which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prevent the misuse of drones, and for other purposes.</official-title></form><legis-body id="H9C74B094DFBB44158671B91A9F500C1F" style="OLC"><section section-type="section-one" id="HE6175EE88216412BA2855C9F10EE4F8E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Drone Act of 2022</short-title></quote>.</text></section><section id="H0958467236464264B7654A3E99CB31F6"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="HFDEC248008DE4F59951A22B3F00EB740"><enum>(1)</enum><text>drone technology has the potential to revolutionize commerce, military operations, law enforcement, and various industries, as well as recreation in general;</text></paragraph><paragraph id="H10C4F28331BE44BA8468CDC6A7C1B590"><enum>(2)</enum><text>drone technology also presents a potential danger to public safety and national security;</text></paragraph><paragraph id="H93BE07D2D7234B78A8E4EBA0537121C5"><enum>(3)</enum><text>drone technology is increasingly being used by drug trafficking and human trafficking organizations at the southern border—</text><subparagraph id="HED49E68AB9864FD1ABEF5D3964EF638A"><enum>(A)</enum><text>to assist in smuggling into the United States high-value items;</text></subparagraph><subparagraph id="H30123AB71EA945E3B678113882CCA676"><enum>(B)</enum><text>for conducting reconnaissance; and</text></subparagraph><subparagraph id="HE6D1735343AA4868884B7DCB036EE471"><enum>(C)</enum><text>even as offensive weapons against competing criminal organizations;</text></subparagraph></paragraph><paragraph id="H04A566436DC0437190D15D53871E05DA"><enum>(4)</enum><text>drone technology has been used to deliver into Federal correctional centers contraband such as cell phones, wire cutters, screwdrivers, and hacksaws;</text></paragraph><paragraph id="H59A5F42AA0B54D39AC576F5B0F0611E3"><enum>(5)</enum><text>there were 875 drone sightings in restricted airport airspace in 2020, and 766 such sightings in the first half of 2021, including 36 such sightings in the vicinities of runways; and</text></paragraph><paragraph id="HAD8D9BE6A0E04EA39354CBDDD7ADF4C6"><enum>(6)</enum><text>while existing Federal law includes some criminal provisions relating to misuse of drones, those provisions are fragmentary in nature and therefore fail to restrain and deter the most serious drone-related crimes.</text></paragraph></section><section id="H4AECA8E545724F11B989C7E7A1C84CC3"><enum>3.</enum><header>Drone offenses</header><text display-inline="no-display-inline">Part I of title 18, United States Code, is amended—</text><paragraph id="HA1EAC918869C4E28971E36A9A287ED7E"><enum>(1)</enum><text>in section 39B(a)—</text><subparagraph id="H17F1780FAE0D47DB8E3304784E4DFB76"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H724FFC8F583C4D8EB3B969743A9F57F2"><enum>(i)</enum><text>by striking <quote>operation of, an aircraft</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="H908630E0354C4D94A59C84512796394D"><text>operation of—</text><subparagraph id="H4041C86B8AF94356A7C5B829087DE9FC"><enum>(A)</enum><text>an aircraft</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="H5B677E85599A472C9CD94CD02B38255D"><enum>(ii)</enum><text>by striking the period at the end and inserting a semicolon; and</text></clause><clause id="H4A866BFCEA314D43A3B90DBFA1CA7371"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA546ADDF0C004A7E9B5FE8A35E2CE418"><subparagraph id="H6FF021C7481F4F628DE7360F87D56C20"><enum>(B)</enum><text>a vessel of the United States, or a vessel subject to the jurisdiction of the United States, as those terms are defined in section 70502 of title 46, carrying 1 or more occupants, in a manner that poses an imminent safety hazard to such occupants, shall be punished as provided in subsection (c);</text></subparagraph><subparagraph id="H685BE3A1419E4B31874C5AE250BCCE8A"><enum>(C)</enum><text>a motor vehicle that is used, operated, or employed in interstate or foreign commerce and is carrying 1 or more occupants, in a manner that poses an imminent safety hazard to such occupants, shall be punished as provided in subsection (c); or</text></subparagraph><subparagraph id="H6A3CA96D277948B3B05D656F9AD02D88"><enum>(D)</enum><text>a vehicle used or designed for flight or navigation in space described in section 7(6), shall be punished as provided in subsection (c).