R. 8154</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220621">June 21, 2022</action-date><action-desc><sponsor name-id="B001292">Mr. Beyer</sponsor> (for himself, <cosponsor name-id="L000582">Mr. Lieu</cosponsor>, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, and <cosponsor name-id="R000515">Mr. Rush</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit use of facial recognition technology on any image acquired by body-worn cameras of law enforcement officers, and for other purposes.</official-title></form><legis-body id="H33185D242CA8401E8FB78E24DC539EDC" style="OLC"><section id="H46B1203F442849D18114DEE9241EE8F7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Facial Recognition Ban on Body Cameras Act</short-title></quote>.</text></section><section id="H4623619C61ED420DBCBED6DBA43B3EA5"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H021370BFEA9C40EF887EC303F09EE05F"><enum>(1)</enum><text>Facial recognition and other remote biometric surveillance technology pose unique and significant threats to the civil rights and civil liberties of residents and visitors.</text></paragraph><paragraph id="H6FFAF964BDCD4141847CFF38A574A0B6"><enum>(2)</enum><text>The use of facial recognition and other remote biometric surveillance is the functional equivalent of requiring every person to show a personal photo identification card at all times in violation of recognized constitutional rights. This technology also allows people to be tracked without consent.</text></paragraph><paragraph id="H5B205157B8AF4143A015235B5C35540B"><enum>(3)</enum><text>It would also generate massive databases about law-abiding Americans, and may chill the exercise of free speech in public places.</text></paragraph><paragraph id="HD9269CF43D134B7198375F18994C345C"><enum>(4)</enum><text display-inline="yes-display-inline">Facial recognition and other remote biometric surveillance technology has been repeatedly demonstrated to misidentify women, young people, people with disabilities, transgender people, and people of color and to create an elevated risk of harmful “false positive” identifications.</text></paragraph><paragraph id="HD67BC23629504FFC93C6DD7C90A742F9"><enum>(5)</enum><text>Facial and other remote biometric surveillance would corrupt the core purpose of officer-worn body-worn cameras by transforming those devices from transparency and accountability tools into roving surveillance systems.</text></paragraph><paragraph id="H3E05BCB5509244A9A4C39EDD4ED8C025"><enum>(6)</enum><text>The use of facial recognition and other remote biometric surveillance would disproportionately impact the civil rights and civil liberties of persons who live in highly policed communities.</text></paragraph><paragraph id="H817C0D09F930496FAEE1F3B6CC3586DA"><enum>(7)</enum><text>Its use would also diminish effective policing and public safety by discouraging people in these communities, including victims of crime, undocumented persons, people with unpaid fines and fees, and those with prior criminal history from seeking police assistance or from assisting the police.</text></paragraph></section><section id="HC0A13747AF3C4B2ABA0C116A706E4E87"><enum>3.</enum><header>Prohibiting use of facial recognition technology and other remote biometric surveillance systems</header><subsection id="H53042647A81F4CB892E7851ECBB65522"><enum>(a)</enum><header>Federal Financial Assistance</header><text display-inline="yes-display-inline">Beginning on the first day of the first fiscal year beginning after the date of the enactment of this Act, a State or unit of local government is ineligible to receive Federal financial assistance under the Byrne grant program under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 unless the State or unit of local government is complying with a law or policy that is substantially similar to the prohibition set forth in section 4.</text></subsection><subsection id="HF7C2318BC298454FA2F72C5DB3074A78"><enum>(b)</enum><header>Rule of Construction</header><text>Nothing in this section may be construed to preempt or supersede any Federal, State, or local law that imposes a more stringent limitation than the prohibition set forth in section 4.</text></subsection></section><section id="HDF05D600BFAD4C0783416DF213D2D3A6"><enum>4.</enum><header>Federal prohibition</header><text display-inline="no-display-inline">A Federal law enforcement agency may not use facial recognition technology or other remote biometric surveillance systems on any image acquired by body-worn cameras of law enforcement officers.</text></section><section id="HD18C7AE5C8614629BDFE970C8AB82C59"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HEBC5D4D500F4469EA1B0A592F6FC5AEC"><enum>(1)</enum><header>Biometic surveillance system</header><text display-inline="yes-display-inline">The term <quote>biometric surveillance system</quote> means any computer software or application that performs facial recognition or other remote biometric surveillance.</text></paragraph><paragraph id="H90AC8A0FD4B046EF820C7F78207C49B8"><enum>(2)</enum><header>Body-worn camera</header><text display-inline="yes-display-inline">The term <quote>body-worn camera</quote> means an officer camera or similar device that records or transmits images or sound and is attached to the body or clothing of, or carried by, a law enforcement officer.</text></paragraph><paragraph id="HA620E9ED77B941CF9122E30CB67ADE1D"><enum>(3)</enum><header>Facial recognition</header><text>The term <quote>facial recognition</quote> means an automated or semi-automated process that—</text><subparagraph id="H4AE8BFB270074612AE8D58FA9D24C3C2"><enum>(A)</enum><text>assists in identifying an individual, capturing information about an individual, or otherwise generating or assisting in generating surveillance information about an individual based on the physical characteristics of the individual’s face; or</text></subparagraph><subparagraph id="H912620AF1401416E966A7AA264B4F606"><enum>(B)</enum><text>logs characteristics of an individual’s face, head, or body to infer emotion, associations, activities, or the location of an individual.</text></subparagraph></paragraph><paragraph id="H89A33D6D625A426F8A02F22A2F799A31"><enum>(4)</enum><header>Other remote biometric recognition</header><text>The term <quote>other remote biometric recognition</quote>—</text><subparagraph id="HB9170ED3041F4C98B9FB480398528B7A"><enum>(A)</enum><text>means an automated or semi-automated process that—</text><clause id="H4B62B93C50B64BF285D16A5CB5DE29DE"><enum>(i)</enum><text>assists in identifying an individual, capturing information about an individual, or otherwise generating or assisting in generating surveillance information about an individual based on the characteristics of the individual’s gait or other immutable characteristic ascertained from a distance;</text></clause><clause id="H52806D65738C4BA4B62A0E158EA3FD9A"><enum>(ii)</enum><text>uses voice recognition technology; or</text></clause><clause id="H9343FCD8C5BA485B9EE7F2BAA2746EDF"><enum>(iii)</enum><text>logs such characteristics to infer emotion, associations, activities, or the location of an individual; and</text></clause></subparagraph><subparagraph id="H22EA36F9721D4348BB563953C1AD296C"><enum>(B)</enum><text>does not include identification based on fingerprints or palm prints.</text></subparagraph></paragraph><paragraph id="H12DF4FCC50B640C7B7B12B3BEA106ACF"><enum>(5)</enum><header>Use</header><text>The term <quote>use</quote> means one or both of the following:</text><subparagraph id="HFB2A1677A51F4CC9B2E752750DC4E97E"><enum>(A)</enum><text display-inline="yes-display-inline">The direct use of a biometric surveillance system by a law enforcement officer or a law enforcement agency.</text></subparagraph><subparagraph id="HF42FA1DBC18C46AAB5C8F92B7EBB372E"><enum>(B)</enum><text display-inline="yes-display-inline">A request or agreement by a law enforcement officer or law enforcement agency that another law enforcement agency or other third party use a biometric surveillance system on behalf of the requesting officer or agency.</text></subparagraph></paragraph></section></legis-body></bill>
