which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name>, and in addition to the Committees on <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, and <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Defense Production Act of 1950 to include the Secretary of Agriculture on the Committee on Foreign Investment in the United States and require review of certain agricultural transactions, and for other purposes.</official-title></form><legis-body id="HC44D71D07F5F42CB8F68A78101C2D96C" style="OLC"><section id="H25BF50F4930B43219D065154E4560739" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Agriculture Safeguards and Security Act of 2022</short-title></quote> or the <quote><short-title>PASS Act of 2022</short-title></quote>. </text></section><section id="H53B58D2FEF4D485B9B8A197A45D3BAD9"><enum>2.</enum><header>Review of agriculture-related transactions by CFIUS</header><subsection id="H1A9C88C11F814776A05A6C0BD6F79572"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 721 of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565</external-xref>) is amended—</text><paragraph id="H41FC8FF85BB248758D8D900EA2509035"><enum>(1)</enum><text>in subsection (a)(5)—</text><subparagraph id="HB670FC78951A472E923E26B4AE39D441"><enum>(A)</enum><text>by striking <quote>means, subject</quote> and inserting the following:</text><quoted-block style="OLC" id="H839E0C7E7AFE4D5CBFFC0EEB59463893" display-inline="yes-display-inline"><text>means—</text><subparagraph id="H3577D751D78242D492A506617550E07E"><enum>(A)</enum><text display-inline="yes-display-inline">subject</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H9FBBE7D9B09D468DBD5CB2E09D4A4DE9"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and </text></subparagraph><subparagraph id="HC269E17DB4B249FBA7C8DA5BE8CC0DE2"><enum>(C)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H06ECE7A3C4594ECA9002C48DCA309884" display-inline="no-display-inline"><subparagraph id="H6E507277A3094B3ABBC33AF0FA55E590"><enum>(B)</enum><text display-inline="yes-display-inline">includes—</text><clause id="HB23EF7EF2B814C828A40D54278EE6B3E"><enum>(i)</enum><text>the sector of agriculture (as such term is defined in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>)); and</text></clause><clause id="H9E665A8C251C4F898EF2C67C8635E28D"><enum>(ii)</enum><text>biotechnology related to the agriculture sector. </text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HDFC8074143ED4F9A8B328C53B10A6F86"><enum>(2)</enum><text>in subsection (k)(2)—</text><subparagraph id="H594EAD9D629D446BB29274ABAD6E74EE"><enum>(A)</enum><text>by redesignating subparagraph (J) as subparagraph (K); and</text></subparagraph><subparagraph id="HF36E5CBB003C408FA79B7D45F768734C"><enum>(B)</enum><text>by inserting after subparagraph (I) the following:</text><quoted-block style="OLC" id="H3276861C7B98419595D9FA6ED96C256B" display-inline="no-display-inline"><subparagraph id="H145E66988E70478FA02C255742ABA25E"><enum>(J)</enum><text display-inline="yes-display-inline">The Secretary of Agriculture.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H0AD91A7FDA6F4DC582D30E9A2AA8C960"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HC13BCE61344E48B493B0D6B58654CB66" display-inline="no-display-inline"><subsection id="H9EB8E277406046628931A15F7E5E7D24"><enum>(r)</enum><header>Prohibition with respect to agricultural companies</header><paragraph id="HED7BE874BB784B19A5810BAF563489F1"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of this section, persons who are acting on behalf of or otherwise directed by the government of a prohibited country may not carry out any merger, acquisition, or takeover that could result in foreign control of a United States agricultural company.</text></paragraph><paragraph id="HFECA7489611F4698A2B0A73CC9255517"><enum>(2)</enum><header>Prohibited country</header><text>In this subsection, the term <term>prohibited country</term> means each of the following:</text><subparagraph id="HE5D904E755254FBD80A2ED01FAC15DFC"><enum>(A)</enum><text>China.</text></subparagraph><subparagraph id="H0B661A94958F46248FD7A1A9D0CD2E3F"><enum>(B)</enum><text>Russia. </text></subparagraph><subparagraph id="H24C465873BBF43E6B42988AEBC277933"><enum>(C)</enum><text display-inline="yes-display-inline">Iran.</text></subparagraph><subparagraph id="HF759CEF9FE8F45AAA24F8799BE9CE1A2"><enum>(D)</enum><text>North Korea.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA368D4BCFD004A1E84262F4B069ED9D4"><enum>(b)</enum><header>Report required</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and every 180 days thereafter, the Secretary of Agriculture shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report on the risks that foreign purchases of agricultural companies pose to the agricultural sector of the United States.</text></subsection></section></legis-body></bill>
