Russell National School Lunch Act to require mandatory certification for certain students and reduce stigma associated with unpaid school meal fees, and for other purposes.</official-title></form><legis-body id="HB7CA078BFDC74C3AA612CDCD5895EC41" style="OLC"> 
<section id="H54EBE9A6035548A38994788005E831DC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Shame at School Act of 2022</short-title></quote>.</text></section> <section id="HCE863ADE596A49A4A83309562A998CC9"><enum>2.</enum><header>Unpaid meal debt</header> <subsection id="HFB6116AE9D3447EA9DD67D74615B0149"><enum>(a)</enum><header>Mandatory certification</header><text>Section 9(b)(5) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(5)</external-xref>) is amended—</text> 
<paragraph id="H98EB9403920F4266BD15FB18E68BC4D7"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">Discretionary</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Mandatory</header-in-text></quote>;</text></paragraph> <paragraph id="H51872B993D4F4794BB912D72CCC7038B" commented="no"><enum>(2)</enum><text>by striking <quote>any local</quote> and inserting <quote>a local</quote>; and </text></paragraph> 
<paragraph id="H94742BAF9EC246D0B19A3A9D84FC9A6C"><enum>(3)</enum><text>by striking <quote>may</quote> and inserting <quote>shall</quote>.</text></paragraph></subsection> <subsection id="HB9D34B9C6FEE45E5AAD21C4764C71ED7"><enum>(b)</enum><header>Retroactive reimbursement</header><text>Section 9(b)(9)(C) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(9)(C)</external-xref>) is amended—</text> 
<paragraph id="H919FE92E9FBC43058DFB025439FDD161"><enum>(1)</enum><text>by striking <quote>Except</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="HFCF73EAD8D9B48ED980C6ECCB53FAE95" style="OLC"> <clause id="H31C4FCDCEF2E4F4A9F666F26684CA3C6"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Except</text></clause><after-quoted-block>; </after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC14F2BAB2EA54F7FADB761E6FBAF2B6E"><enum>(2)</enum><text>by redesignating clauses (i) and (ii) as subclauses (I) and (II); and</text></paragraph> <paragraph id="H2EE93901A36145588904E16C57A7A9C2"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H1F70B1D99452432FAA249B5F2327F688" style="OLC"> 
<clause commented="no" id="H303DE61C0FC0411B9ACB3B7376CDE4C9"><enum>(ii)</enum><header>Retroactivity</header><text display-inline="yes-display-inline">A local educational agency shall revise a previously submitted meal claim to reflect the eligibility approval of a child for free or reduced price meals for the period that begins on the first day of the current school year.</text> </clause> <clause id="HBAD48A27ECF24E7E988EBD8CABA4D609"><enum>(iii)</enum><header>Meal claim defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>meal claim</term> means any documentation provided by a school food authority to a State agency in order to receive reimbursement for the cost of a meal served to a child by such school food authority.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H4065C141A81749C3A23C5E998E3727C9"><enum>(c)</enum><header>Reducing stigma associated with unpaid school meal fees</header><text>Section 9(b)(10) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(10)</external-xref>) is amended to read as follows:</text> <quoted-block id="H26A1E126A623495DA8056588E0F59CA7" style="OLC"> <paragraph commented="no" id="H1503727B48CA46C4B3B83D3D06DE9B93"><enum>(10)</enum><header>Reducing stigma associated with unpaid school meal fees</header> <subparagraph commented="no" id="H5F4E60E29956439EB195DD923A2148C2"><enum>(A)</enum><header>Overt identification prohibited</header><text>A local educational agency or school food authority may not, based on the status of a covered child as a covered child—</text> 
<clause commented="no" id="H143D9F6CE323436C96A0EC013B3EAB67"><enum>(i)</enum><text>physically segregate such covered child;</text></clause> <clause commented="no" id="H229A1102D91C4D84A8796F7EA33DEBC1"><enum>(ii)</enum><text>overtly identify such covered child—</text> 
<subclause commented="no" id="H2C82730253224CD5BA3D2969C95283F5"><enum>(I)</enum><text>through the use of special tokens or tickets; or</text></subclause> <subclause commented="no" id="H3CD792B3A35F48FF9BB5B2B81A9D17CE"><enum>(II)</enum><text>by an announcement or a published list of names; or</text></subclause></clause> 
