which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Defense Production Act of 1950 to provide that authority under the Act can only be exercised during a period in which Congress has formally declared war, and for other purposes.</official-title></form><legis-body id="H6ECD9B38D29C4E89AA318DD2684094DD" style="OLC"><section id="H908C9CCD5723453E88943D002F8A232D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DPA Reform Act of 2022</short-title></quote>.</text></section><section id="H2EE78027E1AF4820B0681936725A82B7"><enum>2.</enum><header>Declaration of war required to exercise authority under the DPA</header><subsection id="HF62BA8B2C9FB493FA1E20CCAB779E9A1"><enum>(a)</enum><header>Priorities and allocations</header><text>Title I of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4511">50 U.S.C. 4511 et seq.</external-xref>) is amended—</text><paragraph id="H3F595452A43B4423A6839276BA21FEEC"><enum>(1)</enum><text display-inline="yes-display-inline">in section 101—</text><subparagraph id="HD031D5D5C594417EAA498213539AF077"><enum>(A)</enum><text>in subsection (a) by striking <quote>authorized</quote> and inserting <quote>authorized, during a period in which Congress has formally declared war,</quote>; and</text></subparagraph><subparagraph id="H5AFC12969F874C91BCAA3F8255EAC3B7"><enum>(B)</enum><text>in subsection (c)(1) by inserting <quote>during a period in which Congress has formally declared war,</quote> after <quote>may,</quote>;</text></subparagraph></paragraph><paragraph id="H6A93D3EC86574D1E9CA1A992D94EEC64"><enum>(2)</enum><text>in section 102 by inserting <quote>during a period in which Congress has formally declared war,</quote> after <quote>hoarding,</quote>; and</text></paragraph><paragraph id="H4F424F890B7B4974A45708FC63AB89D6"><enum>(3)</enum><text>in section 107(b)(1) by striking <quote>peacetime, graduated mobilization, and national emergency</quote> and inserting <quote>a period in which Congress has formally declared war</quote>.</text></paragraph></subsection><subsection id="H630D2A22E9984FF6A827EFA08646A57B"><enum>(b)</enum><header>Expansion of productive capacity and supply</header><text>Title III of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4531">50 U.S.C. 4531 et seq.</external-xref>) is amended—</text><paragraph id="HA565933CCB92439D9DD96D90C3281154"><enum>(1)</enum><text>in section 301(a)(1) by striking <quote>the President may authorize</quote> and inserting <quote>the President may, during a period in which Congress has formally declared war, authorize</quote>;</text></paragraph><paragraph id="H8C117D4F8FE847B0A91B6250F6809EE7"><enum>(2)</enum><text>in section 302(a) by striking <quote>the President may make</quote> and inserting <quote>the President may, during a period in which Congress has formally declared war, make</quote>; and</text></paragraph><paragraph id="H542B6881265E4B81B0A4F4540507B60F"><enum>(3)</enum><text display-inline="yes-display-inline">in section 303—</text><subparagraph id="HEF5EFD6D9E63408D94D07F4910E228FA"><enum>(A)</enum><text>in subsection (a)(1) by striking <quote>the President may make</quote> and inserting <quote>the President may, during a period in which Congress has formally declared war, make</quote>; </text></subparagraph><subparagraph id="H005BFB459F2C4F72A1F4680E828B03F5"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (c)(2) by striking <quote>the President may make</quote> and inserting <quote>the President may, during a period in which Congress has formally declared war, make</quote>;</text></subparagraph><subparagraph id="H1D13E41B34D74C0F92A609F3F433A4E9"><enum>(C)</enum><text>in subsection (e)(1) by inserting <quote>, during a period in which Congress has formally declared war</quote> after <quote>the President is authorized</quote>; and</text></subparagraph><subparagraph id="HC349932281D64CB88EB54E599BE9B489"><enum>(D)</enum><text display-inline="yes-display-inline">in subsection (g) by striking <quote>the President may make</quote> and inserting <quote>the President may, during a period in which Congress has formally declared war, make</quote>.</text></subparagraph></paragraph></subsection><subsection id="H0B43F4550652405FB6305B2451C8E749"><enum>(c)</enum><header>General provisions</header><text>Title VII of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4531">50 U.S.C. 4531 et seq.</external-xref>) is amended—</text><paragraph id="H29D84AD4699C47DEA8331D77EA397C0F"><enum>(1)</enum><text>in section 703 by inserting <quote>, during a period in which Congress has formally declared war</quote> after <quote>Any officer or agency head may</quote>;</text></paragraph><paragraph id="HCC9F9FA166E142B98D68734F4B891E2E"><enum>(2)</enum><text display-inline="yes-display-inline">in section 708(c)(1) by striking <quote>the President may consult</quote> and inserting <quote>the President may, during a period in which Congress has formally declared war, consult</quote>; and</text></paragraph><paragraph id="HF891DB4221F7400D98836715B0B692ED"><enum>(3)</enum><text>in section 710—</text><subparagraph id="HD3782774E8B94A82A5D73106C379FDF9"><enum>(A)</enum><text>in subsection (b)(1) by inserting <quote>during a period in which Congress has formally declared war,</quote> after <quote>authorized,</quote>;</text></subparagraph><subparagraph id="H4DD07FCFE4B04B0AB50BC5D48376DBB9"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (c) by inserting <quote>during a period in which Congress has formally declared war,</quote> after <quote>authorized,</quote>;</text></subparagraph><subparagraph id="H905D42813E9348BB881681616E98CFB7"><enum>(C)</enum><text>in subsection (d) by striking <quote>The President may utilize</quote> and inserting <quote>The President may, during a period in which Congress has formally declared war, utilize</quote>; and</text></subparagraph><subparagraph id="H9A9425B164B14B9984E8972EADB6B8AF"><enum>(D)</enum><text>in subsection (e) by striking <quote>authorized</quote> and inserting <quote>authorized, during a period in which Congress has formally declared war,</quote>.</text></subparagraph></paragraph></subsection><subsection id="H01CB679487514A23B8DB451AD2CDDEA2"><enum>(d)</enum><header>Technical amendments</header><paragraph id="H9EF4C88026D64FB7BDEB4AA12F12C8BC"><enum>(1)</enum><text display-inline="yes-display-inline">Section 101(c)(1) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4511">50 U.S.C. 4511(c)(1)</external-xref>) is amended by striking <quote>paragraph (3)</quote> and inserting <quote>paragraph (2)</quote>.</text></paragraph><paragraph id="HE1A21ADCFF094F9AA91B772A5796BA54"><enum>(2)</enum><text display-inline="yes-display-inline">Section 710 of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4560">50 U.S.C. 4560</external-xref>) is amended—</text><subparagraph id="HDB692F5E9DEF4AE6A63BE08175A7A510"><enum>(A)</enum><text>by redesignating subsections (b) through (g) as subsections (a) through (f), respectively;</text></subparagraph><subparagraph id="HDD895EDE961847849BDCABF44BCDB00B"><enum>(B)</enum><text>in subsection (a), as so redesignated, by striking <quote>subsection (b)</quote> and inserting <quote>subsection</quote> each place it appears; and</text></subparagraph><subparagraph id="HB97DF46143B241428B90C569E5B9D436"><enum>(C)</enum><text>in subsection (b), as so redesignated, by striking <quote>section 55a</quote> and inserting <quote>section 3109</quote>. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