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H266455B81FBE44FD87787E738F2B251E"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="H42FC196C08884165BFC500F44E2F69FF"><enum>(i)</enum><text>by striking <quote>operation of, an aircraft</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="H14F6AB144C4140E5A4EA862D16C0CDF8"><text>operation of—</text><subparagraph id="H41D3B10C51214D98827B83867E94D4D0"><enum>(A)</enum><text>an aircraft</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="H75D1364EC0CF4EF2994B409F55A43812"><enum>(ii)</enum><text>by striking the period at the end and inserting a semicolon; and</text></clause><clause id="HE9A588EF2883468980D66FFF2379F5EC"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5ACCA22E55BB4DA5B7C83A467A195BA2"><subparagraph id="HFF450AFB20564951B80C7BA7D79737CD"><enum>(B)</enum><text>a vessel of the United States, or a vessel subject to the jurisdiction of the United States, as those terms are defined in section 70502 of title 46, carrying 1 or more occupants, in a manner that poses an imminent safety hazard to such occupants, shall be punished as provided in subsection (c);</text></subparagraph><subparagraph id="HDF64AC4DD6F24C4386897C6D8329DF51"><enum>(C)</enum><text>a motor vehicle that is used, operated, or employed in interstate or foreign commerce and is carrying 1 or more occupants, in a manner that poses an imminent safety hazard to such occupants, shall be punished as provided in subsection (c); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1D69B362CEA54C74A9E3F4141CAEE20B"><enum>(D)</enum><text>a vehicle used or designed for flight or navigation in space described in section 7(6), shall be punished as provided in subsection (c).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H80EC2FEC89144404BA6CF260C69C56D3"><enum>(2)</enum><text>in section 40A—</text><subparagraph id="H2EEC4FCA337545618AEA4386A6733509"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="section" style="USC">Operation of unauthorized unmanned aircraft over wildfires</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Interference by unauthorized unmanned aircraft with law enforcement, emergency response, and military activities</header-in-text></quote>; and</text></subparagraph><subparagraph id="H7FB95841E0C641609B25C93A15F057CB"><enum>(B)</enum><text>in subsection (a)—</text><clause id="H7D890799C74643B39E1279F66816BF9E"><enum>(i)</enum><text>by striking <quote>operates an unmanned aircraft and knowingly or recklessly</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="H96BF9A9633BD45E2ADC63BB916E655CB"><text>operates an unmanned aircraft and—</text><paragraph id="H821336BAF3FC4D0CB20E92E1CE77769F"><enum>(1)</enum><text>knowingly or recklessly</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="HDF67F7147B30410F88F5FA46E361F359"><enum>(ii)</enum><text>by striking the period at the end and inserting <quote>; or</quote>; and</text></clause><clause id="HE7FA4862E7634330A2A58FCDB78B0A64"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H14D2177755DC4DA4BD4A854864F77657"><paragraph id="H454D4A61658342D49955E7DB077E25F1"><enum>(2)</enum><text>knowingly or recklessly interferes with a law enforcement, emergency response, or military operation or activity of a unit or agency of the United States Government or of a State, tribal, or local government (other than a wildfire suppression or law enforcement or emergency response efforts related to a wildfire suppression) shall be fined under this title, imprisoned for not more than 2 years, or both.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H6CEAEE5BB839485CB8B676552BA454AB"><enum>(3)</enum><text>by inserting after section 40A the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H727A86C950294D6F8E1D7466A4FD85D3"><section id="H8EC0B3DF5D3D454DA2CDB33C51D2FB4F"><enum>40B.