<official-title display="yes">To amend the Public Health Service Act to encourage the rapid development of certain public health data standards, authorize epidemiological surveillance grants, and authorize a data linkage demonstration project, and for other purposes.</official-title>

<section id="H611E398D81AB4A65AA531D21255B635F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Health Standards To Advance Transparency, Integrity, Science, Technology Infrastructure, and Confidential Statistics Act of 2021</short-title></quote> or the <quote><short-title>Health STATISTICS Act of 2021</short-title></quote>.</text></section> <section id="H5077CF55FD414E8E815C8EF9C469EFCC"><enum>2.</enum><header>Improving public health data</header><text display-inline="no-display-inline">Title XXXI of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300kk">42 U.S.C. 300kk</external-xref>) is amended—</text>
<paragraph id="H59FC1D8D1AA44792B7C0DCD08365F4B3"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting before section 3101 the following subtitle designation and heading:</text> <quoted-block style="OLC" id="H638B2F7421824D198A87060A16629A1F" display-inline="no-display-inline"> <subtitle id="H6706879A7EE14DE697D30AE7EB8EB196"><enum>A</enum><header>In general</header></subtitle><after-quoted-block>;</after-quoted-block></quoted-block> <subparagraph id="idFC0012AA4EB54036BE950E0F6D57D17A"><enum/><text> and</text></subparagraph></paragraph>
<paragraph id="H57B68967BDE04813A6054E024AC99DA2"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new subtitle:</text> <quoted-block style="OLC" id="HC21D54320AB249E5BF8D432BE9B59C32" display-inline="no-display-inline"> <subtitle id="H83B1FECE36334FB193C08D2FADDFD80C" commented="no"><enum>B</enum><header>Public health common data standards</header> <section id="H1BA65CC0AB9649CC883568FCF98C3E01" commented="no"><enum>3111.</enum><header>Treatment of public health data</header> <subsection id="HE42237B85B1D4D74A1D384E61D1DC097" commented="no"><enum>(a)</enum><header>Standardized reporting</header> <paragraph id="H1A3FEAB0F08D44BEB749785D0EE4CAE9" commented="no"><enum>(1)</enum><header>In general</header><text>The Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall—</text>
<subparagraph id="HF97449FD447E4E0FA0AADE013F424FDA" commented="no"><enum>(A)</enum><text>adopt and update as necessary uniform standards for State and local health departments to report data to the Centers; and</text></subparagraph> <subparagraph id="H4663826425824ACAA924EFF03D17B24F" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">in adopting and updating standards under this subsection, give deference to—</text>
<clause id="H4FD31776B7804783952F9E65B0DEE38A" commented="no"><enum>(i)</enum><text>corresponding standards developed by standards development organizations and voluntary consensus-based standards bodies; and</text></clause> <clause id="HC54FF4A9D562406EB7542F8DD3DA50B0" commented="no"><enum>(ii)</enum><text>the recommendations of the working group established under paragraph (3).</text></clause></subparagraph></paragraph>
<paragraph id="H2ADD7D2E0C7A4980B237CCB83D549B38" commented="no"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">The standards under paragraph (1) shall— </text> <subparagraph id="H5F40F64336BC4A08AAEE8FB43F9C315D" commented="no"><enum>(A)</enum><text>be consistent with—</text>
<clause id="H961E8317388C4EB8BC1FF1164B5DCD60" commented="no"><enum>(i)</enum><text>standards for the interoperability of health information technology under subtitle A;</text></clause> <clause id="H285BD758A7DC4B89871AEED8CAEFCF83" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">Office of Management and Budget Circular A–119 (or any successor thereto);</text></clause>
<clause id="H6FC0B653564749C182E1DE17D05FDDF7" commented="no"><enum>(iii)</enum><text> Office of Management and Budget standards for race and ethnicity and other relevant measures; and</text></clause> <clause id="HC9297FB8704842738FEB2ACE8E38ACBD"><enum>(iv)</enum><text display-inline="yes-display-inline">the data and technology standards designated under section 2823(a)(2); and</text></clause></subparagraph>
