<official-title display="yes">To require the Secretary of the Treasury to mint coins in commemoration of the Granite Mountain Hotshots who fought the Yarnell Hill Fire, and for other purposes.</official-title>

<section id="H22ABB7923BD84954A7CEBBD50ACE12D6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Granite Mountain Hotshots Commemorative Coin Act</short-title></quote>.</text></section> <section id="H676B93AF222F48F3AD110AC1FDC8891E"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
<paragraph id="HD79E31BEABB141048291FC6CA63984FE"><enum>(1)</enum><text><quote>Hotshots</quote> are elite firefighters that specialize in the containment of wildfires. </text></paragraph> <paragraph id="HB643B8F339C84BB3979E6BD288ADBA6C"><enum>(2)</enum><text>On June 28, 2013, lighting ignited the Yarnell Hill Fire on a ridge west of Yarnell, Arizona, and the fire spread rapidly.</text></paragraph>
<paragraph id="H568267B62266488A9753DAED947CEC8D"><enum>(3)</enum><text display-inline="yes-display-inline">Firefighters from the Granite Mountain Interagency Hotshot Crew (hereafter in this Act referred to as the <quote>Granite Mountain Hotshots</quote>), a crew within the Prescott Fire Department, were deployed to assist with the containment of the Yarnell Hill Fire. </text></paragraph> <paragraph id="HC752BDED76AF4314B5BE73F193D26D93"><enum>(4)</enum><text display-inline="yes-display-inline">On June 30, 2013, 19 firefighters from the Granite Mountain Hotshots perished while attempting to contain the Yarnell Hill Fire and preserve the lives and livelihoods of the residents of Yarnell. The 19 firefighters were—</text>

<subparagraph id="H8ECED9C395C045CAABD1773B7377F9A5"><enum>(S)</enum><text display-inline="yes-display-inline">Garret Zuppiger, age 27.</text></subparagraph></paragraph> <paragraph id="H1845F5987BC446FB923ED175E42DE6C6"><enum>(5)</enum><text display-inline="yes-display-inline">Of the 20 Granite Mountain Hotshots fighting the Yarnell Hill Fire, only the lookout, Brendan McDonough, survived. Brendan McDonough is now a motivational speaker who honors the legacy of the 19 fallen Granite Mountain Hotshots.</text></paragraph>
<paragraph id="H4FD367A956304D14BC103EA10BA00034"><enum>(6)</enum><text display-inline="yes-display-inline">The Yarnell Hill Fire was the deadliest wildfire in the history of the State of Arizona. The Yarnell Hill Fire was the deadliest wildfire in the United States for firefighters since the year 1933 and the third deadliest wildfire in the history of the United States. The Yarnell Hill Fire resulted in more firefighter deaths in the United States than any single occurrence since the September 11, 2001, terrorist attacks. </text></paragraph> <paragraph id="HCCD5D44526DC4480A89F52321EAA8FE8"><enum>(7)</enum><text>Every year, on June 30, residents of Yarnell honor the Granite Mountain Hotshots.</text></paragraph>
<paragraph id="HBA3B2FA4D8364EFFBC9B6D2F3D18CF22"><enum>(8)</enum><text>The Granite Mountain Hotshots Memorial State Park, located on the site of the Yarnell Hill Fire, was dedicated to the Granite Mountain Hotshots in the year 2016.</text></paragraph></section> <section id="HD9210265FBEA49959F962E91BA2559DC"><enum>3.</enum><header>Coin specifications</header> <subsection id="H9DB4BACB94A94201A6D62FFF02014952"><enum>(a)</enum><header>Denomination</header><text display-inline="yes-display-inline">The Secretary of the Treasury (hereafter in this Act referred to as the <quote>Secretary</quote>) shall mint and issue the following coin:</text>
<paragraph id="H405984FFD75B4D7CBBC13C9F4DE280DC"><enum>(1)</enum><header>$5 gold coins</header><text display-inline="yes-display-inline">Not more than 50,000 $5 coins, which shall—</text> <subparagraph id="H4166C7C9323444A18A9DDB9D1EF5D2FE"><enum>(A)</enum><text display-inline="yes-display-inline">weigh 8.359 grams;</text></subparagraph>
<subparagraph id="HDEBAAF0B82F84787A6287D979225681B"><enum>(B)</enum><text display-inline="yes-display-inline">have a diameter of 0.850 inches; and</text></subparagraph> <subparagraph id="HCACA73D020424152BF4EA5AB4AFB6928"><enum>(C)</enum><text>contain not less than 90 percent gold.</text></subparagraph></paragraph>
<paragraph id="H3514E6B667DC4B7197AEE6ED69BD7808"><enum>(2)</enum><header>$1 silver coins</header><text display-inline="yes-display-inline">Not more than 400,000 $1 coins, which shall—</text> <subparagraph id="H7185B23A20754901973E6C3527688ABA"><enum>(A)</enum><text display-inline="yes-display-inline">weigh 26.73 grams;</text></subparagraph>
