<section section-type="section-one" id="H913E0FFAA4D74F37B409F87C61D110F6"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public and Federally Assisted Housing Fire Safety Act of 2022</short-title></quote>. </text></section> <section id="HECF91327655744A2904B456E0CAD63D4"><enum>2.</enum><header>Smoke alarms in federally assisted housing</header> <subsection id="H542A6B297C874597B649C24EACDA5211"><enum>(a)</enum><header>Public housing, tenant-Based assistance, and project-Based assistance</header><text>The United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437">42 U.S.C. 1437 et seq.</external-xref>) is amended—</text>
<paragraph id="H43FE906B16AA4056813887401D476204"><enum>(1)</enum><text>in section 3(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(a)</external-xref>), by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HE7D71468FEE44157B46437BB864B2E88"> <paragraph id="H77FBBB03DEE0414A928D1F3B1FE3B9E6"><enum>(9)</enum><header>Qualifying smoke alarms</header> <subparagraph id="H879C5F884BDC4156A1BABDAD322D5C78"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each public housing agency shall ensure that a qualifying smoke alarm is installed in accordance with applicable codes and standards published by the International Code Council or the National Fire Protection Association and the requirements of the National Fire Protection Association Standard 72, or any successor standard, in each level and in or near each sleeping area in any dwelling unit in public housing owned or operated by the public housing agency, including in basements but excepting crawl spaces and unfinished attics, and in each common area in a project containing such a dwelling unit.</text></subparagraph>
<subparagraph id="H9841CA53C75C4A93B3F7014865606218"><enum>(B)</enum><header>Definitions</header><text>For purposes of this paragraph, the following definitions shall apply:</text> <clause id="HB5469601E228458790879BC616FD5073"><enum>(i)</enum><header>Smoke alarm defined</header><text>The term <term>smoke alarm</term> has the meaning given the term <quote>smoke detector</quote> in section 29(d) of the Federal Fire Prevention and Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/2225">15 U.S.C. 2225(d)</external-xref>).</text></clause>
<clause id="H3C69B36AE9644FB4B1609B3AFD4F5840"><enum>(ii)</enum><header>Qualifying smoke alarm defined</header><text display-inline="yes-display-inline">The term <term>qualifying smoke alarm</term> means a smoke alarm that—</text> <subclause id="H57B97F9919044C4DA3BF852EDFF4F406"><enum>(I)</enum><text>in the case of a dwelling unit built before the date of enactment of this paragraph and not substantially rehabilitated after the date of enactment of this paragraph is—</text>
<item id="H562DDA45743C415790A85FDBA005F6D0"><enum>(aa)</enum><text>hardwired; or</text></item> <item id="H30668060FFB74B4C835B85B65A555A3A"><enum>(bb)</enum><text display-inline="yes-display-inline">uses 10-year non rechargeable, nonreplaceable primary batteries and—</text>
<subitem id="H881087A259314B9995075CA7D463C781"><enum>(AA)</enum><text>is sealed;</text></subitem> <subitem id="H77FCF1C7F41545EAB9C2F72FC3938E71"><enum>(BB)</enum><text>is tamper resistant;</text></subitem>
<subitem id="HC00CF167F9234E0987C7D08A74C55E7F"><enum>(CC)</enum><text>contains silencing means; and</text></subitem> <subitem id="HB7ECB28D750C420DAC6949B34F3B5ADA"><enum>(DD)</enum><text display-inline="yes-display-inline">provides notification for persons with hearing loss as required by the National Fire Protection Association Standard 72, or any successor standard; or</text></subitem></item></subclause>
<subclause id="HD778C03198774706A86D31C58BD92A91"><enum>(II)</enum><text>in the case of a dwelling unit built or substantially rehabilitated after the date of enactment of this paragraph, is hardwired.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H437A2ACBA8A645C897B0B60377358789"><enum>(2)</enum><text>in section 8 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>)—</text>
