which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Education to award grants to provide financial assistance to certain educators to make down payments on certain homes, and for other purposes.</official-title></form><legis-body id="HC8EAE7CFCA4B49049013C9159BE149D9" style="OLC"><section id="H3F71C085DC014B9989B4E0B6A36DD2DA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Educator Down Payment Assistance Act of 2022</short-title></quote>.</text></section><section id="HD6B8A811C0E34124BFBBEFB5EE12B89B"><enum>2.</enum><header>First-time homebuyer down payment assistance program</header><subsection id="HAF3BB7F2BE124F7CB62695332C6797FF" commented="no"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Education shall award grants, on a competitive basis, to eligible entities to award subgrants to eligible educators in accordance with subsection (d).</text></subsection><subsection id="H3F6E948DF25E4D8B88C0655ED73EB966"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity seeking a grant under this section shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines appropriate, including an assurance that such entity will utilize an existing, or establish a new, down payment assistance program to award subgrants to eligible educators.</text></subsection><subsection id="H4EC9D373CD474E389AA54B45575DB090"><enum>(c)</enum><header>Geographic areas</header><text display-inline="yes-display-inline">In the case of a geographic area that is served by an eligible entity that is a unit of local government and an eligible entity that is a local educational agency, the Secretary may only award a grant to 1 such entity in such geographic area.</text></subsection><subsection id="H7AA5DB35B9B24285BD7FF7C5409D1C1B"><enum>(d)</enum><header>Subgrants</header><paragraph id="H55AF8141DFB04A94A748B3C0FFC45EC2"><enum>(1)</enum><header>In general</header><text>An eligible entity that receives a grant under subsection (a) shall use such grant funds to award subgrants to eligible educators.</text></paragraph><paragraph id="HAEE2EFA7648B412098487EB2F031C910"><enum>(2)</enum><header>Application</header><text>An eligible educator seeking a subgrant under this subsection shall submit to the eligible entity an application in such form, at such time, and containing such information as the eligible entity determines appropriate, including an assurance that such educator will—</text><subparagraph id="HE6D1FD9C4C434B16BB941615BA08E8D0"><enum>(A)</enum><text>complete the housing counseling required under paragraph (8); and</text></subparagraph><subparagraph id="H07445C627866473483288EE5E42741F9" commented="no"><enum>(B)</enum><text>use an eligible residential mortgage loan to purchase an eligible dwelling.</text></subparagraph></paragraph><paragraph id="HFDDFB9591A7C476C877447D63FAF0C1D" commented="no"><enum>(3)</enum><header>Subgrant uses</header><text>An eligible educator that receives a subgrant under this subsection shall use such subgrant funds to pay, with respect to the purchase of an eligible dwelling using an eligible residential mortgage loan, for—</text><subparagraph id="H962B81DF45674BE289DD235AE2AD8771" commented="no"><enum>(A)</enum><text>direct down payment costs associated with such purchase;</text></subparagraph><subparagraph id="HF1E15C7B0B1B4787AA5F466D9D201D47" commented="no"><enum>(B)</enum><text>closing costs associated with such purchase; and</text></subparagraph><subparagraph id="H80229D24C464496FA43A5CAEA6795EC0" commented="no"><enum>(C)</enum><text>costs related to reducing the rates of interest on such eligible residential mortgage loan associated with such purchase.</text></subparagraph></paragraph><paragraph id="H68A167B2655E4926AD788B5CD7DD8215" commented="no"><enum>(4)</enum><header>Subgrant amount</header><subparagraph id="H2375C5D060D545CCAE78EDF2BB6DE5CF" commented="no"><enum>(A)</enum><header>In general</header><text>Except as provided under subparagraph (B), a subgrant awarded under this subsection may not exceed $25,000.</text></subparagraph><subparagraph id="H4CB9D6A2A61F4B408FFC219012E53B6F" commented="no"><enum>(B)</enum><header>Exception</header><text>In the case of an eligible educator purchasing an eligible dwelling that is located in a high-cost area (as determined by the Secretary based on area median income), a subgrant awarded under this subsection may exceed $25,000.</text></subparagraph></paragraph><paragraph id="HA354142FBBB34D0BADE13F65B5C12EBA" commented="no"><enum>(5)</enum><header>Subgrant limit</header><text>An eligible educator may only receive 1 subgrant under this subsection.</text></paragraph><paragraph id="HE1188C33183147DD9079B6A1474E6F72" commented="no"><enum>(6)</enum><header>Additional funds</header><text display-inline="yes-display-inline">An eligible entity may award a subgrant under this subsection to an eligible educator who is receiving funds from other sources, including other State, Federal, local, private, public, and nonprofit sources, for the purpose of purchasing an eligible dwelling.</text></paragraph><paragraph id="HF450DDA37DDD47C4A287B62314BE9D60"><enum>(7)</enum><header>Occupancy requirement</header><subparagraph id="H1BB1C4A1B1F64CDBAB7B005D68AEBBE4"><enum>(A)</enum><header>In general</header><text>An eligible educator who is awarded a subgrant under this subsection and makes a down payment on an eligible dwelling with such subgrant funds shall use such dwelling as a primary residence for a period of not less than 3 years.