which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Elementary and Secondary Education Act of 1965 to provide criteria for use of Federal funds to support trauma-informed practices in schools, and for other purposes.</official-title></form><legis-body id="H79EFC75109034C139B4D4F4B9B080598" style="OLC"><section id="HDE736ADADD154930BC7B3AACF3E6B057" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Trauma-Informed Schools Act of 2022</short-title></quote>.</text></section><section id="H2DCD7052CA1546AB904478D9E221CE5A"><enum>2.</enum><header>Trauma-informed practices</header><subsection id="HFFFC6688C4C141C3983FF0BFC57E069E"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>) is amended—</text><paragraph id="HF7685EF8F68E4E06B73A1BB118D94FF3"><enum>(1)</enum><text>by redesignating paragraphs (51) and (52) as paragraphs (52) and (53), respectively; and</text></paragraph><paragraph id="H0D7C0A0519F94E4EAC26F54ACD3D6401"><enum>(2)</enum><text>by inserting after paragraph (50) the following:</text><quoted-block display-inline="no-display-inline" id="H8656F251731A4D7DAF1B001219C28CF2" style="OLC"><paragraph id="HC2FF46B7CC6B41FF937A2484C9017BF5"><enum>(51)</enum><header>Trauma-informed practices</header><text display-inline="yes-display-inline">The term <term>trauma-informed practices</term> means—</text><subparagraph id="H241321C51F614CB88332A9B2C4434F1F"><enum>(A)</enum><text display-inline="yes-display-inline">evidence-based professional development that promotes a shared understanding among teachers, teachers assistants, school leaders, paraprofessionals, specialized instructional support personnel, and other staff that—</text><clause id="HEEC17CBC49B049E0BB254025EFE070B5"><enum>(i)</enum><text>adverse and potentially traumatic experiences are common among students;</text></clause><clause id="H29102870D1CC40EDB6701E104C9BF38E"><enum>(ii)</enum><text>trauma can impact student learning, behavior, and relationships in school;</text></clause><clause id="H8A05FA8A558942109C660D1BA8AEEB2F"><enum>(iii)</enum><text display-inline="yes-display-inline">adverse and potentially traumatic experiences do not inherently undermine the capabilities of students to reach high expectations in academics and life;</text></clause><clause id="HA93678CC9DD94C179878BA38553B60A1"><enum>(iv)</enum><text display-inline="yes-display-inline">school-wide learning environments where all students and adults feel safe, welcomed, and supported can enable students to succeed despite adverse and potentially traumatic experiences; and</text></clause><clause id="HF5BB64DCF48945528B7F6E4A67957A3C"><enum>(v)</enum><text display-inline="yes-display-inline">services, supports, and programs provided to meet individual student needs should be trauma-informed, where appropriate, and increase student connection to the school-wide learning environment;</text></clause></subparagraph><subparagraph commented="no" id="H50D1D8B5B49D4CE1903A11A3CD6AE66F"><enum>(B)</enum><text>adoption of disciplinary procedures and practices that—</text><clause commented="no" id="H88A28487E48D483CA362BC7BAF919821"><enum>(i)</enum><text>accompany disciplinary actions with holistic assessments and positive behavioral interventions and supports to address the underlying causes of student behavior, including trauma;</text></clause><clause commented="no" id="H3AFFD34B31144939A2CDAF7AE4DFA901"><enum>(ii)</enum><text>avoid harsh, punitive, or exclusionary disciplinary practices;</text></clause><clause commented="no" id="HCA17B39DB81A40758AE7848A6B8AE880"><enum>(iii)</enum><text>utilize evidence-based restorative practices that build a culture of trust; and</text></clause><clause commented="no" id="H9B5972BF72C04280B89647C50E4C7204"><enum>(iv)</enum><text display-inline="yes-display-inline">do not discriminate on the basis of race, color, national origin, sex (including sexual orientation or gender identity), disability, English proficiency status, migrant status, or age consistent with the Age Discrimination Act of 1975 (<external-xref legal-doc="usc" parsable-cite="usc/42/6101">42 U.S.C. 6101 et seq.