which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Energy Policy and Conservation Act to prohibit the Secretary of Energy from prescribing any new or amended energy conservation standard for a product that is not technologically feasible and economically justified, and for other purposes.</official-title></form><legis-body id="H61128BBF0AD142EC800AED374610825F" style="OLC"><section id="H141733D076B4484B9B76C760EF54C9B6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DOE Appliance and Equipment Standards Reform and Consumer Protection Act</short-title></quote>.</text></section><section id="H5A83FC5075CD44D9BB7D74BB9ACB3AC5"><enum>2.</enum><header>Prescribing new or amended energy conservation standards</header><subsection id="HD06110AD103C40EBA8B860CD8881AB80" commented="no"><enum>(a)</enum><header>Petition for amended standard</header><text display-inline="yes-display-inline">Section 325(n) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(n)</external-xref>) is amended—</text><paragraph id="HD40EF269E7C14D99B113CE96875FB9C7" commented="no"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>or revoked</quote> after <quote>should be amended</quote>; </text></paragraph><paragraph id="H1D13E72ED35B4B829AC25AAF70AB05E2" commented="no"><enum>(2)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" id="HD7E0AF3B0A634DE78D3B3CBBE12912AD" display-inline="no-display-inline"><paragraph id="H0A7203ACAACA404EB5229284CB9EC7EB"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary shall grant a petition to determine if energy conservation standards for a covered product should be amended or revoked if the Secretary finds that such petition contains evidence, assuming no other evidence were considered, that such standards—</text><subparagraph id="HE3FC8F3F31964041A621793E11900A0C"><enum>(A)</enum><text>result in additional costs to consumers;</text></subparagraph><subparagraph id="H47B6E1E4192B4F2B8E916B62A457E106"><enum>(B)</enum><text display-inline="yes-display-inline">do not result in significant conservation of energy or water;</text></subparagraph><subparagraph id="HE85AA86E7D6E46479F60DB55131EA50F" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">are not technologically feasible; and</text></subparagraph><subparagraph id="HEB869A6D5BA94C6D86DC65DF114F08C0"><enum>(D)</enum><text display-inline="yes-display-inline">result in such covered product not being commercially available in the United States to all consumers.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HCBE4C376713D4745B8889B71A41DCCC3"><enum>(3)</enum><text>in paragraph (4)—</text><subparagraph id="H0A6DFA0421D24A22A0F76356F0FAE12F"><enum>(A)</enum><text>by striking <quote><header-in-text level="paragraph" style="traditional">New or amended standards.</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="traditional">New, amended, or revoked standards.</header-in-text></quote>;</text></subparagraph><subparagraph id="H20A3A719CAB64EE5BDFA8FF29B0499B5"><enum>(B)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively;</text></subparagraph><subparagraph id="H011FEA0F10F64257BEDD441B986ACCBD"><enum>(C)</enum><text display-inline="yes-display-inline">by striking <quote>Not later than 3 years</quote> and inserting <quote><header-in-text level="subparagraph" style="OLC"><enum-in-header>(A)</enum-in-header></header-in-text> Not later than 3 years</quote>; and</text></subparagraph><subparagraph id="H18F234411A3E410B8985397A48D4817D"><enum>(D)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H9C72BCC3F1164BF18707DF69C6A454FE" display-inline="no-display-inline"><subparagraph id="HAECED92CCB7F43519A3B3BA83420366A" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Not later than 180 days after the date of granting a petition to revoke standards, the Secretary shall publish in the Federal Register—</text><clause id="H3F1F21F7C39144E88AE7E3AF4C68E8DF"><enum>(i)</enum><text>a final rule revoking the standards; or</text></clause><clause id="HFC9183EE7C1848AB897856FFE81CFDC3"><enum>(ii)</enum><text>a determination that it is not necessary to revoke the standards.</text></clause></subparagraph><subparagraph id="HB8CDD90547244D14941EC030BDCB2C1C" indent="up1"><enum>(C)</enum><text>The grant of a petition by the Secretary under this subsection creates no presumption with respect to the Secretary’s determination of any of the criteria in a rulemaking under this section.