which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 40, United States Code, to prohibit the distribution of Federal funds to certain entities related to the People’s Republic of China for certain public works projects, and for other purposes.</official-title></form><legis-body id="H4AB7013315424D3C8B5ECFC0FA5C493D" style="OLC"><section id="HECD5488B0FB646E087A9431496F981C0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Communist Construction of Public Infrastructure Act of 2022</short-title></quote> or the <quote><short-title>Stop CCP Infrastructure Act of 2022</short-title></quote>. </text></section><section id="HFBB0CCCBD4894FB5B5968589C73C8204" section-type="subsequent-section"><enum>2.</enum><header>Restriction of entities from using Federal funds from engaging, entering into, and awarding public works contracts</header><subsection id="H0B84AFD1222F4B57885B1E39DD691D80"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/33">Chapter 33</external-xref> of title 40, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H5929F83677F240C2892C353C1BCD410F" display-inline="no-display-inline"><section id="H6C9AB543A4B94514AB24B690CAB5B9CD"><enum>3320.</enum><header>Restriction of entities from using Federal funds to engage, enter into, and award public works contracts</header><subsection id="H0C16EE19231F471C8A04A53AA6CD1B21"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, Federal funds may not be provided to any covered entity for any covered public works project.</text></subsection><subsection id="H76D89AB36F11437CA800554437EEBB0B" display-inline="no-display-inline"><enum>(b)</enum><header>Requirements</header><text>Any entity receiving funds for any covered public works project shall be free from any obligations, influences, or connections to any covered entity.</text></subsection><subsection id="H7033A8611C9E4C2A995B4987C85825AA"><enum>(c)</enum><header>Exception</header><text display-inline="yes-display-inline">This section shall only apply to projects that are located in the United States. </text></subsection><subsection id="H5893A967CDB34B59AB818F9374B60408"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H410AFB4537D049FC9D8F5DBD751BD764"><enum>(1)</enum><header>Covered entity</header><text>The term <quote>covered entity</quote> means any entity that—</text><subparagraph id="HAA7002B13BA349799EBE9431DD7660D0"><enum>(A)</enum><text>is headquartered in China;</text></subparagraph><subparagraph id="HAA9D25EEE30A454D8A9729631229BCC6"><enum>(B)</enum><text display-inline="yes-display-inline">is owned, directed, controlled, financed, or influenced directly or indirectly by the Government of the People’s Republic of China, the CCP, or the Chinese military, including any entity for which the Government of the People’s Republic of China, the CCP, or the Chinese military have the ability, through ownership of a majority or a dominant minority of the total outstanding voting interest in an entity, board representation, proxy voting, a special share, contractual arrangements, formal or informal arrangements to act in concert, or other means, to determine, direct, or decide for an entity in an important manner; or </text></subparagraph><subparagraph id="H91ED96536D1F4ED7B788C5D81ABDD411"><enum>(C)</enum><text>is a parent, subsidiary, or affiliate of any entity described in subparagraph (B).</text></subparagraph></paragraph><paragraph id="H3DF7515D14164B0181B6FB5A5FB3EE7C"><enum>(2)</enum><header>Covered public works project</header><text display-inline="yes-display-inline">The term <quote>covered public works project</quote> means any project of the construction, repair, renovation, or maintenance of public buildings, structures, sewers, water works, roads, bridges, docks, underpasses and viaducts, as well as any other improvement to be constructed, repaired or renovated or maintained on public property to be paid, in whole or in part, with public funds or with financing to be retired with public funds in the form of lease payments or otherwise.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCB506271212E4A4C8FC4B2F35C668FBD"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/33">chapter 33</external-xref> of title 40, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H60C37B9C270143FAAB41B3264B6B64A9" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">3320. Restriction of entities from using Federal funds to engage, enter into, and award public works contracts.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD67A809278884A58974031D6E6165839"><enum>(c)</enum><header>Non-Federal public works</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/35">Chapter 35</external-xref> of title 40, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H548C6DB681604C4FB53B7D15549343C7" display-inline="no-display-inline"><section id="HEB60BCF2349A48AD9E1A84A0C0EB2B41"><enum>3506.</enum><header>Restriction of States and local governments from using Federal funds to engage, enter into, and award public works contracts</header><subsection id="H44C87C72EB0C4B949C721A04340D8653"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A State or local government receiving Federal funds may not provide such funds to any covered entity for any covered public works project.</text></subsection><subsection id="HEE74A43C0C7A4A5A87CBB41D4F318D64"><enum>(b)</enum><header>Requirements</header><text>A State or local government shall verify that any entity receiving funds for any covered public works project is free from any obligations, influences, or connections to any covered entity.</text></subsection><subsection id="H833B54A9B7344D2FBF494A90AC14DAC9"><enum>(c)</enum><header>Exception</header><text display-inline="yes-display-inline">This section shall only apply to projects that are located in a State. </text></subsection><subsection id="H05F1F1AD98D747C58A96C17C8A7AE599"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H9FE2718A655C4EF2B4E87C6A15D2F677"><enum>(1)</enum><header>Covered entity</header><text>The term <quote>covered entity</quote> means any entity that—</text><subparagraph id="H3D510054DB174171A4BA5096033FA692"><enum>(A)</enum><text>is headquartered in China;</text></subparagraph><subparagraph id="H633F16A2A39C4A1C9551EBFBA5E30C4E"><enum>(B)</enum><text display-inline="yes-display-inline">is owned, directed, controlled, financed, or influenced directly or indirectly by the Government of the People’s Republic of China, the CCP, or the Chinese military, including any entity for which the Government of the People’s Republic of China, the CCP, or the Chinese military have the ability, through ownership of a majority or a dominant minority of the total outstanding voting interest in an entity, board representation, proxy voting, a special share, contractual arrangements, formal or informal arrangements to act in concert, or other means, to determine, direct, or decide for an entity in an important manner; or </text></subparagraph><subparagraph id="H1B9AFD72E7B844FD8CBE0F84955E351E"><enum>(C)</enum><text>is a parent, subsidiary, or affiliate of any entity described in subparagraph (B).</text></subparagraph></paragraph><paragraph id="HB0C69A8B985A4C21AC5775C3D6D81F03"><enum>(2)</enum><header>Covered public works project</header><text display-inline="yes-display-inline">The term <quote>covered public works project</quote> means any project of the construction, repair, renovation, or maintenance of public buildings, structures, sewers, water works, roads, bridges, docks, underpasses and viaducts, as well as any other improvement to be constructed, repaired or renovated or maintained on public property to be paid, in whole or in part, with public funds or with financing to be retired with public funds in the form of lease payments or otherwise.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA463ADA521114AED804C0FE04AD51002"><enum>(d)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/35">chapter 35</external-xref> of title 40, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="HCA4738D438BD426BBD9F56448A215800" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">3506. Restriction of States and local governments from using Federal funds to engage, enter into, and award public works contracts. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA0D92851C9C44BE5A8F8E4B9B0968AE9"><enum>(e)</enum><header>Updating regulations</header><text display-inline="yes-display-inline">The Federal Acquisition Regulation and the Defense Federal Acquisition Regulation shall be revised to implement the provisions of this Act.</text></subsection><subsection id="HF35CDD09A3214EC19D282070EFE8BDB7"><enum>(f)</enum><header>Rule of applicability</header><text>The amendments made by this section shall take effect, and shall apply to projects beginning on or after, 180 days after the date of enactment of this Act. </text></subsection></section></legis-body></bill>