</external-xref>), title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>), title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>), section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>), the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>), and the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1400">42 U.S.C. 1400 et seq.</external-xref>); and</text></clause></subparagraph><subparagraph commented="no" id="H1042295F39664A56BB78752C573A4A2E"><enum>(C)</enum><text display-inline="yes-display-inline">activities that engage teachers, teachers assistants, school leaders, paraprofessionals, specialized instructional support personnel, other staff, and families in a process of school-based planning to—</text><clause commented="no" id="H7B01D5AFA1DD4A78B721D01892184327"><enum>(i)</enum><text display-inline="yes-display-inline">promote a school-wide culture of acceptance;</text></clause><clause id="H1CDF8F0F885F4C76A1AA7C6CACB8E895"><enum>(ii)</enum><text display-inline="yes-display-inline">help all students feel safe and connected to the school community;</text></clause><clause id="H4858A4764D084AEFA29359470BDD3030"><enum>(iii)</enum><text display-inline="yes-display-inline">support all students to form positive relationships with adults and peers, understand and manage emotions, achieve success academically and in extra-curricular areas, and experience physical and psychological health and well being;</text></clause><clause id="HEB62489DEF034827BCF258B7A9DEC2C9"><enum>(iv)</enum><text>promote teamwork and effective communication among all staff and shared responsibility for every student;</text></clause><clause id="HA042870243504A53A2AA7A13D385FEDC"><enum>(v)</enum><text>integrate evidence-based practices that build social-emotional skills into rigorous academic instruction; and</text></clause><clause id="HA14F6931D65E41098946D4DB0B55B40A"><enum>(vi)</enum><text>recognize and prevent adult implicit bias.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H3FA0906FC94044A08A16EC835AF9DA53"><enum>(b)</enum><header>State plan</header><text display-inline="yes-display-inline">Section 1111(g)(1)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(g)(1)(C)</external-xref>) is amended—</text><paragraph id="HDEFC2432E3B94D1E9B25641FDB0E8E23"><enum>(1)</enum><text>by striking <quote>reducing</quote>;</text></paragraph><paragraph id="HF4EDB87A05354692A37B630EDAD9859D"><enum>(2)</enum><text>in clause (i), by inserting <quote>reducing</quote> before <quote>incidences</quote>;</text></paragraph><paragraph id="H6D2D30761769459EB4ED089871A7360D"><enum>(3)</enum><text>in clause (ii)—</text><subparagraph id="HE808702F3BDD40BC92C205049BF0210F"><enum>(A)</enum><text>by inserting <quote>reducing</quote> before <quote>the overuse</quote>; and</text></subparagraph><subparagraph id="H4DD1B0A70B704B928B4E35AE6DE41223"><enum>(B)</enum><text>by striking <quote>and</quote>;</text></subparagraph></paragraph><paragraph id="HA4489775E85340D5B7D78AFB025F25B8"><enum>(4)</enum><text>in clause (iii)—</text><subparagraph id="HD18ED6C0F1F54E00AD95F76B78FF35DF"><enum>(A)</enum><text>by inserting <quote>reducing</quote> before <quote>the use</quote>; and</text></subparagraph><subparagraph id="HC34231A79C794BA99FEED553A2E8D4EC"><enum>(B)</enum><text>by inserting <quote>and</quote> after <quote>safety;</quote>; and</text></subparagraph></paragraph><paragraph id="H9D8709F22F234B20B89D5DF7D9BA7EF6"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H8508251E190F454FBB2355BF9E6139F0" style="OLC"><clause id="HA14026EBA1BC4035AE83FFB2581FCFDD"><enum>(iv)</enum><text display-inline="yes-display-inline">increasing the prevalence of trauma-informed practices;</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H627F8D1BEF4B4012980120ED67134776"><enum>(c)</enum><header>Plan provisions</header><text display-inline="yes-display-inline">Section 