NICS Report.</toc-entry></toc></subsection></section><title id="HC3F54EC62DC1423EAFE93D3468221ADA"><enum>I</enum><header>Raise the Age</header><section id="HA367851F60D849DB8BEC3FCCE26F8846"><enum>101.</enum><header>Prohibition on Federal firearms licensee selling or delivering certain semiautomatic centerfire rifles or semiautomatic centerfire shotguns to a person under 21 years of age, with exceptions</header><subsection id="HB1F19988C92248D6B805C9C8B8CE366B"><enum>(a)</enum><header>In general</header><text>Section 922(b)(1) of title 18, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H3271AD43286649D8A89D86D88C82C9B1" style="OLC"><paragraph id="H8DF12C6C2FF248D38E407970FEE6D838"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H8ECB85E5C7DB46E88A55E8F8910AAE47"><enum>(A)</enum><text display-inline="yes-display-inline">any firearm or ammunition to any individual who the licensee knows or has reasonable cause to believe has not attained 18 years of age;</text></subparagraph><subparagraph id="H1FDFDC2BCB5D4DE3B34B417B61CE204F" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">any semiautomatic centerfire rifle or semiautomatic centerfire shotgun that has, or has the capacity to accept, an ammunition feeding device with a capacity exceeding 5 rounds, to any individual who the licensee knows or has reasonable cause to believe has not attained 21 years of age and is not a qualified individual; or</text></subparagraph><subparagraph id="HE50A1E5C5F304047BB30E03F5AE90918" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">if the firearm or ammunition is not a semiautomatic centerfire rifle or semiautomatic centerfire shotgun described in subparagraph (B) and is other than a shotgun or rifle, or ammunition for a shotgun or rifle, to any individual who the licensee knows or has reasonable cause to believe has not attained 21 years of age;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H63CA4BB4E47540C58891860ECC87EBCE" commented="no"><enum>(b)</enum><header>Conforming amendment</header><text>Section 922(c)(1) of such title is amended by striking <quote>in the case of any firearm</quote> and all that follows through <quote>eighteen years or more of age</quote> and inserting <quote>(1) in the case of a semiautomatic centerfire rifle or semiautomatic centerfire shotgun that has, or has the capacity to accept, an ammunition feeding device with a capacity exceeding 5 rounds, I am at least 21 years of age or a qualified individual (as defined in section 921(a)(30) of title 18, United States Code), (2) in the case of a firearm other than a shotgun, a rifle, or such a semiautomatic centerfire rifle or semiautomatic centerfire shotgun, I am at least 21 years of age, or (3) in the case of any other shotgun or rifle, I am at least 18 years of age</quote>.</text></subsection><subsection id="H96FB908CB7294150A741391B777B14FD"><enum>(c)</enum><header>Qualified individual defined</header><text>Section 921(a) of such title is amended by inserting after paragraph (29) the following:</text><quoted-block display-inline="no-display-inline" id="H2E7F684EC6A0436DB6D8C91EDA8216C5" style="OLC"><paragraph id="HE25D01D674B6475FB6B8A8BF2CAEE39E" indent="up1"><enum>(30)</enum><text display-inline="yes-display-inline">The term <term>qualified individual</term> means—</text><subparagraph id="HF1D02BA520724071A76296CDE2DA90E1"><enum>(A)</enum><text>a member of the Armed Forces on active duty; and</text></subparagraph><subparagraph id="H8A988F0BB54749DFAD29F7D394E932BC"><enum>(B)</enum><text display-inline="yes-display-inline">a full-time employee of the United States, a State, or a political subdivision of a State who in the course of his or her official duties is authorized to carry a firearm.</text></subparagraph></paragraph><paragraph id="HAF37887449CA49218BDB2C5884C185D5" indent="up1"><enum>(31)</enum><text display-inline="yes-display-inline">The term <term>ammunition feeding device</term> means a magazine, belt, drum, feed strip, or similar device, but does not include an attached tubular device which is only capable of operating with .22 caliber rimfire ammunition.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H0BA0F092CBFC4832AA3E560FFBCD460D"><enum>102.</enum><header>Operation of the Federal Bureau of Investigation’s public access line</header><subsection id="H25978EDA5ADB4A189E9F056187BD9371"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Director of the Federal Bureau of Investigation (in this section referred to as the <quote>FBI</quote>) shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report regarding operation of the FBI’s public access line.</text></subsection><subsection id="H5227D7A9D3E44C95BE75B68A7FD7226F"><enum>(b)</enum><header>Matters included</header><text display-inline="yes-display-inline">The report required by subsection (a) shall, at a minimum, include the following:</text><paragraph id="HAD2DBF38EE3A41CDA9AFDC265D933582"><enum>(1)</enum><text>A description of the protocols and procedures in effect with respect to information-sharing between the public access line and the field offices of the FBI.</text></paragraph><paragraph id="H3D7995FF99D5422C8D8A92A11E8CF55B"><enum>(2)</enum><text>Recommendations for improving the protocols and procedures to improve the information-sharing.</text></paragraph></subsection></section></title><title id="H19D307834E8C49AF8BDB3961C1BBA0A4"><enum>II</enum><header>Prevent Gun Trafficking</header><section id="H52010DE68B614C4698A8D12D61448321"><enum>201.</enum><header>Prohibition on straw purchases of firearms; prohibition on gun trafficking</header><subsection id="HBF39725B76494197B2C7EE44A6CFFB9A"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, is amended—</text><paragraph id="H49961EBB141D48F98C57C22FBAAE4F66"><enum>(1)</enum><text>in section 921(a), by adding at the end the following:</text><quoted-block id="H38BF24F2B7B74510B68AB914BDC3D3D1" style="OLC"><paragraph id="HD6AD4C308FCE4D25BE56DD94745F0888" indent="up1"><enum>(37)</enum><text>The term <term>family members</term> means spouses, domestic partners, parents and their children, including step-parents and their step-children, siblings, aunts or uncles and their nieces or nephews, or grandparents and their grandchildren.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H31859C61A038409580DA14060EE0EF21"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="HB653A017F8524DF1A3E434D4742EEBCD" style="USC"><section id="H0B9866F0037A40199DAEC8C84265B55D"><enum>932.