which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII and title XIX of the Social Security Act to codify certain infection control and emergency preparedness regulations, to prohibit a reduction in the frequency of surveys of skilled nursing facilities and nursing facilities, to prohibit the waiver of certain reporting requirements, and for other purposes.</official-title></form><legis-body id="HF897D76516264F39B4CD3DBFAC9A59DF" style="OLC"><section id="HCDE99F24E0424462BAA1E7B7B98C4388" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Restoration of Emergency Preparedness and Advancing Response to Epidemics in Long-Term Care Act</short-title></quote> or the <quote><short-title>PREPARE LTC Act</short-title></quote>.</text></section><section id="HC732A8A9C05B47D7B172DE2372EA6CCC"><enum>2.</enum><header>Codifying infection control and emergency preparedness regulations for skilled nursing facilities and nursing facilities as a requirement for participation under the Medicare and Medicaid programs</header><subsection id="HBC375C4D9F074CC9997F73EA9BE9141E"><enum>(a)</enum><header>Infection control regulations</header><paragraph id="HDCA47E983D204F748AF8ED2CB78CF8F4"><enum>(1)</enum><header>Medicare</header><text display-inline="yes-display-inline">Section 1819(d)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(d)(3)</external-xref>) is amended—</text><subparagraph id="H752461E1479F4A06B4DB02E5E2DA8C81"><enum>(A)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and moving such clauses 2 ems to the right;</text></subparagraph><subparagraph id="H05BC6A0B34D84C659EAA847C3778660D"><enum>(B)</enum><text>by striking <quote><header-in-text level="subparagraph" style="OLC">environment.— </header-in-text>A skilled nursing facility must—</quote> and inserting </text><quoted-block style="OLC" id="HBFB3614FB9EF4905A8FB7DA5D0804C2F" display-inline="yes-display-inline"><text><header-in-text level="paragraph" style="OLC">environment.—</header-in-text></text><subparagraph id="H09ED3662DE0540C8B7D6FE0E99307B25"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A skilled nursing facility must—</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HFB603A749C7E45AB8711425E3F257E77"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="HFABFF04A6B154B40AE1B7DBB07B4283A" display-inline="no-display-inline"><subparagraph id="H7B6B08CB2145477BAFD34D46BC94511B"><enum>(B)</enum><header>Application statement</header><text display-inline="yes-display-inline">For purposes of carrying out this paragraph, the Secretary shall apply by reference the provisions of section 483.80 of title 42, Code of Federal Regulations (as in effect on the date of the enactment of the Promoting Restoration of Emergency Preparedness and Advancing Response to Epidemics in Long-Term Care Act), except in applying subsection (g) of such regulation—</text><clause id="H92DFE9899EB64AAD9D566CAFE9F4C1C1"><enum>(i)</enum><text>any reference to COVID-19 shall be treated as a reference to an infectious disease outbreak, as defined in subparagraph (C); and</text></clause><clause id="H15B2B9CB0DD348DB9BB09DD084EB50B9"><enum>(ii)</enum><text>any reference to ventilator capacity shall be treated as a reference to medical equipment and supplies critical to the infectious disease outbreak, including ventilator capacity.</text></clause></subparagraph><subparagraph id="HC1EE2D14536A41F5B95C7E920B33C7B1"><enum>(C)</enum><header>Infectious disease outbreak defined</header><text display-inline="yes-display-inline">For purposes of subparagraph (B), the term <quote>infectious disease outbreak</quote> means any of the following periods:</text><clause id="HE664898B12DD4FCDACCF8C26C762AA2D"><enum>(i)</enum><header>COVID-<enum-in-header>19</enum-in-header> emergency period</header><text>The emergency period described in section 1135(g)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)(1)(B)</external-xref>).</text></clause><clause id="HD4E28FFCFE2C4483A1E6643D60A25834"><enum>(ii)</enum><header>Other infectious disease outbreak periods</header><subclause id="H2302D6C7E11D41D8A814B17B8644E5D4"><enum>(I)</enum><text display-inline="yes-display-inline">The period beginning on the date a nationwide emergency related to a public health emergency is declared pursuant to the Stafford Act, a Major Disaster Declaration, or the National Emergencies Act and ending on the date that is 6 months after the date on which the declaration pursuant to the Stafford Act, a Major Disaster Declaration, or the National Emergencies Act, as applicable, ends, whichever is the latest. </text></subclause><subclause id="HC094C6DA3D2A496192335641A4CD51EF"><enum>(II)</enum><text>The period during which there exists a public health emergency related to an infectious disease outbreak declared by the Secretary pursuant to section 319 of the Public Health Service Act.