which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize a grant program to support equitable access to postsecondary STEM pathways.</official-title></form><legis-body id="H3D05F975238F427EA3E24E69E5346FEA" style="OLC"><section id="HAA88DFACF3864BEAA62EAC2991186B00" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>STEM Pathways Through College Act</short-title></quote>. </text></section><section id="HC1C6E36FA2AE4197A70AEB14A3F80B1F" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Postsecondary STEM pathways grants</header><subsection id="H5720A0E68EB748D4A1F41C5765AF0F90" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to support equitable access to postsecondary STEM pathways to increase the number of students exposed to high-quality STEM advanced coursework, support students in reducing college costs, improve postsecondary credit transfers, and increase postsecondary completion.</text></subsection><subsection id="HA379A20EB5C24114B1C7C6C5853F9F53" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HA0406B03A09F43EF9082AC1089645799" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Advanced coursework</header><text display-inline="yes-display-inline">The term <term>advanced coursework</term> means coursework designed for students to earn postsecondary credit upon its successful completion while still in high school, including coursework or assessments associated with Advanced Placement, International Baccalaureate, a dual or concurrent enrollment program, or an early college high school program.</text></paragraph><paragraph id="H277533515F4E408FA8515A030BB66CAF" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means a partnership that—</text><subparagraph id="H761282CD2D4240C6AF10F0CEF211304B" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">shall include—</text><clause id="HBD16EA4E3EDC429D8E1A1705EF838D1E" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the State educational agency;</text></clause><clause id="H7A852F641DAF41FFB0F9B5E6E9DC6133" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">one or more local educational agencies located in the State, which may include an educational service agency; and</text></clause><clause id="HF3F508C817A7461899FD6E2C945D240A" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">either—</text><subclause id="H8BE7FECC9BEF43B78F67B347CAAC0017" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the State public higher education system inclusive of all 2-year and 4-year public institutions of higher education in the State; or</text></subclause><subclause id="H52E648125EDC42A6837A2E1D11D0A316" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">a consortium of the State’s public higher education institutions or systems that, together, is inclusive of all 2-year and 4-year public institutions of higher education in the State; and</text></subclause></clause></subparagraph><subparagraph id="HB3ABD8088B164FBD9F6EF49470EE78A4" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">may include 1 or more businesses, associations, or nonprofit organizations representing businesses, private nonprofit institutions of higher education, nonprofit organizations, a State workforce agency, or a State workforce development board established under section 101 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3111">29 U.S.C. 3111</external-xref>).</text></subparagraph></paragraph><paragraph id="H6DB140BC2F0A417B9B9F6D77F215DF43" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">ESEA definitions</header><text display-inline="yes-display-inline">The terms <term>dual or concurrent enrollment program</term>, <term>early college high school</term>, <term>educational service agency</term><term>elementary school</term>, <term>English learner</term>, <term>evidence-based</term>, <term>high school</term>, <term>institution of higher education</term>, <term>local educational agency</term>, <term>middle grades</term>, <term>other staff</term>, <term>professional development</term>, <term>regular high school diploma</term>, <term>Secretary</term>, <term>State</term>, <term>State educational agency</term>, and <term>technology</term> shall have the meaning given the terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="H04D15871C2CA45688205FFB308AC37D9" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Governor</header><text display-inline="yes-display-inline">The term <term>Governor</term> means the chief executive officer of a State.</text></paragraph><paragraph id="HCDFB14CB6DD94DCD99AC0E2E834A596C" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Perkins definitions</header><text display-inline="yes-display-inline">The terms <term>career and technical education</term> and <term>work-based learning</term> have the meaning given the terms in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>).