Chávez and the Farmworker Movement National Historical Park in the States of California and Arizona, and for other purposes.</official-title></form><legis-body id="H311CBA7B5A5C47DAA93787FA6734FF3A" style="OLC"><section id="HDF5C79DFDCBF48E1BB821250B4BFDB0C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>César E. Chávez and the Farmworker Movement National Historical Park Act</short-title></quote>.</text></section><section id="H6DB6E9F8083A45ADA5301CA33E8C69F5" section-type="subsequent-section"><enum>2.</enum><header>Findings and purpose</header><subsection id="HF23C5A965F13492091C5A74AF6D733C4"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds as follows:</text><paragraph id="H8FC5DCD20FF04E66B157D639160EDA07"><enum>(1)</enum><text>The César E. Chávez National Monument was established by Presidential Proclamation 8884 on October 8, 2012, for the purposes of protecting and interpreting the nationally significant resources associated with the property in Keene, California, known as <quote>Nuestra Señora Reina de la Paz</quote>.</text></paragraph><paragraph id="HBCE8955E6AB94983A341F420D7D75E5D"><enum>(2)</enum><text>Nuestra Senora Reina de la Paz—</text><subparagraph id="H241FEBDEB6334C85A462C213118AA0FD"><enum>(A)</enum><text>served as the national headquarters of the United Farm Workers; and</text></subparagraph><subparagraph id="H2CB282C38FA5417FBDD1CA2782ACEA08"><enum>(B)</enum><text display-inline="yes-display-inline">was the home and workplace of César E. Chávez, the family of César E. Chávez, union members, and supporters of César E. Chávez.</text></subparagraph></paragraph><paragraph id="HDAAF3AF8BFF14661ADAD2A5195172314"><enum>(3)</enum><text>While the César E. Chávez National Monument marks the extraordinary achievements and contributions to the history of the United States by César Chávez and the farmworker movement, there are other significant sites in the States that are important to the story of the farmworker movement.</text></paragraph><paragraph id="H9DFCE679319742B8BD3EFAB3C7CB2297"><enum>(4)</enum><text>In the study conducted by the National Park Service entitled <quote>César Chávez Special Resource Study and Environmental Assessment</quote> and submitted to Congress on October 24, 2013, the National Park Service—</text><subparagraph id="H67D3C00E4E56468C9010B8240D7CD48B"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H25FEB4775D364E3B82B7C16F65D45462"><enum>(i)</enum><text display-inline="yes-display-inline">found that several sites associated with César E. Chávez and the farmworker movement—</text><subclause id="H31037791DB2C4564A099144CD727617B" indent="up1"><enum>(I)</enum><text>are suitable for inclusion in the National Park System; and</text></subclause><subclause id="HA8F15540912849EABF74406A90DEEC7A" indent="up1"><enum>(II)</enum><text>depict a distinct and important aspect of the history of the United States not otherwise adequately represented at existing units of the National Park System; and</text></subclause></clause><clause id="H11448B9BF17A4062A9BE75B589850A26" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">recommended that Congress establish a national historical park to honor the role that César E. Chávez played in lifting up the lives of farmworkers; and</text></clause></subparagraph><subparagraph id="H50F88A5A847D445492398F4EBECC25EE"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H64A25D7DD21A4EDE9E344E40923BE606"><enum>(i)</enum><text>found that the route of the 1966 march from Delano to Sacramento, California—</text><subclause id="H7A0DC4305CBA4FD98BB94C2046537027" indent="up1"><enum>(I)</enum><text>is eligible for National Historic Landmark status; and</text></subclause><subclause id="H2E537ABB07B34615ADD2C51265F549DE" indent="up1"><enum>(II)</enum><text>meets the criteria for designation as a national historic trail; and</text></subclause></clause><clause id="HBED9B147F7794FF1AFECC5DF0F259413" indent="up1"><enum>(ii)</enum><text>recommended that the National Park Service work with partner organizations and agencies to provide for interpretation programs along the route of the 1966 march from Delano to Sacramento, California.