<subparagraph id="HC4D3F753CC5748919CBDD92348766B5D" commented="no"><enum>(B)</enum><text>provide for the use of interoperable systems, consistent with the application programming interface standards and associated implementation specifications under section 170.215 of title 45 (or any successor regulations).</text></subparagraph></paragraph> <paragraph id="HC749DF5597734F09AA07D600947C3A1A" commented="no"><enum>(3)</enum><header>Working group</header> <subparagraph id="H4059ECDB5E0C4D2F9F283841D6870CC7" commented="no"><enum>(A)</enum><header>Establishment</header><text>The Secretary shall establish a technical working group (in this paragraph referred to as the <quote>working group</quote>) to make recommendations on an ongoing basis and as needed to establish more comprehensive common standards across appropriate health care, public health, environmental, and public assistance data systems.</text></subparagraph>
<subparagraph id="HDCA83A1AA80A442FA3121DA9066769C7" commented="no"><enum>(B)</enum><header>Duties</header><text>In making the recommendations required by subparagraph (A), the working group shall—</text> <clause id="HFFB4EB2BD37F4CCE8D403BF7F28179FF" commented="no"><enum>(i)</enum><text>coordinate, and consult with the Interagency Council on Statistical Policy established under section 3504 of title 44, United States Code, and any other relevant interagency or intra-agency committee;</text></clause>
<clause id="H29F4F56BC9034C1F81D2DBCA93B5CED0" commented="no"><enum>(ii)</enum><text>include recommendations for—</text> <subclause id="H00C4033829CC4561A8DB9A2B39318C36" commented="no"><enum>(I)</enum><text>efficiencies to reduce redundancy and the public reporting burden in Federal health data reporting requirements and data collections; and</text></subclause>
<subclause id="HFAFA81DD52DE43B6BB7FE0F9F7DDCC1D" commented="no"><enum>(II)</enum><text>methods to facilitate evidence-building through standardized local and State reporting and cross-agency, linkable data sharing between and among local, State, and Federal agencies to collect, acquire, and compile complete statistics; and</text></subclause></clause> <clause id="H4B76B047B3A54D92A233AC184ECE3DAE" commented="no"><enum>(iii)</enum><text>build on existing efforts of public multistakeholder initiatives seeking to standardize key data elements necessary for documenting clinical and other activities related to the social determinants of health in order to improve interoperability, exchange, and use of social determinants of health data across the health and human services sectors.</text></clause></subparagraph>
<subparagraph id="HA8756BD9A0E6431584C8B3F7A47D8A4B" commented="no"><enum>(C)</enum><header>Additional consultation</header><text>The working group may consult with outside experts, including State, local, Tribal, and territorial public health officials, public health researchers, and health care providers representing communities most affected by health disparities.</text></subparagraph> <subparagraph id="H1F741794E525419C805F59B6144CFDD7" commented="no"><enum>(D)</enum><header>Timing</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this subtitle, the working group shall provide initial recommendations under subsection (a) to the Secretary and the Director of the Centers for Disease Control and Prevention.</text></subparagraph>
<subparagraph id="HBFB6AE641D534156A748C74A033A8A83" commented="no"><enum>(E)</enum><header>Composition</header>
<clause id="HEBCDCADE647B4D1BB0E1F18404DBF101" commented="no"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The working group shall, at a minimum, include representation from—</text> <subclause id="H9EA1A35120D146A0A573A57518F13C83" commented="no"><enum>(I)</enum><text>all relevant Department of Health and Human Services units, including—</text>
<item id="HF89E1AFAFF8443A3839F186829437A01"><enum>(aa)</enum><text display-inline="yes-display-inline">the National Center for Health Statistics;</text></item> <item id="HC724BB234B59488097AB3439768C7A79"><enum>(bb)</enum><text>the Centers for Disease Control and Prevention;</text></item>
<item id="H615B977DE6D1458D88CD843D560ABE60"><enum>(cc)</enum><text>the Office of the Chief Technology Officer in the Office of the Secretary;</text></item> <item id="H9C8BE8E207C8464D80C0EDBD71768352"><enum>(dd)</enum><text>the Office of the National Coordinator for Health Information Technology; and</text></item>
