R. 8364</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220713">July 13, 2022</action-date><action-desc><sponsor name-id="L000589">Mrs. Lesko</sponsor> (for herself, <cosponsor name-id="G000565">Mr. Gosar</cosponsor>, <cosponsor name-id="N000190">Mr. Norman</cosponsor>, and <cosponsor name-id="G000552">Mr. Gohmert</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the Secretary of Agriculture from establishing or enforcing certain requirements related to spaces reserved for biological males and biological females in schools that participate in the school meal programs, and for other purposes.</official-title></form><legis-body id="HA4529D74D4CE45368CAEE5A901C8F822" style="OLC"><section id="H4847E52B4B0D48D885F5017244CF4424" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Kids, Protecting Lunches Act of 2022</short-title></quote>.</text></section><section id="H561C7918D4624707B66205D453470ACA" section-type="subsequent-section"><enum>2.</enum><header>Prohibiting certain requirements for participation in school meal programs</header><text display-inline="no-display-inline">In carrying out the school lunch program authorized under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>) and the school breakfast program established by section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>), the Secretary of Agriculture shall not—</text><paragraph id="H1DCEC4BBA201411D956D76636FBF7F64"><enum>(1)</enum><text>require a State or local educational agency, school food authority, or any other entity that participates in such school meal programs to, with respect to schools served by such entities—</text><subparagraph id="H9BA93972EBEB4D10B4D6DF60C59637F4"><enum>(A)</enum><text display-inline="yes-display-inline">prohibit the existence of spaces in such schools, including sports teams, that are reserved exclusively for biological males or biological females;</text></subparagraph><subparagraph id="HCCC0B34BF5584D8096C9B2AF124C852B"><enum>(B)</enum><text display-inline="yes-display-inline">allow biological males in such spaces reserved exclusively for biological females; or</text></subparagraph><subparagraph id="HD92E23FBF46649389073FEC3ECE49416"><enum>(C)</enum><text display-inline="yes-display-inline">allow biological females in such spaces reserved exclusively for biological males; and</text></subparagraph></paragraph><paragraph id="H6150D88D00DA4B8F86302A9C7328E7A6"><enum>(2)</enum><text>condition funding for participation in such school meal programs on any such requirement described in subparagraphs (A) through (C) of paragraph (1).</text></paragraph></section></legis-body></bill>