</text></paragraph><paragraph id="HAE89FBCF809B4ED7A27A668F86F214FC" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Postsecondary stem pathway</header><text display-inline="yes-display-inline">The term <term>postsecondary STEM pathway</term> means a sequence of courses focused on STEM education, including advanced coursework approved by the eligible entity taken at any point during high school that—</text><subparagraph id="H70E9761B04284C4E97BAD4F25956372D" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">when taken together, provide at least 12 credit hours or the equivalent coursework toward an associate degree or baccalaureate degree, or, in the case of postsecondary credit in career and technical education earned through such sequence of courses, credit toward a recognized postsecondary credential for a high-skill, high-wage, or in-demand industry sector or occupation; and</text></subparagraph><subparagraph id="HE8B57BEE6E694DE49505A64ADED4F675" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">if completed successfully, results in credit that—</text><clause id="H7EFB1880B1A347688F588B599B357320" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">satisfies requirements for the State’s regular high school diploma; and</text></clause><clause id="HC9ADA6A86D5845F2BB7FE76F3B6715AA" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">is a part of the statewide articulation agreement described in subsection (d)(2)(B); and</text></clause></subparagraph><subparagraph id="H33202135CDCB4F098818F54252303B80" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">may include work-based learning in a STEM field aligned with the academic coursework offered in a postsecondary STEM pathway.</text></subparagraph></paragraph><paragraph id="HF4E22FD6899344AA9EE9C557454A59AC" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">STEM education</header><text display-inline="yes-display-inline">The term <term>STEM education</term> means courses, activities, high-quality instruction, and learning in the subjects of science, technology, engineering, or mathematics, including computer science.</text></paragraph><paragraph id="H3AC7248D3627451DAFB2BFF8365B2576" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header display-inline="yes-display-inline">Subgroup of students</header><text display-inline="yes-display-inline">The term <term>subgroup of students</term> means—</text><subparagraph id="HC409BE3346514E32A5217BE39323AD22" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">students from a family with a low income;</text></subparagraph><subparagraph id="H3CD3FDBFFB5F4297B013915BA53A824C" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">students of color;</text></subparagraph><subparagraph id="H3CF2E721475A4A7BB09C1BFDC273AA42" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">children with disabilities, as defined in section 602(3) of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401(3)</external-xref>);</text></subparagraph><subparagraph id="H709181F8E0C94263907DFAB92A54B74E" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">English learners;</text></subparagraph><subparagraph id="H52F488D4434F4423B5E975278101AF31" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">migratory children, as described in section 1309(3) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6399">20 U.S.C. 6399(3)</external-xref>);</text></subparagraph><subparagraph id="H4496714496F140EF8134BB215558C0C6" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">homeless children and youths, as defined in section 725 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11434a">42 U.S.C. 11434a</external-xref>);</text></subparagraph><subparagraph id="H241FA6D586384CDCABC7E14568B1871A" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">students who are in foster care or are aging out of the foster care system; and</text></subparagraph><subparagraph id="HFDE2F3B6FA1E43D1B51E73DCE36F7970" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">first-generation college students.</text></subparagraph></paragraph><paragraph id="HFD84606A3B8245E0A7363895768BEA8A" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header display-inline="yes-display-inline">WIOA definitions</header><text display-inline="yes-display-inline">The terms <term>in-demand industry sector or occupation</term> and <term>recognized postsecondary credential</term> have the meanings given the terms in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph><paragraph id="H6770D4EACCCF430E985B9784D68EC761" commented="no" display-inline="no-display-inline"><enum>(10)</enum><header display-inline="yes-display-inline">Students from a family with a low income</header><text display-inline="yes-display-inline">The term <term>students from a family with a low income</term> includes any student who is identified by any of the measures described in section 1113(a)(5) of the Elementary and Secondary Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6313">20 U.S.C. 6313(a)(5)</external-xref>).</text></paragraph><paragraph id="H35FD8F0AD0D84231BC8D3B2EDA09F597" commented="no" display-inline="no-display-inline"><enum>(11)</enum><header display-inline="yes-display-inline">First-generation college student</header><text display-inline="yes-display-inline">The term <term>first-generation college student</term> has the meaning given the term in section 402A(h) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-11">20 U.S.C. 1070a–11(h)</external-xref>).</text></paragraph></subsection><subsection id="HFD6C070ACC5E4954A9144FB6D6A170B3" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Authorization of grants</header><paragraph id="HFFE309AC0244403684FA07EA37A4D3F4" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">From the amounts appropriated under subsection (i) and not reserved under paragraph (2), the Secretary shall award grants, on a competitive basis, to eligible entities to enable those eligible entities to implement activities described under subsection (e).