R. 830</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210204">February 4, 2021</action-date><action-desc><sponsor name-id="P000608">Mr. Peters</sponsor> (for himself and <cosponsor name-id="D000619">Mr. Rodney Davis of Illinois</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Labor Standards Act of 1938 to prohibit States and municipalities from adopting certain laws and ordinances, and for other purposes.</official-title></form><legis-body id="H0370DADDEB7D4B38B38C99CB4A423760" style="OLC"><section id="HA78246530C8B4EADB261A00C09A8BB5B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wage Increase Fairness Act</short-title></quote>.</text></section><section id="H18A497D89B40425DBA44A9CD080CFBD6"><enum>2.</enum><header>Amendment to the Fair Labor Standards Act 1938</header><text display-inline="no-display-inline">Section 6 of the Fair Labor Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HF208A641999740939259B20B4EF6F050" style="OLC"><subsection id="H8CFA6C90662B434DA234C5595B16E9B0"><enum>(h)</enum><text display-inline="yes-display-inline">Nothing in this subsection shall limit the amount of a minimum wage set pursuant to this section, or of a minimum wage set by a State or municipality pursuant to section 18 of this Act, provided that: notwithstanding section 18 or any other provision of law, no State or municipality shall adopt any law or ordinance which has the purpose or effect of establishing a minimum wage which distinguishes, classifies, or establishes any requirement on an employer based on its status as excluded from the definition of “enterprise” pursuant to the second sentence of section 3(r)(1).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