<subparagraph id="H2F5F46220E924295824CAA7E6B037AE7"><enum>(A)</enum><text>by inserting after subsection (k) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H130BDA5785F34DC8BAF0C6BEC0BBB41A"> <subsection id="HFA4BF345007F44D59595FB949A49B4E5"><enum>(l)</enum><header>Qualifying smoke alarms</header> <paragraph id="H712B3408C609412FB0E1A6C84C8005A6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each owner of a dwelling unit receiving project-based assistance under this section shall ensure that qualifying smoke alarms are installed in accordance with applicable codes and standards published by the International Code Council or the National Fire Protection Association and the requirements of the National Fire Protection Association Standard 72, or any successor standard, in each level and in or near each sleeping area in such dwelling unit, including in basements but excepting crawl spaces and unfinished attics, and in each common area in a project containing such a dwelling unit.</text></paragraph>
<paragraph id="H11CC2D9C805D499680868CA8F14C1DE2"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subsection, the following definitions shall apply:</text> <subparagraph id="H779443818F254AF692B5EA5E0B014E01"><enum>(A)</enum><header>Smoke alarm defined</header><text>The term <term>smoke alarm</term> has the meaning given the term <quote>smoke detector</quote> in section 29(d) of the Federal Fire Prevention and Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/2225">15 U.S.C. 2225(d)</external-xref>).</text></subparagraph>
<subparagraph id="H5F54BFB4839C420AB82DD1059DBA02AC"><enum>(B)</enum><header>Qualifying smoke alarm defined</header><text display-inline="yes-display-inline">The term <term>qualifying smoke alarm</term> means a smoke alarm that—</text> <clause id="HCD56A86408404DCAB1C65F1B8A5FAD62"><enum>(i)</enum><text>in the case of a dwelling unit built before the date of enactment of this paragraph and not substantially rehabilitated after the date of enactment of this paragraph is—</text>
<subclause id="H867322023C5B4D0C99E7704629A42473"><enum>(I)</enum><text>hardwired; or</text></subclause> <subclause id="HEBA09D07F38C4FECB105944C7F19F3D5"><enum>(II)</enum><text display-inline="yes-display-inline">uses 10-year non rechargeable, nonreplaceable primary batteries and—</text>
<item id="H5CB42625A1484AFDA9912D47813984F2"><enum>(aa)</enum><text>is sealed;</text></item> <item id="H7B9A76F99E3A4A5EA6986D6F81234A4B"><enum>(bb)</enum><text>is tamper resistant;</text></item>
<item id="HACF7FC5FF7B94782988B350BA34B42D8"><enum>(cc)</enum><text>contains silencing means; and</text></item> <item id="H00E9B915AD304D09BF1AF31EFD235B99"><enum>(dd)</enum><text display-inline="yes-display-inline">provides notification for persons with hearing loss as required by the National Fire Protection Association Standard 72, or any successor standard; or</text></item></subclause></clause>
<clause id="HE470BAE37C4A4E9286065D640F1A1F18"><enum>(ii)</enum><text>in the case of a dwelling unit built or substantially rehabilitated after the date of enactment of this paragraph, is hardwired.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HA893F04D1BC0400DAAAD29EEF3114E33"><enum>(B)</enum><text>in subsection (o), by adding at the end the following:</text>

<paragraph id="HF8E8F6CE082E4A499CE60896693233C6"><enum>(22)</enum><header>Qualifying smoke alarms</header>
<subparagraph id="HAB3E4141EA1D462B9099A9BD552092B2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each dwelling unit receiving tenant-based assistance or project-based assistance under this subsection shall have a qualifying smoke alarm installed in accordance with applicable codes and standards published by the International Code Council or the National Fire Protection Association and the requirements of the National Fire Protection Association Standard 72, or any successor standard, in each level and in or near each sleeping area in such dwelling unit, including in basements but excepting crawl spaces and unfinished attics, and in each common area in a project containing such a dwelling unit.</text></subparagraph> <subparagraph id="HF5DFF8513A174EA491C90F4CF0F34A0F"><enum>(B)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this paragraph, the following definitions shall apply:</text>
<clause display-inline="no-display-inline" id="H9A9593408900453F8F2B3DC61000D585"><enum>(i)</enum><header>Smoke alarm defined</header><text>The term <term>smoke alarm</term> has the meaning given the term <quote>smoke detector</quote> in section 29(d) of the Federal Fire Prevention and Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/2225">15 U.S.C. 2225(d)</external-xref>).</text></clause> <clause id="HAB4DBCF526F04A9B9A608DD511CD65EC"><enum>(ii)</enum><header>Qualifying smoke alarm defined</header><text display-inline="yes-display-inline">The term <term>qualifying smoke alarm</term> means a smoke alarm that—</text>