<item id="H4D10872241F94DFE874794B36A0062AC"><enum>(ee)</enum><text>the Health and Human Services Data Council;</text></item></subclause> <subclause id="HA117D989F5A842A88D352909875AA25A"><enum>(II)</enum><text>the Office of Information and Regulatory Affairs of the Office of Management and Budget;</text></subclause>
<subclause id="HE8CF17A3434F4289BA4D888B1A44F1FD" commented="no"><enum>(III)</enum><text>the National Institute of Standards and Technology;</text></subclause> <subclause id="H7D877364BD3E437084EC4E4D809A48A4" commented="no"><enum>(IV)</enum><text>the Veterans Health Administration;</text></subclause>
<subclause id="H255952435B794617B4FCD6A37BD362BF" commented="no"><enum>(V)</enum><text>the Military Health System; and</text></subclause> <subclause id="H133F9EBB94BF4641947B767F27FD57E1"><enum>(VI)</enum><text display-inline="yes-display-inline">the Indian Health Service.</text></subclause></clause>
<clause id="HABAA7A4445B24076A2E118E0BA02245F" commented="no"><enum>(ii)</enum><header>Chair</header><text>The chair of the working group shall be the Director of the National Center for Health Statistics (or the Director’s designee).</text></clause></subparagraph></paragraph></subsection> <subsection id="HF856FF5E13154003866125A08D0839DA" commented="no"><enum>(b)</enum><header>Increasing efficiency and advancing evidence building</header><text>Consistent with the standards in effect under subsection (a), the Chief Statistician of the United States in the Office of Management and Budget, in accordance with section 3504(e) of title 44, United States Code, shall issue and update on an ongoing basis as needed, directives guiding Federal health data information collection to reduce public reporting burden, ensure information quality, improve use of determinants of health data, and enhance access to health data for evidence-building activities.</text></subsection>
<subsection id="HD74FB812C70345DA9EB243D9E0F8869E" commented="no"><enum>(c)</enum><header>COVID–19 high-Priority standards</header><text>Not later than 30 days after the date of enactment of this subtitle, the Secretary, acting through the Director of the Centers for Disease Control and Prevention, and in consultation with the Director of the National Institutes of Health, shall—</text> <paragraph id="H3C84EBE2A0CC4DFD920C45F8BFD5DCE2" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">establish standards under subsection (a) with respect to COVID–19, including for genomic epidemiology, modeling outbreak preparedness and response, therapeutic interventions, treatment settings, and associated outcomes; and</text></paragraph>
<paragraph id="H1AFE249857B744B5826371FC8376025B" commented="no"><enum>(2)</enum><text>in carrying out paragraph (1), adopt or build upon existing standards.</text></paragraph></subsection> <subsection id="H31C56CD3A4E34BE99EB5C63570A43652" commented="no"><enum>(d)</enum><header>Sharing data related to COVID–19</header><text>Subject to applicable law on the privacy and confidentiality of individually identifiable information, the Secretary shall—</text>
<paragraph id="H5FBBEA9EE1B1422A88411A4763E02A30" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">share real-time data related to COVID–19 data collected by the Department of Health and Human Services with—</text> <subparagraph id="H0AEAA180F5C0492588213232B12ADECC" commented="no"><enum>(A)</enum><text>the Centers for Disease Control and Prevention; and</text></subparagraph>
<subparagraph id="H8C05045CCD3949498D123B26C9971F75" commented="no"><enum>(B)</enum><text>Federal, State, and local public health agencies outside of the Department of Health and Human Services; and</text></subparagraph></paragraph> <paragraph id="H55EE9FB4419345F3955195F6CC9FBDE2"><enum>(2)</enum><text display-inline="yes-display-inline">make such data (including metadata as defined in section 3502 of title 44, United States Code) publicly available using standardized, machine-readable formats—</text>
<subparagraph id="H77A4ADC90F854FA0B86BB841052A4581"><enum>(A)</enum><text display-inline="yes-display-inline">on the website of the Department of Health and Human Services; and</text></subparagraph> <subparagraph id="H907922890571400EB54F9C253EDEA407"><enum>(B)</enum><text>in the Federal data catalogue maintained under section 3511(c) of title 44, United States Code.</text></subparagraph></paragraph></subsection></section>