1112(b) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6312">20 U.S.C. 6312(b)</external-xref>) is amended—</text><paragraph id="HDE238B78292B43E5B26EFBBC7A4BB63D"><enum>(1)</enum><text>by redesignating paragraphs (12) and (13) as paragraphs (13) and (14), respectively; and</text></paragraph><paragraph id="HAA8CDE8DD1824D89B16AF7A53ABC7587"><enum>(2)</enum><text>by inserting after paragraph (11) the following:</text><quoted-block display-inline="no-display-inline" id="HC1585695AA644C10BAAC644FFDF0D681" style="OLC"><paragraph id="H7553C71FFA394DAF8B6B5B5FD85CB09F"><enum>(12)</enum><text display-inline="yes-display-inline">how the local educational agency will support efforts to increase the prevalence of trauma-informed practices;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC9250ECCA96D49A383C1822AC5F91CFD"><enum>(d)</enum><header>Schoolwide program</header><text display-inline="yes-display-inline">Section 1114(b)(7)(A)(iii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6314">20 U.S.C. 6314(b)(7)(A)(iii)</external-xref>) is amended—</text><paragraph id="HB33F8E86D1BB4526885B1FA05AE28FE1"><enum>(1)</enum><text display-inline="yes-display-inline">in subclause (IV), by striking at the end <quote>and</quote>; and</text></paragraph><paragraph id="H7A457FFACADE4930BE9EE8DC7F7AB666"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H391173889F884C069572C396E0AB362D" style="OLC"><subclause id="HED12B023D884423AB2C81F56C8686A10"><enum>(VI)</enum><text display-inline="yes-display-inline">the implementation of trauma-informed practices; and</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H5E3BAA961FC34D069013B9308F2AF33C"><enum>(e)</enum><header>Training</header><text display-inline="yes-display-inline">Section 2101 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6611">20 U.S.C. 6611</external-xref>) is amended—</text><paragraph id="H728A670DC7A64F37B9086E3C282CEC18"><enum>(1)</enum><text>in subsection (c)(4)(B)—</text><subparagraph id="H329C6A7FE1F74320A1162AD0431844E6"><enum>(A)</enum><text>by redesignating clauses (xv) through (xxi) as clauses (xvi) through (xxii), respectively; and</text></subparagraph><subparagraph id="H0242DA0A9BB4456C902C52CBFCB1BCF1"><enum>(B)</enum><text>by inserting after clause (xiv) the following:</text><quoted-block display-inline="no-display-inline" id="H3B47CD336A60424C980079170F252AB9" style="OLC"><clause id="H6CDF1997142D42D7B3B5F70C4FB2CB71"><enum>(xv)</enum><text display-inline="yes-display-inline">Providing training for all teachers, school leaders, paraprofessionals, and specialized instructional support personnel on trauma-informed practices.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H7A3E1B94864E4C7580B579B2A8A573D5"><enum>(2)</enum><text>in subsection (d)(2)—</text><subparagraph id="HE196DA2722F84B0B8998989A71B97CB4"><enum>(A)</enum><text>by redesignating subparagraphs (K) through (M) as subparagraphs (L) through (N) respectively; and</text></subparagraph><subparagraph id="H4E1445EDFB154C80B3C3D12C1C44F60C"><enum>(B)</enum><text>by inserting after subparagraph (J) the following:</text><quoted-block display-inline="no-display-inline" id="H6B56C791E4E549FEB35AE1BDD248976C" style="OLC"><subparagraph id="H7421DB5913A849B7BFFF182ABD3D08F3"><enum>(K)</enum><text display-inline="yes-display-inline">A description of how the State educational agency will use funds under this part to increase the prevalence of trauma-informed practices.