<subclause id="H2E209272F8BD425283AC04636B24A391"><enum>(I)</enum><text>in the case of a dwelling unit built before the date of enactment of this paragraph and not substantially rehabilitated after the date of enactment of this paragraph is—</text> <item id="HDF720BFD5189442A96F2C944AF01F675"><enum>(aa)</enum><text>hardwired; or</text></item>
<item id="HA32105A7CAD74461BBC9458B01B2A2E8"><enum>(bb)</enum><text display-inline="yes-display-inline">uses 10-year non rechargeable, nonreplaceable primary batteries and—</text> <subitem id="H197B1338BCFF4B05AE46B44C53C57F99"><enum>(AA)</enum><text>is sealed;</text></subitem>
<subitem id="H7C126613691F48EBA80B6CD03E1516F1"><enum>(BB)</enum><text>is tamper resistant;</text></subitem> <subitem id="H2E155DA61F354A4080DC3893C3B472D0"><enum>(CC)</enum><text>contains silencing means; and</text></subitem>
<subitem id="H28A5A395EF524A38ABACF297757267EA"><enum>(DD)</enum><text display-inline="yes-display-inline">provides notification for persons with hearing loss as required by the National Fire Protection Association Standard 72, or any successor standard; or</text></subitem></item></subclause> <subclause id="H774E2EBD7E28415EA63E5631A04E4860"><enum>(II)</enum><text>in the case of a dwelling unit built or substantially rehabilitated after the date of enactment of this paragraph, is hardwired.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection>
<subsection id="H50CE970F38A640749B77EB297C7C47E3"><enum>(b)</enum><header>Supportive housing for the elderly</header><text>Section 202(j) of the Housing Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701q">12 U.S.C. 1701q(j)</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H3D7266C185AB4B089A5478B0AC1D9089"> <paragraph id="HF442B0A8809B450AA7013074FAE7A320"><enum>(10)</enum><header>Qualifying smoke alarms</header> <subparagraph id="H737ECC61267647D79F93EE007265D147"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each owner of a dwelling unit assisted under this section shall ensure that qualifying smoke alarms are installed in accordance with the requirements of applicable codes and standards and the National Fire Protection Association Standard 72, or any successor standard, in each level and in or near each sleeping area in such dwelling unit, including in basements but excepting crawl spaces and unfinished attics, and in each common area in a project containing such a dwelling unit.</text></subparagraph>

<clause id="H947D6823C40F47C086866D2691E8753B"><enum>(ii)</enum><header>Qualifying smoke alarm defined</header><text display-inline="yes-display-inline">The term <term>qualifying smoke alarm</term> means a smoke alarm that—</text> <subclause display-inline="no-display-inline" id="HDA7529E3A1E54C29BCEA5B6EA28573FB"><enum>(I)</enum><text>in the case of a dwelling unit built before the date of enactment of this paragraph and not substantially rehabilitated after the date of enactment of this paragraph is—</text>
<item id="HD5362B22B8514914A1BD1D8E19D7D274"><enum>(aa)</enum><text>hardwired; or</text></item> <item id="H1B5554FCB4054BF1992BDB10778925EB"><enum>(bb)</enum><text display-inline="yes-display-inline">uses 10-year non rechargeable, nonreplaceable primary batteries and—</text>
<subitem id="HA7265AC54C4845338E2C0CDB9F163525"><enum>(AA)</enum><text>is sealed;</text></subitem> <subitem id="H8C1833AF93234F24AA66DD3C2356C038"><enum>(BB)</enum><text>is tamper resistant;</text></subitem>
<subitem id="H31C6AB2824EB40C1993BFE8E46A4CD6D"><enum>(CC)</enum><text>contains silencing means; and</text></subitem> <subitem id="H35500AD475BC405F9F814269A7273CF1"><enum>(DD)</enum><text display-inline="yes-display-inline">provides notification for persons with hearing loss as required by the National Fire Protection Association Standard 72, or any successor standard; or</text></subitem></item></subclause>
<subclause id="H4EA775804DCE4EB695C96CF6541AA9A7"><enum>(II)</enum><text>in the case of a dwelling unit built or substantially rehabilitated after the date of enactment of this paragraph, is hardwired.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HA75647B9875C45DBAF14DF8CB9F7E74E"><enum>(c)</enum><header>Supportive housing for persons with disabilities</header><text>Section 811(j) of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C. 8013(j)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H495E25AC84C1446D9543C9D166382240"><enum>(8)</enum><header>Qualifying smoke alarms</header>