</text></clause></subparagraph></paragraph></subsection><subsection id="H6921B9299CEF49AE9DCCC5D09270DFBF"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to establish the César E. Chávez and the Farmworker Movement National Historical Park—</text><paragraph id="H9D3F9017753C48779682728C73A04A07"><enum>(1)</enum><text>to help preserve, protect, and interpret the nationally significant resources associated with César Chávez and the farmworker movement;</text></paragraph><paragraph id="HBE0BB6F2CE7A4266AA00C64F1629AF53"><enum>(2)</enum><text>to interpret and provide for a broader understanding of the extraordinary achievements and contributions to the history of the United States made by César Chávez and the farmworker movement; and</text></paragraph><paragraph id="H0FB8F5401DF14FEEA6D8CFB475D88254"><enum>(3)</enum><text>to support and enhance the network of sites and resources associated with César Chávez and the farmworker movement.</text></paragraph></subsection></section><section id="H319ADA86FBEB454E9525740866C6C367"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H3E9548A178664E38AE62D0607D54F4E1"><enum>(1)</enum><header>Historical park</header><text display-inline="yes-display-inline">The term <term>historical park</term> means the César E. Chávez and the Farmworker Movement National Historical Park established by section 4(a).</text></paragraph><paragraph id="HEE4C65E03B1D4D87B40B181B23BEADD5"><enum>(2)</enum><header>Map</header><text display-inline="yes-display-inline">The term <term>map</term> means the map entitled, <quote>César Chávez National Historical Park Proposed Boundary</quote>, numbered 502/179857, and dated March 2022.</text></paragraph><paragraph id="HA26F81F25B544050B17726EC3CD4ABDF"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="H7600FC19213541D88064C8E0618340CE"><enum>(4)</enum><header>States</header><text>The term <term>States</term> means— </text><subparagraph id="HE86A6EAA75B0440CA7950E874CB2408C"><enum>(A)</enum><text>the State of California; and</text></subparagraph><subparagraph id="HA3F1D7D44EE84CAD8DD2CC6530AB184B"><enum>(B)</enum><text>the State of Arizona.</text></subparagraph></paragraph></section><section id="H3DD1636A56E748B58C70F7DDBF19488C"><enum>4.</enum><header>César E. Chávez and the Farmworker Movement National Historical Park</header><subsection id="HD086123577414DA5BB14313756E0209D"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the States a unit of the National Park System to be known as the <quote>César E. Chávez and the Farmworker Movement National Historical Park</quote>.</text></subsection><subsection id="HCF346CAEC38541F4A5403311E9924624"><enum>(b)</enum><header>Boundary</header><text>The boundary of the historical park shall include the following areas, as generally depicted on the map:</text><paragraph id="HDBEE566540CC469B99E988BF6409EFA6"><enum>(1)</enum><text>The Forty Acres in Delano, California.</text></paragraph><paragraph id="H3CD0E3A6576D4B2A99F50C6598012194"><enum>(2)</enum><text>César E. Chávez National Monument, including Nuestra Señora Reina de la Paz, in Keene, California.</text></paragraph><paragraph id="H4C7D24C4981A43D5A5D06DA1F6CE32DA"><enum>(3)</enum><text>Santa Rita Center in Phoenix, Arizona.</text></paragraph></subsection><subsection id="H928A35D6A3B34BC39ECB90E7A8F6D1DC"><enum>(c)</enum><header>Additional site</header><text display-inline="yes-display-inline">On written agreement by the Secretary and the owner of the property indicating support for the inclusion, the Secretary may include within the boundary of the historical park McDonnell Hall in San Jose, California, as generally depicted on the map.</text></subsection><subsection id="H164D1AC5554540B38E83DC0AED847C3D"><enum>(d)</enum><header>Availability of map</header><text>The map shall be available for public inspection in the appropriate offices of the National Park Service.