</enum><header>Misuse of unmanned aircraft</header><subsection id="H6D5622EFB6814E0392DA4C50236F6498"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="HCEDF9E0BCA604D95AC4763A83D6858F3"><enum>(1)</enum><text>the term <term>aircraft</term>, notwithstanding section 31(a)(1), means any device, craft, vehicle, or contrivance that is—</text><subparagraph id="HAD63B6CFC0A04FBBA7C974742FD24E2D"><enum>(A)</enum><text>invented, used, or designed to navigate, fly, or travel in the air; or</text></subparagraph><subparagraph id="HB94EB44289BC4DE186E5415FE253B510"><enum>(B)</enum><text>used or intended to be used for flight in the air;</text></subparagraph></paragraph><paragraph id="H5051CB77CEFE4D1BB72A44DDB21CDEEC"><enum>(2)</enum><text>the term <term>airport</term> has the meaning given the term in section 40102(a)(9) of title 49;</text></paragraph><paragraph id="HABA12609B4F445A0A89873CE52197E72"><enum>(3)</enum><text>the term <term>contraband</term> has the meaning given the term in section 80302(a) of title 49;</text></paragraph><paragraph id="HAE4508D632EB472B964200ECDFD2384B"><enum>(4)</enum><text>the term <term>dangerous weapon</term> has the meaning given the term in section 930;</text></paragraph><paragraph id="HD2196B927298465D88EC412E8A57FD6B"><enum>(5)</enum><text>the term <term>explosive</term> means any thing within the scope of the definition of <term>explosive materials</term> in section 841;</text></paragraph><paragraph id="H23CC56A3A7AF4D1D9A5CD255E9841DCF"><enum>(6)</enum><text>the term <term>firearm</term> has the meaning given the term in section 921;</text></paragraph><paragraph id="HCCBFDDE7EE6C425D85D97C9903E8D3C1"><enum>(7)</enum><text>the term <term>Federal law</term> includes any form of Federal law, including any Federal statute, rule, regulation, or order;</text></paragraph><paragraph id="HCAB36AFE07DA4D8D81A0547D8E3DC2AF"><enum>(8)</enum><text>the term <term>personnel of the United States</term> means any Federal officer, employee, or contractor, or any person assisting such an officer, employee, or contractor in the performance of duties;</text></paragraph><paragraph id="HD97CBC650B1F4777A5DFFEC301D660CF"><enum>(9)</enum><text>the terms <term>prison</term> and <term>prohibited object</term> have the meanings given those terms in section 1791;</text></paragraph><paragraph id="HB532F78E145340E5AACFF28D6EADF89C"><enum>(10)</enum><text>the term <term>restricted electromagnetic weapon</term> means any type of device, instrument, technology, or contrivance that—</text><subparagraph id="H847322C4169D4BEDA10CDADA6684A3CF"><enum>(A)</enum><text>can generate or emit electromagnetic radiation or fields that are capable of jamming, disrupting, degrading, damaging, or interfering with the operation of any technological or electronic asset, system, network, or infrastructure, or any component or subcomponent thereof; and</text></subparagraph><subparagraph id="H0FE0509A3CB04CDE82957807ACB52A28"><enum>(B)</enum><text>is classified as a restricted electromagnetic weapon by the Attorney General, in consultation with the Secretary of Defense;</text></subparagraph></paragraph><paragraph id="HB5EFE827880B4112B2E9286E40A58728"><enum>(11)</enum><text>the term <term>serious bodily injury</term> has the meaning given the term in section 1365;</text></paragraph><paragraph id="H6671A3802DD24DB6912697C21C93E45B"><enum>(12)</enum><text>the term <term>United States corporation or legal entity</term> means any corporation or other entity organized under the laws of the United States or any State;</text></paragraph><paragraph id="HF8CE7B0183484E55B039D3A143B0BD08"><enum>(13)</enum><text>the term <term>unmanned aircraft</term> has the meaning given the term in section 44801 of title 49;</text></paragraph><paragraph id="HB44C349576464E4BA6A7E8ACFB1B533A"><enum>(14)</enum><text>the term <term>vessel</term> means any craft or contrivance used, capable of being used, or designed to be used for transportation in, on, or through water; and</text></paragraph><paragraph id="HBE50BCD9B0ED46CF893A84B2BDFF92AF"><enum>(15)</enum><text>the term <term>weapon of mass destruction</term> has the meaning given the term in section 2332a.