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H01859B6CFC49473EBEF380B6FEEA25C6"><enum>(b)</enum><header>Criteria</header><text display-inline="yes-display-inline">Paragraphs (2) and (3) of section 325(o) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(o)</external-xref>) are amended to read as follows:</text><quoted-block style="OLC" id="H3CBD1F873DBD4DEAA0003CBF49070240" display-inline="no-display-inline"><paragraph id="HA0315B552EAA416CA1221E436FFA35EC"><enum>(2)</enum><header>Requirements</header><subparagraph id="H68A63B37F2E046469BDA88B71949F17A"><enum>(A)</enum><header>Design</header><text>Any new or amended energy conservation standard prescribed by the Secretary under this section for any type (or class) of covered product shall be designed to achieve the maximum improvement in energy efficiency, or, in the case of showerheads, faucets, water closets, or urinals, water efficiency, which the Secretary determines is technologically feasible and economically justified. </text></subparagraph><subparagraph id="HC607D909DE5E4B53A8DCD5839A76758D" commented="no"><enum>(B)</enum><header>Test procedures</header><text display-inline="yes-display-inline">The Secretary may not prescribe a new or amended energy conservation standard under this section for a type (or class) of covered product if a test procedure has not been prescribed pursuant to section 323 with respect to that type (or class) of product.</text></subparagraph><subparagraph id="H2AEBC11CF461428AA3F0D7F258AA10B7"><enum>(C)</enum><header>Significant conservation</header><text display-inline="yes-display-inline">The Secretary may not prescribe a new or amended energy conservation standard under this section for a type (or class) of covered product if the Secretary determines that the establishment and imposition of such energy conservation standard will not result in significant conservation of—</text><clause id="H3641536A4227480E890AEC7D4F6E18A8"><enum>(i)</enum><text>energy; or</text></clause><clause id="HCC4648DA717B40049071D608077520C4"><enum>(ii)</enum><text>in the case of showerheads, faucets, water closets, or urinals, water.</text></clause></subparagraph><subparagraph id="H867BC17DD8744A698ABD6E91105C00A2"><enum>(D)</enum><header>Technologically feasible and economically justified</header><clause id="H03F0DF248C614780B648D2170FF68C97"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may not prescribe a new or amended energy conservation standard under this section for a type (or class) of covered product unless the Secretary determines that the establishment and imposition of such energy conservation standard is technologically feasible and economically justified.</text></clause><clause id="H2900015DD2704730A9ABB96B67B0D569" commented="no"><enum>(ii)</enum><header>Effect</header><text>For purposes of section 327, a determination under clause (i) with respect to any type (or class) of covered products shall have the same effect as would a standard prescribed for such type (or class). </text></clause></subparagraph></paragraph><paragraph id="HF5A06ECE07214CD1B9A10ED167B0C7E6"><enum>(3)</enum><header>Factors for determination</header><subparagraph id="HBD3C942BF5EE46ADBB23E116A91D27BC"><enum>(A)</enum><header>Economic analysis</header><text display-inline="yes-display-inline">Prior to prescribing any new or amended energy conservation standard under this section for any type (or class) of covered product, the Secretary shall conduct a quantitative economic impact analysis of imposition of the energy conservation standard that determines the predicted—</text><clause id="HC4F05E7F0AAA4D9F8661FD100A42BC65" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">effects of imposition of the energy conservation standard on costs to consumers of the products subject to such energy conservation standard, including—</text><subclause id="H62266EFA1DC54B939580E17BAC6C76D2" commented="no"><enum>(I)</enum><text>costs to low-income households; and</text></subclause><subclause id="H36D214DF0CC8453AB8172ED0CB573FF2" commented="no"><enum>(II)</enum><text>variations in costs to consumers based on differences in regions, including climatic differences;</text></subclause></clause><clause id="H19EDB84064AE4C779C7742399CEF646F"><enum>(ii)</enum><text display-inline="yes-display-inline">effects of imposition of the energy conservation standard on employment; and</text></clause><clause id="H76D0E0DF492D4ED1B0CEE15610018619"><enum>(iii)</enum><text>lifecycle costs for the covered product, including costs associated with the purchase, installation, maintenance, disposal, and replacement of the covered product.