<section id="H856404B992DC4C838AC0E2ACAB155533" commented="no"><enum>3112.</enum><header>Epidemiological surveillance grants</header>
<subsection id="HC1244DFD4A5E431585240F37BC20D8F6" commented="no"><enum>(a)</enum><header>Grant authority</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Director of the National Center for Health Statistics, may award grants or cooperative agreements to public health reporting entities—</text> <paragraph id="HAB214448167B400FBFDB0AA5978CC7E8"><enum>(1)</enum><text>to establish protocols and acquire technologies to implement the standards under section 3111 for reporting, directly or indirectly, to the Federal Government, including by—</text>
<subparagraph id="HDACD7A1D976E4093A207CF2D5C3E2E7B" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">supporting expansion and modernization of electronic case reporting, laboratory reporting, and mortality reporting with an emphasis on modernizing and linking, where appropriate, modularized medical examiner and coroner case management systems, electronic death registration systems, electronic health records, and supporting laboratory systems to improve data timeliness and quality;</text></subparagraph> <subparagraph id="HF1E96CC2D52D4C5FBAF8DC6898C4D5F6"><enum>(B)</enum><text display-inline="yes-display-inline">making data sharing with the National Center for Health Statistics bidirectional, such that the data received by the National Center for Health Statistics is provided quickly back to State and local offices and to Federal partners and in a form that is quickly understandable and actionable;</text></subparagraph>
<subparagraph id="H0AD52D29092745B085E4B4FB45DDD0B3"><enum>(C)</enum><text display-inline="yes-display-inline">supporting survey activities to more broadly measure health disparities at the national, State, and local levels;</text></subparagraph> <subparagraph id="H010F85FAF9234192A1AB0F0AA18A0A44"><enum>(D)</enum><text>improving interoperability standards and implementation specifications for industry use to fulfill specific clinical health information technology interoperability needs;</text></subparagraph>
<subparagraph id="HC9195C089B9949119167C047D2F8E474" commented="no"><enum>(E)</enum><text>developing and implementing protections required by subsection (b); and</text></subparagraph> <subparagraph id="H80BFB3768C964F85B5E74EC500790170" commented="no"><enum>(F)</enum><text>conducting real-world testing of data important for forecasting to ensure viability, scalability, and adaptability of data collection and reporting activities; and</text></subparagraph></paragraph>
<paragraph id="HC921CA37921C46B8B950D979C844CA5C"><enum>(2)</enum><text>to carry out such reporting using such protocols and technologies.</text></paragraph></subsection> <subsection id="HF846A2B328E74D5086FC7400DD8E8991"><enum>(b)</enum><header>Adoption of standards and data protections</header><text>The Secretary may not award a grant or cooperative agreement under subsection (a) unless the applicant develops an implementation plan to develop and implement policies, practices, procedures, and controls related to—</text>
<paragraph id="H0210EEF654F74757AB3A93B01F065319" commented="no"><enum>(1)</enum><text>improving data quality and reporting timeliness;</text></paragraph> <paragraph id="H895B788F876C4E588662D5DAA651DD14" commented="no"><enum>(2)</enum><text>data security, in accordance with the most recent versions of the Cybersecurity Framework and Privacy Framework (or successor frameworks) of the National Institute of Standards and Technology; and</text></paragraph>
<paragraph id="HAFF4C27FADD945489B026902DA5EE218" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">confidentiality and privacy of any information that pertains to an individual and from which, either alone or in combination with other reasonably available information, the individual's identity can be determined, including policies, practices, procedures, and controls for—</text> <subparagraph id="H2271ABF1F5A649A798AB1A6C7C60097B" commented="no"><enum>(A)</enum><text>minimizing collection, processing, maintenance, retention, and disclosure of such information to what is necessary, proportionate, and limited for a good faith public health purpose that is clearly described and limited in an agreement between the Federal Government and the recipient; </text></subparagraph>