</text></subsection><subsection id="H5E2334CDA3E24693AA32D24EC89E468C"><enum>(e)</enum><header>Land acquisition</header><text>The Secretary may acquire land and interests in land that are within the boundary of the historical park by donation, purchase with donated or appropriated funds, or exchange.</text></subsection><subsection id="HD8094187EE634B8EB4F3E1207F6C67DB"><enum>(f)</enum><header>César E. Chávez national monument</header><text display-inline="yes-display-inline">Notwithstanding the inclusion of the César E. Chávez National Monument within the boundaries of the historical park, the César E. Chávez National Monument shall continue to be administered as a distinct and identifiable unit of the National Park System in accordance with Presidential Proclamation 8884 (<external-xref legal-doc="usc" parsable-cite="usc/54/320301">54 U.S.C. 320301</external-xref> note).</text></subsection><subsection id="H9861DAA0D5E9475DBEA096FCCB5205D9"><enum>(g)</enum><header>Administration</header><paragraph id="HBE468BCA7E3F4AF2BBE00026436E42F6"><enum>(1)</enum><header>In general</header><text>The Secretary shall administer the historical park in accordance with—</text><subparagraph id="H5364511369C5401396F35AA903C4F4F2"><enum>(A)</enum><text>this section; and</text></subparagraph><subparagraph id="HBB311E5C0D7A4FD5B4CAE287E78F0EF2"><enum>(B)</enum><text>the laws generally applicable to units of the National Park System, including—</text><clause id="H358E0960041F43AE8AEED064E6E4FF60"><enum>(i)</enum><text>section 100101(a), chapter 1003, and sections 100751(a), 100752, 100753, and 102101 of title 54, United States Code; and</text></clause><clause id="HB11CDDBE4FE34B1AA99CC59D06A8AF2F"><enum>(ii)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/54/3201">chapter 3201</external-xref> of title 54, United States Code.</text></clause></subparagraph></paragraph><paragraph id="HF769E39AFD5B49AB83F8C2609A7AEF0A"><enum>(2)</enum><header>Interpretation</header><text display-inline="yes-display-inline">The Secretary may provide technical assistance and public interpretation of historic sites, museums, and resources on land not administered by the Secretary relating to the life of César E. Chávez and the history of the farmworker movement.</text></paragraph><paragraph id="H4D20C3751E044CA184460D294DD24422"><enum>(3)</enum><header>Cooperative agreements</header><text display-inline="yes-display-inline">The Secretary may enter into cooperative agreements with the States, local governments, public and private organizations, and individuals to provide for the preservation, development, interpretation, and use of the historical park.</text></paragraph></subsection><subsection id="H0CFDE8D9930B4F52B6A4259C51CB3C36"><enum>(h)</enum><header>General management plan</header><paragraph id="H00B53EFA3165479A956CCCC30C8306B9"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date on which funds are made available to carry out this section, the Secretary shall prepare a general management plan for the historical park in accordance with section 100502 of title 54, United States Code.</text></paragraph><paragraph id="H79A0B1EBE8BA4499A782ED9EE8BEDD01"><enum>(2)</enum><header>Additional sites</header><subparagraph id="H62D9DE46E35747F183764902C31C4DBB"><enum>(A)</enum><header>In general</header><text>The general management plan shall include a determination of whether there are—</text><clause id="HBD9416664632492DAEAB8C84D21FF8EE"><enum>(i)</enum><text>sites located in the Coachella Valley in the State of California that were reviewed in the Study that should be added to the historical park;</text></clause><clause id="H3A85966013B74D47B555B9E415D9A958"><enum>(ii)</enum><text>additional representative sites in the States that were reviewed in the Study that should be added to the historical park; or</text></clause><clause id="HD088750463CC4479B78AA33B133F9018"><enum>(iii)</enum><text>sites outside of the States in the United States that relate to the farmworker movement that should be linked to, and interpreted at, the historical park.