<subparagraph id="H575D7F1C936949818DCC275E6A9D383D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each dwelling unit assisted under this section shall contain qualifying smoke alarms that are installed in accordance with applicable codes and standards published by the International Code Council or the National Fire Protection Association and the requirements of the National Fire Protection Association Standard 72, or any successor standard, in each level and in or near each sleeping area in such dwelling unit, including in basements but excepting crawl spaces and unfinished attics, and in each common area in a project containing such a dwelling unit.</text></subparagraph> <subparagraph display-inline="no-display-inline" id="H2472C0EA7C8543FFAAB06E0B9386F17A"><enum>(B)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this paragraph, the following definitions shall apply:</text>

<subclause display-inline="no-display-inline" id="H996AE275D57947CB9AC32EAED1B56AAC"><enum>(I)</enum><text>in the case of a dwelling unit built before the date of enactment of this paragraph and not substantially rehabilitated after the date of enactment of this paragraph is—</text> <item id="H9D24374633594E5FA08BB889D6A201B0"><enum>(aa)</enum><text>hardwired; or</text></item>
<item id="HD3B6B83CEB9F4D1398ED4E871CE92EA4"><enum>(bb)</enum><text display-inline="yes-display-inline">uses 10-year non rechargeable, nonreplaceable primary batteries and—</text> <subitem id="H7DB04DC1021242F9A88C5F6876AD6891"><enum>(AA)</enum><text>is sealed;</text></subitem>
<subitem id="HF12E764E022F45E8AA6C69814BEEE909"><enum>(BB)</enum><text>is tamper resistant;</text></subitem> <subitem id="H23B7F331986A46F286BE20FCE3D8521A"><enum>(CC)</enum><text>contains silencing means; and</text></subitem>
<subitem id="HE12ACE332FBB49769FB692239C028533"><enum>(DD)</enum><text display-inline="yes-display-inline">provides notification for persons with hearing loss as required by the National Fire Protection Association Standard 72, or any successor standard; or</text></subitem></item></subclause> <subclause id="HB772CB047F10453CADEB726C27823B35"><enum>(II)</enum><text>in the case of a dwelling unit built or substantially rehabilitated after the date of enactment of this paragraph, is hardwired.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H734E1C28FF034DCFAA4B94E9BD7E86BF"><enum>(d)</enum><header>Housing Opportunities for Persons with AIDS</header><text>Section 856 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12905">42 U.S.C. 12905</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H50AD9FE369F94E349B3E01439421A735"> <subsection id="H483AA2EFBFBC41B69344849E91A579B8"><enum>(j)</enum><header>Qualifying smoke alarms</header> <paragraph id="HB796B0FD1C4D4B88BC6803A04B66D30B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each dwelling unit assisted under this subtitle shall contain qualifying smoke alarms that are installed in accordance with applicable codes and standards published by the International Code Council or the National Fire Protection Association and the requirements of the National Fire Protection Association Standard 72, or any successor standard, in each level and in or near each sleeping area in such dwelling unit, including in basements but excepting crawl spaces and unfinished attics, and in each common area in a project containing such a dwelling unit.</text></paragraph>
<paragraph id="H276F41D29FD7470BA32F001B7F2A9AAB"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subsection, the following definitions shall apply:</text> <subparagraph display-inline="no-display-inline" id="HE8B9FBEECBF64BC8B835322740F73B22"><enum>(A)</enum><header>Smoke alarm defined</header><text>The term <term>smoke alarm</term> has the meaning given the term <quote>smoke detector</quote> in section 29(d) of the Federal Fire Prevention and Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/2225">15 U.S.C. 2225(d)</external-xref>).</text></subparagraph>