</text></paragraph></subsection><subsection id="H4883A53F861A4A3E99372B1B5D1314BD"><enum>(b)</enum><header>Offenses</header><paragraph id="HCE4CE9050A87464A9C3088C029604F1D"><enum>(1)</enum><header>Weaponization</header><text>It shall be unlawful, in a circumstance described in subsection (c), to knowingly—</text><subparagraph id="HC84967F33E19419FB8FD0FD824EF22CE"><enum>(A)</enum><text>equip or arm an unmanned aircraft with a firearm, explosive, dangerous weapon, restricted electromagnetic weapon, or weapon of mass destruction;</text></subparagraph><subparagraph id="HBBA79AB53A304D92AF530BFED23FEF74"><enum>(B)</enum><text>possess, receive, transfer, operate, or produce an unmanned aircraft that is equipped or armed with a firearm, explosive, dangerous weapon, restricted electromagnetic weapon, or weapon of mass destruction;</text></subparagraph><subparagraph id="H2038844733A04F16ADDED0A187C7D9EF"><enum>(C)</enum><text>discharge or deploy a firearm, explosive, dangerous weapon, restricted electromagnetic weapon, or weapon of mass destruction using an unmanned aircraft; or</text></subparagraph><subparagraph id="H1E761B57D2C74151B67A10326596320D"><enum>(D)</enum><text>use an unmanned aircraft to cause—</text><clause id="HDD4620324FB4469CB06B4E2CB0BA0996"><enum>(i)</enum><text>serious bodily injury or death to a person; or</text></clause><clause id="H80637E1490D3421CB0DA4BA29707B68A"><enum>(ii)</enum><text>damage to property in an amount that exceeds $5,000.</text></clause></subparagraph></paragraph><paragraph id="H732FD9B14B3646B8B313D7605E17C0D7"><enum>(2)</enum><header>Operation of drone to commit felony</header><text>It shall be unlawful to knowingly operate an unmanned aircraft in furtherance of the commission of a crime punishable by death or imprisonment of more than 1 year under a law of the United States or a State, if Federal law requires that the aircraft be registered and the aircraft is not registered.</text></paragraph><paragraph id="H1803844B7ECA41D9BA9B0BCD7A9D2C50"><enum>(3)</enum><header>Impairment of identification or lighting</header><text>It shall be unlawful to, in violation of Federal law, knowingly and willfully—</text><subparagraph id="H513D42C139D84811947FA5FEC49F7C05"><enum>(A)</enum><text>remove, obliterate, tamper with, or alter the identification number of the unmanned aircraft;</text></subparagraph><subparagraph id="H5EB09780F73B4DF8B39B50E6D9E904AB"><enum>(B)</enum><text>disable or fail to effect any required identification transmission or signaling of the unmanned aircraft; or</text></subparagraph><subparagraph id="HD56CC87719094424A1CE8FF1A4BC2131"><enum>(C)</enum><text>disable or obscure any required anti-collision lighting of the unmanned aircraft or fail to have or illuminate such lighting as required.</text></subparagraph></paragraph><paragraph id="H39C8F441423C4497937D3AC85BE8F0CC"><enum>(4)</enum><header>Intrusion on protected spaces</header><text>It shall be unlawful for any person, knowing that the conduct of the person is unlawful, to—</text><subparagraph commented="no" id="HF1AACDA3E931468FAD6D3A85898393A1"><enum>(A)</enum><text>operate an unmanned aircraft in any airspace, or cause the takeoff or landing of an unmanned aircraft in any place, in violation of Federal law, including all applicable rules, regulations, and orders of the Federal Aviation Administration and the Department of Homeland Security; or</text></subparagraph><subparagraph id="H674A0BCE5F61457D9780749C499E8589"><enum>(B)</enum><text>operate an unmanned aircraft across a border of the United States or its territories or possessions without complying with the requirements of Federal law, including all applicable rules, regulations, and orders of the Federal Aviation Administration and the Department of Homeland Security.</text></subparagraph></paragraph><paragraph id="HE4DB9144CEC44547B401D0616BAA0AD9"><enum>(5)</enum><header>Transportation of contraband</header><text>It shall be unlawful to knowingly use an unmanned aircraft to—</text><subparagraph id="HEC62AC96D2524B93B269234926E03F95"><enum>(A)</enum><text>transport contraband; or</text></subparagraph><subparagraph id="H9AE38283FEC34FCCB4C5027A40438FA0"><enum>(B)</enum><text>introduce a prohibited object into a prison.