 Mrs. Spartz introduced the following bill; which was referred to the 
 Committee on Energy and Commerce, and in addition to the Committee on 
   Ways and Means, for a period to be subsequently determined by the 
  Speaker, in each case for consideration of such provisions as fall 
           within the jurisdiction of the committee concerned

To amend title XVIII of the Social Security Act to repeal the Obamacare 
        ban on provider-owned hospitals, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Flexibility in Hospital Ownership 
Act''.

SEC. 2. REPEALING REQUIREMENTS FOR HOSPITALS TO QUALIFY FOR RURAL 
              PROVIDER AND HOSPITAL EXCEPTION TO OWNERSHIP OR 
              INVESTMENT PROHIBITION AND DISCLOSURE REQUIREMENTS FOR 
              IN-OFFICE ANCILLARY SERVICES EXCEPTION TO SELF-REFERRAL 
              PROHIBITION FOR CERTAIN IMAGING SERVICES.

    Section 1877 of the Social Security Act (42 U.S.C. 1395nn) is 
amended--
            (1) in subsection (b)(2), in the matter following 
        subparagraph (B), by striking the last sentence;
            (2) in subsection (d)(2)--
                    (A) in subparagraph (A), at the end, by inserting 
                ``and'';
                    (B) in subparagraph (B), at the end, by striking 
                ``; and'' and inserting a period; and
                    (C) by striking subparagraph (C);
            (3) in subsection (d)(3)--
                    (A) in subparagraph (B), at the end, by inserting 
                ``and'';
                    (B) in subparagraph (C), at the end, by striking 
                ``; and'' and inserting a period; and
                    (C) by striking subparagraph (D); and
            (4) by striking subsection (i).