<subparagraph id="HEDC8E076CE2F4F188FC54D680EEAD432" commented="no"><enum>(B)</enum><text>prohibiting disclosure of such information to persons, including government entities, absent legal safeguards included in Federal or State laws or regulations, for protecting the security and privacy of such information; and</text></subparagraph> <subparagraph id="H22961D41A987406FBC1D70EC9B9BCDF1" commented="no"><enum>(C)</enum><text>making the data available to the National Center for Health Statistics for statistical purposes under subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code.</text></subparagraph></paragraph></subsection>
<subsection id="HD9A2CFEDF02D4587AFC07B35481D7EE4"><enum>(c)</enum><header>COVID–19 reporting</header><text>The Secretary may not award a grant or cooperative agreement under subsection (a) unless the applicant agrees—</text> <paragraph id="HC47234AA56264CAA860897445D89AF2E"><enum>(1)</enum><text>to use the grant for activities under subsection (a) with respect to COVID–19, including with respect to—</text>
<subparagraph id="H5F2611D0094349AFB234456613148416"><enum>(A)</enum><text display-inline="yes-display-inline">testing results data;</text></subparagraph> <subparagraph id="H39510766706B44CBBFEAF000D11C722B"><enum>(B)</enum><text display-inline="yes-display-inline">testing results turnaround time;</text></subparagraph>
<subparagraph id="HAB9E7C64358144528AE4B3D4AA55396F"><enum>(C)</enum><text>hospitalization and intensive care unit data;</text></subparagraph> <subparagraph id="HA300D22943714B7698C9C8944D1F3B32"><enum>(D)</enum><text display-inline="yes-display-inline">new infections among health care workers;</text></subparagraph>
<subparagraph id="H686DED70D6C04DBE95285D8199C4B001"><enum>(E)</enum><text display-inline="yes-display-inline">new cases among quarantined contacts; and</text></subparagraph> <subparagraph id="HE3FAE0709CF14F25AA107542679DD5E4"><enum>(F)</enum><text display-inline="yes-display-inline">long-term care facilities, prisons, and other congregate settings; and</text></subparagraph></paragraph>
<paragraph id="H208FD13863624C36BE1DF501AF20A81B"><enum>(2)</enum><text display-inline="yes-display-inline">in carrying out such activities, to disaggregate data by age, sex, race, ethnicity, sexual orientation, gender identity, and Zip Code, as appropriate and to the extent possible.</text></paragraph></subsection> <subsection id="HA1D35622B8E34B308E459F6D562B99A4" commented="no"><enum>(d)</enum><header>Application</header><text>A public health reporting entity applying for a grant or cooperative agreement under this section shall submit an application to the Secretary at such time and in such manner as the Secretary may require.</text></subsection>
<subsection id="H8098297A5A08483FAD787B75B2EA914D"><enum>(e)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>public health reporting entity</term> means any entity that reports data to the Centers for Disease Control and Prevention or another public health authority, including a State or local public health department, a public health laboratory, and a health care provider.</text></subsection></section> <section id="H2F43E433F4DA40E3AF7D0DE7D0D3A9D0" commented="no"><enum>3113.</enum><header>Evidence-building demonstration program</header> <subsection id="H95E13B5EC6404A1B97B5F0C1D3B696CE" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary acting through the Director of the National Center for Health Statistics (in this section referred to as the <quote>Secretary</quote>) shall expand the data linkage program of the Department of Health and Human Services consisting of Federal statistical and programmatic datasets from specified Federal entities, as authorized by subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, for the purpose of facilitating statistical public health research on trends and patterns across specifically defined, statistically relevant populations, with a particular focus on linking social determinants of health data, including with respect to—</text>
<paragraph id="H8E114D0BAD634FA9979D71E06A9E71B4"><enum>(1)</enum><text>food insecurity;</text></paragraph> <paragraph id="H6E5682A042994B3E85B09F655256DC2F"><enum>(2)</enum><text>housing instability;</text></paragraph>