</text></subparagraph></paragraph></subsection><subsection id="H9E6E82E1759A450CB6990036320785B8"><enum>(c)</enum><header>Circumstances</header><text>The circumstances described in this subsection are that the offense—</text><paragraph id="H529F927A0DE94D989F906425E80B4B70"><enum>(1)</enum><text>is an offense under paragraph (2), (3), (4), or (5) of subsection (b);</text></paragraph><paragraph id="HA77782E64446484D8FD08FB67AA66467"><enum>(2)</enum><text>involves an unmanned aircraft, firearm, explosive, dangerous weapon, restricted electromagnetic weapon, weapon of mass destruction, or ammunition that has moved at any time in interstate or foreign commerce;</text></paragraph><paragraph id="HB2179DDEC4AF46F5B0929DEB03FF0CAB"><enum>(3)</enum><text>occurs in or affects interstate or foreign commerce;</text></paragraph><paragraph id="H1BCC076C95634A32A765F8EC863B703A"><enum>(4)</enum><text>involves the movement of any person or thing in, or use of any means or instrumentality of, interstate or foreign commerce;</text></paragraph><paragraph id="H1329F26B88FD4C58AB3F7534D470F7CE"><enum>(5)</enum><text>involves—</text><subparagraph id="HB71BE012D9B74CB2A68223107115D767"><enum>(A)</enum><text>any use of the electromagnetic spectrum that is subject to the jurisdiction of the Federal Communications Commission or the National Telecommunications and Information Administration; or</text></subparagraph><subparagraph id="HC8D2A91A2AA1483985355E3B3C5DDC00"><enum>(B)</enum><text>any aircraft or airspace use that is subject to the jurisdiction of the Federal Aviation Administration;</text></subparagraph></paragraph><paragraph id="H46188591A204445A9053B766362714CF"><enum>(6)</enum><text>is committed, whether within or outside of the United States, against—</text><subparagraph id="H516AAF5B1585463F911E73F8EF433B03"><enum>(A)</enum><text>the United States or any department, agency, property, activity, or personnel of the United States; or</text></subparagraph><subparagraph id="H682BC08D73014E2AB1E99375F6830C4A"><enum>(B)</enum><text>an aircraft in the special aircraft jurisdiction of the United States (as defined in section 46501 of title 49);</text></subparagraph></paragraph><paragraph id="H223F06DBB4774F96A0441498A6AE961B"><enum>(7)</enum><text>is committed outside of the United States against any United States national, United States corporation or legal entity, aircraft registered under United States law, or vessel of the United States or vessel subject to the jurisdiction of the United States (as those terms are defined in section 70502 of title 46); or</text></paragraph><paragraph id="HB49516958A6F4882BB4FA2E2B80438AF"><enum>(8)</enum><text>is committed in the special maritime and territorial jurisdiction of the United States.</text></paragraph></subsection><subsection id="HA9F9B5CA22214997B719ADE912EDAD15"><enum>(d)</enum><header>Penalties</header><text>Any person who violates subsection (b)—</text><paragraph id="H46A81589C71E43D09E4D34C0F7943E74"><enum>(1)</enum><text>in the case of a violation of paragraph (2), (3), or (4) of that subsection, shall be imprisoned for not more than 5 years, fined under this title, or both;</text></paragraph><paragraph id="HC93E31B01CE64670B012F10A16238D3A"><enum>(2)</enum><text>in the case of a violation of paragraph (1)(A), (1)(B), (1)(C), or (5) of that subsection, shall be imprisoned for not more than 10 years, fined under this title, or both;</text></paragraph><paragraph id="H0242A02BCF14490488494696F0D88864"><enum>(3)</enum><text>subject to paragraph (4) of this subsection, in the case of a violation of paragraph (1)(D) of that subsection, shall be imprisoned for not more than 20 years, fined under this title, or both; and</text></paragraph><paragraph id="H68293B3A83C443E4AD8A96CEAB6F9DDE"><enum>(4)</enum><text>in the case of a violation of any paragraph of that subsection, if death results, shall be sentenced to death or imprisoned for any term of years or for life, fined under this title, or both.