R. 8252</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220628">June 28, 2022</action-date><action-desc><sponsor name-id="V000133">Mr. Van Drew</sponsor> (for himself and <cosponsor name-id="H001052">Mr. Harris</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to codify patients’ rights to hospital visitation, and for other purposes.</official-title></form><legis-body id="H739AA67935324415940BE824BF817984" style="OLC"><section id="HC51DBC68ED394706802F618206EDFCCF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Patient Left Alone Act of 2022</short-title></quote>.</text></section><section id="HBD1DA0FC758A4F79B823790C89A7AC73"><enum>2.</enum><header>Patient visitation rights</header><text display-inline="no-display-inline">Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended—</text><paragraph id="H21970DA930324EE0BCE78C6B7D4AA4F7"><enum>(1)</enum><text>in subsection (e)—</text><subparagraph id="H20F2CF0D1202464B9A279ED28343067B"><enum>(A)</enum><text>in paragraph (8), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H7492090CF3184A56B2010A2C78DA2B3D"><enum>(B)</enum><text>by redesignating paragraph (9) as paragraph (10);</text></subparagraph><subparagraph id="H94AC3B0F6BD34B0C912C9E6E38F6811B"><enum>(C)</enum><text>by inserting after paragraph (8) the following new paragraph:</text><quoted-block style="OLC" id="H60A421650A6F40688C7EDACBC9FDFD61" display-inline="no-display-inline"><paragraph id="H5AE260552CFD4974AB507AE7ED2224BA"><enum>(9)</enum><text display-inline="yes-display-inline">has written policies and procedures regarding the visitation rights of individuals receiving items and services at the institution, which shall include a description of any clinically necessary or reasonable restriction or limitation that such institution may need to place on such rights and the reasons for the clinical restriction or limitation, and a requirement that such institution—</text><subparagraph id="H3F47853C8DB345639C8C7DF8373B3887"><enum>(A)</enum><text>inform each such individual of his or her visitation rights, including any clinical restriction or limitation on such rights;</text></subparagraph><subparagraph id="H31A83DB7797F43ECA8F637EB225BF179"><enum>(B)</enum><text>inform each such individual of the right, subject to the individual’s consent, to receive the visitors whom the individual designates, including a spouse, another family member, or a friend, and the individual’s right to withdraw or deny such consent at any time;</text></subparagraph><subparagraph id="HE095FF88E44D452D9A21305072EBCA14"><enum>(C)</enum><text>may not restrict, limit, or otherwise deny visitation privileges on the basis of race, color, national origin, religion, sex, or disability; and</text></subparagraph><subparagraph id="H8F6F27140E184DD885C359C98A945EE9"><enum>(D)</enum><text>ensure that all visitors enjoy full and equal visitation privileges consistent with this paragraph; and</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H17A68346D82743E2ACE9DFF284C655D7"><enum>(D)</enum><text display-inline="yes-display-inline">in the matter following paragraph (10), as redesignated, by striking <quote>paragraph (9)</quote> each place it appears and inserting <quote>paragraph (10)</quote> in each such place; and</text></subparagraph></paragraph><paragraph id="H99C3D17FECC043D58FBC25CF3FB3FF35"><enum>(2)</enum><text>in subsection (f), by striking <quote>(9)</quote> and inserting <quote>(10)</quote>. </text></paragraph></section></legis-body></bill>