<paragraph id="HEB2A55401C714A7DAAFED54AE4B2947B"><enum>(3)</enum><text>transportation access;</text></paragraph> <paragraph id="H5312B7454BEC4F268492D3547C94C138"><enum>(4)</enum><text>safety;</text></paragraph>
<paragraph id="H15AEC9A555284E4885A8508A04CFB76E"><enum>(5)</enum><text>social connection and isolation;</text></paragraph> <paragraph id="H358F36E1FBEA40DB83CA6D4CCEE42F48"><enum>(6)</enum><text>financial resource strain;</text></paragraph>
<paragraph id="HDAC29F2429AD448D9697FD16DC1F7673"><enum>(7)</enum><text>stress;</text></paragraph> <paragraph id="H96BA0E88ED6F4043AB4B8889749D79BA"><enum>(8)</enum><text display-inline="yes-display-inline">race and ethnicity; and</text></paragraph>
<paragraph id="HD5A58A17C85F4E4BBF8EC1104C7AB2A8"><enum>(9)</enum><text>sexual orientation and gender identity.</text></paragraph></subsection> <subsection id="H2C0DC2F96DE74750A602A9C52A434379"><enum>(b)</enum><header>Activities</header><text display-inline="yes-display-inline">The activities of the demonstration program under this section shall include:</text>
<paragraph id="HEAAB2AA6935F46EC8646B0D37539E1F5"><enum>(1)</enum><text>Assessing the availability of identified and deidentified data sets held by Federal, State, local, and non-Federal entities that may be useful for research described in subsection (a).</text></paragraph> <paragraph id="H12EA00806C7B4A5A8BA564114833936E"><enum>(2)</enum><text>Using existing authorities and linkages of data in accordance with subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, when relevant to request the submission of datasets to the National Center for Health Statistics for linking.</text></paragraph></subsection>
<subsection id="H0F69D5087FD6404E881CDD0FF0D56080" commented="no"><enum>(c)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary shall limit access to data under the demonstration program under this section—</text> <paragraph id="H597C7A850869478D8F589BA0AEB3DE1D" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">to Federal statistical agencies and qualified public and private researchers, as determined by the Director of the National Center for Health Statistics;</text></paragraph>
<paragraph id="H0D2C8719DA97428C8F3CB7B23531ACD4" commented="no"><enum>(2)</enum><text>for a period to be specified by the Secretary; and</text></paragraph> <paragraph id="H1A30EA2F87D4402ABAD1D9B19862F73A" commented="no"><enum>(3)</enum><text>exclusively for the purpose described in subsection (a).</text></paragraph></subsection>
<subsection id="H5AC343613B184C4B85039BD5AF8BED7D" commented="no"><enum>(d)</enum><header>Process for making data available</header>
<paragraph id="HD4E5895C54A149238B3669CA092B13C2" commented="no"><enum>(1)</enum><header>In general</header><text>Consistent with paragraph (2), the Secretary shall establish a rigorous process for making data available and usable pursuant to the demonstration program under this section.</text></paragraph> <paragraph id="H8CCA8BE772AD43F1A3591B46B320006C" commented="no"><enum>(2)</enum><header>Requirements</header><text>Before any data is made available pursuant to the demonstration program under this section by an entity described in subsection (b)(1) to another entity described in subsection (b)(1)—</text>
<subparagraph id="HD3426B396B9C4E2A8E0E1FA4D55C6ACC" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline"> the receiving entity shall submit to the Director of the National Center for Health Statistics an application for data for the purpose described in subsection (a); and</text></subparagraph> <subparagraph id="H85D74AC49D4A4CA48A646922E9B52420" commented="no"><enum>(B)</enum><text>the Director shall approve or deny such request in writing, including in the case of a denial an explanation of the reasons for the denial.</text></subparagraph></paragraph></subsection>
<subsection id="H539DD2C540554C3AA88EFEF972023904"><enum>(e)</enum><header>Rulemaking</header>
<paragraph id="HFC9714717ACE45B6BF556281D9953CB9"><enum>(1)</enum><header>No delay on implementation</header><text>The Secretary—</text> <subparagraph id="HB111BEA0EC804D8C8EC70C2FAAEF1347"><enum>(A)</enum><text>shall begin implementation of the demonstration program under this section upon the date of enactment of this subtitle; and</text></subparagraph>