<subparagraph id="H2F0FA46A453E49F99448B8024DBCAB78"><enum>(B)</enum><header>Qualifying smoke alarm defined</header><text display-inline="yes-display-inline">The term <term>qualifying smoke alarm</term> means a smoke alarm that—</text> <clause display-inline="no-display-inline" id="HE4788863C217466A9E59280072E58D00"><enum>(i)</enum><text>in the case of a dwelling unit built before the date of enactment of this subsection and not substantially rehabilitated after the date of enactment of this subsection is—</text>
<subclause id="H3A7D03BF57CB44DC9FE2A09CA6A5AC88"><enum>(I)</enum><text>hardwired; or</text></subclause> <subclause id="H5A98F1C194B4465790987C2482DA9006"><enum>(II)</enum><text display-inline="yes-display-inline">uses 10-year non rechargeable, nonreplaceable primary batteries and—</text>
<item id="H471409E2F446449C9E9C70D70DC7F59A"><enum>(aa)</enum><text>is sealed;</text></item> <item id="H1AD4F07CDB2448EBBBA543DB9414D30A"><enum>(bb)</enum><text>is tamper resistant;</text></item>
<item id="H1461717EAA164E8DA154D5EDC78347E9"><enum>(cc)</enum><text>contains silencing means; and</text></item> <item id="HBCF5FAFD81E243D0ACE6C00ED62BBA4F"><enum>(dd)</enum><text display-inline="yes-display-inline">provides notification for persons with hearing loss as required by the National Fire Protection Association Standard 72, or any successor standard; or</text></item></subclause></clause>
<clause id="H23DBE8920C244621B261432E73EFD0EB"><enum>(ii)</enum><text>in the case of a dwelling unit built or substantially rehabilitated after the date of enactment of this subsection, is hardwired.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H887B12A775D44FA2A2EF32B84E052E44"><enum>(e)</enum><header>Rural housing</header><text>Title V of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1471">42 U.S.C. 1471 et seq.</external-xref>) is amended—</text>
<paragraph id="HC184DD35E90A485689F082206C60C5E0"><enum>(1)</enum><text>in section 514 (<external-xref legal-doc="usc" parsable-cite="usc/42/1484">42 U.S.C. 1484</external-xref>), by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H20AD592BF75C4829B4EFD303B7A24956"> <subsection id="H37652C5FD7714FE6B8FFEC0DF63CBBD0"><enum>(k)</enum><header>Qualifying smoke alarms</header> <paragraph id="HED9C7D342B5749D089168BBD103E203C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Housing and related facilities constructed with loans under this section shall contain qualifying smoke alarms that are installed in accordance with applicable codes and standards published by the International Code Council or the National Fire Protection Association and the requirements of the National Fire Protection Association Standard 72, or any successor standard, in each level and in or near each sleeping area in such dwelling unit, including in basements but excepting crawl spaces and unfinished attics, and in each common area in a project containing such a dwelling unit.</text></paragraph>
<paragraph id="H14BE417062764D91BCEBFE209E631E15"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subsection, the following definitions shall apply:</text> <subparagraph display-inline="no-display-inline" id="H0617DB290BE94765815C05E424521991"><enum>(A)</enum><header>Smoke alarm defined</header><text>The term <term>smoke alarm</term> has the meaning given the term <quote>smoke detector</quote> in section 29(d) of the Federal Fire Prevention and Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/2225">15 U.S.C. 2225(d)</external-xref>).</text></subparagraph>
<subparagraph id="H52FBDC2E684E4142BA9A47710236C19B"><enum>(B)</enum><header>Qualifying smoke alarm defined</header><text display-inline="yes-display-inline">The term <term>qualifying smoke alarm</term> means a smoke alarm that—</text> <clause display-inline="no-display-inline" id="H8FFAF445EF064EC8BB643D0903C44922"><enum>(i)</enum><text>in the case of a dwelling unit built before the date of enactment of this subsection and not substantially rehabilitated after the date enactment of this subsection is—</text>
<subclause id="HE570216CB0A14B328FB759DCAEB6C847"><enum>(I)</enum><text>hardwired; or</text></subclause> <subclause id="HB018FC0F244045B2888EF80E9E51052B"><enum>(II)</enum><text display-inline="yes-display-inline">uses 10-year non rechargeable, nonreplaceable primary batteries and—</text>
<item id="HD57FEB251E574A929460B7EBB1859761"><enum>(aa)</enum><text>is sealed;</text></item> <item id="HE6BF9AD04C4F4EC3AD06B7314CA98AF5"><enum>(bb)</enum><text>is tamper resistant;</text></item>