</text></paragraph></subsection><subsection id="H3748B5046EC940B79908943754EDFACD"><enum>(e)</enum><header>Inchoate offenses</header><paragraph id="H72D9F363A83147C9814CBBEC2B03DA9C"><enum>(1)</enum><header>In general</header><text>Whoever threatens, attempts, or conspires to commit an offense under subsection (b) shall be subject to the same punishment under subsection (d) as for a completed offense.</text></paragraph><paragraph id="H595F40888E184DC1BF75FBC25B0CD441"><enum>(2)</enum><header>Federal jurisdiction</header><text>In the case of a threat, attempt, or conspiracy to commit an offense under subsection (b), the requirement that a circumstance described in subsection (c) exists shall be satisfied if any of the circumstances described in that subsection would have existed had the offense been carried out.</text></paragraph></subsection><subsection id="H2CEA6998C115472DBCFA4208F4D3C69A"><enum>(f)</enum><header>Exceptions</header><paragraph id="HB109B92B5B3046CFB3AB7B2D436B52C1"><enum>(1)</enum><header>Government-authorized conduct</header><text>Subsection (b) shall not apply to conduct by or under the authority of, authorized by, or pursuant to a contract with, the United States or a State, tribal, or local government, or any department or agency of the United States or a State, tribal, or local government.</text></paragraph><paragraph id="HC641BD8941A14CFAAFD4EDED434ECCAF"><enum>(2)</enum><header>Weaponization for authorized or licensed activities</header><text>Subsection (b)(1), as that subsection applies to firearms, explosives, and other dangerous weapons, shall not apply to—</text><subparagraph id="H035C392EED2E45648A38B16FA16E5309"><enum>(A)</enum><text>conduct related to avalanche mitigation; or</text></subparagraph><subparagraph id="H286F9D5C4DE149D2AA4D2084EA3B0276"><enum>(B)</enum><text>any other conduct in which the use of the firearm, explosive, or dangerous weapon is licensed or otherwise permitted for the mitigation of dangers associated with hazardous environments.</text></subparagraph></paragraph><paragraph id="H1828AB225D2642899AF5AC4A27007CCA"><enum>(3)</enum><header>Authorized property damage</header><text>Subsection (b)(1)(D) shall not apply to conduct consisting of injury to property, if engaged in by or with the authorization or consent of the owner of the property, including in any consensual competition in which unmanned aircraft are deployed against each other.</text></paragraph></subsection></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HD32D4102148047F8BE213142E5EE5F17"><enum>(4)</enum><text>in the chapter analysis for chapter 2, by striking the item relating to section 40A and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9E6A568A69454EC4A1BCE5BF7453D1FF"><toc><toc-entry bold="off" level="section">40A. Interference by unauthorized unmanned aircraft with law enforcement, emergency response, and military activities.</toc-entry><toc-entry bold="off" level="section">40B. Misuse of unmanned aircraft.</toc-entry></toc><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H784781C8385047CA8EFF68D1CA4D8740"><enum>(5)</enum><text>in section 982(a)(6)(A), by inserting <quote>39B (relating to unsafe operation of unmanned aircraft), 40A (relating to interference by unauthorized unmanned aircraft with law enforcement, emergency response, and military activities), 40B (relating to misuse of unmanned aircraft),</quote> before <quote>555</quote>;</text></paragraph><paragraph id="H3601B169EA1F4814AC3C9BCD96046B44"><enum>(6)</enum><text>in section 2332b(g)(5)(B), by inserting <quote>40B(b)(1) (relating to weaponization of unmanned aircraft),</quote> before <quote>81</quote>; and</text></paragraph><paragraph id="H412D4F79E57C4909A576D8E18742CC11"><enum>(7)</enum><text>in section 2516(1)(c), by inserting <quote>section 39B (relating to unsafe operation of unmanned aircraft), section 40A (relating to interference by unauthorized unmanned aircraft with law enforcement, emergency response, and military activities), section 40B (relating to misuse of unmanned aircraft),</quote> before <quote>section 43</quote>.</text></paragraph></section></legis-body></bill>
