R. 8230</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220624">June 24, 2022</action-date><action-desc><sponsor name-id="M001215">Mrs. Miller-Meeks</sponsor> (for herself, <cosponsor name-id="J000292">Mr. Johnson of Ohio</cosponsor>, <cosponsor name-id="V000133">Mr. Van Drew</cosponsor>, <cosponsor name-id="C001120">Mr. Crenshaw</cosponsor>, <cosponsor name-id="N000026">Mr. Nehls</cosponsor>, <cosponsor name-id="M001186">Mr. Meijer</cosponsor>, <cosponsor name-id="U000031">Mr. Upton</cosponsor>, <cosponsor name-id="C001104">Mr. Cawthorn</cosponsor>, and <cosponsor name-id="B000668">Mr. Bentz</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name>, and in addition to the Committees on <committee-name committee-id="HHM00">Homeland Security</committee-name>, and <committee-name committee-id="HAS00">Armed Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To terminate certain contracts relating to the construction of the border fence and to transfer unused border fence material to the States along the southwest border.</official-title></form><legis-body id="H9F470693D7CE4AF28381514CE9707CA7" style="OLC"><section id="HB528BE3B1945441784FD815AD64B22B6" section-type="section-one"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border's Unused Idle and Lying Dormant Inventory Transfer Act</short-title></quote> or the <quote><short-title>BUILD IT Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H89F11D86EB4146D99FD7F04D4348EC23"><enum>2.</enum><header>Transfer of unused border fence material to border States</header><subsection id="HC97DB7122B7D4D21AD07E7F02A40D6FA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, not later than 90 days after the date of the enactment of this Act, the Federal Government shall deliver to the Governments of Arizona, California, New Mexico, and Texas, upon request, any materials associated with the construction of the barrier along international border between the United States and Mexico that—</text><paragraph id="HAB69D6D4F5B5418F823D4475AA60A352"><enum>(1)</enum><text display-inline="yes-display-inline">are in the possession of the Department of Homeland Security, the Department of Defense, or any other Federal agency; or</text></paragraph><paragraph id="HED4B0FDBBE5C471387563EEDD98EF967"><enum>(2)</enum><text display-inline="yes-display-inline">have been purchased by the Federal Government, but remain in the possession of any contractor or vendor.</text></paragraph></subsection><subsection id="HF40D829F981843FE8EDECDBE36E62E77"><enum>(b)</enum><header>Prohibition of fees and delivery charges</header><text>The Federal Government may not charge any fee or other delivery charge to any of the States referred to in subsection (a) for the delivery of the materials described in subsection (a). </text></subsection><subsection id="H00B0BB544F48448AB89B4FCFF4CDD7AA"><enum>(c)</enum><header>Use of materials</header><text>Any State receiving materials pursuant to subsection (a) shall use such materials for the purpose of barrier construction along the international border between the United States and Mexico.</text></subsection><subsection id="H25FCD168646B49F7B70D511379EC2DA7"><enum>(d)</enum><header>Termination of existing contracts</header><text>The Federal Government shall terminate, at the convenience of the Government, any contract relating to the maintenance and security of the materials intended for the construction referred to in subsection (a) that—</text><paragraph id="HE1224C10731D4D43955BB701B0571939"><enum>(1)</enum><text>is in effect on the date of the enactment of this Act; and</text></paragraph><paragraph id="HE0462DD343B54B5A9D5E5FC6D80DC3D3"><enum>(2)</enum><text>must be terminated in order to comply with subsection (a).</text></paragraph></subsection></section></legis-body></bill>