</text></clause></subparagraph><subparagraph id="H496621DE980241E497705861D967EC9A" commented="no"><enum>(B)</enum><header>Prohibition on additional costs to the consumer</header><text display-inline="yes-display-inline">The Secretary may not determine that imposition of an energy conservation standard is economically justified unless the Secretary, based on an economic analysis under subparagraph (A) determines that—</text><clause id="H91CD95964FB747AA94E33A23F0A1734C" commented="no"><enum>(i)</enum><text>imposition of such energy conservation standard is not likely to result in additional net costs to the consumer, including any increase in net costs associated with the purchase, installation, maintenance, disposal, and replacement of the covered product; and</text></clause><clause id="H14C6A7AF2A654F428834C620E5B13862" commented="no"><enum>(ii)</enum><text>any additional cost to the consumer of purchasing and installing a covered product complying with such energy conservation standard will be less than 3 times the value of the energy, and as applicable, water, savings during the first year that the consumer will receive as a result of the standard, as calculated under the applicable test procedure. </text></clause></subparagraph><subparagraph id="H8B20831A8F4B471EA75E68E65D9BA85A"><enum>(C)</enum><header>Required energy or water savings</header><text display-inline="yes-display-inline">The Secretary may not determine that imposition of an energy conservation standard is economically justified unless the Secretary determines that compliance with such energy conservation standard will result in—</text><clause id="HB2AFAA01D8A64F1F9631633CE8D104A0"><enum>(i)</enum><text> a reduction of at least 0.3 quads of site energy over 30 years; or</text></clause><clause id="H85A0B7661C294499B4E0C215AE7F2420" commented="no"><enum>(ii)</enum><text>at least a 10 percent reduction in energy or water use of the covered product. </text></clause></subparagraph><subparagraph id="H2BCD513F930A4CBA88A25B40FB41528A"><enum>(D)</enum><header>Criteria related to performance</header><text display-inline="yes-display-inline">The Secretary may not determine that imposition of an energy conservation standard is economically justified unless the Secretary determines that imposition of such energy conservation standard will not result in any lessening of the utility or the performance of the applicable covered product, taking into consideration the effects of such energy conservation standard on—</text><clause id="HD561560EF9F2493382AAD1DD2CD131FD"><enum>(i)</enum><text display-inline="yes-display-inline">the compatibility of the covered product with existing systems;</text></clause><clause id="HCD416E3BB06F4D48AE79ED72FA7DF0CB"><enum>(ii)</enum><text>the life span of the covered product;</text></clause><clause id="H1D7DE240816B4B7DAA2BFD1390E926DD"><enum>(iii)</enum><text>the operating conditions of the covered product;</text></clause><clause id="H00D06191BA164596BA3989A342AA6AC1"><enum>(iv)</enum><text>the duty cycle, charging time, and run time of the covered product, as applicable;</text></clause><clause id="HCCBDFBC53C2B456EA86353E435624BB2"><enum>(v)</enum><text>the maintenance requirements of the covered product; and</text></clause><clause id="HB093F5C98D0E4FD99901BBA584A6D25C"><enum>(vi)</enum><text>the replacement and disposal requirements for the covered product.</text></clause></subparagraph><subparagraph id="HC917B2BE98D94A5ABDC1467E88A88CE9"><enum>(E)</enum><header>Criteria related to market competition and price discrimination</header><text display-inline="yes-display-inline">The Secretary may not determine that imposition of an energy conservation standard is economically justified unless the Secretary determines that imposition of the energy conservation standard is not likely to result in—</text><clause id="H0613FD29CE3E400E9D59889CA5FADB10"><enum>(i)</enum><text>any lessening of market competition; or</text></clause><clause id="H505B59D07F4F4013A5A18B11C07AC53F" commented="no"><enum>(ii)</enum><text>price discrimination.</text></clause></subparagraph><subparagraph id="HAD346C9565B04A42A6ABCCA372A8D71D" commented="no"><enum>(F)</enum><header>Technological innovation</header><text display-inline="yes-display-inline">The Secretary may not determine that imposition of an energy conservation standard is economically justified unless the Secretary determines that imposition of such energy conservation standard is not likely to result in the unavailability in the United States of a type (or class) of products based on what type of fuel the product consumes. </text></subparagraph><subparagraph id="H56880FD31B7E442693D73E440B95DD04" commented="no"><enum>(G)</enum><header>Other considerations</header><text display-inline="yes-display-inline">In determining whether imposition of an energy conservation standard is economically justified, the Secretary—</text><clause id="H4B31545F350743D292017B515CF24653" commented="no"><enum>(i)</enum><text>shall prioritize the interests of consumers;</text></clause><clause id="HCA834DB340844A4482D90CA44D1D139F" commented="no"><enum>(ii)</enum><text>may not consider estimates of the social costs or social benefits associated with incremental greenhouse gas emissions; and</text></clause><clause