<subparagraph id="H4062E4E6FA394AC18741A2F9D261431E"><enum>(B)</enum><text display-inline="yes-display-inline">have a diameter of 1.500 inches; and</text></subparagraph> <subparagraph id="H3323C200746940E3804443C74AEC5C14"><enum>(C)</enum><text display-inline="yes-display-inline">contain not less than 90 percent silver.</text></subparagraph></paragraph>
<paragraph id="H945920B6C97B4D9CAB622B7C9E13C8F0"><enum>(3)</enum><header>Half-dollar clad coins</header><text display-inline="yes-display-inline">Not more than 750,000 half-dollar coins which shall—</text> <subparagraph id="H411DE5E24F774200A3C5F3F31E728384"><enum>(A)</enum><text display-inline="yes-display-inline">weigh 11.34 grams;</text></subparagraph>
<subparagraph id="H20B4DCB692FB4A53BAC5B3209D40E172"><enum>(B)</enum><text display-inline="yes-display-inline">have a diameter of 1.205 inches; and</text></subparagraph> <subparagraph id="H2D0BF0C6D2CD453B99324120196B1FE7"><enum>(C)</enum><text>be minted to the specifications for half-dollar coins contained in section 5112(b) of title 31, United States Code.</text></subparagraph></paragraph></subsection>
<subsection id="H5E011CD2F53245A7B70FCD89A9E6B4B9"><enum>(b)</enum><header>Legal tender</header><text display-inline="yes-display-inline">The coins minted under this Act shall be legal tender, as provided in section 5103 of title 31, United States Code.</text></subsection> <subsection id="HA3739B614B6F433BBC349976AAD3FA69"><enum>(c)</enum><header>Numismatic Items</header><text display-inline="yes-display-inline">For purposes of sections 5134 and 5136 of title 31, United States Code, all coins minted under this Act shall be considered to be numismatic items.</text></subsection></section>
<section id="H5B4F468F78B445C6B98B0BB0D4C14512"><enum>4.</enum><header>Design of coins</header>
<subsection id="H0D2F97EA33374AA1A65AF175A65FC16D"><enum>(a)</enum><header>Design requirements</header>
<paragraph id="HA06A12E45E2A480B95DCF8E3E68B0A74"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The designs of the coins minted under this Act shall be emblematic of the fight of the Granite Mountain Hotshots against the Yarnell Hill Fire in the year 2013. </text></paragraph> <paragraph id="HB32E8483364941B6B8E97D127E769352"><enum>(2)</enum><header>Number of designs</header><text display-inline="yes-display-inline">The Secretary shall mint and issue 20 distinct designs under this Act, each of which will honor a different firefighter of the Granite Mountain Hotshots who fought the Yarnell Hill Fire on June 30, 2013, by including on one side the name and likeness of such firefighter. </text></paragraph>
<paragraph id="HA41D2C93904B447FA456B5309CB3AA7F"><enum>(3)</enum><header>Designation and inscriptions</header><text display-inline="yes-display-inline">On each coin minted under this Act, there shall be—</text> <subparagraph id="H2BF4E61ABEB44CC2B22B43A0C48E1338"><enum>(A)</enum><text display-inline="yes-display-inline">a designation of the value of the coin;</text></subparagraph>
<subparagraph id="H63F76322A4354D8198CB4CE234AB5D54"><enum>(B)</enum><text display-inline="yes-display-inline">an inscription of the year “2023”; and</text></subparagraph> <subparagraph id="H550142F7E33D40C380B3BF1F2BBA4568"><enum>(C)</enum><text display-inline="yes-display-inline">inscriptions of the words “Liberty”, “In God We Trust”, “United States of America”, and “E Pluribus Unum”.</text></subparagraph></paragraph></subsection>
<subsection id="HF7F7FD1D74D843A88691DA405E62457C"><enum>(b)</enum><header>Selection</header><text display-inline="yes-display-inline">The design for the coins minted under this Act shall be—</text> <paragraph id="HFFC8D611D0D140E38B51A3FB3159F3FC"><enum>(1)</enum><text display-inline="yes-display-inline">selected by the Secretary after consultation with the Commission of Fine Arts; and</text></paragraph>
<paragraph id="H8CB2284EEFE5464CA9F3CF66AF099485"><enum>(2)</enum><text display-inline="yes-display-inline">reviewed by the Citizens Coinage Advisory Committee.</text></paragraph></subsection></section> <section id="H7CB4B2E0AE2A4C3DBE235AF58041D69D"><enum>5.</enum><header>Issuance of coins</header> <subsection id="HEAD1794AAA504565B5A815E75360DBD4"><enum>(a)</enum><header>Quality of coins</header><text display-inline="yes-display-inline">Coins minted under this Act shall be issued in uncirculated and proof qualities.</text></subsection>
<subsection id="HD136E3F34BAE4F4B95A34B2C73AE64EF"><enum>(b)</enum><header>Period for issuance</header><text display-inline="yes-display-inline">The Secretary may issue coins minted under this Act only during the 1-year period beginning on January 1, 2023.</text></subsection></section> <section id="HCAB93D8CC73447158D9460D1CA4005DD"><enum>6.</enum><header>Sale of coins</header> <subsection id="H1B48E899B9CE42329A03EDBF695B404C"><enum>(a)</enum><header>Sale Price</header><text display-inline="yes-display-inline">The coins issued under this Act shall be sold by the Secretary at a price equal to the sum of—</text>