</text></subclause><subclause id="HECEE758A88D54384AD4FA7BE211F93E7"><enum>(III)</enum><text>With respect to a skilled nursing facility in a State with respect to which the Governor has declared an emergency or major disaster (as defined by the State) with respect to an infectious disease outbreak, the period for which such declaration is in effect with respect to such State.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HFFF20D625B86471E8D99E42CA59A75AD"><enum>(2)</enum><header>Medicaid</header><text display-inline="yes-display-inline">Section 1919(d)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(d)(3)</external-xref>) is amended—</text><subparagraph id="HAF92B8A5A9B14B2594DDBDA7163C0C0E"><enum>(A)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and moving such clauses 2 ems to the right;</text></subparagraph><subparagraph id="H6A4D71C8E3E243EF91CFA53D1BDEF338"><enum>(B)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC">environment.—</header-in-text> A nursing facility must—</quote> and inserting </text><quoted-block style="OLC" id="H7071FCF84A6340F7B765D74DCF37D11F" display-inline="yes-display-inline"><text><header-in-text level="paragraph" style="OLC">environment.—</header-in-text></text><subparagraph id="HAEF9808D796341E989A44136E7D79C1B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A nursing facility must—</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H7C5C7D87F6C944E8A70DA65715CA6B18"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBEAB4383059049F7889919CF6316AF63"><subparagraph id="HA9732B25793E458AB853F65734EB4F63"><enum>(B)</enum><header>Application statement</header><text display-inline="yes-display-inline">For purposes of carrying out this paragraph, the Secretary shall apply by reference the provisions of section 483.80 of title 42, Code of Federal Regulations (as in effect on the date of the enactment of the Promoting Restoration of Emergency Preparedness and Advancing Response to Epidemics in Long-Term Care Act), except in applying subsection (g) of such regulation—</text><clause id="H265AB03CD8D14ADF97005B022EC71B7E"><enum>(i)</enum><text>any reference to COVID-19 shall be treated as a reference to an infectious disease outbreak, as defined in subparagraph (C); and</text></clause><clause id="HDC4B3F6AD2C74872BC307414CF41FC37"><enum>(ii)</enum><text>any reference to ventilator capacity shall be treated as a reference to medical equipment and supplies critical to the infectious disease outbreak, including ventilator capacity.</text></clause></subparagraph><subparagraph id="H8E8A3FC679424B3C9CADDFEC907DB7EB"><enum>(C)</enum><header>Infectious disease outbreak defined</header><text>The term <quote>infectious disease outbreak</quote> has the meaning given such term in section 1819(d)(3)(C).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H596AB299E12B43CBB86BE544E2D4010D"><enum>(b)</enum><header>Emergency preparedness regulations</header><paragraph id="HE3C430FE5B0F48CAAE1D37AD986162B6"><enum>(1)</enum><header>Medicare</header><text>Section 1819(d) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H9606C3BBDF95481983C144FE56C052EB" display-inline="no-display-inline"><paragraph id="H86C3B00CB771453E9AEB9CC5372287FE"><enum>(5)</enum><header>Emergency preparedness</header><text display-inline="yes-display-inline">A skilled nursing facility shall meet the requirements applicable to skilled nursing facilities under the provisions of section 483.73 of title 42, Code of Federal Regulations (as in effect on the date of the enactment of the Restoring Safety and Transparency for Long-Term Care Residents Act).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HDDC8DB53C629402F8552E50A5F8584E7"><enum>(2)</enum><header>Medicaid</header><text>Section 1919(d) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H89A53E880637490799EBF399AE96B710" display-inline="no-display-inline"><paragraph id="H35E2C5AC5C984BBD93FDDC7FF9D5D32D"><enum>(5)</enum><header>Emergency preparedness</header><text display-inline="yes-display-inline">A nursing facility shall meet the requirements applicable to nursing facilities under the provisions of section 483.73 of title 42, Code of Federal Regulations (as in effect on the date of the enactment of the Promoting Restoration of Emergency Preparedness and Advancing Response to Epidemics in Long-Term Care Act).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HCE78A4B9D94D41E3A42C0D3273B00D1F"><enum>(c)</enum><header>Requirement To issue guidance</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Health and Human Services shall issue guidance to carry out the amendments made by this section.