<subparagraph id="H3A3DC0BBB9B244BB82204678D8A02CD3"><enum>(B)</enum><text>shall not delay such implementation for purposes of promulgating the regulations required by paragraph (2).</text></subparagraph></paragraph> <paragraph id="H7CBD53C9EA8F4CFDAFAE91857CAC3FD0"><enum>(2)</enum><header>Promulgation</header><text>The Secretary shall—</text>
<subparagraph id="H72906BB1A70141F1B1DD65026FAA8D6A"><enum>(A)</enum><text>issue regulations for carrying out this section; and</text></subparagraph> <subparagraph id="H1BD188F95AB64B92A1EF9E3ED02FF9B5"><enum>(B)</enum><text>specify in such regulations the allowed and disallowed purposes for sharing and linking data through the program, including areas of potential research.</text></subparagraph></paragraph></subsection>
<subsection id="H7F87CD5ECF784EE9A4AF1580CF6104D1" commented="no"><enum>(f)</enum><header>Website</header><text display-inline="yes-display-inline">The Secretary shall maintain a publicly accessible website—</text> <paragraph id="HD3CA68F06AD347D7B0172AA6E128E0B9" commented="no"><enum>(1)</enum><text>providing information about a demonstration program under this section;</text></paragraph>
<paragraph id="H0DBD38AC4DDC4F90ACF0FF769F613183" commented="no"><enum>(2)</enum><text>facilitating stakeholder participation in such demonstration program;</text></paragraph> <paragraph id="H205DF948F6BF49DAACBFCD121E501FF7" commented="no"><enum>(3)</enum><text>facilitating oversight of such demonstration program;</text></paragraph>
<paragraph id="H684AD5CAF1494F89A01EAFF11D605833"><enum>(4)</enum><text display-inline="yes-display-inline">providing lists of datasets from Federal and non-Federal entities;</text></paragraph> <paragraph id="H35F589E37EC24EBB96F8989DD78494D1"><enum>(5)</enum><text>providing lists of identified and deidentified datasets;</text></paragraph>
<paragraph id="H182EEC51ABA54C62826F3601AED18265"><enum>(6)</enum><text>identifying linked datasets;</text></paragraph> <paragraph id="H3F791DA5994E471895DE1977949424E9"><enum>(7)</enum><text>delineating a process to protect privacy and confidentiality;</text></paragraph>
<paragraph id="H37110BA7554E4945AE4DC9CDEA3DDD53"><enum>(8)</enum><text>identifying sources of the datasets; and</text></paragraph> <paragraph id="H6AC25AE787BF4CE5B8C53751EE987014"><enum>(9)</enum><text>delineating categories of personal data.</text></paragraph></subsection>
<subsection id="H7E82F167CB90491A998B37163DA64942" commented="no"><enum>(g)</enum><header>Program requirements</header><text>The demonstration program under this section shall be designed to—</text> <paragraph id="HD0D72774CF7A4D4FB8D569014D456841" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">support data matching services for agencies and researchers using the National Death Index; and</text></paragraph>
<paragraph id="HC6AB6F5147044CBA998FB10507D9F7B5" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">facilitate collaboration with States and private entities to examine, update, and modernize the fee structure of the National Death Index to support a broad range of data queries while assuring the continued support of the State systems collecting and providing this information to the National Death Index.</text></paragraph></subsection> <subsection id="HC3FD6C99FF9440F084557539BAB68F75" commented="no"><enum>(h)</enum><header>Contracted entities</header> <paragraph id="HCB1F2FF4EB614A9CB79FBF08F38E7BEC" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, the Secretary may enter into contracts with eligible entities, as appropriate, for infrastructure and support services in carrying out the demonstration program under this section.</text></paragraph>
<paragraph id="HE546586867DD41B1B26C66C00FC35CE0" commented="no"><enum>(2)</enum><header>Eligibility</header><text>To be eligible for a contract under paragraph (1), an entity shall—</text> <subparagraph id="HACD2E0D305454167A6F7EE5583282D77" commented="no"><enum>(A)</enum><text>demonstrate core capabilities for data sharing, data linkage, and compliance with subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code; and</text></subparagraph>
<subparagraph id="HA2378E285C294E938A4E643CEAD58912" commented="no"><enum>(B)</enum><text>adhere to security standards in accordance with the Federal Risk and Authorization Management Program (or any successor program).</text></subparagraph></paragraph></subsection> <subsection id="H0FD8B031B3DA48CC9E8ED0745625F151" commented="no"><enum>(i)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to authorize the availability or use of data for—</text>