id="HA7A6FC0B4D9543E4B6CC592ECB58B83C" commented="no"><enum>(iii)</enum><text>shall consider—</text><subclause id="HB80DCC0B0AC042B09716D17F4D6455AA" commented="no"><enum>(I)</enum><text>the economic impact of the standard on the manufacturers and on the consumers of the products subject to such standard; </text></subclause><subclause id="H3ED048803D604DDD97D36CCAD83A1ADC" commented="no"><enum>(II)</enum><text>the savings in operating costs throughout the estimated average life of the covered product in the type (or class) compared to any increase in the price of, or in the initial charges for, or maintenance expenses of, the covered products which are likely to result from the imposition of the standard; </text></subclause><subclause id="H7985A29CC40149BBA217D276B9877AFF" commented="no"><enum>(III)</enum><text>the total projected amount of energy, or as applicable, water, savings likely to result directly from the imposition of the standard;</text></subclause><subclause id="H6590CE1A2C0D4FC5B7E16C93C43E49FA" commented="no"><enum>(IV)</enum><text display-inline="yes-display-inline">the need for national energy and water conservation; and</text></subclause><subclause id="H467CA902A56A476BA37DE1646CC58053" commented="no"><enum>(V)</enum><text>other factors the Secretary considers relevant.</text></subclause></clause></subparagraph><subparagraph id="H975025C8161E4DFFB60BECFC20A36593" indent="up1" commented="no"><enum>(H)</enum><header>Regulatory review</header><clause id="H6FCC7AB449344E18B1956DEEB5B8A762"><enum>(i)</enum><header>Evaluation</header><text>Not later than 2 years after the issuance of any final rule prescribing a new or amended energy conservation standard under this section for any type (or class) of covered product, the Secretary shall evaluate the rule to determine whether such energy conservation standard is technologically feasible and economically justified and whether the regulatory impact analysis for such rule remains accurate.</text></clause><clause id="H18999CA9B1F547C39AE8E6C81F573B3D"><enum>(ii)</enum><header>Effect</header><text>Notwithstanding any other provision of this part, if the Secretary determines, based on an evaluation under clause (i), that an energy conservation standard is not technologically feasible or economically justified—</text><subclause id="HCEFD2CF85D28470A93A02BFAA0D5F084"><enum>(I)</enum><text>the Secretary shall publish such determination and such energy conservation standard shall have no force or effect; and</text></subclause><subclause id="H0DC02929CA4C4F9D8BBB15E6240364F5"><enum>(II)</enum><text display-inline="yes-display-inline">the Secretary may publish a final rule amending the energy conservation standard for the type (or class) of covered product to be technologically feasible and economically justified in accordance with this subsection, which amendment shall apply to such a product that is manufactured after the date that is 2 years after publication of such final rule.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H64DDA103614F494B813EA225ABC9F5C5"><enum>3.</enum><header>Conforming amendments</header><subsection id="HDD9F8C5524B44A07A406B8F3A80724F0"><enum>(a)</enum><header>Amendment of standards</header><text display-inline="yes-display-inline">Section 325(m)(1)(A) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(m)(1)(A)</external-xref>) is amended by striking <quote>, based on the criteria established under subsection (n)(2)</quote>.</text></subsection><subsection id="H5581629E9E9A4C9B8C7818F45592DCDC"><enum>(b)</enum><header>Regional standards</header><text display-inline="yes-display-inline">Section 325(o)(6)(D)(i)(II) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(o)(6)(D)(i)(II)</external-xref>) is amended by striking <quote>this paragraph</quote> and inserting <quote>this subsection</quote>.</text></subsection><subsection id="HD712BA10FBAE498AB0814D921A0059AF"><enum>(c)</enum><header>Procedure for prescribing new or amended standards</header><text display-inline="yes-display-inline">Section 325(p)(2)(A) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(p)(2)(A)</external-xref>) is amended by striking <quote>taking into account those factors which the Secretary must consider under subsection (o)(2)</quote> and inserting <quote>as determined in accordance with subsection (o)</quote>. </text></subsection><subsection id="HBDAB3550FA294E66BC808F81B1AC4CF4"><enum>(d)</enum><header>Energy conservation standards for high-Intensity discharge lamps, distribution transformers, and small electric motors</header><text>Section 346 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6317">42 U.S.C. 6317</external-xref>) is amended by striking subsection (c).</text></subsection></section></legis-body></bill>