</enum><header>Gun trafficking</header><subsection id="H1AFFF57FC1294DB49E6BEA08097C1E47"><enum>(a)</enum><text>It shall be unlawful for any person (other than a licensee under this chapter), in or otherwise affecting interstate or foreign commerce, to knowingly purchase or acquire, or attempt to purchase or acquire, a firearm for the possession of a third party.</text></subsection><subsection id="H18DC29CA476342AEBA7FF5BE947B6C43"><enum>(b)</enum><text display-inline="yes-display-inline">It shall be unlawful for any person (other than a licensee under this chapter), in or otherwise affecting interstate or foreign commerce, to hire, solicit, command, induce, or otherwise endeavor to persuade another person to purchase, or attempt to purchase, any firearm for the purpose of obtaining the firearm for the person or selling or transferring the firearm to a third party.</text></subsection><subsection id="H341911044AEA477F8CBB931895218BC4"><enum>(c)</enum><text>The Attorney General shall ensure that the firearm transaction record form required to be completed in connection with a firearm transaction includes a statement outlining the penalties that may be imposed for violating subsection (a).</text></subsection><subsection id="H2E1AAE3A04E14500B5F76BB32AADE145"><enum>(d)</enum><text>This section shall not apply to any firearm, if the purchaser or person acquiring the firearm has no reason to believe that the recipient of the firearm will use or intends to use the firearm in a crime or is prohibited from purchasing or possessing firearms under State or Federal law and the firearm—</text><paragraph id="H32A3EB6E59024F19ABB39E35FC12BAB4"><enum>(1)</enum><text>is purchased or acquired by any person, or that any person attempts to purchase or acquire, as a bona fide gift between family members; or</text></paragraph><paragraph id="H0591F461244D47869A2D195BB212CE17" commented="no"><enum>(2)</enum><text>is purchased or acquired by an agent of a lawful business, or that an agent of a lawful business attempts to purchase or acquire, for the purpose of transferring to another agent of the business, for lawful use in the business.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7DA7F493B8004153B69AC889DCA3B937"><enum>(b)</enum><header>Forfeiture</header><text>Section 982(a)(5) of such title is amended—</text><paragraph id="H5DBD868312E5496B8F778730DEAB7275"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>or</quote> at the end; and</text></paragraph><paragraph id="H1F8CBEED6CC049B7B7BA24D0BB39C041"><enum>(2)</enum><text>by inserting after subparagraph (E) the following:</text><quoted-block id="HCE535E214F124F44BEE7314545C2FB03" style="OLC"><subparagraph id="H7010C24DC1A54430B3CA1CDFA5114D5F" indent="up1"><enum>(F)</enum><text>section 922(a)(1)(A) (related to unlicensed firearms sales);</text></subparagraph><subparagraph id="HFDA88743B6CC4F5985E5DB762A1A48F7" indent="up1"><enum>(G)</enum><text>section 922(d) (relating to illegal gun transfers); or</text></subparagraph><subparagraph id="HC97FDA764BFE4873964CFB12E57944C1" indent="up1"><enum>(H)</enum><text>section 932 (relating to gun trafficking),</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HAFBF46EACD3E4F7B854B5A3DA77D7511"><enum>(c)</enum><header>Money laundering amendment</header><text>Section 1956(c)(7)(D) of such title is amended by striking <quote>section 924(n)</quote> and inserting <quote>section 922(a)(1)(A), 922(d), 924(n), or 932</quote>.</text></subsection><subsection id="H1AA947A668B3415CB20E64E8FA748038"><enum>(d)</enum><header>Clerical amendment</header><text>The table of sections for such chapter is amended by adding at the end the following:</text><quoted-block style="USC" id="HFE1776F80E0E48D48DEF37255131311E" display-inline="no-display-inline"><toc container-level="quoted-block-container" quoted-block="no-quoted-block" lowest-level="section" idref="HB653A017F8524DF1A3E434D4742EEBCD" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"><toc-entry idref="H0B9866F0037A40199DAEC8C84265B55D" level="section">932. Gun trafficking.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HB6B5239885F146CB917CF274280F46DE"><enum>202.</enum><header>Prohibition on disposition of firearm to person intending unlawful further disposition</header><text display-inline="no-display-inline">Section 922(d) of title 18, United States Code, is amended in the 1st sentence—</text><paragraph id="H5B804A587378473EABB1BCD86EA51495"><enum>(1)</enum><text>in paragraph (8), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="H2A5F2A4DFC884C7C80FC07FCE3EA1832"><enum>(2)</enum><text>in paragraph (9), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H0ACD490D9E774A079E92F060F1579264"><enum>(3)</enum><text>by inserting after and below paragraph (9) the following:</text><quoted-block id="H0C0AE3413F5A47D5B78730EC825E93DF" style="OLC"><paragraph id="H9B1D943FAB88451B803C4BF810B8E7F5"><enum>(10)</enum><text>intends to sell or otherwise dispose of the firearm or ammunition in violation of a Federal law, or to sell or otherwise dispose of the firearm or ammunition to a person in another State in violation of a law of that State.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H485C8DBCD9DB4D5E83C1FF5ED5927BDE"><enum>203.</enum><header>Penalties</header><text display-inline="no-display-inline">Section 924(a) of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block id="H6C64F1DAE90C42939D658D8DD7A1DDDE" style="OLC"><paragraph id="HC79C4EEC734342859DB4F20E24B61D7A" indent="up1"><enum>(8)</enum><text>Whoever knowingly violates section 922(a)(1)(A) or 932 shall be fined under this title, imprisoned not more than 10 years, or both.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H3942915C51C24480BE0E2C6A0F3CC911"><enum>204.</enum><header>Firearms subject to forfeiture</header><text display-inline="no-display-inline">Section 924(d) of title 18, United States Code, is amended—</text><paragraph id="HBDC27CBAEE57496FBC4F9CCF44E734C9"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>or 932</quote> after <quote>section 924</quote>; and</text></paragraph><paragraph id="H86BA518BF10542A58703684EE402AD9E"><enum>(2)</enum><text>in paragraph (3)—</text><subparagraph id="H8C8799309F91459EAA5BA785F2CCA01D"><enum>(A)</enum><text>in subparagraph (E), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H99619C5BDE1C459383AF33FA79647ADC"><enum>(B)</enum><text>in subparagraph (F), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HF2F771A15CD04EA786154BFF49399447"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="HBCFC9FF0D2C0420F9F0011040535C8A6" style="OLC"><subparagraph id="H5E04FB46D540466A8539144930B04355" indent="up1"><enum>(G)</enum><text>any offense under section 932.