which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Omnibus Crime Control and Safe Streets Act to direct district attorney and prosecutors offices to report to the Attorney General, and for other purposes.</official-title></form><legis-body id="H43CF9E2C99DE4F148C5A6837893F64F6" style="OLC"><section id="H7FB33739A83546C0B6EBC4B228497E65" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prosecutors Need to Prosecute Act</short-title></quote>. </text></section><section id="H17CE45F343974BBDB8C02A00CBCB9DC7"><enum>2.</enum><header> District attorney reporting requirements for Byrne grants</header><text display-inline="no-display-inline">Section 501 of subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151</external-xref>) is amended—</text><paragraph id="H7D62127192A44E099AE79C17B1140B77"><enum>(1)</enum><text>by redesignating subsection (g) as subsection (h); and</text></paragraph><paragraph id="H2C6707471A2B448AADFEB9A0F6F3DEC4"><enum>(2)</enum><text>by inserting after subsection (f) the following:</text><quoted-block id="H50B6EF8206334138A8E16CDCFA1AA312" style="OLC"><subsection id="H25F84E7C56DE469199DD885C3E15E72D"><enum>(g)</enum><header>District Attorney Reporting Requirements</header><paragraph id="HE44C5192A34A48EAAFCD225EC37DB989"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">On an annual basis, each chief executive of a district attorney or prosecutor’s office that serves a jurisdiction of 380,000 or more persons, which jurisdiction receives funds under this part, shall submit to the Attorney General a report that contains, for the previous fiscal year, the following: </text><subparagraph id="HB84E37B8B2ED4E14B798E6837EFCAD4E"><enum>(A)</enum><text>The total number of cases referred to the office for prosecution of a covered offense. </text></subparagraph><subparagraph id="H035F57D3879D4FA2AB97B4C3E5F9FC04"><enum>(B)</enum><text>The number of cases such office declined to prosecute involving a covered offense.</text></subparagraph><subparagraph id="H78A88705E2844455A5492F594115BE21"><enum>(C)</enum><text>For cases involving a covered offense that resulted in a plea agreement reached with the defendant—</text><clause id="H1A1940E64A7747709D20A7C03E58362E"><enum>(i)</enum><text>the total number of such cases;</text></clause><clause id="HA11AD69983504C28B36BFEACCE3008F0"><enum>(ii)</enum><text>the number of such cases by each initial charge; and</text></clause><clause id="H1DD4340F1EF5439690BA4ADA4756A037"><enum>(iii)</enum><text>the number of such cases by each charge of conviction. </text></clause></subparagraph><subparagraph id="HF3F9434F84CD46A7AACB15187CFDD4E0"><enum>(D)</enum><text>The number of cases involving covered offenses initiated against a defendant—</text><clause id="H7D2B101CF0CD4E2E9BFB5E9DA4F15702"><enum>(i)</enum><text>previously arrested for a covered offense arising out of separate conduct;</text></clause><clause id="HDC56D87F448F474498779C3A7D8FDB81"><enum>(ii)</enum><text display-inline="yes-display-inline">previously convicted for a covered offense arising out of separate conduct;</text></clause><clause id="H9F53576A2E094389B1B80696A92A7413"><enum>(iii)</enum><text display-inline="yes-display-inline">with an open case involving a covered offense arising out of separate conduct;</text></clause><clause id="H2967EEB180364E6C805B3B00B915C86F"><enum>(iv)</enum><text display-inline="yes-display-inline">serving a term of probation for a conviction for a covered offense arising out of separate conduct; and</text></clause><clause id="H59787E78DEAF41A0BDCFA9014B5CF2B2"><enum>(v)</enum><text display-inline="yes-display-inline">released on parole for a conviction for a covered offense arising out of separate conduct.</text></clause></subparagraph><subparagraph id="H7CC2DDD65A0342EBBE4F9016D2C34A9D"><enum>(E)</enum><text>The number of defendants charged with a covered offense—</text><clause id="HB2063B697FAF478B8B1EF89146961058"><enum>(i)</enum><text display-inline="yes-display-inline">who were released on their own recognizance; </text></clause><clause id="H69F0C825B71E4EF6A667AB6E2F3AC17C"><enum>(ii)</enum><text>who were eligible for bail; and </text></clause><clause id="H686D677BD4024C29BFCBEDB045ECCE13"><enum>(iii)</enum><text>for whom the prosecutor requested bail.</text></clause></subparagraph></paragraph><paragraph id="HE5E056BD68E04091893C35AC462A71AB"><enum>(2)</enum><header>Uniform standards</header><text>The Attorney General shall define uniform standards for the reporting of the information required under this subsection, including the form such reports shall take and the process by which such reports shall be shared with the Attorney General.</text></paragraph><paragraph id="HDDFA1FE7E0AF46A4BFD703BD8925BF5E"><enum>(3)</enum><header>Submission to Judiciary Committees</header><text>The Attorney General shall submit the information received under this subsection to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives and shall publish such information on a publicly viewable website.</text></paragraph><paragraph id="HBE875A88DE64408DA2F6AA9003D95B80"><enum>(4)</enum><header>Covered offense defined</header><text>In this subsection, the term <term>covered offense</term> means any of the following: </text><subparagraph id="HA3002229097B4279A04047F305B88CD5"><enum>(A)</enum><text>Murder or non-negligent manslaughter. </text></subparagraph><subparagraph id="H25957D58A6144AB1AAD49E4508705A7A"><enum>(B)</enum><text>Forcible rape.</text></subparagraph><subparagraph id="HD0D87F71EF9D4D6E8F9FF1F607EEC643"><enum>(C)</enum><text>Robbery. </text></subparagraph><subparagraph id="H6F75CB2A729E4DBCA06D6094E61A0091"><enum>(D)</enum><text>Aggravated assault. </text></subparagraph><subparagraph id="H602B4499135D41A180B9311C0B658E69"><enum>(E)</enum><text>Burglary. </text></subparagraph><subparagraph id="H14DC4D586F574F7D91DA38ABA6095D5A"><enum>(F)</enum><text>Larceny. </text></subparagraph><subparagraph id="H4980F4368A544282A982B913275B192C"><enum>(G)</enum><text>Motor vehicle theft. </text></subparagraph><subparagraph id="HA643DABBA3354619A355A45E66323668"><enum>(H)</enum><text>Arson. </text></subparagraph><subparagraph id="H9F549BA306BA41888A3F8C1330223ACD"><enum>(I)</enum><text display-inline="yes-display-inline">Any offense involving the illegal use of a firearm.</text></subparagraph><subparagraph id="HDBF6623720A54309A01C57BFDB3F98E7"><enum>(J)</enum><text>Any offense involving the illegal possession of a firearm.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