<paragraph id="H0B945F5C696B443C98410F7863BF2D9C" commented="no"><enum>(1)</enum><text>law enforcement; or</text></paragraph> <paragraph id="H6B08A436E2CC42169FC00DC7F5D94951" commented="no"><enum>(2)</enum><text>any determination of the eligibility of an individual for any direct or indirect payment, benefit, or service.</text></paragraph></subsection>
<subsection id="H53F3CB4C60FC401A8CCC7A6AF3A3AD0D" commented="no"><enum>(j)</enum><header>Report to Congress</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary shall submit a report to the Congress on the implementation of this section, including—</text> <paragraph id="H7C423BA06D7E40F7A38A2E4C5738B7EC"><enum>(1)</enum><text display-inline="yes-display-inline"> identification of best States practices for—</text>
<subparagraph id="HE41CBF4B25C4481185BC237E0F7E4F2C"><enum>(A)</enum><text>sharing data with, and reporting data to, the National Death Index; and</text></subparagraph> <subparagraph id="H5ADB8D574ECD47E4BB324EA317AA606F"><enum>(B)</enum><text>ensuring the quality of such data; and</text></subparagraph></paragraph>
<paragraph id="H43E09560DFB042A2A6E877D6131D4F11"><enum>(2)</enum><text>recommendations to improve—</text> <subparagraph id="H34CBD19750AC478EB628CCFAD79149A7"><enum>(A)</enum><text>such sharing and reporting; and</text></subparagraph>
<subparagraph id="H75E9F9679B8E421F8E5ECAF602739F03"><enum>(B)</enum><text>access to the National Death Index by researchers.</text></subparagraph></paragraph></subsection></section> <section id="H98B897A4CDD142198AE8A9E0FDEDC68B" commented="no"><enum>3114.</enum><header>Building statistical public health research capacity</header> <subsection id="H6485019FDB964B73BA17FB72072AC372" commented="no"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall provide financial assistance to research entities and public health departments to establish, expand, or enhance capacity for conducting statistical public health research—</text>
<paragraph id="H3341D7D7C1F64426A3CF708C5752CC36" commented="no"><enum>(1)</enum><text>in connection with the programs and activities under this subtitle; and</text></paragraph> <paragraph id="H8B2CF7C0630A47BA9A311AB1376165C0" commented="no"><enum>(2)</enum><text>in accordance with subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code.</text></paragraph></subsection>
<subsection id="H5B935F316E0B4736ABC2C21BFC4D8C76" commented="no"><enum>(b)</enum><header>Capacity for sharing and linking</header><text display-inline="yes-display-inline">The capacity referred to in subsection (a) may include sharing and linking information and accessing and utilizing linked health data files in accordance with established data use agreements with data holders (including electronic case reporting, electronic health records, and electronic test orders and results) with public health agencies and related systems, including the National Death Index, immunization information systems, syndromic surveillance systems, laboratory information management systems, electronic case reporting systems, medical examiner case management systems, and Patient Unified Look-up Systems for Emergencies.</text></subsection></section> <section id="H203B3411D4764508939F173CAB8DFA61" commented="no"><enum>3115.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this subtitle shall be construed to supersede the authority of the Director of the Office of Management and Budget under title 44, United States Code, to determine and issue relevant standards for information management.</text></section>
<section id="H9D7E94FA07E44B2C85E35D4114823242" commented="no"><enum>3116.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated—</text> <paragraph id="H475E46FA4CA446B7A366709639EE2230" commented="no"><enum>(1)</enum><text>to carry out this subtitle (other than section 3113), $450,000,000, to remain available until expended; and</text></paragraph>
<paragraph id="HC0565C97E31B4A9F8B1D4E2A9CBBEE0D" commented="no"><enum>(2)</enum><text>to carry out section 3113, $100,000,000 for the period of fiscal years 2020 through 2025.</text></paragraph></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body> </bill>