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></title><title id="HDF2105780E3F49CABE285103D6794FE9" commented="no"><enum>III</enum><header>Untraceable Firearms</header><section id="HCF010785CDC04BE48ED37FA65C882EC7" commented="no"><enum>301.</enum><header>Requirement that all firearms be traceable</header><subsection id="H409D02C1ECC6482EA00A99A63DF7F634" commented="no"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 921(a) of title 18, United States Code, as amended by this Act, is further amended—</text><paragraph id="H2E07516997F746889B7E43E0AA006663"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (10), by adding at the end the following: <quote>The term <term>manufacturing firearms</term> shall include assembling a functional firearm or molding, machining, or 3D printing a frame or receiver, and shall not include making or fitting special barrels, stocks, or trigger mechanisms to firearms.</quote>; and</text></paragraph><paragraph id="HDA8FA5E6DD2A4AF596DE5A8883114302"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H03911FE3672A4A589091B9F4C01E1CDA"><paragraph id="HEA9D3719925A4DBAB1D1ECB20981ABE7" indent="up1" commented="no"><enum>(38)</enum><text>The term <term>ghost gun</term>—</text><subparagraph id="HA3C27907674A4CD88652AC6FC4AEF0A4" commented="no"><enum>(A)</enum><text>means a firearm, including a frame or receiver, that lacks a unique serial number engraved or cast on the frame or receiver by a licensed manufacturer or importer in accordance with this chapter; and</text></subparagraph><subparagraph id="HCED696DA51634962A3107B406A42FE48" commented="no"><enum>(B)</enum><text>does not include—</text><clause id="HF4D636DC48B544649F306E32DA462D36" commented="no"><enum>(i)</enum><text>a firearm that has been rendered permanently inoperable; </text></clause><clause id="HDF63C61CAA5A4958A591000D32ED0E0A" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">a firearm that, not later than 30 months after the date of enactment of this paragraph, has been identified by means of a unique serial number, assigned by a State agency, engraved or cast on the receiver or frame of the firearm in accordance with State law; </text></clause><clause id="H39C1F2E1327B41ADADB5377F46837642" commented="no"><enum>(iii)</enum><text>a firearm manufactured or imported before December 16, 1968; or</text></clause><clause id="H5E7067F79C154CBEAD9B29D56846228A" commented="no"><enum>(iv)</enum><text>a firearm identified as provided for under <external-xref legal-doc="usc" parsable-cite="usc/26/5842">section 5842</external-xref> of the Internal Revenue Code of 1986.</text></clause></subparagraph></paragraph><paragraph indent="up1" id="H57814E8BA4AC4EF1ADBDF51A1572E552" commented="no"><enum>(39)</enum><text>The term <term>fire control component</term>—</text><subparagraph id="H8020DA35B92342428D57081419CBD5C3" commented="no"><enum>(A)</enum><text>means a component necessary for the firearm to initiate or complete the firing sequence; and </text></subparagraph><subparagraph id="H6E929328DF104882B049CD51147A9EEE" commented="no"><enum>(B)</enum><text>includes a hammer, bolt or breechblock, cylinder, trigger mechanism, firing pin, striker, and slide rails.</text></subparagraph></paragraph><paragraph id="HDF18BDEF97194B1EB69A4DA71E47DFEC" indent="up1" commented="no"><enum>(40)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H81C60FA7333D41BCB4461FABFC6EF6E1"><enum>(A)</enum><text>The term <term>frame or receiver</term>—</text><clause id="HD9055A169C1D469391807B8920A18BA1" indent="up1" commented="no"><enum>(i)</enum><text>means a part of a weapon that provides or is intended to provide the housing or structure to hold or integrate 1 or more fire control components, even if pins or other attachments are required to connect those components to the housing or structure;</text></clause><clause id="H4CEBB21EAA2A4D5085F536B5B43BCDD1" indent="up1" commented="no"><enum>(ii)</enum><text>includes a frame or receiver, blank, casting, or machined body, that requires modification, including machining, drilling, filing or molding, to be used as part of a functional firearm, and which is designed and intended to be used in the assembly of a functional firearm, unless the piece of material has had—</text><subclause id="H5F65627EC2D84555AB25B57271ECA1BD" commented="no"><enum>(I)</enum><text>its size or external shape altered solely to facilitate transportation or storage; or</text></subclause><subclause id="H68DFDAF86E3B4FF2B0AEBE1A4208E689" commented="no"><enum>(II)</enum><text>solely its chemical composition altered.</text></subclause></clause></subparagraph><subparagraph id="H0834BB16A35A40FAB53B72E3D24A0FE7" indent="up1"><enum>(B)</enum><text>For purposes of subparagraph (A)(i), if a weapon with more than 1 part that provides the housing or a structure designed to hold or integrate 1 or more fire control or essential components, each such part shall be considered a frame or receiver, unless the Attorney General has provided otherwise by regulation or other formal determination with respect to the specific make and model of weapon on or before January 1, 2023.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="HCE3ADD780D044D38A48C405768FBEA23"><enum>(b)</enum><header>Prohibition; requirements</header><text>Section 922 of title 18, United States Code, is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H15063294DD6348038D6600AB76B19990"><subsection id="HDE30EBC6D10A40A29060133D5A27C703" commented="no"><enum>(aa)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HF29E784C30DF4E54801EB452DF84BC10"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H5B25F06437564C43A6EA3A49AFC7BF05"><enum>(A)</enum><text>Except as provided in subparagraph (B), it shall be unlawful for any person to manufacture, sell, offer to sell, transfer, purchase, or receive a ghost gun in or affecting interstate or foreign commerce.</text></subparagraph><subparagraph id="HBC85AF4AE69A4912BA9727DFCA31859A" indent="up2"><enum>(B)</enum><text>Subparagraph (A) shall not apply to—</text><clause id="H1240E9AD34BE495BB9D21679BC443042" commented="no"><enum>(i)</enum><text>the manufacture of a firearm by a licensed manufacturer if the licensed manufacturer complies with section 923(i) before selling or transferring the firearm to another person;</text></clause><clause id="H4262934907A34DD8AD882BA29D19D26C" commented="no"><enum>(ii)</enum><text>the offer to sell, sale, or transfer of a firearm to, or purchase or receipt of a firearm by, a licensed manufacturer or importer before the date that is 30 months after the date of enactment of this subsection; or</text></clause><clause id="H527A0568BBB74BE1A945066639DC32F1" commented="no"><enum>(iii)</enum><text>transactions between licensed manufacturers and importers on any date.