</text></clause></subparagraph><subparagraph id="H6864A597623E43288C0E078C3643176C"><enum>(B)</enum><header>Inclusion</header><text>On a determination by the Secretary under subparagraph (A) that an additional site is appropriate for inclusion in the historical park, the Secretary may, with the consent of the owner of the applicable site, incorporate the applicable site into the historical park by publishing notice in the Federal Register of the inclusion of the site in the historical park.</text></subparagraph></paragraph><paragraph id="HBBF064548AE44A7E92ACEA2E43650BD5"><enum>(3)</enum><header>Consultation</header><text>The general management plan under paragraph (1) shall be prepared in consultation with—</text><subparagraph id="H921BBA7AD5284A4D96E15C9FDC28A491"><enum>(A)</enum><text>any owner of land that is included within the boundaries of the historical park; and</text></subparagraph><subparagraph id="H1834F38A2A65491B8C20A089601050AA"><enum>(B)</enum><text>appropriate Federal, State, and Tribal agencies, public and private organizations, and individuals, including—</text><clause id="HEA10CB59B802444483EB60710947D869"><enum>(i)</enum><text display-inline="yes-display-inline">the National Chávez Center; and</text></clause><clause id="HA14806A956BC479A891EACC7A0D72958"><enum>(ii)</enum><text display-inline="yes-display-inline">the César Chávez Foundation.</text></clause></subparagraph></paragraph></subsection></section><section id="H899F8ACB6AE64A6E833D134BEFA36F55"><enum>5.</enum><header>Farmworker Peregrinación National Historical Trail</header><text display-inline="no-display-inline">Section 5(a) of the National Trails System Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1244">16 U.S.C. 1244(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HE3808C26FC7E4D1A9D1D99E73ED9790D" display-inline="no-display-inline"><paragraph id="HC583B7CACCFC4F8BAA74A74E8AF772D5"><enum>(31)</enum><header>Farmworker Peregrinación national historic trail</header><subparagraph id="H167B846703A747D3B29D663E94C33E27"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Farmworker Peregrinación National Historic Trail (referred to in this paragraph as the <quote>trail</quote>), a route of approximately 300 miles taken by farmworkers between Delano and Sacramento, California, in 1966, as generally depicted as <quote>Alternative C</quote> in the study conducted by the National Park Service entitled <quote>César Chávez Special Resource Study and Environmental Assessment</quote> and submitted to Congress on October 24, 2013.</text></subparagraph><subparagraph id="HFD93133E379843A484219D828A055639"><enum>(B)</enum><header>Map</header><text>A map describing the trail shall be on file and available for public inspection in the appropriate offices of the National Park Service.</text></subparagraph><subparagraph id="H5E160E84E37446B390B44F651593B22F"><enum>(C)</enum><header>Administration</header><text>The trail shall be administered by the Secretary of the Interior, in consultation with—</text><clause id="H3D2C4F60769A453ABA2853D5E81634A0"><enum>(i)</enum><text>other Federal, State, Tribal, regional, and local agencies; and</text></clause><clause id="HF527126B16994E93BFB7AFE30C1987D2"><enum>(ii)</enum><text>the private sector.</text></clause></subparagraph><subparagraph id="H8E7C699705E04BAFAE8E120FE99AB7BC"><enum>(D)</enum><header>Land acquisition</header><text>The United States shall not acquire for the trail any land or interest in land outside the exterior boundary of any federally managed area without the consent of the owner of the land or interest in land.</text></subparagraph><subparagraph id="H8989D6010BE9453EA16FA2F0517F7B4F"><enum>(E)</enum><header>Cooperative agreements</header><text>The Secretary of the Interior may enter into cooperative agreements with interested entities to provide for the preservation, development, interpretation, and use of the trail.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