</text></subparagraph><subparagraph id="HD66008BBD458422AAB57E94FC3FAD93D"><enum>(B)</enum><header>Enforcement</header><clause id="H86147A7A9ADB479789184093360C2A73"><enum>(i)</enum><header>Return of funds</header><text>An eligible educator who does not comply with the requirement under subparagraph (A) shall return to the eligible entity the total amount of the subgrant funds awarded to such educator under this subsection.</text></clause><clause id="H7FF7B7195BE74578BBBE0CA00DF7E0E3"><enum>(ii)</enum><header>Timing</header><text>Such funds shall be returned in accordance with clause (i) not later than 1 year after such educator ceases to use such dwelling as a primary residence in violation of the requirement under subparagraph (A).</text></clause><clause id="HACEA266E31B04D059701E123C1D2A8B7"><enum>(iii)</enum><header>Exception</header><text display-inline="yes-display-inline">An eligible educator who does not comply with the requirement under subparagraph (A) due to an emergency event shall not be required to return subgrant funds under clause (i).</text></clause></subparagraph></paragraph><paragraph id="H32EF06B478BE49AEA2D1CEE9351BDD1B"><enum>(8)</enum><header>Housing counseling requirement</header><subparagraph id="H142451884D224FF4AB48BDEE0E9FE480"><enum>(A)</enum><header>In general</header><text>An eligible educator shall provide to the eligible entity, in accordance with clause (iii), proof of completion of a program of housing counseling that—</text><clause id="HB5BD7A97A1DF4BAA9F65674E82662604"><enum>(i)</enum><text>is offered—</text><subclause id="H5AA3CBF2546F4B2D9852E3EA537FCF82" commented="no"><enum>(I)</enum><text>by a housing counseling agency that is approved by the Department of Housing and Urban Development; and</text></subclause><subclause id="H3A0E4F037C2D4883BEDFDA53B72459F2"><enum>(II)</enum><text display-inline="yes-display-inline">in person, virtually, by telephone, or by any other method determined by the Secretary to be acceptable;</text></subclause></clause><clause id="H8C7F3230C275483FA09035DD50EBFEF9"><enum>(ii)</enum><text>includes information with respect to—</text><subclause id="H06521E69387C475797E2D0AB95515873"><enum>(I)</enum><text>the responsibilities and financial management required with respect to owning a home; and</text></subclause><subclause id="H364987CD802C47A5BF71D627FC60B957" commented="no"><enum>(II)</enum><text>fair housing rights and how to file a fair housing complaint; and</text></subclause></clause><clause id="H73A3ACE3373E46B89DA958E03BF9426F"><enum>(iii)</enum><text>is completed prior to filling out a loan application or entering into a sales purchase agreement.</text></clause></subparagraph><subparagraph id="H247C9E45465D4AADB7094AC03DD5F26A"><enum>(B)</enum><header>Funding</header><text>The Secretary shall reserve not less than 5 percent of the funds made available to carry out this section to pay for the costs of the housing counseling required under subparagraph (A) for eligible educators.</text></subparagraph></paragraph></subsection><subsection id="HBA00A70AEDD04D4CB87AE7B109225ED8"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HB596CCE43F6F41BF8BE9D0490A1FC26C" commented="no"><enum>(1)</enum><header>Eligible dwelling</header><subparagraph id="HC9C463B1D04942918EAEA30D77511DCF" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>eligible dwelling</term> means a residential property, an apartment, a condominium, or a manufactured dwelling unit.</text></subparagraph><subparagraph id="H55B5B8621EE749BF83F87CD551C14279" commented="no"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">An eligible dwelling does not include a residential property that contains more than 4 dwelling units. </text></subparagraph></paragraph><paragraph id="H144FF562617F42D99FDC8FBF25B40AAA"><enum>(2)</enum><header>Eligible educator</header><text display-inline="yes-display-inline">The term <term>eligible educator</term> means a public elementary or secondary school teacher, principal, paraprofessional, school leader, or other staff who—</text><subparagraph id="H46D9731AAC354D8DB618C90F2AF8DDFD"><enum>(A)</enum><text>is a first-time homebuyer;</text></subparagraph><subparagraph id="H8BD42222AB3540529F8A7D3D22FDE948"><enum>(B)</enum><text display-inline="yes-display-inline">has served in their position or another position in the educational system for not less than a total of 3 years (without regard to whether such years were consecutive); </text></subparagraph><subparagraph id="HAC3B8AEA8DA64EFDAEBD41439F43F9EC"><enum>(C)</enum><text>has a qualifying income; and</text></subparagraph><subparagraph id="H6EAAC58A49A9401A9DDADC48581CFE8C" commented="no"><enum>(D)</enum><text>is in good standing.</text></subparagraph></paragraph><paragraph id="H1203857F7B6C4EDC89EAF379959E406D"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="H09A70E00067C4676A4D1F6AB523AD1C4"><enum>(A)</enum><text>a unit of local government;</text></subparagraph><subparagraph id="HA7B91976C5C94029B3271C023FA7F968"><enum>(B)</enum><text>a State housing finance agency; or</text></subparagraph><subparagraph id="H5A2E74E5A8BE4242A45E9340F862D8BF"><enum>(C)</enum><text>a local educational agency.