<item id="HB5C7D3AD6F7648F3937BB880AAA899AD"><enum>(cc)</enum><text display-inline="yes-display-inline">contains silencing means; and</text></item> <item id="H13A1A32AF6F643AE88EEBE6C493E3DE8"><enum>(dd)</enum><text display-inline="yes-display-inline">provides notification for persons with hearing loss as required by the National Fire Protection Association Standard 72, or any successor standard; or</text></item></subclause></clause>
<clause id="HE1C26E2DCF934B2EB688ECB59CB83954"><enum>(ii)</enum><text>in the case of a dwelling unit built or substantially rehabilitated after the date of enactment of this subsection, is hardwired.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H7A14EC49ED4541519DEDE81DF3638F22"><enum>(2)</enum><text>in section 515(m) (<external-xref legal-doc="usc" parsable-cite="usc/42/1485">42 U.S.C. 1485(m)</external-xref>) by adding at the end the following:</text>

<paragraph id="HBAC942AFFC2C4048B1F84CF9DF1AB74A" indent="up1"><enum>(3)</enum><header>Qualifying smoke alarms</header>
<subparagraph id="HBE2E9337D42C4DD3AD6AF6950C8889DD"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Housing and related facilities rehabilitated or repaired with amounts received under a loan made or insured under this section shall contain qualifying smoke alarms that are installed in accordance with applicable codes and standards published by the International Code Council or the National Fire Protection Association and the requirements of the National Fire Protection Association Standard 72, or any successor standard, in each level and in or near each sleeping area in such dwelling unit, including in basements but excepting crawl spaces and unfinished attics, and in each common area in a project containing such a dwelling unit.</text></subparagraph> <subparagraph display-inline="no-display-inline" id="H8B11001709B543D78878C7735454C36F"><enum>(B)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this paragraph, the following definitions shall apply:</text>

<subclause display-inline="no-display-inline" id="HD93B373542174128B655333CB5CC7516"><enum>(I)</enum><text>in the case of a dwelling unit built before the date of enactment of this paragraph and not substantially rehabilitated after the date of enactment of this paragraph is—</text> <item id="H1F8639CC5D144676B63141B84EBAA6D4"><enum>(aa)</enum><text>hardwired; or</text></item>
<item id="HAC9F7E816E8B4BDB90FE1B4575813D5E"><enum>(bb)</enum><text display-inline="yes-display-inline">uses 10-year non rechargeable, nonreplaceable primary batteries and—</text> <subitem id="H4D956A69EA884B65BE97206AC5EDD7A5"><enum>(AA)</enum><text>is sealed;</text></subitem>
<subitem id="H11F3599BA2CD43B0803B6DBD7BACE938"><enum>(BB)</enum><text>is tamper resistant;</text></subitem> <subitem id="H1FB0CC8B76DA445F8711ECB511CEF29A"><enum>(CC)</enum><text>contains silencing means; and</text></subitem>
<subitem id="H34DC699ACD0A4D95A9CCDE25EB747234"><enum>(DD)</enum><text display-inline="yes-display-inline">provides notification for persons with hearing loss as required by the National Fire Protection Association Standard 72, or any successor standard; or</text></subitem></item></subclause> <subclause id="H48BC850D6D504D169699981FF007B464"><enum>(II)</enum><text>in the case of a dwelling unit built or substantially rehabilitated after the date of enactment of this paragraph, is hardwired.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H1CD0AC6655E94634BA97128ED3A67001"><enum>(f)</enum><header>Farm Labor Housing Direct Loans &amp; Grants</header><text display-inline="yes-display-inline">Section 516 of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1486">42 U.S.C. 1486</external-xref>) is amended—</text> <paragraph id="HC866ABB28EAC4DD98B2C874508DFE1C6"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)—</text>
<subparagraph id="H51386C4BA692469A9AE6E45A962DC2D2"><enum>(A)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="H67CCC2CCCC234118912D13C6651890EB"><enum>(B)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph>
