which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 46, United States Code, to require certain port authorities to provide preferential berthing to certain vessels, and for other purposes.</official-title></form><legis-body id="HBF566D78A851481B9470DE2D1BDE7710" style="OLC"><section id="H01457AEA90264D1CA11CBFF990054117" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Port Access Privileges Act of 2022</short-title></quote>.</text></section><section id="H746E1C92D4684B48B134AB1506E842EC" section-type="subsequent-section"><enum>2.</enum><header>Port privilege requirements</header><subsection id="HFF6383972FBB4E79BEE9CEBE32A3D244"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/503">Chapter 503</external-xref> of title 46, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H0E530255A786429DBACED917DF56B3BA" display-inline="no-display-inline"><section id="H15A44009BC2E4BBF818851367221C80E"><enum>50309.</enum><header>Preferential berthing</header><subsection id="H888EF5BB0F7545F0B3872815A4A12C7A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A covered port authority shall provide preferential berthing for loading and unloading vessels that are—</text><paragraph id="H8F9A00132BA041CE999E4B3225CE1529"><enum>(1)</enum><text>vessels of the United States or under contract to the Federal Government, including—</text><subparagraph id="HA6387FC280BC4C4EB4A0088CACCA3D3B"><enum>(A)</enum><text>vessels with a coastwise endorsement under chapter 121; and </text></subparagraph><subparagraph id="H061E11E5A18E46BA83258290CFED2ED8"><enum>(B)</enum><text display-inline="yes-display-inline">vessels participating in the Maritime Security Program or the Emergency Preparedness Program under chapter 531, the Cable Security Fleet under chapter 532, or the Tanker Security Fleet under chapter 534;</text></subparagraph></paragraph><paragraph id="H3281976591D44F8999397BA486FB2047"><enum>(2)</enum><text>vessels calling at more than 1 port in the United States (including any territory or possession of the United States) before calling on a foreign port; and </text></paragraph><paragraph id="H66DD3D4E3C5648348500F4D2BDCC975F"><enum>(3)</enum><text display-inline="yes-display-inline">vessels that the ocean common carrier has certified in writing to the covered port authority or marine terminal operator in the United States (including any territory or possession of the United States) has cargo bookings of U.S. exports that are—</text><subparagraph id="HEA1408920FE94E58AD094D284521226A"><enum>(A)</enum><text>estimated to weigh not less than 51 percent of such vessel’s total carrying capacity by tonnage before calling on a foreign port; or</text></subparagraph><subparagraph id="H2B6E19171CFA4A89A0EED95AA20BC5BC"><enum>(B)</enum><text>equivalent to 51 percent of such vessel’s total carrying capacity of 20-foot equivalent units before calling on a foreign port.</text></subparagraph></paragraph></subsection><subsection id="H0C689A2593E84B6CA31724862671FB4D"><enum>(b)</enum><header>Requirement</header><text display-inline="yes-display-inline">The owner, operator, or agent of a vessel to be provided preference pursuant to paragraphs (2) and (3) of subsection (a) shall inform the respective covered port authority or marine terminal operator, as applicable, in writing not less than 7 days before the date on which the vessel calls on the port expected to provide such preference.</text></subsection><subsection id="H5C95495F551C400399092CE31B5CB177" commented="no"><enum>(c)</enum><header>Authority To collect data</header><paragraph id="H0CE65FB95E3142E39C525C78976DB23A" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each covered port authority or marine terminal operator, as applicable, shall submit to the Director of the Bureau of Transportation Statistics such data as the Director determines to be necessary for the implementation of this subsection, subject to subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44.