R. 83</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210104">January 4, 2021</action-date><action-desc><sponsor name-id="D000616">Mr. DesJarlais</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Communications Act of 1934 to protect constitutional rights from online platform censorship, and for other purposes.</official-title></form><legis-body id="H19B7861487264C7C9AC2564E5E3C2EE4" style="OLC"><section id="HEA80BFBB31A7468383BCA71DEC75CB28" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Constitutional Rights from Online Platform Censorship Act</short-title></quote>.</text></section><section id="H4F3A9A1AB5174BC68509CE6626C636D7"><enum>2.</enum><header>Protection of Constitutional Rights</header><subsection id="H651FCE59B5BB46EDBB711C6186FF7BCB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 230(c) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>) is amended—</text><paragraph id="HF6FD3CCAE49B460CB9BA9BD130773CF5"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="subsection" style="OLC">Protection for <quote>Good Samaritan</quote> Blocking and Screening of Offensive Material</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Blocking and screening of lawful and Constitutional material</header-in-text></quote>; and </text></paragraph><paragraph id="HEC69F87749EC4AF7B52D3CC739C2A396"><enum>(2)</enum><text display-inline="yes-display-inline">by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" id="H7E42E120BF9F4D1CA2E15FB77E5C5C9C" display-inline="no-display-inline"><paragraph id="HAB818876C1C64B09A7C2C24FF0CCE7B5"><enum>(2)</enum><header>Prohibition</header><subparagraph id="H48CBFA998D284833979D10BC5B42AF9C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">It shall be unlawful for any internet platform to take an action to restrict access to or the availability of protected material of a user of such platform.</text></subparagraph><subparagraph id="H5B0F02D4B3DB4F769AE3ADB86C491CD9"><enum>(B)</enum><header>Private right of action</header><text>If an internet platform takes an action to restrict access to or the availability of protected material of a user of such platform, such user may bring an action in an appropriate State court or an appropriate district court of the United States against such platform to obtain the relief described under subparagraph (C).</text></subparagraph><subparagraph id="H209463D15F5D4200A9ACD70C420142BC"><enum>(C)</enum><header>Relief</header><text>A user that prevails in a civil action under subparagraph (B) may obtain monetary relief of not less than $10,000 but not more than $50,000 per action described under subparagraph (A).</text></subparagraph><subparagraph id="H879571DE7E5644DBA95D07836FB8C643"><enum>(D)</enum><header>Protected material defined</header><text display-inline="yes-display-inline">In this paragraph, the term <quote>protected material</quote> means material that is protected under the Constitution or otherwise protected under Federal, State, or local law. </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA7EDEB0B5C5A4BBF97C7404D611C52ED"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">This Act, and the amendments made by this Act, shall take effect 30 days after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