<subparagraph id="H53165D607A504681A101B86B6D6B7F26"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H799A12C2F54647F8B4387BAC1A2B62B0"> <paragraph id="HD1266ED4F6174F8CAB121BCF24014EF8"><enum>(4)</enum><text display-inline="yes-display-inline">that such housing shall contain qualifying smoke alarms that are installed in accordance with applicable codes and standards published by the International Code Council or the National Fire Protection Association and the requirements of the National Fire Protection Association Standard 72, or any successor standard, in each level and in or near each sleeping area in such dwelling unit, including in basements but excepting crawl spaces and unfinished attics, and in each common area in a project containing such a dwelling unit.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HFFEEED3956B04443A0660D1396F3FC3C"><enum>(2)</enum><text>in subsection (g)—</text> <subparagraph id="H02271E2777904ECF9ADC170F916AB6D0"><enum>(A)</enum><text>in paragraph (3) by striking <quote>and</quote> at the end;</text></subparagraph>

<subparagraph commented="no" display-inline="no-display-inline" id="HB463CC4D5C884617B874253C2D68B7FD"><enum>(A)</enum><text>in the case of a dwelling unit built before the date of enactment of this paragraph and not substantially rehabilitated after the date of enactment of this paragraph is—</text> <clause commented="no" id="H67D1610450804985AB9276284473CB38"><enum>(i)</enum><text>hardwired; or</text></clause>
<clause commented="no" id="HE0768E525A1F4F84B8B12650A3A836AB"><enum>(ii)</enum><text display-inline="yes-display-inline">uses 10-year non rechargeable, nonreplaceable primary batteries and—</text> <subclause commented="no" id="H1951EF3C9261490589A4C6AAE14350E6"><enum>(I)</enum><text>is sealed;</text></subclause>
<subclause commented="no" id="H9E6A86830F574AFC9C14D4EA649B886B"><enum>(II)</enum><text>is tamper resistant;</text></subclause> <subclause commented="no" id="HF4924C1D055A4971958A9AB97CD1EAF3"><enum>(III)</enum><text>contains silencing means; and</text></subclause>
<subclause commented="no" id="H8458237BB30841758251E3D923FD1D88"><enum>(IV)</enum><text display-inline="yes-display-inline">provides notification for persons with hearing loss as required by the National Fire Protection Association Standard 72, or any successor standard; or</text></subclause></clause></subparagraph> <subparagraph commented="no" id="HA745F07FBC2C4F6C82954089C03E2CA9"><enum>(B)</enum><text>in the case of a dwelling unit built or substantially rehabilitated after the date of enactment of this paragraph, is hardwired.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection>
<subsection id="H34EEAB6E366E4AAEB738E4CD2D07435D"><enum>(g)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out the amendments made by this section such sums as are necessary for each of fiscal years 2023 through 2027.</text></subsection> <subsection id="H936C6BB936E2473E8F78961964793308"><enum>(h)</enum><header>Effective date</header><text>The amendments made by subsections (a) through (f) shall take effect on the date that is 2 years after the date of enactment of this Act.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H7A0AB25355384F3F97185DB5A1733600"><enum>(i)</enum><header>No preemption</header><text>Nothing in the amendments made by this section shall be construed to preempt or limit the applicability of any State or local law relating to the installation and maintenance of smoke alarms in housing that requires standards that are more stringent than the standards described in the amendments made by this section.</text></subsection></section> <section id="H7F18DC9FFBFB4E5192DE1752E3F0884E"><enum>3.</enum><header>Fire safety educational program</header> <subsection display-inline="no-display-inline" id="H52544BF95FD644249FF27E4C4200A3A6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development shall, not later than 1 year after the date of enactment of this Act, complete a national educational campaign that educates the general public about health and safety requirements in housing and how to properly use safety features in housing, including self-closing doors, smoke alarms, and carbon monoxide detectors.</text></subsection>
<subsection id="H5BFAF8D0C7FF4B059DAC5AF435D90505"><enum>(b)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary of Housing and Urban Development to carry out this section, $2,000,000 for fiscal year 2024. </text></subsection></section> </legis-body><attestation><attestation-group><attestation-date date="20220727" chamber="House">Passed the House of Representatives July 27, 2022.</attestation-date><attestor display="no">Cheryl L.