</text></paragraph><paragraph id="H616DD988A2E14F51A58D2D92D12B240E" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Reservations</header><text display-inline="yes-display-inline">From the total amount appropriated under subsection (i) for a fiscal year, the Secretary shall reserve—</text><subparagraph id="H33CED0546F3343798F75F39619CC2535" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">1 percent for the Bureau of Indian Education to improve access to postsecondary STEM pathways;</text></subparagraph><subparagraph id="HF317071BCF9F42F2879297EBEA5A5003" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">2 percent to conduct the evaluation described under subsection (g); and</text></subparagraph><subparagraph id="HB961480BC74940A799B413F6AF04E952" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">2 percent for technical assistance and dissemination, which may include—</text><clause id="H5C5CEB8451B8470598054FA7163EBBE1" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">providing, directly or through grants, contracts, or cooperative agreements, technical assistance on using evidence-based practices to improve the outcomes of activities funded under this section; and</text></clause><clause id="H6E2E8A73097F4E41BCDF9A5E0692FE82" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">disseminating information on evidence-based practices that are successful in improving the quality of activities funded under this section.</text></clause></subparagraph></paragraph><paragraph id="H7369AC5C8B174E088D1B8AC03BDA1206" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Duration</header><text display-inline="yes-display-inline">A grant awarded under this section shall be for a period of not more than 5 years.</text></paragraph><paragraph id="H37864670E19D41A0ABA597035CAA8782" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Renewal</header><text display-inline="yes-display-inline">The Secretary may renew a grant awarded under this section for 1 additional 2-year period for programs that meet the goals specified in subsection (d)(4)(B) of the initial grant.</text></paragraph><paragraph id="H3A79BDCBE7FE4AFD97D63086BEBF84A3" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Diversity of projects</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall ensure that, to the extent practicable, grants are distributed among eligible entities that will serve geographically diverse areas, including urban, suburban, and rural areas.</text></paragraph><paragraph id="HDDF6F0C99AC2474095A92F5B3C99481E" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Sufficient size and scope</header><text display-inline="yes-display-inline">Each grant awarded under this section shall be of sufficient size and scope to allow the eligible entity to carry out the purposes of this section.</text></paragraph><paragraph id="H26F12BB0F1EE4D0591FF155020C45D9A" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Priorities</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall give priority to applications that—</text><subparagraph id="H5E04DD5ACB394BCBB16255A9D80FC8F7" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">provide postsecondary STEM pathways to a high proportion of the State’s students enrolled in high schools operated by local educational agencies;</text></subparagraph><subparagraph id="H81A4523A7BC244FE92D1DDD3EE13B980" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">prioritize evidence-based strategies to ensure subgroups of students have equitable access to postsecondary STEM pathways; and</text></subparagraph><subparagraph id="H3A9A8543AD754D68B1521D9037EED95E" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">are submitted by eligible entities that include local educational agencies who are in the highest quartile of local educational agencies, in a ranking of all qualified local educational agencies in the State, ranked in descending order by the number or percentage of children in each agency counted under section 1124(c) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6333">20 U.S.C. 6333(c)</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="HE1521AB0B9C84D46B8387F8F52648DAD" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Eligible entity application</header><text display-inline="yes-display-inline">In order to receive a grant under subsection (c)(1), the eligible entity shall submit an application to the Secretary, at such time, in such manner, and containing such information as the Secretary may reasonably require. Such application shall include, at a minimum—</text><paragraph id="H7A9D4A3B6B8E4E6AA71783B83B1F6662" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">signatures from the Governor, chief State school officer, and State higher education executive officer verifying the eligible entity shall meet the requirements described in paragraph (2) within the specified timeframe;</text></paragraph><paragraph id="HEA8C3116C1564940866B1FDAD0CCA2D2" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">a description of how the eligible entity will, not later than 2 years after the date of the initial receipt of funds under this section—</text><subparagraph id="HD7A4F4B8D0724B09AE814B090DA3CB47" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">ensure STEM postsecondary pathways are aligned with entrance requirements for credit-bearing coursework at the State’s public institutions of higher education; and</text></subparagraph><subparagraph id="H16710CC0C89D4EBFA70A5DD9639DCDDC" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">develop a formal, universal statewide articulation agreement among all public institutions of higher education or systems