</text></clause></subparagraph></paragraph><paragraph id="HDC7FE41F3002426E8F9AA81090D72C44" indent="up1" commented="no"><enum>(2)</enum><text>It shall be unlawful for a person other than a licensed manufacturer or importer to engrave or cast a serial number on a firearm in or affecting interstate or foreign commerce unless specifically authorized by the Attorney General.</text></paragraph><paragraph id="H33D9A63B3053493E9D75F1942DA2A567" indent="up1" commented="no"><enum>(3)</enum><text>Beginning on the date that is 30 months after the date of enactment of this subsection, it shall be unlawful for any person other than a licensed manufacturer or importer to knowingly possess a ghost gun in or affecting interstate or foreign commerce. </text></paragraph><paragraph id="H0CAE1B92EFDF48EB8640FA246E0F154E" indent="up1" commented="no"><enum>(4)</enum><text>Beginning on the date that is 30 months after the date of enactment of this subsection, it shall be unlawful for any person other than a licensed manufacturer or importer to possess a ghost gun in or affecting interstate or foreign commerce with the intent to sell or transfer the ghost gun with or without further manufacturing or to manufacture a firearm with the ghost gun.</text></paragraph><paragraph id="HEB404F42D82B496DAD83A363F1EB54F7" indent="up1" commented="no"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HC0EC95B5B70B4040B4C0A15696A7E8E3"><enum>(A)</enum><text>It shall be unlawful for any person to sell, offer to sell, or transfer, in or affecting interstate or foreign commerce, to any person other than a licensed manufacturer a machine that has the sole or primary function of manufacturing firearms.</text></subparagraph><subparagraph id="HF8330078EFB644DC868B9C3673DB9326" indent="up1" commented="no"><enum>(B)</enum><text>Except as provided in subparagraph (A), beginning on the date that is 180 days after the date of enactment of this subsection, it shall be unlawful for any person other than a licensed manufacturer to possess, purchase, or receive, in or affecting interstate or foreign commerce, a machine that has the sole or primary function of manufacturing firearms.</text></subparagraph><subparagraph indent="up1" id="H93CF33A6E53E447C9AC3FBACDE89DC36" commented="no"><enum>(C)</enum><text>Subparagraph (B) shall not apply to a person who is engaged in the business of selling manufacturing equipment to a licensed manufacturer who possesses a machine with the intent to sell or transfer the machine to a licensed manufacturer.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="HB697A7E48E994EE2AB79AE420265CEB9"><enum>(c)</enum><header>Requirements</header><paragraph commented="no" id="H5CC4D89F1A434E31994FAD270B2653DC"><enum>(1)</enum><header>Removal of serial numbers</header><text>Section 922(k) of title 18, United States Code, is amended—</text><subparagraph commented="no" id="HDB4B48AE794E498C80C28FA6F8991ED1"><enum>(A)</enum><text>by striking <quote>importer's or manufacturer's</quote> each place it appears; and</text></subparagraph><subparagraph commented="no" id="H66FB3D645DCA404D9055E34E592756EC"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>authorized by this chapter or under State law</quote> before <quote>removed</quote> each place it appears. </text></subparagraph></paragraph><paragraph commented="no" id="H0B74530103DC46E6B9B453E0F28355D8"><enum>(2)</enum><header>Licensed importers and manufacturers</header><text>Section 923(i) of title 18, United States Code, is amended—</text><subparagraph commented="no" id="HA40EA5127B96407AA3663DD0D6823B41"><enum>(A)</enum><text>by inserting <quote>(1)(A)</quote> before <quote>Licensed</quote>; and</text></subparagraph><subparagraph commented="no" id="HB35EEEA7F12B417789106A3F58E88043"><enum>(B)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="HFD01DCBA7B5943C39E3C71DF14805930"><text>The serial number shall be engraved or cast on the frame or receiver in a manner sufficient to identify the firearm and the manufacturer or importer that put the serial number on the firearm.</text><paragraph id="H21BF204E997C4243B7FE4BDAC2B38986" indent="up1" commented="no"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HC1967B6A0A574F478D3E0EF1F58B145D"><enum>(A)</enum><text>Not later than 180 days after the date of enactment of this paragraph, the Attorney General shall prescribe regulations for engraving a unique serial number onto a ghost gun. </text></subparagraph><subparagraph indent="up1" id="H080D292FA73A4C99865AFFA8D6769822" commented="no"><enum>(B)</enum><text>The regulations prescribed under subparagraph (A) shall—</text><clause id="H9B021AA1517841538441426B1E02E3D1" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">allow an owner of a firearm described in subparagraph (A) to have a unique serial number engraved on the firearm by a licensed manufacturer or importer; and </text></clause><clause id="H7B04A3B290714092939BA60A2AF0C16D" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">require that a serial number be engraved on the frame or receiver in a manner sufficient to identify the firearm and the licensed manufacturer or importer that put the serial number on the firearm. </text></clause></subparagraph><subparagraph indent="up1" id="H46517738BB424AE8A33E3D4D5678E7C9" commented="no"><enum>(C)</enum><text>The regulations authorized under this paragraph shall expire on the date that is 30 months after the date of enactment of this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" id="H5F69164D03B7453F8D8674A974EBB12A"><enum>(d)</enum><header>Penalties</header><text>Section 924 of title 18, United States Code, is amended—</text><paragraph id="H9DBB4876ED204343861C3F495E1E2446" commented="no"><enum>(1)</enum><text>in subsection (a)(1)(B), by striking <quote>or (q)</quote> and inserting <quote>(q), (aa)(1), (aa)(2), (aa)(4), or (aa)(5)</quote>; </text></paragraph><paragraph id="H5BB6124E2A404692BDE9E82C15137C76" commented="no"><enum>(2)</enum><text>in subsection (c)</text><subparagraph id="H4DBC7C69908C4144ABD0E815F276E8FA" commented="no"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H666CB03B85334FD0BCC5646DFEB35469" commented="no"><enum>(i)</enum><text>in subparagraph (A), in the matter preceding clause (i), by inserting <quote>functional</quote> before <quote>firearm</quote> each place it appears; </text></clause><clause id="HAFE8851CE05743FA85766CCF52FAE93B" commented="no"><enum>(ii)</enum><text>in subparagraph (B), in the matter preceding clause (i), by inserting <quote>functional</quote> before <quote>firearm</quote>; and</text></clause><clause id="H7091BB3440ED45E4A6E48870AD2B5111" commented="no"><enum>(iii)</enum><text>in subparagraph (D)(ii), by inserting <quote>functional</quote> before <quote>firearm</quote>; and</text></clause></subparagraph><subparagraph id="H7A29EC66E37449EF819ED0F32E6678BC" commented="no"><enum>(B)</enum><text>in paragraph (4), by striking <quote>all or part of the firearm</quote> and all that follows through <quote>person.