<clause commented="no" id="H1C7E8678632B468A9398807522830AB3"><enum>(iii)</enum><text>identify or stigmatize such covered child by any other means.</text></clause></subparagraph> <subparagraph commented="no" id="HDEE7BFCA55ED42E29175C6F10ED4BD46"><enum>(B)</enum><header>Eligibility determination by local educational agency</header><text>For any covered child who is a member of a household that owes a week or more of unpaid school meal fees, a local educational agency shall—</text> 
<clause commented="no" id="H67E86F0F4D474BDEA92C5C05FE1686C9"><enum>(i)</enum><text>attempt to directly certify such covered child for free meals under paragraph (4) or (5); or</text></clause> <clause commented="no" id="HD4B02B38FC084E76BDEFA432CB015C5D"><enum>(ii)</enum><text>in a case where the local educational agency is not able to directly certify such covered child under paragraph (4) or (5), provide to the household of such covered child—</text> 
<subclause commented="no" id="H60E62949C3B8401AB49D5D20AD786FAA"><enum>(I)</enum><text>a household application and applicable descriptive material; and</text></subclause> <subclause commented="no" id="HD9F85A2AB63943998235E95ABF7D981E"><enum>(II)</enum><text>written and oral communications to encourage submission of the application.</text></subclause></clause></subparagraph> 
<subparagraph commented="no" id="H7FBE8ACB7F7C46D5A6C52C48A5187D15"><enum>(C)</enum><header>Collection of unpaid school meal fees</header><text>In attempting to collect unpaid school meal fees from a household, a local educational agency or school food authority may not—</text> <clause commented="no" id="H2B84523DDD4A49EB8BB72633351B22B8"><enum>(i)</enum><text>except as described in subparagraph (D), direct any communication regarding unpaid school meal fees to a covered child who is a member of such household;</text></clause> 
<clause commented="no" id="H4CF9CABFF69E4D8C9533C24CE0E13C7F"><enum>(ii)</enum><text>withhold educational opportunities (including grades and participation in extracurricular activities or local educational agency programs or services) from, or otherwise stigmatize, a covered child due to the status of the covered child as a covered child; or</text></clause> <clause commented="no" id="H4DACB76CCDE449669E1B6963EE1DBC88"><enum>(iii)</enum><text>use a debt collector (as such term is defined in section 803 of the Consumer Credit Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692a">15 U.S.C. 1692a</external-xref>)).</text></clause></subparagraph> 
<subparagraph commented="no" id="HD91A5A813CCA409EB49856E02C44D302"><enum>(D)</enum><header>Letters</header><text>A school food authority may require that a covered child deliver a sealed letter addressed to a parent or guardian of the covered child that contains a communication relating to unpaid school meal fees, subject to the condition that the letter shall not be distributed to the covered child in a manner that stigmatizes the covered child.</text></subparagraph> <subparagraph commented="no" id="HD822393B1A14426C86D65AD37289B84D"><enum>(E)</enum><header>Eliminating stigma in meal service</header><text>In providing a meal to a covered child, a local educational agency or school food authority may not, based on the status of the covered child as a covered child, dispose of or take away from the covered child any food that has already been served to such covered child.</text></subparagraph> 
<subparagraph commented="no" id="HF557860DD074462A94D590BB4B52C7A9"><enum>(F)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph:</text> <clause commented="no" id="H539FAC5FFADC4E89917E6FEEBB93C1A4"><enum>(i)</enum><header>Covered child</header><text display-inline="yes-display-inline">The term <term>covered child</term> means a child who—</text> 
<subclause id="HC22DB3BF94C04816A8C1DF086E575B55"><enum>(I)</enum><text>is enrolled in a school that participates in the school lunch program under this Act or the school breakfast program under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>); and</text></subclause> <subclause commented="no" id="HE15A17A283A9423A9F5D98AD6FE5D4C2"><enum>(II)</enum><text>is a member of a household that owes unpaid school meal fees.</text></subclause></clause> 
<clause commented="no" id="H27E1C4FAA9DC41F7A9D60E4460A3B93B"><enum>(ii)</enum><header>Unpaid school meal fees</header><text display-inline="yes-display-inline">The term <term>unpaid school meal fees</term> means outstanding fees owed by a household to a local educational agency for lunches under this Act or breakfasts under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> </section> </legis-body></bill>