in the State—</text><clause id="H47F8A9408FFF4683853FD654C725E7BB" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">to guarantee that—</text><subclause id="H69473B20B13040D4A9235F302A7CA10E" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">all advanced coursework successfully completed as part of a postsecondary STEM pathway results in credit that—</text><item id="HC8DB263EA2F04E5ABD3AF63F018AC247" commented="no" display-inline="no-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline">counts as credit for a regular high school diploma;</text></item><item id="HB8585C83504E495398CAA0D0F8D13485" commented="no" display-inline="no-display-inline"><enum>(bb)</enum><text display-inline="yes-display-inline">fully transfers to, and is credited by, all public institutions of higher education in the State, and that such credits will count toward meeting related degree or certificate requirements; and</text></item><item id="HE335F78C4F4044FBB9DF5723B15CB96B" commented="no" display-inline="no-display-inline"><enum>(cc)</enum><text display-inline="yes-display-inline">is transferable to any private nonprofit institution of higher education or public institution of higher education located in another State that chooses to participate in the articulation agreement; and</text></item></subclause><subclause id="H2C3B4097F88E48D3B695184A9047AB32" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">if a student earns an associate degree (including an associate degree in applied science) as part of a postsecondary STEM pathway, such associate degree, awarded by a participating institution of higher education in the State, shall be fully acceptable in transfer and credited as the first 2 years of a related baccalaureate program at a public institution of higher education in such State; and</text></subclause></clause><clause id="H68B8CC7BD3534800A584E0E857F138C2" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">to facilitate the seamless transfer of credit earned in the postsecondary STEM pathway among such institutions of higher education, including between 2-year and 4-year public institutions of higher education and private nonprofit institutions of higher education (if such private nonprofit institutions of higher education choose to participate in the articulation agreement), by using methods such as—</text><subclause id="H4A9A41C2634E45278FBA7CD88744D433" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">common course numbering;</text></subclause><subclause id="HC68E3FB7F6B24413A33A217ED51B9C2E" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">a general education core curriculum; and</text></subclause><subclause id="HBBB24FBFC70D4FE4A24107F3F09DCE3C" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">management systems regarding course equivalency, transfer of credit, and articulation;</text></subclause></clause></subparagraph></paragraph><paragraph id="HB5EEF2E5020E4F42B068DA265AAA1AF2" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">a description of how the eligible entity will disseminate information to subgroups of students in the middle grades and high school served by the eligible entity, including their families, about the opportunity to participate in a postsecondary STEM pathway and the benefits of participation;</text></paragraph><paragraph id="HA46B4F8E98504D258902DDF2CEEDD3C7" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">a description of how the eligible entity will implement postsecondary STEM pathways in all local educational agencies participating in the eligible entity, including—</text><subparagraph id="HE7E2703B6ECE4A9FAD3132D4FCAEF156" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the timeline and plan to provide, by the end of the grant period, a substantial number of students in the State the opportunity to participate in a postsecondary STEM pathway; and</text></subparagraph><subparagraph id="HFC17E0A0EB224AC3A347E4A4CA5A0AF2" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">annual goals for participation in advanced coursework and postsecondary STEM pathways among subgroups of students such that, if the goals are met—</text><clause id="HADE74F6849C44FD38A56601B92DF36FD" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">significant progress will be made toward improving equity in access to advanced coursework and postsecondary STEM pathways across the local educational agencies within the eligible entity in the State; and</text></clause><clause id="HBF5288F754934FEA9733DC498EE21C9A" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the demographics of students participating in advanced coursework and postsecondary STEM pathways will be similar to the demographics of total student enrollment in the State the eligible entity is located in by the end of the grant period; </text></clause></subparagraph></paragraph><paragraph id="H8B7BBB22FDEF477EAF6C2EEFECA8EBAC" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">a description of how the eligible entity has, or will, ensure that postsecondary STEM pathways are aligned with in-demand industries or occupations and provide students with opportunities for work-based learning;</text></paragraph><paragraph id="H05CBF8DE8CDC4667AB344580F01B1155" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">a description of how the eligible entity consulted with stakeholders in development of its application and how the eligible entity will continue to engage, collaborate, and solicit feedback with stakeholders to improve