<section id="H0899E043B89D46D0A9EC823F7F1EEA5E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Schools Act</short-title></quote>.</text></section> <section section-type="subsequent-section" id="H0C027B354C8F49CBB204ADABC50A5E60"><enum>2.</enum><header>Additional funds for school security</header> <subsection id="HD0385137E049426583835B44CFD6338B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of an ESSERF program or any other law, a State or local educational agency that has received funds under an ESSERF program may, in lieu of the original requested or authorized use for such funds, use a portion of, or all, of the unexpended funds to carry out 1 or more school security measures. </text></subsection>
<subsection id="H9E9C2D87C1DD4893B1432E1AB890CEFD"><enum>(b)</enum><header>No Federal interference</header><text>The Secretary of Education shall not—</text> <paragraph id="H78BDE347E7B4413286F81ABBA0857A62"><enum>(1)</enum><text>prevent or discourage any State or local educational agency from using any ESSERF program funds for school security measures; </text></paragraph>
<paragraph id="HC8B8E7D0EEAD4B06884A35EDBEDABA38"><enum>(2)</enum><text>require the use of funds under subsection (a) to be in response to, or in any way connected with, the coronavirus; or</text></paragraph> <paragraph id="H27961AACC3704D1B95A5FEBE5EB40476"><enum>(3)</enum><text>enforce any requirement of an ESSERF program if such requirement would prevent a State or local educational agency from carrying out a school security measure authorized under subsection (a).</text></paragraph></subsection>
<subsection id="HB327B72200F94F87AEF5A0CE629D81CA"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H10058DD824EF4401AA98024E5CF8F0D1"><enum>(1)</enum><header>ESSERF program</header><text>The term <term>ESSERF program</term> means a program carried out under—</text>
<subparagraph id="H0765CF8F82C04C9F9334C506D2024362"><enum>(A)</enum><text>section 18003 of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/20/3401">20 U.S.C. 3401</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>);</text></subparagraph> <subparagraph id="HB379CABEBF3842AC9706FBA653C99634"><enum>(B)</enum><text>section 313 of division M of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; 134 Stat. 1929); or </text></subparagraph>
<subparagraph id="H1675543FF5E1416AB0E4A7FCA7693AB9" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>section 2001 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>; 135 Stat. 19). </text></subparagraph></paragraph> <paragraph id="HA33A02520C8341CE83FE93C5E76769E9"><enum>(2)</enum><header>School security measure</header><text>The term <term>school security measure</term> means any of the following:</text>
<subparagraph id="H52ED1498369F447D82CDFBB9810F4A05"><enum>(A)</enum><text>An evidence-based strategy or program to prevent violence, which may include the use of appropriate technologies, including the placement and use of metal detectors and other deterrent measures and emergency notification and response technologies.</text></subparagraph> <subparagraph id="HE8864A517F4C41A3A281692F2185AF1C"><enum>(B)</enum><text>Training to prevent student violence against others and self, including training for local law enforcement officers, school personnel, and students.</text></subparagraph>
<subparagraph id="H10A56868D16A4106B8E353DD371F72B4"><enum>(C)</enum><text>The development and operation of an anonymous reporting system for threats of school violence, including a mobile telephone application, hotline, or internet website.</text></subparagraph> <subparagraph id="H21367C77E02A41378CA2BDD0B92DD7D5"><enum>(D)</enum><text>The development and operation of—</text>
<clause id="HA5E4FD0C93C74F3FAB62D84FB3CA17E3"><enum>(i)</enum><text>a school threat assessment and intervention team that may include coordination with law enforcement agencies and school personnel; and</text></clause> <clause id="H9CB4BCF51D7C482588929E3D174F745A"><enum>(ii)</enum><text>specialized training for school officials in responding to mental health crises.</text></clause></subparagraph>
<subparagraph id="H5389520C69AA4DB0A667CEDDFFAE5BA6"><enum>(E)</enum><text> Coordination with local law enforcement agencies.</text></subparagraph> <subparagraph id="H9793D28BC42C41F59C7E982FCA4B3D0F"><enum>(F)</enum><text>A security assessment.</text></subparagraph>
<subparagraph id="HF1D7CFC71F614DFEBB1E46429722C1ED"><enum>(G)</enum><text>Security training of personnel and students.</text></subparagraph> <subparagraph id="H6F1257579565416BAB1570FB6545EEAD"><enum>(H)</enum><text>Acquisition and installation of technology for expedited notification of local law enforcement during an emergency.</text></subparagraph>
<subparagraph id="HF1A58B8BD6FA42ABB3FD19E806B490F5"><enum>(I)</enum><text>Reinforcing or replacing classroom doors, locks, or window panels.</text></subparagraph> <subparagraph id="H296BC523CE2E478A82BA97FD7FC9069C"><enum>(J)</enum><text>Constructing fencing, bollards, planters, curbs, walls, or any other entry control measure to create a single point of entry to the campus.</text></subparagraph>
<subparagraph id="H4C7F2208FEFF4124AE8482B30A5A635A"><enum>(K)</enum><text>Clearing exterior spaces of foliage or structures to eliminate spaces that could conceal illicit activity, provide access to the building above the first floor, or otherwise aid an intruder.</text></subparagraph> <subparagraph id="H7AA9DE7F74CE4BF08EF8958E395B30F9"><enum>(L)</enum><text>Installing a system to monitor hallways, stairwells, and utility rooms, such as physical inspection or surveillance cameras.</text></subparagraph>
<subparagraph id="H3A2747F0A62C44E89FEFDB6CB81980C0" commented="no" display-inline="no-display-inline"><enum>(M)</enum><text>Hiring and paying the salaries of qualified individuals, such as retired law enforcement officers or military veterans, to serve as armed school resource officers.</text></subparagraph></paragraph></subsection></section> </legis-body></bill>