</quote> and inserting the following: <quote>all or part of the functional firearm, or otherwise make the presence of the functional firearm known to another person, in order to intimidate that person, regardless of whether the functional firearm is directly visible to that person.</quote>; </text></subparagraph></paragraph><paragraph id="H5AD5941793D045C792916FD66CCD6294" commented="no"><enum>(3)</enum><text>in subsection (d)(1), by striking <quote>or (k)</quote> and inserting <quote>(k), (aa)(1), (aa)(2), (aa)(4), or (aa)(5)</quote>; </text></paragraph><paragraph id="HB1DF215CC9D54DEEB468D5399C8AD02F" commented="no"><enum>(4)</enum><text>in subsection (e)(1), by inserting <quote>through the possession of a functional firearm</quote> before <quote>and has three</quote>; and</text></paragraph><paragraph id="H5FB1DC649E29452D800EBB44FABE9143" commented="no"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H55652373792948FB978850C4B3B1461D"><subsection id="H51A4105462284FFDB3AA09A9DEA66B5D" commented="no"><enum>(q)</enum><text>A person who violates section 922(aa)(3) shall—</text><paragraph id="HE0E0D7C23A3043A29289C730FAC58339" commented="no"><enum>(1)</enum><text>in the case of the first violation by the person, be fined under this title, imprisoned not more than 1 year, or both; or</text></paragraph><paragraph id="HD6904B90E97B41D8850915CFA3366AB4" commented="no"><enum>(2)</enum><text>in the case of any subsequent violation by the person, be fined under this title, imprisoned not more than 5 years, or both.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section section-type="subsequent-section" id="H5BD01BEC7B0D40E19CBC57A90DA89157" commented="no"><enum>302.</enum><header>Modernization of the prohibition on undetectable firearms</header><text display-inline="no-display-inline">Section 922(p) of title 18, United States Code, is amended—</text><paragraph id="HFD1A2A854677429A9EB79A06A6D3D65C" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph id="H09A6950762E14B03A5B6D95C96830380" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by striking <quote>any firearm</quote>;</text></subparagraph><subparagraph id="H0501A0804B3E4DCFB4276A12AD9D6668" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6082D8D48F2F4DF7B1928C7CF42B7EEF"><subparagraph id="HF4C3C667A9E8403DA95603077F7908E5" indent="up1" commented="no"><enum>(A)</enum><text>an undetectable firearm; or</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H55D84831BA414A87897FAEABC6725BFA" commented="no"><enum>(C)</enum><text>in subparagraph (B), by striking <quote>any major component of which, when subjected to inspection by the types of x-ray machines commonly used at airports, does not generate</quote> and inserting the following: <quote>a major component of a firearm which, if subjected to inspection by the types of detection devices commonly used at airports for security screening, would not generate</quote>;</text></subparagraph></paragraph><paragraph id="HA5CA3612EF6445EF8C8C2D767322BE27" commented="no"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="HE638ED63C6234186BED4C4BA48C0FADF" commented="no"><enum>(A)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H80A8D27D97A64D2FB393887DBB48D318"><subparagraph id="HDE949899AC6B41CEB8E34075C446BDC8" indent="up1" commented="no"><enum>(A)</enum><text>the term <term>undetectable firearm</term> means a firearm, as defined in section 921(a)(3)(A), of which no major component is wholly made of detectable material;</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="HE1DF2EF5FB2A46B4B523FE3212A4EA6A" commented="no"><enum>(B)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H513D697E73AE426485D00680B4BA70F1"><subparagraph id="HEEC3E58D9B044FF5BC2AABC449A8C51F" indent="up1" commented="no"><enum>(B)</enum><text>the term <term>major component</term>, with respect to a firearm—</text><clause id="H45C75FDF72284BC3BC5587DE957B187D" commented="no"><enum>(i)</enum><text>means the slide or cylinder or the frame or receiver of the firearm; and</text></clause><clause id="HA7D9BE0AFEB443FEABF9A8C66AB4244C" commented="no"><enum>(ii)</enum><text>in the case of a rifle or shotgun, includes the barrel of the firearm; and</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HF4C9B65CFF8C4DE2BEFB3E104D0FB020" commented="no"><enum>(C)</enum><text>by striking subparagraph (C) and all that follows through the end of the undesignated matter following subparagraph (C) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6410AF31E2B44C2D8CF64ED612281750"><subparagraph id="HC33091D2149840528F146E1C58A399B5" indent="up1" commented="no"><enum>(C)</enum><text>the term <term>detectable material</term> means any material that creates a magnetic field equivalent to or more than 3.7 ounces of 17–4 pH stainless steel.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H4A03CD21F81445899317568B97C5E0D8" commented="no"><enum>(3)</enum><text>in paragraph (3)—</text><subparagraph id="HE523CEA7B54743038C68BFA6ACD7C9B4" commented="no"><enum>(A)</enum><text>in the first sentence, by inserting <quote>, including a prototype,</quote> after <quote>of a firearm</quote>; and</text></subparagraph><subparagraph id="H212D44488B9846198FA8C65E1F5E2170" commented="no"><enum>(B)</enum><text>by striking the second sentence; and</text></subparagraph></paragraph><paragraph id="HDE4259C7795D4CFA93CE33CE26812FE1" commented="no"><enum>(4)</enum><text>in paragraph (5), by striking <quote>shall not apply to any firearm which</quote> and all that follows and inserting the following: “shall not apply to—</text><quoted-block style="OLC" display-inline="no-display-inline" id="H47AAF69FDC5F447085ED63B6B92E35E0"><subparagraph id="H9163878023FF469F819719EBA8C4CA81" indent="up1" commented="no"><enum>(A)</enum><text>any firearm received by, in the possession of, or under the control of the United States; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H67598FFBAB924884B7D46681DFEDA667" indent="up1"><enum>(B)</enum><text>the manufacture, importation, possession, transfer, receipt, shipment, or delivery of a firearm by a licensed manufacturer or licensed importer pursuant to a contract with the United States.