quote> or the <quote><short-title>PROVIDE Act</short-title></quote>. </text></subsection> <subsection id="H0B259EE43D1A4470B83166F48CCA63D4"><enum>(b)</enum><header>Findings</header><text display-inline="yes-display-inline">The Congress finds that—</text>
<paragraph id="H16B0CA4909F242B4805B5BF436388C4F"><enum>(1)</enum><text>volunteers are essential during national disasters and emergencies;</text></paragraph> <paragraph id="HB203489AEE1A4E39AC601D8A761587B7"><enum>(2)</enum><text>in times of these disasters and emergencies, residents from one State may aid those in a different State and provide necessary assistance;</text></paragraph>
<paragraph id="HA70BE5508BF744ADA2C7FCE349433173"><enum>(3)</enum><text>assistance from across State lines may continue for many weeks or months; and</text></paragraph> <paragraph id="H6827FCB4F5CF459A997AB5A3C6A62D60" commented="no"><enum>(4)</enum><text>therefore, it is in the interest of Congress to ensure that those who volunteer in a State in which they do not reside are not burdened by an unfair income tax.</text></paragraph></subsection></section>
<section id="H16D16B7614B0456BA7F101CC55AC51A1"><enum>2.</enum><header>Ineligibility for Federal financial assistance for jurisdictions that tax volunteers during an emergency</header><text display-inline="no-display-inline">Beginning with fiscal year 2020, any State or local government which taxes the income of an out-of-State individual that has traveled to such State for the purpose of volunteering or otherwise providing assistance in response to a Federally declared disaster or emergency during the emergency period shall be ineligible to receive Federal financial assistance (as such term is defined in section 7501(a)(5) of title 31, United States Code).</text></section> <section id="H6A1466E5844E4BFF9B610DC209376046"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="HD8BA1FBC393F42C9B369606DFD9AE8E9"><enum>(1)</enum><header>Emergency period</header><text>The term <term>emergency period</term> means the period of time in which a Federally declared disaster or emergency is in effect. </text></paragraph> <paragraph id="HB7DD8122567D43E6970CEC8BB1643F95"><enum>(2)</enum><header>Federally declared disaster or emergency</header><text display-inline="yes-display-inline">The term <term>Federally declared disaster or emergency</term> means any disaster or emergency declared by the President of the United States or the Secretary of Health and Human Services in accordance with Federal law.</text></paragraph>
<paragraph id="HA4E7BCE2A14A4B86B231774C1DAD5E71"><enum>(3)</enum><header>Local government</header><text>The term <term>local government</term> means a county, city, town, village, or other general purpose political subdivision, instrumentality, or authority of a State.</text></paragraph> <paragraph id="H1A11FCC45F074D55917C808945AA1416"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means each of the 50 States and the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and Indian Tribes.</text></paragraph></section>
