which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to authorize the Secretary of Veterans Affairs to waive the requirement of certain veterans to make copayments for hospital care and medical services in the case of an error by the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body id="H8FDBDD747DC54BC0A4D831718CCF5278" style="OLC"><section id="H4F6BACD9D80B4464840F6D6BEE896939" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>VA Billing Accountability Act</short-title></quote>.</text></section><section id="HC4F9EC71138F4B2383E49CC5C44911EA" section-type="subsequent-section"><enum>2.</enum><header>Authority of Secretary of Veterans Affairs to waive requirement of certain veterans to make copayments for care and services in the case of Department of Veterans Affairs error</header><subsection id="HA430467835CF46A9B952F33888417002"><enum>(a)</enum><header>Hospital care, nursing home care, and medical services</header><text display-inline="yes-display-inline">Section 1710(f)(3) of title 38, United States Code, is amended by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="HBEB41ACDA54C46F4952BCECE42D63C44" style="USC"><subparagraph id="H14BF90CE2E1C424AA471E86637E26D73" indent="up2"><enum>(G)</enum><text display-inline="yes-display-inline">The Secretary may waive the requirement of a veteran to make a payment under this subsection or subsection (g) if—</text><clause id="HA712D7C25B154AB78C9EF65D944E106E"><enum>(i)</enum><text>an error committed by the Department or an employee of the Department was the cause of delaying notification sent to the veteran of the requirement to make the payment; and</text></clause><clause id="H23DEE78E22914B019B735307A0D3D941"><enum>(ii)</enum><text display-inline="yes-display-inline">the veteran received such notification later than 180 days after the date on which the veteran received the care or services for which the payment was required.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD3CD41823F3F4B92AED16159BC2F466A"><enum>(b)</enum><header>Medications</header><text>Section 1722A of such title is amended—</text><paragraph id="H06BEA35D7DF041B69643517B276E5657"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph><paragraph id="HD62B7B3C884D470B8DC6908C0DABBA5A"><enum>(2)</enum><text>by inserting after subsection (b) the following new subsection (c):</text><quoted-block display-inline="no-display-inline" id="H36DC18FA01814C618ECE7F5136178BC0" style="USC"><subsection id="H572A1F1654D5411AA7A67C568660EE1C"><enum>(c)</enum><text display-inline="yes-display-inline">The Secretary may waive the requirement of a veteran to make a payment under this section if—</text><paragraph id="H5761012314FB4DB2B01D7EDBBCC9634C"><enum>(1)</enum><text>an error committed by the Department or an employee of the Department was the cause of delaying notification sent to the veteran of the requirement to make the payment; and</text></paragraph><paragraph id="HE50F2D1EAB6A4C7C831760A03CC47D15"><enum>(2)</enum><text display-inline="yes-display-inline">the veteran received such notification later than 180 days after the date on which the veteran received the medication for which the payment was required.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H5F126248F22248749FBF2A99B9482820"><enum>(c)</enum><header>Billing procedures</header><paragraph id="H1DF91419DA0B490493806FB4FE9F1998"><enum>(1)</enum><header>In general</header><text>Subchapter I of chapter 17 of such title is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="HC246ED068A9848368870A3A1E3820D6D" style="USC"><section id="H3F6083E415734F6F87E6309735FF6C5F"><enum>1709D.</enum><header>Procedures for copayments</header><subsection id="H37E30FA41FAC4FE1829AA0C589ADC398"><enum>(a)</enum><header>Care at Department facility</header><paragraph commented="no" display-inline="yes-display-inline" id="H6EC1929FEB93484FBBE86D1D4159D81E"><enum>(1)</enum><text>In requiring a veteran to make a payment for care or services provided at a medical facility of the Department pursuant to this chapter, including sections 1710 and 1722A, the Secretary shall provide to such veteran a notification of such required payment by not later than 180 days after the date on which the veteran receives the care or services for which payment is required.</text></paragraph><paragraph id="HBA79679BD3994693AB7FD89EF75D756D" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If the Secretary does not provide to a veteran a notification of the required payment by the date required under paragraph (1), the Secretary may not collect such payment, including through a third-party entity, unless the Secretary provides the veteran the following:</text><subparagraph id="HFAAF04672E61443EBF682D85B9EAEB82"><enum>(A)</enum><text>Information regarding how to apply for a waiver described in section 1710(f)(3)(G) or section 1722A(c) of this title, as appropriate.</text></subparagraph><subparagraph id="HD5A3BE88909F4416A034DE47B0A6147F"><enum>(B)</enum><text>Information regarding how to establish a payment plan with the Secretary.</text></subparagraph><subparagraph id="H11300621A4EA4C50ABE62FDB903C2AB6"><enum>(C)</enum><text>Opportunity to make such a waiver or establish such a payment plan.</text></subparagraph></paragraph></subsection><subsection id="H6E51E9EFF07A4453917287FEA4CE6FCC"><enum>(b)</enum><header>Care at non-Department facility</header><paragraph commented="no" display-inline="yes-display-inline" id="H68F2BB0436854A70AF73EF51D388AD87"><enum>(1)</enum><text>In requiring a veteran to make a payment for care or services provided at a non-Department facility pursuant to this chapter or other provision of law, the Secretary shall provide to such veteran a notification of such required payment by not later than 18 months after the date on which the veteran receives the care or services for which payment is required.</text></paragraph><paragraph id="H3DAB374EE3B4491B83AAA0999A308107" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If the Secretary does not provide to a veteran a notification of the required payment by the date required under paragraph (1), the Secretary may not collect such payment, including through a third-party entity, unless the Secretary provides the veteran the following:</text><subparagraph id="H08599485C1CB4DD9BE4F44D0F7D24A57"><enum>(A)</enum><text>Information regarding how to apply for a waiver described in paragraph (3).</text></subparagraph><subparagraph id="HE635E371336F41CE9C7193D9B1FB6363"><enum>(B)</enum><text>Information regarding how to establish a payment plan with the Secretary.</text></subparagraph><subparagraph id="HC5D21808B1A0413595306B91690E6AC3"><enum>(C)</enum><text>Opportunity to make such a waiver or establish such a payment plan.</text></subparagraph></paragraph><paragraph id="H19C8D92961EE495D9639CB09C8C5A325" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary may waive the requirement of a veteran to make a payment for care or services provided at a non-Department facility pursuant to this chapter or other provision of law if—</text><subparagraph id="HB645A3E5218D43228923628A74D32A38"><enum>(A)</enum><text display-inline="yes-display-inline">an error committed by the Department, an employee of the Department, or a non-Department facility was the cause of delaying the notification sent to the veteran of the requirement to make the payment; and</text></subparagraph><subparagraph id="H5C38DD339427481888C6C9195D925A18"><enum>(B)</enum><text display-inline="yes-display-inline">the veteran received such notification after the period described in paragraph (1).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H2385612421BA45BDB8AF6D01C5EAF9AE"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 1709C the following new item:</text><quoted-block display-inline="no-display-inline" id="HF178A4E320F0445389A26B71C1A40A47" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">1709D. Procedures for copayments.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H38E833D69185421BB0639B167C37AEB8"><enum>(d)</enum><header>Improvement of procedures</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall—</text><paragraph id="H35F37D7C5EE34A86B84BBFE352CFC377"><enum>(1)</enum><text>review the copayment billing internal controls and notification procedures of the Department of Veterans Affairs; and</text></paragraph><paragraph id="HF7E66D466BBF4A6A97452B887B7D085B"><enum>(2)</enum><text>improve such controls and procedures, including pursuant to the amendments made by this Act.</text></paragraph></subsection></section></legis-body></bill>