<paragraph id="H2DB05B080C3E4BC595798247A69EE282"><enum>(1)</enum><text display-inline="yes-display-inline">the face value of the coins;</text></paragraph> <paragraph id="H8EB8F6D80EA44A60AB5ED880BB5703D4"><enum>(2)</enum><text display-inline="yes-display-inline">the surcharge provided in section 7(a) with respect to such coins; and</text></paragraph>
<paragraph id="HBB5924CA84C442569371062EC151C8C5"><enum>(3)</enum><text display-inline="yes-display-inline">the cost of designing and issuing the coins (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping).</text></paragraph></subsection> <subsection id="HB269514ABDC04CF4A5C917608FAAE24A"><enum>(b)</enum><header>Bulk Sales</header><text display-inline="yes-display-inline">The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount.</text></subsection>
<subsection id="H17695BEB0C444A399F6D4392D972161B"><enum>(c)</enum><header>Prepaid Orders</header>
<paragraph id="HB42752C148334E7BBCFEE4C0EDCA5DA1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of such coins.</text></paragraph> <paragraph id="H9FCE01B0AD124539A3B1E51939490C08"><enum>(2)</enum><header>Discount</header><text display-inline="yes-display-inline">Sale prices with respect to prepaid orders under paragraph (1) shall be at a reasonable discount.</text></paragraph></subsection></section>
<section id="H4E42C0AA1119426495089EE091B46E57"><enum>7.</enum><header>Surcharges</header>
<subsection id="H92B7168F24D74E949AD25B8BB79E2E3E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">All sales of coins issued under this Act shall include a surcharge of—</text> <paragraph id="H36DB06525E324B11A03040AB6DE1F5AC"><enum>(1)</enum><text display-inline="yes-display-inline">$35 per coin for the $5 coin;</text></paragraph>
<paragraph id="H9AEEC12CCFF14FC9B436126A331243AF"><enum>(2)</enum><text>$10 per coin for the $1 coin; and</text></paragraph> <paragraph id="H3C5D54466EFE4BAFBE0F35D1BE090C5B"><enum>(3)</enum><text>$5 per coin for the half-dollar coin.</text></paragraph></subsection>
<subsection id="HAD2E41E888664184AA11515AA452506F"><enum>(b)</enum><header>Distribution</header><text display-inline="yes-display-inline">Subject to section 5134(f) of title 31, United States Code, all surcharges received by the Secretary from the sale of coins issued under this Act shall be promptly paid to the Yarnell Fire District for the purpose of wildfire prevention and wildfire education.</text></subsection> <subsection id="HF043A7F47B40480C9B59C65103734C68"><enum>(c)</enum><header>Audits</header><text display-inline="yes-display-inline">The recipient of surcharges under this Act shall be subject to the audit requirements of section 5134(f)(2) of title 31, United States Code, with regard to the amounts received under subsection (b).</text></subsection>
<subsection id="H752163975C634E4686048E868B84A032"><enum>(d)</enum><header>Limitation</header><text display-inline="yes-display-inline">Notwithstanding subsection (a), no surcharge may be included with respect to the issuance under this Act of any coin during a calendar year if, as of the time of such issuance, the issuance of such coin would result in the number of commemorative coin programs issued during such year to exceed the annual 2 commemorative coin program issuance limitation under section 5112(m)(1) of title 31, United States Code (as in effect on the date of the enactment of this Act). The Secretary may issue guidance to carry out this subsection.</text></subsection></section> <section id="HFC2FFAE2055D4EDD8633F675CF3B74B8"><enum>8.</enum><header>Financial Assurances</header><text display-inline="no-display-inline">The Secretary shall take such actions as may be necessary to ensure that—</text>
<paragraph id="HF9343B6420E849C59B7E175E397F2E0F"><enum>(1)</enum><text display-inline="yes-display-inline">minting and issuing coins under this Act will not result in any net cost to the United States Government; and</text></paragraph> <paragraph id="H800D3CB651C643F09BC4E92D54708B5E"><enum>(2)</enum><text display-inline="yes-display-inline">no funds, including applicable surcharges, shall be disbursed to any recipient designated in section 6 until the total cost of designing and issuing all of the coins authorized by this Act (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping) is recovered by the United States Treasury, consistent with sections 5112(m) and 5134(f) of title 31, United States Code.</text></paragraph></section>
