R. 8305</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220707">July 7, 2022</action-date><action-desc><sponsor name-id="F000450">Ms. Foxx</sponsor> (for herself and <cosponsor name-id="S001175">Ms. Speier</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 10, United States Code, to require the Secretary of Defense to develop guidelines and resources on the acquisition or licensing of intellectual property, and for other purposes.</official-title></form><legis-body id="H4A2E93B1FAB341239FC52D0474B315D1" style="OLC"><section id="H571DF039A16447469F71AC0021B3E811" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defense Maintenance Data Transparency Act</short-title></quote>.</text></section><section id="HEF8AAB71E5CA443099EAD1EC663C5572" section-type="subsequent-section"><enum>2.</enum><header>Guidelines and resources on the acquisition or licensing of intellectual property</header><text display-inline="no-display-inline">Section 3791 of title 10, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block style="USC" id="H27A6F288C4A24C689B27D0B972E02A3A" display-inline="no-display-inline"><subsection id="H7EADCE5DCDC64DEABB518CA3D571CBE2"><enum>(c)</enum><header>Guidelines and resources</header><paragraph id="HF1542216A4AD42D5A4997C23F81F8FC2"><enum>(1)</enum><header>In general</header><text>The Secretary of Defense, acting through the Under Secretary of Defense for Acquisition and Sustainment, shall develop guidelines and resources on the acquisition or licensing of intellectual property, including—</text><subparagraph id="H99AB4934721541B1A6DC31851E146EE4"><enum>(A)</enum><text>model forms for specially negotiated licenses described under section 3774(c) of this title (as appropriate); and</text></subparagraph><subparagraph id="H1B7583E9E4B24C17B9DDC5276AAEF819"><enum>(B)</enum><text> an identification of definitions, key terms, examples, and case studies that resolve ambiguities in the differences between—</text><clause id="H0359865442B842A7B59210560B4F61D9"><enum>(i)</enum><text display-inline="yes-display-inline">detailed manufacturing and process data;</text></clause><clause id="HAA3081B9EACB4BDEAF6266A7977EC87F"><enum>(ii)</enum><text display-inline="yes-display-inline">form, fit, and function data; and</text></clause><clause id="HB817AF3D0C7E4966B3CDA8D0F706C4E3"><enum>(iii)</enum><text display-inline="yes-display-inline">data required for operations, maintenance, installation, and training.</text></clause></subparagraph></paragraph><paragraph id="HEC15FFF207E942318D9101607CA470F7"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">In developing the guidelines and resources described in paragraph (1), the Secretary shall regularly consult with appropriate persons.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
