<section id="HE440C1B349864F5B9825BC599DB3214E" section-type="section-one"><enum>1.</enum><header>Restrictions on the use of automated telephone equipment</header> 
<subsection id="H94D620FE53B1422090B5D24609F97A9C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>) is amended—</text> <paragraph id="H2E70AD782AEB4B0BA1E07993A78B8A02"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text> 
<subparagraph id="HF673930A8E3C4368A8456169D81C97CE"><enum>(A)</enum><text>in paragraph (1)—</text> <clause id="HAAE89448045845599B82938353422B19"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>, using a random or sequential number generator</quote> and inserting <quote>or sent a text message</quote>; and</text></clause> 
<clause id="HA7D7D4C848464C03800D5A5934A7A09B"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>dial such numbers</quote> and inserting <quote>automatically dial or send a text message to such numbers</quote>; and</text></clause></subparagraph> <subparagraph id="H2B839C3B27AA40DF968AED3DC3F64829"><enum>(B)</enum><text>by redesignating paragraph (5) as paragraph (6) and inserting after paragraph (4) the following new paragraph:</text> 
<quoted-block style="OLC" id="H440F81E68E0640F0B02D947DCE5F9B2F" display-inline="no-display-inline"> 
<paragraph id="H8E617320060E4246903370180E76E934"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>text message</term> has the meaning given such term in subsection (e)(8).</text> </paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HC47C38734F30428FBFAB6DA91B036242"><enum>(2)</enum><text>in subsection (b)—</text> 
<subparagraph id="HB6268F323E8B4B7CA076EA9CA0EEC8BF"><enum>(A)</enum><text>in paragraph (1)—</text> <clause id="H2EEBE06783C5496DA1BB6E808ACD67C1"><enum>(i)</enum><text>in subparagraph (A)—</text> 
<subclause id="H8CD6DE1881884DFBAAA9A30944E38B9D"><enum>(I)</enum><text>in the matter preceding clause (i), by striking <quote>any call</quote> and all that follows through <quote>called party)</quote> and inserting <quote>any call or send any text message (other than a call made or text message sent for emergency purposes or with the prior express consent of the recipient of such call or text message)</quote>; and </text></subclause> <subclause id="H02DC7353F72C499C9522144CB0F26967"><enum>(II)</enum><text>in clause (iii), by striking <quote>called party</quote> and all that follows through <quote>United States</quote> and inserting <quote>recipient of such call or text message is charged for receiving such call or text message</quote>; and</text></subclause></clause> 
<clause id="HA9653B9A11F74210BD4EE7953CE81AF8"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>, is made solely pursuant to the collection of a debt owed to or guaranteed by the United States,</quote>; and</text></clause></subparagraph> <subparagraph id="H765C720BAFBE4B6EAB3660D5A8733055"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

<paragraph id="H949E1A97EE1742948862E5470DC0A8FD"><enum>(5)</enum><header>Safe harbor for reassigned numbers</header> 
<subparagraph id="HC26530B85D484FC1A50E5926C7A4CE05"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">It shall not be a violation of the prohibition in paragraph (1)(A) for a person, using an automatic telephone dialing system or an artificial or prerecorded voice, to make a call or send a text message to a telephone number without the prior express consent of the subscriber assigned such telephone number if such person obtained express consent to make such call or send such text message to such number from a subscriber assigned such number on the date on which such express consent was obtained.</text></subparagraph> <subparagraph id="H76B2E0D23C924AC5BF729A7F95CD09D3"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">Subparagraph (A) shall not apply unless the person making such call or sending such text, bearing the burden of proof, demonstrates that—</text> 
<clause id="H36242983AC614028A493FEF6F1E576DD"><enum>(i)</enum><text>prior to making such call, such person queried the database maintained by the Commission under subparagraph (C) to determine whether such number was permanently disconnected after the date on which prior express consent was obtained from a subscriber previously assigned such number, and received a response indicating such number was not permanently disconnected after such date; and</text></clause> <clause id="H8743C8F9B4CD47C78BF1A37403D75C51"><enum>(ii)</enum><text>if such person had not received such response, such person would not have made such call or sent such text message to such number.</text></clause></subparagraph> 
<subparagraph id="H364C8D0F3E114BEBA0D1218E5F097DF6"><enum>(C)</enum><header>Reassigned telephone number database</header><text display-inline="yes-display-inline">The Commission shall maintain a database which persons may query for the purpose of determining whether a telephone number was permanently disconnected after the date on which prior express consent was obtained from a subscriber assigned such number.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> </subsection> <subsection id="HBA47A3FF2AC54FF2B5881EE2273C32D7"><enum>(b)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Federal Communications Commission, with consideration given to modern dialing practices and consumer preferences, shall issue a rule defining the terms <quote>automatically</quote>, <quote>dial</quote>, <quote>send</quote>, and <quote>charged for the call</quote>, as used in 227(a)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(a)(1)</external-xref>), as amended by this Act.</text> </subsection></section>