</text></paragraph><paragraph id="HF7763F00ED55486E99B5F3D35A0DFF48" commented="no"><enum>(2)</enum><header>Publication</header><text>Not less frequently than once each fiscal year, the Director shall publish statistics relating to the vessels provided preference pursuant to paragraphs (2) and (3) of subsection (a), including—</text><subparagraph id="HC3C672E91A904306840A6B802BFCFE56" commented="no"><enum>(A)</enum><text>the total number of vessels by registry, class, and type; and</text></subparagraph><subparagraph id="H165A898E6C224C63BF20C332770E8B63" commented="no"><enum>(B)</enum><text>the average percentage of cargo bookings of U.S. exports reported (by the ocean common carrier) pursuant to paragraph (3) of subsection (a) identified by the—</text><clause id="H65E79323768A44BDA27815CACB012743" commented="no"><enum>(i)</enum><text>average percentage of all such vessels’ total carrying capacity by tonnage; and</text></clause><clause id="H3A1B9B241C4E4C6AB826A6D70261FBF2" commented="no"><enum>(ii)</enum><text>the average percentage of all such vessels’ total carrying capacity of 20-foot equivalent units. </text></clause></subparagraph></paragraph></subsection><subsection id="H98A02F9D696D4454AABFDA3E5E2C7387"><enum>(d)</enum><header>Rules of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to—</text><paragraph id="H97E82CEFA0534D969F18657F3C775B6B"><enum>(1)</enum><text>preclude a port authority, marine terminal operator, or vessel from following a direction by the Coast Guard or from the Vessel Traffic Service maintained under subchapter I of chapter 700; or</text></paragraph><paragraph id="HE518233D664645B09CDAE8172734C021"><enum>(2)</enum><text display-inline="yes-display-inline">require a port authority, marine terminal operator, or the operator of a vessel to take any action prohibited or otherwise in conflict with a bona fide collective bargaining agreement in effect before the date of enactment of this section. </text></paragraph></subsection><subsection id="H21846A8BC09E44DAB5065DE85CDE2EB9"><enum>(e)</enum><header>Definitions</header><text>In this section: </text><paragraph id="HFE62D0654CC14868BEDA2D321617E5C6"><enum>(1)</enum><header>Covered port authority</header><text>The term <quote>covered port authority</quote> means a port authority that receives funding after the date of enactment of this section under—</text><subparagraph id="HCE2D13FE98FC4E0FA11B639F87815590"><enum>(A)</enum><text>the port infrastructure development program under section 54301(a); or</text></subparagraph><subparagraph id="HC3D4A749C5284F728A4509E3CE3ED77D"><enum>(B)</enum><text>the maritime transportation system emergency relief program under section 50308.</text></subparagraph></paragraph><paragraph id="HF1B5D39E0B3A4554B85BF3CA2DFE0480"><enum>(2)</enum><header>Marine terminal operator</header><text>The term <quote>marine terminal operator</quote> has the meaning given such term in section 40102.</text></paragraph><paragraph id="HCAD271EF372D4CE88EF98F68F35E6945"><enum>(3)</enum><header>Ocean common carrier</header><text>The term <quote>ocean common carrier</quote> has the meaning given such term in section 40102. </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H17557BD4A63C4E4784DBBEFDD59EDACB"><enum>(b)</enum><header>Defining preferential berthing</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary of Transportation shall issue such regulations as are necessary to carry out section 50309 of title 46, United States Code (as added by this Act), and define <quote>preferential berthing</quote> for the purposes of such section. </text></subsection><subsection id="HC3FB63E3D2574AD5BDC7935BCA5750A4"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/503">chapter 503</external-xref> of title 46, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H6635C2D41E9E477183714AE522D5C739" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">50309. Preferential berthing.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HE9024323E62A47C68DC48D9327271201"><enum>3.</enum><header>Technical and conforming amendments</header><subsection id="HBCB2BD2F7376450EAB6A15705A17F22F"><enum>(a)</enum><header>Assessment of penalties</header><text display-inline="yes-display-inline">Section 41109(c) of title 46, United States Code, is amended by striking <quote>section 41104(1) or (2)</quote> and inserting <quote>paragraph (1) or (2) of section 41104(a)</quote>.