which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the New Philadelphia National Historical Park in the State of Illinois as a unit of the National Park System, and for other purposes.</official-title></form><legis-body id="HEA8713E3CF33407795A48B7BCEE5B665" style="OLC"><section id="HFE200FFC2FC94E16A02C8F9858013620" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>New Philadelphia National Historical Park Act</short-title></quote>.</text></section><section id="HADC1E6254C7349A09371F41AF7D792EE"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="HB524B8A2027C4718BA093D4AA9904CBE"><enum>(1)</enum><text display-inline="yes-display-inline">Frank McWorter, an enslaved man, bought his freedom and the freedom of 15 family members by mining for crude niter in Kentucky caves and processing the mined material into saltpeter, by hiring his time to other settlers, and by selling lots in New Philadelphia, the town he founded;</text></paragraph><paragraph id="H5E5DF6AA692842E288EC4E737A51FA48"><enum>(2)</enum><text>New Philadelphia, founded in 1836 by Frank McWorter, was the first town planned and legally registered by a free African American before the Civil War;</text></paragraph><paragraph id="HC8E312E49D174976899FCC3859E807E7"><enum>(3)</enum><text>the first railroad constructed in the area of New Philadelphia bypassed New Philadelphia, which led to the decline of New Philadelphia; and</text></paragraph><paragraph id="HD8927471B3F44572B15E663F5FB34177"><enum>(4)</enum><text>the New Philadelphia site is a registered National Historic Landmark.</text></paragraph></section><section id="HF46E87D95BF14C95876B8A611378C43D"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HF2EFE920B7AD4B19987E0A909AC9F717"><enum>(1)</enum><header>Park</header><text>The term <term>Park</term> means the New Philadelphia Historical Park established by this Act.</text></paragraph><paragraph id="HCF85D1EB8FED4B129A142909566194E8"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="HEA4C830E24794EDB8187478D59808B90"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means the State of Illinois.</text></paragraph></section><section id="H335D57996F114E6B85F318F6D2BEFAD0"><enum>4.</enum><header>Establishment of New Philadelphia</header><subsection id="HE01ABD7CCCA84A4EA3C1F1A63B24C5F8"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the State a unit of the National Park System to be known as the <quote>New Philadelphia Historical Park</quote> to coordinate—</text><paragraph id="HC02B1AABC1484FFC9665384DB1C478FC"><enum>(1)</enum><text>preservation, protection, and interpretation efforts of the Park by the Federal Government, the State, units of local government, and private and nonprofit organizations; and</text></paragraph><paragraph id="HEB8A94FBE04F46439655193D129925AF"><enum>(2)</enum><text>appropriate management options necessary to ensure the protection, preservation, and interpretation of the many significant aspects of the Park.</text></paragraph></subsection><subsection id="HC04B13492AA84C5D9C067F92E2496B36"><enum>(b)</enum><header>Boundary</header><text display-inline="yes-display-inline">The Park shall consist of the approximately ___ acres generally depicted as <quote>____</quote> on the map titled <quote>________</quote> and dated ______.</text></subsection></section><section id="HB86E8E0FCBB94FA1BE6742A521AB3BDD"><enum>5.</enum><header>Administration</header><subsection id="H9D66266A4955406EB6B3F7FDF79A698F"><enum>(a)</enum><header>In general</header><text>The Secretary shall administer land within the boundary of the Park in accordance with—</text><paragraph id="HE27B25136EDD4BA2B731B11229D4E4DC"><enum>(1)</enum><text>this Act; and</text></paragraph><paragraph id="H3D438F7D7877469E8285EAF4D2583AD7"><enum>(2)</enum><text>the laws generally applicable to units of the National Park System, including—</text><subparagraph id="HA5251CED8A45478CB5CC95552FF98114"><enum>(A)</enum><text>section 100101(a), chapter 1003, and sections 100751(a), 100752, 100753, and 102101 of title 54, United States Code; and</text></subparagraph><subparagraph id="H18CDA2B241024E4387E84913EA55CEAC"><enum>(B)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/54/3201">chapter 3201</external-xref> of title 54, United States Code.</text></subparagraph></paragraph></subsection><subsection id="H53E93CA14C4E41B38503A838ED97DA26"><enum>(b)</enum><header>Cooperative agreements</header><text>The Secretary may enter into cooperative agreements with the State or other public and nonpublic entities, under which the Secretary may identify, interpret, and provide assistance for the preservation of non-Federal land within the boundaries of the Park and at sites in close proximity to the Park, but located outside the boundaries of the Park, including providing for placement of directional and interpretive signage, exhibits, and technology-based interpretive devices.</text></subsection><subsection id="HE6121D6A68C2406B86480DA499796EA3"><enum>(c)</enum><header>Acquisition of land</header><text>The Secretary may acquire for inclusion in the Park any land (including interests in land), buildings, or structures owned by the State or any other political, private, or nonprofit entity by donation, transfer, exchange, or purchase from a willing seller.</text></subsection><subsection id="H2A2988EB51674674907E2E2A17AB7D21"><enum>(d)</enum><header>Technical and preservation assistance</header><text>The Secretary may provide public interpretation and technical assistance for the preservation of historic structures of, the maintenance of the cultural landscape of, and local preservation planning for, related historic and cultural resources within the boundaries of the Park.</text></subsection><subsection id="H22F76674858C461CB9DF55104B082F54"><enum>(e)</enum><header>Management plan</header><text>Not later than 3 fiscal years after the date on which funds are first made available to carry out this Act, the Secretary, in consultation with the State, shall complete a general management plan for the Park in accordance with—</text><paragraph id="HE99C15F98F0D42B1AF78A9CC40E7CC4B"><enum>(1)</enum><text>section 100502 of title 54, United States Code; and</text></paragraph><paragraph id="H3E79FBAB77784449899A3324F52E1FF5"><enum>(2)</enum><text>any other applicable laws.</text></paragraph></subsection><subsection id="HBF91957C613649FD8311F30E8BE4AA54"><enum>(f)</enum><header>No buffer zone created</header><text display-inline="yes-display-inline">Nothing in this Act, the acquisition of the land or an interest in land authorized by this Act, or the management plan for the Park shall be construed to create buffer zones outside of the Park. That activities or uses can be seen, heard, or detected from the acquired land shall not preclude, limit, control, regulate, or determine the conduct or management of activities or uses outside of the Park.</text></subsection><subsection id="HBD74CB4C48FB4ED38ED276C6878309EF"><enum>(g)</enum><header>Eminent domain or condemnation</header><text display-inline="yes-display-inline">In carrying out this Act, the Secretary of the Interior may not use eminent domain or condemnation.</text></subsection><subsection id="H122B0D228FFD41A88E3BA1069C49E6C8"><enum>(h)</enum><header>Effect</header><text>Nothing in this Act modifies any authority of the Federal Government to carry out Federal laws on Federal land located in the Park.</text></subsection></section></legis-body></bill>
