R. 8042</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220613">June 13, 2022</action-date><action-desc><sponsor name-id="N000026">Mr. Nehls</sponsor> (for himself, <cosponsor name-id="B000825">Mrs. Boebert</cosponsor>, <cosponsor name-id="B001274">Mr. Brooks</cosponsor>, <cosponsor name-id="C001116">Mr. Clyde</cosponsor>, <cosponsor name-id="L000578">Mr. LaMalfa</cosponsor>, <cosponsor name-id="P000605">Mr. Perry</cosponsor>, and <cosponsor name-id="S001214">Mr. Steube</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Transportation to rescind certain no fly zone restrictions, and for other purposes.</official-title></form><legis-body id="H413655B91FF341E487DFC688EF9CA8F1" style="OLC"><section id="HD9F38BCAF85342EF94F6E9E680FDE89A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Airlines Independent of Restrictions Act </short-title></quote> or the <quote><short-title>AIR Act</short-title></quote>. </text></section><section id="H83D0BB3407204BA3BB74051D28AE67D0" section-type="subsequent-section"><enum>2.</enum><header>No fly zone repeal</header><subsection id="H5A410243519044EDB3FCDB3D7A3ADC87"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, beginning on the date of enactment of this Act, the Secretary of Transportation shall rescind the Federal Aviation Administration Notices to Airmen FDC 4/3634 and FDC 4/3635 and stop maintaining the restrictions imposed under such notices.</text></subsection><subsection id="HF24F14FDCE36477FBA67A92F2B60D535"><enum>(b)</enum><header>Limitation of authority</header><paragraph id="H32E876E48868400E90ABC9A73079D17C"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law and except as provided in paragraph (2), the Secretary of Transportation may not issue a regulation or a Notice to Air Missions to impose a no fly zone over the covered airspace for a period longer than 30 days.</text></paragraph><paragraph id="H05DA5F2743E24453B157F88312CDD00C"><enum>(2)</enum><header>Exception</header><text>The Secretary may issue a regulation or Notice to Air Missions to impose a no fly zone over the covered airspace for a period longer than 30 days if the Secretary of Transportation, the Secretary of Homeland Security, or the Secretary of Defense transmits to Congress a justification identifying the national security concerns and rationale for imposing such a no fly zone of the covered airspace for longer than 30 days.</text></paragraph></subsection><subsection id="H8BD30E128BEC40E9BEDB65E129BC638D"><enum>(c)</enum><header>Covered airspace defined</header><text display-inline="yes-display-inline">In this section, the term <quote>covered airspace</quote> means the airspace covered under the no fly zone imposed under the Federal Aviation Administration Notices to Airmen FDC 4/3634 and FDC 4/3635.</text></subsection></section></legis-body></bill>