implementation of the application requirements described in this subsection and uses of funds described in subsection (e), including—</text><subparagraph id="HB27DAC2E929540089BBEB34CA6871BF6" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the State board of education (if the State has a State board of education);</text></subparagraph><subparagraph id="HF98535887D36410CA0226EF97C3869E1" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the State higher education governing or coordinating entity (if the State has such an entity);</text></subparagraph><subparagraph id="HA0F6E2BA8BBF41F8A8C747354F2B2D22" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">a State board or local board, as defined in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>)</text></subparagraph><subparagraph id="H9A086F249CF04CE3AF435A31928D517F" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the State agency responsible for the administration of career and technical education in the State or for the supervision of the administration of career and technical education in the State (if the State has such an entity);</text></subparagraph><subparagraph id="HA5BFBDABA3324DFDB2CA239D834C148E" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">institutions of higher education in the State;</text></subparagraph><subparagraph id="H1C030A98CD224380A33E8C0AAE599E55" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">local educational agencies, including those located in rural areas and with the highest enrollments of students from low income families, as described in subsection (c)(7)(C);</text></subparagraph><subparagraph id="HF829AC76FD3C4E42B05C46AE9444723A" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">representatives of Indian Tribes located in the State;</text></subparagraph><subparagraph id="HA02DAFE040F2446A99796D94825E7685" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">charter school leaders (if the State has charter schools);</text></subparagraph><subparagraph id="H15538F588BB242E281982A581BF7B793" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">civil rights organizations in the State;</text></subparagraph><subparagraph id="H8A0DDF3628A8430CA9AB61058127E10B" commented="no" display-inline="no-display-inline"><enum>(J)</enum><text display-inline="yes-display-inline">business leaders or their representatives in the State;</text></subparagraph><subparagraph id="H4E46121F276947C3ADFFE57823FE4AF8" commented="no" display-inline="no-display-inline"><enum>(K)</enum><text display-inline="yes-display-inline">teachers, principals, and other school leaders; and</text></subparagraph><subparagraph id="H537AD67DA14B40B1A362C19C8F309728" commented="no" display-inline="no-display-inline"><enum>(L)</enum><text display-inline="yes-display-inline">parents and students;</text></subparagraph></paragraph><paragraph id="H5CE6784D69344F83B82C404173B44F63" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">an assurance that the eligible entity will provide postsecondary STEM pathways at no cost to students and families, including that students and their parents shall not be required to pay the cost of tuition, fees (including examination fees associated with Advanced Placement, International Baccalaureate, and similar examinations), books, and supplies necessary to successfully complete postsecondary STEM pathways;</text></paragraph><paragraph id="H4C24CF001A7E460E84D3D913AD3D31AB" commented="no" display-inline="no-display-inline"><enum>(8)</enum><text display-inline="yes-display-inline">an assurance that not less than half of grant funds received by the eligible entity will be used to support subgroups of students in accessing and completing postsecondary STEM pathways; and</text></paragraph><paragraph id="HC2FB8DEF98154DA1912F801E2566102A" commented="no" display-inline="no-display-inline"><enum>(9)</enum><text display-inline="yes-display-inline">an assurance that the State will comply with the supplement, not supplant requirement described under subsection (h).</text></paragraph></subsection><subsection id="H4C819D2D493F4A1981BE8657C0C83B08" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Uses of funds</header><paragraph id="H2F5A7B47E4314EB1AA17F974BEB2AB92" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Required uses</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under this section shall use grant funds to carry out the following:</text><subparagraph id="H20C84F11A9B44E798C758904CBF0FE26" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">Activities to implement the alignment requirements pursuant to subsection (d)(2) for a period of time not to exceed the first 2 fiscal years for which the grant is provided.</text></subparagraph><subparagraph id="HE8946908BE7D452FB05A7F8513A65766" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">Supporting the development and implementation of postsecondary STEM pathways consistent with the timeline, plan, and goals specified in subsection (d)(4) in order to increase the number of students accessing and completing postsecondary STEM pathways in the State, including—</text><clause id="H4AB6048D169C42AAA5490E822767E66C" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">expanding advanced coursework offered to students served by the eligible entity to increase the availability of postsecondary STEM pathways;</text></clause><clause id="H88293881CA084B608070AF1B230C13F0" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">covering tuition, fees (including examination fees associated with Advanced Placement, International Baccalaureate, and similar examinations), books, and supplies for students participating in postsecondary STEM pathways, in accordance with subsection (d)(7); and</text></clause><clause id="H6CD42F08DB7F459295EEDECDDFCEAD95" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">covering transportation costs necessary for full participation in postsecondary STEM pathways for students from a family with a low income.