</text></subsection><subsection id="HFCA5B8AA7DD54207A9EB8086B559A1C7" commented="no"><enum>(d)</enum><header>Public availability of data on deficiencies in infection control and direct care staffing in skilled nursing facilities</header><text display-inline="yes-display-inline">Not later than 2 weeks after the beginning of a period of an infectious disease outbreak (as defined in subparagraph (C) of subsection (d)(3) of section 1819 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3</external-xref>), as added by subsection (a)(1)), (or, in the case of the COVID-19 emergency period described in section 1135(g)(1)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)(1)(B)</external-xref>), not later than 60 days after the date of the enactment of this Act), the Administrator of the Centers for Medicare &amp; Medicaid Services shall make publicly available on the internet website of the Centers for Medicare &amp; Medicaid Services data on deficiencies identified during the survey process described under subsection (g) of such section, with respect to infection control and direct care staffing in a skilled nursing facility (as defined in subsection (a) of such section). Such data so posted, with respect to an infectious disease outbreak (as defined in subparagraph (C) of such subsection (d)(3)), shall be updated every two weeks until the end of the period of such outbreak.</text></subsection></section><section id="HED5AA8C961754D6CA33022EEDA00349A"><enum>3.</enum><header>Prohibition on reducing frequency of standard surveys</header><subsection id="H641C8FCA814342F2A0BAF8E793CDCFA9"><enum>(a)</enum><header>Medicare</header><text display-inline="yes-display-inline">Section 1819(g)(2)(A)(iii) is amended by adding at the end the following new subclause:</text><quoted-block style="OLC" id="H45EF388EC5FA4497B8069C1D26A43D1C" display-inline="no-display-inline"><subclause id="H9ECE50AEEB664AFC9CC303818536395F"><enum>(III)</enum><header>Prohibition on reducing frequency of surveys conducted during an infectious disease outbreak</header><text display-inline="yes-display-inline">The Secretary shall not reduce the frequency of surveys conducted under this section during an infectious disease outbreak (as defined in subsection (d)(3)(C)).</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H559846A2DADB4A26A42EC5DDBD8EAC1C"><enum>(b)</enum><header>Medicaid</header><text>Section 1919(g)(2)(A)(iii) is amended by adding at the end the following new subclause:</text><quoted-block style="OLC" id="H4C6C45ECA5FB4D8F9CC8E11F6C4A01B2" display-inline="no-display-inline"><subclause id="H7021000D337C4457BDF9CA4B3BF5A14F"><enum>(I)</enum><header>Prohibition on reducing frequency of surveys conducted during an infectious disease outbreak</header><text display-inline="yes-display-inline">The Secretary shall not reduce the frequency of surveys conducted under this section during an infectious disease outbreak (as defined in section 1819(d)(3)(C)).</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HEFF2A7FC0FC642488F3763A549B3BDD6"><enum>4.</enum><header>Prohibition on waiving submissions of direct care staffing information</header><text display-inline="no-display-inline">Section 1128I(g) of the Social Security Act (42 U.S.C. 1320a–7j(g)) is amended—</text><paragraph id="HB9F6B53600CD46BCAFDE4551A5473B8E"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H13B4AF7D9D6E4E2E9DC39D9C8EE4B218"><enum>(2)</enum><text>in paragraph (4), by striking the period and inserting <quote>; and</quote>;</text></paragraph><paragraph id="H70B8F4F6582D4413B5C09C29AD1298DA"><enum>(3)</enum><text>by inserting after paragraph (4) the following new paragraph:</text><quoted-block style="OLC" id="H637D843A1EB64AF992A0DB2B73C31F66" display-inline="no-display-inline"><paragraph id="H53B2E123FCB741D7A92820C3811F408C"><enum>(5)</enum><text display-inline="yes-display-inline">shall be submitted not less frequently than quarterly, on a schedule specified by the Secretary.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H8CE3B9DB6E824F2694A48A1CC0613816"><enum>(4)</enum><text>by adding at the end the following new sentence: <quote>The Secretary shall not waive the requirements of this subsection in the case of an infectious disease outbreak (as defined in section 1819(d)(3)(C)).</quote>.</text></paragraph></section><section id="H810B29101F414C77B9317D0FB1D41418"><enum>5.</enum><header>GAO study and report</header><text display-inline="no-display-inline">Not later than one year after the end of the COVID-19 emergency period (as described in section 1135(g)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)(1)(B)</external-xref>)), the Comptroller General of the United States shall submit to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate a report analyzing deficiencies during such period in infection control measures and direct care staffing requirements for skilled nursing facilities (as defined in section 1819(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(a)</external-xref>)), as reported by the Administrator under section 2(d)(1).</text></section><section id="H2672D5952FB74B359B80B8BF3FE3665A"><enum>6.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply with respect to skilled nursing facilities and nursing facilities beginning on the date of the enactment of this Act.</text></section></legis-body></bill>