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title><title id="H44A1CDD906F34D32AE8D25767C21FC82"><enum>IV</enum><header>Safe Storage</header><section id="HD9C1EBCE7E52483A80CB09FA6C9EDFA5"><enum>401.</enum><header>Ethan’s Law</header><subsection id="H51588E6B69DD4DDFB5D5E96A06535AD7"><enum>(a)</enum><header>Secure gun storage or safety device</header><text>Section 922(z) of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HA4DA7F3C3E0A4B62A69A4EEE4F6112EC" style="OLC"><paragraph id="HF07FC8A06B174BA0BAA341E44A7C0D96"><enum>(4)</enum><header>Secure gun storage by owners</header><subparagraph id="H1FB8255FAC124C99B8DDDACFA2ADF7C3"><enum>(A)</enum><header>Offense</header><clause id="H9DA673769AC541CB998164177D585F5F"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), it shall be unlawful for a person to store or keep any firearm that has moved in, or that has otherwise affected, interstate or foreign commerce on the premises of a residence under the control of the person if the person knows, or reasonably should know, that—</text><subclause id="H68BB93332B34411FA1CAAC1CE8197E40"><enum>(I)</enum><text>a minor is likely to gain access to the firearm without the permission of the parent or guardian of the minor; or</text></subclause><subclause id="H76BD8114866A4E3490026A76FD4B3DE2"><enum>(II)</enum><text>a resident of the residence is ineligible to possess a firearm under Federal, State, or local law.</text></subclause></clause><clause id="H48EDD7A601A34B95AC4EE654A8723000"><enum>(ii)</enum><header>Exception</header><text>Clause (i) shall not apply to a person if—</text><subclause id="H05FF2E3BC14E404FBE2E321C9E0B0BDC"><enum>(I)</enum><text>the person—</text><item id="HFB48D380FE25429DBB86BD89910A3302"><enum>(aa)</enum><text>keeps the firearm—</text><subitem id="HFC78EF21F8DC41E988638C075E6202A4"><enum>(AA)</enum><text>secure using a secure gun storage or safety device; or</text></subitem><subitem id="H2F0E30C5F48C4A74B957D58AFB8CAF24"><enum>(BB)</enum><text>in a location which a reasonable person would believe to be secure; or</text></subitem></item><item id="HB5BF5DB19DAC4C41A2B35D2093D6C1A4"><enum>(bb)</enum><text display-inline="yes-display-inline">carries the firearm on his or her person or within such close proximity thereto that the person can retrieve and use the firearm as readily as if the person carried the firearm on his or her person; or</text></item></subclause><subclause id="H0B6CF03DADC448969D6D17A93A3235E3"><enum>(II)</enum><text display-inline="yes-display-inline">another individual unlawfully enters the premises under the control of the person and thereby gains access to the firearm. </text></subclause></clause></subparagraph><subparagraph id="H51D41381026C4607BF58E5586D22029B"><enum>(B)</enum><header>Penalty</header><clause id="H447C7DF7BF5A492C9356131021B6E469" commented="no"><enum>(i)</enum><header>In general</header><text>Except as otherwise provided in this subparagraph, any person who violates subparagraph (A) shall be fined $500 per violation.</text></clause><clause id="H2A4990E303E04B52948B5D2C711DE6CC"><enum>(ii)</enum><header>Forfeiture of improperly stored firearm</header><text>Any firearm stored in violation of subparagraph (A) shall be subject to seizure and forfeiture in accordance with the procedures described in section 924(d).</text></clause></subparagraph><subparagraph id="H2A0BF844AE3A4B2DA04122B4A307B04C"><enum>(C)</enum><header>Minor defined</header><text>In this paragraph, the term <term>minor</term> means an individual who has not attained 18 years of age.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H510BFD146DA44DEC81AD39A192E060D7"><enum>(b)</enum><header>Firearm Safe Storage Program</header><text>Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10101">34 U.S.C. 10101 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H24B656A3760E4B9A92C87F2C354B9372" style="OLC"><part id="H60B01620B9144780BA2AD73DC3DB2894" style="OLC"><enum>PP</enum><header>Firearm Safe Storage Program</header><section id="H7C11515A3CBD42CFA9680346C88C556C"><enum>3061.</enum><header>Firearm Safe Storage Program</header><subsection id="H8AE28337A23D45FAA06B0F46578DE23E"><enum>(a)</enum><header>In general</header><text>The Assistant Attorney General shall make grants to an eligible State or Indian Tribe to assist the State or Indian Tribe in carrying out the provisions of any State or Tribal law that is functionally identical to section 922(z)(4) of title 18, United States Code.</text></subsection><subsection id="HD6F92A9CE64D4E3CAEA0D4000412BB47"><enum>(b)</enum><header>Eligible State or Indian Tribe</header><paragraph id="HB70230A164444B9CB5A4A49ABD44CE6B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), a State or Indian Tribe shall be eligible to receive grants under this section on and after the date on which the State or Indian Tribe enacts legislation functionally identical to section 922(z)(4) of title 18, United States Code.</text></paragraph><paragraph id="H8842783BB1AA4D65817F8A3EC3CC83DB"><enum>(2)</enum><header>First year eligibility exception</header><subparagraph id="HC4C46DDBFB124F96A904AF7DAFDE89F1"><enum>(A)</enum><header>In general</header><text>A covered State or Indian Tribe shall be eligible to receive a grant under this section during the 1-year period beginning on the date of enactment of this part.</text></subparagraph><subparagraph id="H90091AEBB1F04C20913C723AABC92517"><enum>(B)</enum><header>Covered State or Indian Tribe</header><text display-inline="yes-display-inline">In this paragraph, the term <term>covered State or Indian Tribe</term> means a State or Indian Tribe that, before the date of enactment of this part, enacted legislation that is functionally identical to section 922(z)(4) of title 18, United States Code.</text></subparagraph></paragraph></subsection><subsection id="H8B4A734227834AAB988E029943D37637"><enum>(c)</enum><header>Use of funds</header><text>Funds awarded under this section may be used by a State or Indian Tribe to assist law enforcement agencies or the courts of the State or Indian Tribe in enforcing and otherwise facilitating compliance with any State law functionally identical to section 922(z)(4), of title 18, United States Code.</text></subsection><subsection id="H96E7D0E148E04FAEB4115E83614BE61C"><enum>(d)</enum><header>Application</header><text>An eligible State or Indian Tribe desiring a grant under this section shall submit to the Assistant Attorney General an application at such time, in such manner, and containing or accompanied by such information, as the Assistant Attorney General may reasonably require.