</text></subsection><subsection id="HF05D280D59EC486EB4F3DC9DF6F83CCB"><enum>(b)</enum><header>National shipper advisory committee</header><text display-inline="yes-display-inline">Section 42502(c)(3) of title 46, United States Code, is amended by striking <quote><header-in-text level="paragraph" style="USC">Representation</header-in-text></quote> and all that follows through <quote>Members</quote> and inserting <quote><header-in-text level="paragraph" style="USC">Representation.—</header-in-text>Members</quote>.</text></subsection><subsection id="HFDEDB9A65DFE4232AE6B9C4F70DF42B1"><enum>(c)</enum><header>Federal maritime commission</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/461">chapter 461</external-xref> of title 46, United States Code, is amended by striking the first item relating to chapter 461.</text></subsection><subsection id="HFAB32B9DB1FB47E5AEBC6B25BD937505"><enum>(d)</enum><header>Chapter analysis</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/503">chapter 503</external-xref> of title 46, United States Code, is amended in the item relating to section 50308 by striking <quote>Port development; maritime transportation system emergency relief program</quote> and inserting <quote>Maritime transportation system emergency relief program</quote>.</text></subsection><subsection id="H86E5387592B747B6A3DE1786BAF07810"><enum>(e)</enum><header>Vessel operations revolving fund</header><text>Section 50301(b) of title 46, United States Code, is amended by striking <quote>(<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/1291">50 App. U.S.C. 1291(a)</external-xref>, (c), 1293(c), 1294)</quote> and inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/50/4701">50 U.S.C. 4701(a)</external-xref>, (c), 4703(c), 4704)</quote>.</text></subsection><subsection id="HD14DDF6111964B14AAC1E212CCBB7559"><enum>(f)</enum><header>Maritime transportation system emergency relief program</header><text>Section 50308(a)(2)(B) of title 46, United States Code, is amended by striking <quote>Federal Emergency Management Administration</quote> and inserting <quote>Federal Emergency Management Agency</quote>.</text></subsection><subsection id="H95A92577D4A74174A4AF50BF98FA60FC"><enum>(g)</enum><header>Ports and waterways safety</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/700">chapter 700</external-xref> of title 46, United States Code, is amended—</text><paragraph id="HDB8E06B0AC7B4AEAA5D8591F4FA74BE2"><enum>(1)</enum><text>by striking the item relating to section 70006 and inserting the following: </text><quoted-block style="USC" id="HBD991795BF76469DA5EBDA0F04D4946E" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">70006. Establishment by Secretary of the department in which the Coast Guard is operating of anchorage grounds and regulations generally. </toc-entry></toc><after-quoted-block>; </after-quoted-block></quoted-block><continuation-text continuation-text-level="paragraph">and</continuation-text></paragraph><paragraph id="H80668456C4AD4D6BB85B8FA0F1B7263C"><enum>(2)</enum><text>by striking the item relating to subchapter IV and inserting the following: </text><quoted-block style="USC" id="H912B9BB58E8D4B3FB94E63A7C24AEF87" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="subchapter">SUBCHAPTER IV—DEFINITIONS, REGULATIONS, ENFORCEMENT, INVESTIGATORY POWERS, APPLICABILITY</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H43561E0492DC4D219DC5819EAEC2A8D1"><enum>(h)</enum><header>Prohibition on entry and operation</header><text>Section 70022(b)(1) of title 46, United States Code, is amended by striking <quote>Federal Register</quote> and inserting <quote>the Federal Register</quote>. </text></subsection><subsection id="H0210ADA409FD44AA98494B88A200E55C"><enum>(i)</enum><header>Port, harbor, and coastal facility security</header><text>Section 70116(b)(2) of title 46, United States Code, is amended by inserting a comma after <quote>acts of terrorism</quote>.</text></subsection></section></legis-body></bill>