</text></clause></subparagraph><subparagraph id="H2618E4982585444F9B7A492DC4E4ED65" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">Implementing programs and activities to improve student preparation for, and participation in postsecondary STEM pathways, with a priority for students enrolled in local educational agencies described in subsection (c)(7)(C) and subgroups of students, which may include—</text><clause id="H2FEFDE20470B4468B2455C56A82C11FA" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">using data from evidence-based early warning indicator systems;</text></clause><clause id="HEA88218D55DD47B4A6BF43A0EB66789C" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">providing supplemental advising or counseling activities that are voluntary to students, including information on choosing postsecondary options, applying for financial aid, completing applications to institutions of higher education, and career counseling and advising, beginning as early as the middle grades; and</text></clause><clause id="HBAAD37E2ACAC4D7196583F5A40526523" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">other evidence-based activities to support the successful implementation of postsecondary STEM pathways and students’ transition from high school to postsecondary education.</text></clause></subparagraph><subparagraph id="HB9B85D310DF345858D3171D772D72F2A" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">Conducting outreach and communicating with subgroups of students, including their families, to build awareness about the opportunity to participate in a postsecondary STEM pathway and the benefits of participation.</text></subparagraph></paragraph><paragraph id="H22A60FAF28514F2CA25ECB7A43FF733F" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Permitted uses</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under this section may also use grant funds to—</text><subparagraph id="H3E175E2025314B44AEAD98D66A8EDBC6" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">provide training, professional development, or recruitment for educators employed by the local educational agencies within the eligible entity and for faculty who teach courses that are included in a postsecondary STEM pathway, including increasing the number of educators qualified to teach dual or concurrent enrollment programs in STEM courses, to improve access and completion of such pathways, particularly for subgroups of students; and</text></subparagraph><subparagraph id="H5728C17277D04DE7A82C336220B25E09" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">carry out capacity-building efforts to improve the coordination between the elementary and secondary education system and the higher education system, including through stakeholder engagement and monitoring.</text></subparagraph></paragraph><paragraph id="HF23A3A2874B749A09677E49D011062A4" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Transportation cap</header><text display-inline="yes-display-inline">An eligible entity shall not use more than 25 percent of grant funds to cover transportation costs authorized under paragraph (1)(B)(iii).</text></paragraph></subsection><subsection id="H785C6BEF48B74A3985A2B3D804D1DEB6" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Reporting requirements</header><paragraph id="H96E91181F4A246888D8676F50C4ADD0C" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Eligible entity reporting</header><text display-inline="yes-display-inline">Not later than 1 year after the enactment of this section and every year thereafter, the eligible entity shall provide a report to the Secretary containing such information as the Secretary may require, including, at a minimum—</text><subparagraph id="H1B8BF36D0F7841E5B8AE9C8663BACC6B" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">information on the progress of the eligible entity in establishing the policies and completing the required activities as specified in subsection (d)(2);</text></subparagraph><subparagraph id="HA1E9AE4E437E4B8E8A4A381BE6553A66" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the number and percentage of local educational agencies and institutions of higher education in the State offering a postsecondary STEM pathway, including changes year-over-year, and the extent to which the eligible entity was meeting its timeline, plan, and goals specified in subsection (d)(4);</text></subparagraph><subparagraph id="H1DF3BFF1523A4884A0C11D4638D08093" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the eligible entity’s progress in meeting the goals established by the eligible entity for the participation of subgroups of students in postsecondary STEM pathways as specified in subsection (d)(4);</text></subparagraph><subparagraph id="HAF234007F50142B3B741F5A9BBB5EA46" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">evidence demonstrating how the eligible entity certified each such pathway meets all the requirements of this section;</text></subparagraph><subparagraph