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H7BD18C7983AC40BE98CFB8886CAC647F"><enum>(f)</enum><header>Local use of funds</header><text display-inline="yes-display-inline">Section 2103(b)(3)(I) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6613">20 U.S.C. 6613(b)(3)(I)</external-xref>) is amended—</text><paragraph id="H4D7EDF4AA6B5424EAA20D23D495C98AC"><enum>(1)</enum><text>by redesignating clauses (i) through (iv) as clauses (ii) through (v); and</text></paragraph><paragraph id="H15F044CF5E7A44E2B75E5B1D603C0246"><enum>(2)</enum><text>by inserting before clause (ii), as redesignated, the following:</text><quoted-block display-inline="no-display-inline" id="HF96D494CC88040CA9FA93BA42BF33120" style="OLC"><clause id="H01D152EA6B8C44C5B582E3FAAFB5CE23"><enum>(i)</enum><text display-inline="yes-display-inline">trauma-informed practices;</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H02C59D36A2184F129B7EBAB99A91CAAC"><enum>(g)</enum><header>State activities</header><text display-inline="yes-display-inline">Section 4104(b)(3)(B)(ii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7114">20 U.S.C. 7114(b)(3)(B)(ii)</external-xref>) is amended—</text><paragraph id="H6A03218DD52644308F996963121EB7FB"><enum>(1)</enum><text display-inline="yes-display-inline">in subclause (I), by striking at the end <quote>or</quote>;</text></paragraph><paragraph id="H15C751653A994945804B5422FD149E64"><enum>(2)</enum><text>in subclause (II), by inserting <quote>or</quote> at the end; and</text></paragraph><paragraph id="HFE3709317AFE4FEE93886E760735B1B8"><enum>(3)</enum><text>by inserting at the end the following:</text><quoted-block display-inline="no-display-inline" id="H0AFBF8AD07A14A3186E4B0C8FEAF5057" style="OLC"><subclause id="HEBC189786D5E41768B00E7BC4033EFE2"><enum>(III)</enum><text display-inline="yes-display-inline">increase the prevalence of trauma-informed practices;</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1FEF8FA245114C1990213675BCD2CB57"><enum>(h)</enum><header>State application</header><text display-inline="yes-display-inline">Section 4203(a)(6) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7173">20 U.S.C. 7173(a)(6)</external-xref>) is amended by striking <quote>development;</quote> and inserting <quote>development, which may include professional development on trauma-informed practices;</quote>.</text></subsection><subsection id="H342CF0DCC5944E91A81A65DB66B4A826"><enum>(i)</enum><header>Description of plan</header><text display-inline="yes-display-inline">Section 4303(f)(1)(A)(viii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7221b">20 U.S.C. 7221b(f)(1)(A)(viii)</external-xref>) is amended—</text><paragraph id="HEFDEC4216DB24B5CA913AB95D6E0CA7C"><enum>(1)</enum><text display-inline="yes-display-inline">in subclause (I), by striking at the end <quote>and</quote>;</text></paragraph><paragraph id="H83F66275CC5A4997855602ADAAC36181"><enum>(2)</enum><text>in subclause (II), by inserting <quote>and</quote> at the end; and</text></paragraph><paragraph id="H0D2005A2BF13440EB03FCB8A21FA501D"><enum>(3)</enum><text>by inserting at the end the following:</text><quoted-block display-inline="no-display-inline" id="HA7945FCD13F047E1B20861EEB27057A8" style="OLC"><subclause id="H837A14BFA8C7471490802864AEF19C83"><enum>(III)</enum><text display-inline="yes-display-inline">adopting trauma-informed practices.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H6095FB48E1224C4FBD2281F473FD5D50"><enum>(j)</enum><header>Application requirements</header><text display-inline="yes-display-inline">Section 4305(b)(3)(B)(ii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7221d">20 U.S.C. 7221d(b)(3)(B)(ii)</external-xref>) is amended—</text><paragraph id="H24B32BCC1C4541D8B0088EB1FD7E3505"><enum>(1)</enum><text display-inline="yes-display-inline">in subclause (II), by striking <quote>and</quote>;</text></paragraph><paragraph id="H7EDC2BDD264D4C65A406CC6F52F3B116"><enum>(2)</enum><text>in subclause (III), by inserting <quote>and</quote> at the end; and</text></paragraph><paragraph id="H65A54DCC69AB4650AB2A624C198A1FAC"><enum>(3)</enum><text>by inserting at the end the following:</text><quoted-block display-inline="no-display-inline" id="H5EA4CE48C2B54D9B902B65C18F84D316" style="OLC"><subclause id="HA8613BF34C2C4C8990C471A4288B86E5"><enum>(IV)</enum><text display-inline="yes-display-inline">the discipline practices that will be used, including a description of whether such practices are consistent with trauma-informed practices;</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