</text></subsection><subsection id="H5807C67162C24872BB7388C51FC5DD8E"><enum>(e)</enum><header>Incentives</header><text display-inline="yes-display-inline">For each of fiscal years 2023 through 2027, the Attorney General shall give affirmative preference to all Bureau of Justice Assistance discretionary grant applications of a State or Indian Tribe that has enacted legislation functionally identical to section 922(z)(4) of title 18, United States Code. </text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H80F40F33CFC54B1A89B4D223750D3B4C"><enum>402.</enum><header>Safe guns, safe kids</header><text display-inline="no-display-inline">Paragraph (4)(B) of section 922(z) of title 18, United States Code, as added by this Act, is amended by adding at the end the following: </text><quoted-block style="USC" id="HABA53E01AA0146988697F3D273F6E0E8" display-inline="no-display-inline"><clause id="H55402BEEDB3C44BE9D419011C65ECEB2" commented="no"><enum>(iii)</enum><header>Enhanced penalty</header><text>If a person violates subparagraph (A) and a minor or a resident who is ineligible to possess a firearm under Federal, State, or local law obtains the firearm and causes injury or death to such minor, resident, or any other individual, the person shall be fined under this title, imprisoned for not more than 5 years, or both.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H3B810F2D6F44437CA45C88428D61A01E"><enum>403.</enum><header>Kimberly Vaughan Firearm Safe Storage</header><subsection id="H8ABB7AEA30BA403099E0BE49D50A8663"><enum>(a)</enum><header>Best practices for safe firearm storage</header><paragraph id="H58C46F3EDF724ADEBAB88783F5730688"><enum>(1)</enum><header>Establishment</header><subparagraph id="H9D0ABCB56E31436F9A3F1C6FBFDC2461"><enum>(A)</enum><header>In general</header><clause id="H43D3CDF3168948D0914F77C1882194B5"><enum>(i)</enum><text>Not later than 180 days after the enactment of this Act, the Attorney General shall establish voluntary best practices relating to safe firearm storage solely for the purpose of public education.</text></clause><clause id="H727A6054AC314B5E9E4B908817238CF2"><enum>(ii)</enum><text>The Attorney General shall give not less than ninety days public notice, and shall afford interested parties opportunity for hearing, before establishing such best practices.</text></clause></subparagraph><subparagraph id="HCC21366B490245D29E5A494A5425EFA5"><enum>(B)</enum><header>Requirements</header><text>In establishing the best practices required under subparagraph (A), the Attorney General shall outline such best practices for preventing firearm loss, theft, and other unauthorized access for the following locations:</text><clause id="H4896CE36955B4F3BB2068D1577928889"><enum>(i)</enum><text>Businesses.</text></clause><clause id="H420D75B0AD4A483B8DDABA73860ED39B"><enum>(ii)</enum><text>Vehicles.</text></clause><clause id="HB4BE067DA1504443AC472FC44F1431D1"><enum>(iii)</enum><text>Private homes.</text></clause><clause id="H4C36A038678B402991F0EBEDED210124"><enum>(iv)</enum><text>Off-site storage facilities.</text></clause><clause id="H7A375F0C4426480592BB66EC22E074F6"><enum>(v)</enum><text>Any other such place the Attorney General deems appropriate to provide such guidance.</text></clause></subparagraph><subparagraph id="HCC6AF67DB98F42E48C41E83F6D92AC3E"><enum>(C)</enum><header>Publication</header><text>Not later than 1 year after the enactment of this Act, the Attorney General shall publish, in print and on a public website, the best practices created pursuant to subparagraph (A) and shall review such best practices and update them not less than annually.</text></subparagraph></paragraph></subsection><subsection id="H0BE784EEC01E4235833A8D9F997BB94F"><enum>(b)</enum><header>Promotion of safe firearm storage</header><paragraph id="H0DDC3A1D8EA64C1589792E072FD6ED66"><enum>(1)</enum><header>In general</header><text>Section 923 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block id="H955C8D74BF70447A920B6714C90F026F" style="OLC"><subsection id="HB9EA3607E9144862A76E9C04D5D64E5A"><enum>(m)</enum><text>Beginning on January 1, 2025, licensed manufacturers and licensed importers that serialize not less than 250 firearms annually pursuant to subsection (i) shall provide a clear and conspicuous written notice with each manufactured or imported handgun, rifle, or shotgun that—</text><paragraph id="H0CB56342A80E46D0B10BF8C93BDAA91C"><enum>(1)</enum><text>is attached or adhered to, or appears on or within any packaging of, each handgun, rifle, or shotgun; and</text></paragraph><paragraph id="HC64C7EF7666F474194632A41F052853A"><enum>(2)</enum><text>states <quote>SAFE STORAGE SAVES LIVES</quote> followed by the address of the public website established by the Attorney General pursuant to section 403(a) of the Protecting Our Kids Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H443E07E1C282406982EE9B28359781D2"><enum>(c)</enum><header>Safe storage devices for all firearm sales</header><paragraph id="HBF0B767112CE4390B415B572B7BA0232"><enum>(1)</enum><header>In general</header><text>Section 922(z) of title 18, United States Code, is amended by striking <quote>handgun</quote> each place it appears and inserting <quote>handgun, rifle, or shotgun</quote>.</text></paragraph><paragraph id="H0F951D1D3F3B4998BAA6C6EAFBBDA83A"><enum>(2)</enum><header>Effective date</header><text>This section and the amendments made by this section shall take effect on the date that is 180 days after the enactment of this Act.</text></paragraph></subsection><subsection id="H2732A33C5B2640FDA69B9A9C8B55786C"><enum>(d)</enum><header>Kimberly Vaughan safe firearm storage grant program</header><text display-inline="yes-display-inline">Part PP of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10101">34 U.S.C. 10101 et seq.</external-xref>), as added by this Act, is amended by adding at the end the following:</text><quoted-block style="OLC" id="H4642F6294D394D74AC444334002B38F0" display-inline="no-display-inline"><section id="H8768DEADBD3049C2A55B31D79EE129EA"><enum>3062.</enum><header>Kimberly Vaughan Firearm Safe Storage Grant Program</header><subsection id="H56DE5315A2D447D1AE40217AC50D2E18"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">The Attorney General may award grants to States and Indian Tribes for the development, implementation, and evaluation of Safe Firearm Storage Assistance Programs.