id="H25BC748A9F6B4267A9E2335CC0438693" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">the number and percentage of students in the State, including disaggregated by each subgroup of students, and by sex, who—</text><clause id="HD3CE412885A74128B8736DAEBF8EA12F" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">participate in a postsecondary STEM pathway; and</text></clause><clause id="H6D4DC2734B3C4E4C87593B15BDEE11C4" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">participate in a postsecondary STEM pathway and—</text><subclause id="H8AF65276636B452A9718A4314E33879E" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">successfully complete a postsecondary STEM pathway;</text></subclause><subclause id="HC8BF66F088824B1BA243AEF71AC8C1A3" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">enroll in an institution of higher education and received credit, in accordance with the alignment requirements described in subsection (d)(2);</text></subclause><subclause id="HE030B4A900A44414A01D0B59B7BAF74E" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">receive credit toward a recognized postsecondary credential for a high-skill, high-wage, or in-demand industry sector or occupation; and</text></subclause><subclause id="H495DE1B0D5454CF9A2545137800B565D" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text display-inline="yes-display-inline">earn a postsecondary credential; and</text></subclause></clause></subparagraph><subparagraph id="H73468BBA14D542FE9F2D451034410B0C" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">any additional information as the Secretary may reasonably require to ensure compliance with the requirements of this section and to effectively evaluate, monitor, and improve grant implementation.</text></subparagraph></paragraph><paragraph id="H8C0DEB8CDFC04A829BC79CF9156B4101" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Secretary’s report</header><text display-inline="yes-display-inline">Not later than 6 months after receiving the initial report described in paragraph (1) and annually thereafter, the Secretary shall submit a report to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and Labor of the House of Representatives that includes a summary of reports submitted by eligible entities and identifies best practices related to improving access to STEM education and postsecondary education, particularly for subgroups of students, through the implementation of postsecondary STEM pathways.</text></paragraph></subsection><subsection id="HCEB9E6712E544E449B44BAC2E31C0912" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header display-inline="yes-display-inline">Evaluation</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of the Institute of Education Sciences, shall conduct an independent evaluation after the initial award of grants under this section, of the policies and services provided under this section, including at a minimum, the impact of such policies and services on outcomes for all students, particularly for subgroups of students, with regard to each of the following:</text><paragraph id="HA6A629CC35F84FC9BF963EB1F3D3A675" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Enrollment in and completion of advanced coursework during high school, including the number of courses students take and the number of credits students earn.</text></paragraph><paragraph id="H4C17B21B34674C6FB253B05C81987CFF" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">Postsecondary enrollment, remediation, first-year credit attainment, persistence, and completion including the number of students who enrolled in a STEM field, and the number of students who received a credential in a STEM field.</text></paragraph><paragraph id="HD6F95DC19910486EB04010198202B43D" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">The rate at which credits earned through postsecondary STEM pathways are recognized for credit by public institutions of higher education institutions.</text></paragraph><paragraph id="HE6E05844CEA84DB78BDA56893996B6F2" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">Postsecondary degree attainment, including completion of an associate degree, baccalaureate degree, or recognized postsecondary credential, and the time it takes students to earn a degree.</text></paragraph><paragraph id="HE85ACE545AAA4CD2ABE2F3FEEFAF5D67" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">Changes in access and rigor of STEM education offered to students served by local educational agencies in eligible entities.</text></paragraph><paragraph id="H3FF15BFF7E5C4446AAB07C4E15902B26" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">To the extent practicable, analysis of student outcomes described in paragraphs (1) through (5) by STEM field.</text></paragraph></subsection><subsection id="HCDA24313906C451FA4E32351DF1CCA47" commented="no" display-inline="no-display-inline"><enum>(h)</enum><header display-inline="yes-display-inline">Supplement, not supplant</header><text display-inline="yes-display-inline">Federal funds provided under this section shall be used to supplement, not supplant, other Federal, State, or local funds available to carry out activities described in this section.</text></subsection><subsection id="H30250AF5FD8A43569C5A12CABE67E2A9" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">For the purpose of carrying out this section, there are authorized to be appropriated such sums as may be necessary for each of fiscal years 2022 through 2026. </text></subsection></section></legis-body></bill>