</text></subparagraph></paragraph><paragraph id="H56397D741A484F85B5CBE09D0BA6FC5E" commented="no"><enum>(4)</enum><header>Eligible residential mortgage loan</header><text>The term <term>eligible residential mortgage loan</term> means a residential mortgage loan that—</text><subparagraph id="H35E52A15F5B74EE3A2262F7136339C58" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">meets the underwriting requirements and dollar amount limitations for acquisition by the Federal National Mortgage Association or the Federal Home Loan Mortgage Corporation; </text></subparagraph><subparagraph id="H538F8C87B4244D4AB4CE297602696AEB" commented="no"><enum>(B)</enum><text>is made, insured, or guaranteed under title II of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707 et seq.</external-xref>) or title V of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1471">42 U.S.C. 1471 et seq.</external-xref>); </text></subparagraph><subparagraph id="HC368F510D7CE4340B82B934E2674355C" commented="no"><enum>(C)</enum><text>is a qualified mortgage, as such term is defined in section 129C(b)(2) of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1639c">15 U.S.C. 1639c(b)(2)</external-xref>); </text></subparagraph><subparagraph id="H08D2EA7F4AFF4DDD9BB3B7C1DA85424D" commented="no"><enum>(D)</enum><text>is made, insured, or guaranteed under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/37">chapter 37</external-xref> of title 38, United States Code; or </text></subparagraph><subparagraph id="H75BD357388234A5EAC020CFDC8498292" commented="no"><enum>(E)</enum><text>is guaranteed under section 184 of the Housing and Community Development Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/12/1715z-13a">12 U.S.C. 1715z–13a</external-xref>).</text></subparagraph></paragraph><paragraph id="H06F60EF70F9F424A889C4A145794E30B"><enum>(5)</enum><header>Emergency event</header><text>The term <term>emergency event</term> includes—</text><subparagraph id="H09BCF0DF996040EB86D6CACFE9E78B98"><enum>(A)</enum><text display-inline="yes-display-inline">military deployment;</text></subparagraph><subparagraph id="HF855052D4D0A4E5AA6B77CAF54817125"><enum>(B)</enum><text>divorce;</text></subparagraph><subparagraph id="H83072C7EB3AA486498A24BC4EA196F60"><enum>(C)</enum><text>death of an eligible educator or spouse; and</text></subparagraph><subparagraph id="H4E02D88CEEF64259920D7B6887D5B742"><enum>(D)</enum><text>other similar unforeseen events as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="H52DDB52E915D4717AFD72B12BE48DDA0"><enum>(6)</enum><header>ESEA terms</header><text>The terms <term>elementary school</term>, <term>local educational agency</term>, <term>other staff</term>, <term>secondary school</term>, and <term>Secretary</term> have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="HC660ACF454A34ABC8E6E7A2C089E2663" commented="no"><enum>(7)</enum><header>First-time homebuyer</header><text>The term <term>first-time homebuyer</term> has the meaning given such term in section 92.2 of title 24, Code of Federal Regulations (as in effect on the date of the enactment of this Act), except that any reference in such section to the American Dream Downpayment Initiative shall be deemed to be a reference to the grant program established under this section.</text></paragraph><paragraph id="H216C1D3C53B644D0A91FD87AE544400A" commented="no"><enum>(8)</enum><header>Good standing</header><subparagraph id="HCE4613D5ED964893B38FD6E320CFB4FE" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>good standing</term> means that, with respect to an eligible educator and for the period described in subparagraph (B), such educator has not received disciplinary action from the local educational agency that serves the school at which such educator works as an educator.</text></subparagraph><subparagraph id="H412916566A2743A5A20B062000630237" commented="no"><enum>(B)</enum><header>Period</header><text>The period described in subparagraph (A)—</text><clause id="HF47E9948586647C78B1D4D9A8C159AD5" commented="no"><enum>(i)</enum><text>begins on the date that is 3 years before the date described in clause (ii); and</text></clause><clause id="H42293D96461040C989EAD3AE3185A04A" commented="no"><enum>(ii)</enum><text>ends on the date on which such educator submits an application under subsection (c).</text></clause></subparagraph></paragraph><paragraph id="HDD16AE81B25E44D0A1159B8BF4622FC3"><enum>(9)</enum><header>Qualifying income</header><subparagraph id="H3E5C75B574724BA6B991057AD4B35EEA"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>qualifying income</term> means, except as provided in subparagraph (B), an income that does not exceed 120 percent of the area median income in which the eligible dwelling to be purchased is located.</text></subparagraph><subparagraph id="H7A98FECA68F4422B8344A5D979B03797" commented="no"><enum>(B)</enum><header>High-cost area</header><text>If the Secretary makes a determination that an area described in subparagraph (A) is a high-cost area, the qualifying income shall be an income that does not exceed 180 percent of the median income of such area.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
