R. 7997</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220609">June 9, 2022</action-date><action-desc><sponsor name-id="G000582">Miss González-Colón</sponsor> (for herself, <cosponsor name-id="S001200">Mr. Soto</cosponsor>, <cosponsor name-id="V000081">Ms. Velázquez</cosponsor>, <cosponsor name-id="S000168">Ms. Salazar</cosponsor>, <cosponsor name-id="C001111">Mr. Crist</cosponsor>, <cosponsor name-id="F000466">Mr. Fitzpatrick</cosponsor>, <cosponsor name-id="B001298">Mr. Bacon</cosponsor>, <cosponsor name-id="E000297">Mr. Espaillat</cosponsor>, and <cosponsor name-id="R000600">Mrs. Radewagen</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to establish a floor in Medicare Advantage benchmark rates for regions with low Medicare fee-for-service penetration and to make the Medicare Savings Program available in all jurisdictions.</official-title></form><legis-body id="H234C9F6B96DE4E5DAB6B80EE02EB33CC" style="OLC"><section id="H85D15F49CE49491885A764B8DF9680E4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Achieving Equity in the Treatment of Dual Eligible Beneficiaries Act</short-title></quote>.</text></section><section id="H05A3A22C44D449AEAE4F8E18EA66F864"><enum>2.</enum><header>Addressing disparities in Medicare Advantage benchmark levels based on penetration</header><subsection id="H7497E83D639848C19D3F53BCE6C64944"><enum>(a)</enum><header>In general</header><text>Section 1853(n) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-23">42 U.S.C. 1395w–23(n)</external-xref>) is amended—</text><paragraph id="HECCF1436CF61473FA39CC149FECB986B"><enum>(1)</enum><text>in paragraph (1)(B), by striking <quote>subsequent year</quote> and inserting <quote>subsequent year, subject to paragraph (6),</quote>; and</text></paragraph><paragraph id="H44930F1F12B649F1B4AF10755E9F4AF1"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="HD06077815E0449C78DF233A3CA5E9C8E" style="OLC"><paragraph id="H37C8AA6A43CC47709504194DFD63CD84"><enum>(6)</enum><header>Average geographic adjustment floor</header><text display-inline="yes-display-inline">For 2024 and subsequent years, when calculating the adjusted average per capita cost under section 1876(a)(4) for the purposes of establishing the base payment amount specified in paragraph (2)(E), the average geographic adjustment shall not be less than 0.70 for any area. For the purposes of the previous sentence, the Secretary may define the term <quote>average geographic adjustment</quote> under subparagraph (A) by program instruction or otherwise.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HAF4CF4AE3E994C3BB37C58EE7FE3B292"><enum>(b)</enum><header>Ensuring plan payments flow to providers and patients</header><text>Section 1854(a)(6) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-24">42 U.S.C. 1395w–24(a)(6)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block id="HD8D6437748F5496488494EE199F8F456" style="OLC"><subparagraph id="HECBABC51FCC94EE5A103BA585F9ADC0E"><enum>(C)</enum><header>Ensuring increased payments support care</header><text>With respect to the increase in blended benchmark amount attributable to the application of section 1853(n)(6), no less than 50 percent shall be directed toward payment for basic benefits as defined in section 1852(a)(1)(B).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H1490504F30114115812A6DAAD619423C"><enum>3.</enum><header>Expanding the Medicare Savings Program to the territories</header><text display-inline="no-display-inline">Section 1905(p)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(p)(4)</external-xref>) is amended by inserting <quote>for fiscal years through 2022</quote> after <quote>Columbia)</quote>.</text></section></legis-body></bill>