</text></subsection><subsection id="HA1C12B8F38D849D0992227D690937BEE"><enum>(b)</enum><header>Application requirements</header><text>Each applicant for a grant under this section shall—</text><paragraph id="H7A0553A1FD8D410DAE0A4EBA98B9EC5E"><enum>(1)</enum><text>submit to the Attorney General an application at such time, in such a manner, and containing such information as the Attorney General may require; and</text></paragraph><paragraph id="HC74D1B96745E4393932307F02884A5C7"><enum>(2)</enum><text>to the extent practicable, identify State, local, Tribal, and private funds available to supplement the funds received under this section.</text></paragraph></subsection><subsection id="H9C07B5048DA040A4988915EAC7A63D26"><enum>(c)</enum><header>Reporting requirement</header><paragraph id="HECAB4C97FEB34276B4C3390137B9F7FF"><enum>(1)</enum><header>Grantee report</header><text display-inline="yes-display-inline">A recipient of a grant under this section shall submit to the Attorney General an annual report, which includes the following information:</text><subparagraph id="H8C48FCB527934F89A5A4B4F8D672B11E"><enum>(A)</enum><text>The amount distributed to each Safe Firearm Storage Assistance Program in the jurisdiction.</text></subparagraph><subparagraph id="HE754DE134E6B40A69F492DAC897CE30D"><enum>(B)</enum><text>The number of safe firearm storage devices distributed by each such Safe Firearm Storage Assistance Program.</text></subparagraph><continuation-text continuation-text-level="paragraph">A recipient of a grant under this section may not include any personally identifying information of recipients of safe firearms storage devices pursuant to a Safe Firearm Storage Assistance Program that received funding pursuant to this section. </continuation-text></paragraph><paragraph id="H9115FCFB043B478899752BC13A09F6C4"><enum>(2)</enum><header>Attorney General report</header><text>Beginning 13 months after the first grants are awarded under this section, and annually thereafter, the Attorney General shall submit to Congress a report, which shall include following information:</text><subparagraph id="H8446AEC4C022416C8DAD2C71D06312F4"><enum>(A)</enum><text>A list of grant recipients during the previous year, including the funds awarded, cumulatively and disaggregated by grantee.</text></subparagraph><subparagraph id="HF4D595DD25DF499FAF2AB0A9FECFAC20"><enum>(B)</enum><text>The information collected pursuant to subsection (d)(1).</text></subparagraph></paragraph></subsection><subsection id="HAF8347209A5B4C1CA77A9B633196F5B6"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Attorney General to carry out this section $10,000,000 for each of fiscal years 2023 through 2033, to remain available until expended.</text></subsection><subsection id="H0D491EB41E404E7BA933E009B326BC15"><enum>(e)</enum><header>Use of funds</header><text>Funds awarded under this section shall be allocated as follows: </text><paragraph id="HD0363E69219C4B498DFB88A492A5A5A2"><enum>(1)</enum><text>Not less than 75 percent of the funds received by a grantee shall be used to create or to provide resources for Safe Firearm Storage Assistance Programs in the jurisdiction. </text></paragraph><paragraph id="HD71608296FA545298AA2953E9938F70D"><enum>(2)</enum><text display-inline="yes-display-inline">Not more than 25 percent of the funds received by a grantee may be made available to nonprofit organizations to partner with units of local government to purchase and distribute safe firearm storage devices.</text></paragraph></subsection><subsection id="H8109BFFC24E74AE0AB6A4E2874E60857"><enum>(f)</enum><header>Definitions</header><text>For purposes of this section:</text><paragraph id="HCE448FAA69154D288B9D56BBDCF405AC"><enum>(1)</enum><text>The term <term>safe firearm storage device</term> means a device that is—</text><subparagraph id="HDB57113B84144C159E19D8A8D619F53E"><enum>(A)</enum><text>designed and marketed for the principal purpose of denying unauthorized access to, or rendering inoperable, a firearm or ammunition; and</text></subparagraph><subparagraph id="H6AF6EA4925B84F0CAB05439602EAA2B6"><enum>(B)</enum><text>secured by a combination lock, key lock, or lock based on biometric information which, once locked, is incapable of being opened without the combination, key, or biometric information, respectively.</text></subparagraph></paragraph><paragraph id="H910D1153506B468A8C281A6D79811A96"><enum>(2)</enum><text>The term <term>Safe Firearm Storage Assistance Program</term> means a program—</text><subparagraph id="H981BC60220834B5AB6F345B5400A80DD"><enum>(A)</enum><text>carried out by a unit of local government or an Indian tribe; and</text></subparagraph><subparagraph id="H8E59EF8C37D1471687723A41123CB7C6"><enum>(B)</enum><text>solely for the purpose of acquiring and distributing safe firearm storage devices to the public.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title><title id="H72B82F8D0D5D46CC93349EAC6593A893"><enum>V</enum><header>Closing the Bump Stock Loophole</header><section id="HF5DD7E1D71FA480883FF12535A803584"><enum>501.</enum><header>Bump stocks</header><subsection id="HBA573EFD1E40470CA334A6D4C164BBDF"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5845">Section 5845</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="H238673F08DE44355AAC2BD1CCBC6D300"><enum>(1)</enum><text>in subsection (a), by striking <quote>and (8) a destructive device.</quote> and inserting <quote>(8) a destructive device; and (9) a bump stock.</quote>; and</text></paragraph><paragraph id="H65582E0FCDA14A708489581BD91C09E0"><enum>(2)</enum><text>by adding at the end the following new subsections:</text><quoted-block id="H02B0E6181FCF4CFAA555BDE71BCC48AE" style="OLC"><subsection id="HF0897D8452C545828860916B3551246F"><enum>(n)</enum><header>Bump stock</header><text>The term <term>bump stock</term> means any of the following:</text><paragraph id="H328AA9046DB641A8AB4B0689473FB95F"><enum>(1)</enum><text>Any manual, power-driven, or electronic device that is designed such that when the device is attached to a semiautomatic weapon, the device eliminates the need for the operator of a semiautomatic weapon to make a separate movement for each individual function of the trigger and—</text><subparagraph id="H9DBBF11FCE0E4C61B0A978BA4F43158E"><enum>(A)</enum><text>materially increases the rate of fire of the semiautomatic weapon, or</text></subparagraph><subparagraph id="HE8D8321FFDD9412697026F1980701990"><enum>(B)</enum><text>approximates the action or rate of fire of a machinegun.</text></subparagraph></paragraph><paragraph id="HA8054258C29548B2B2AE389EC653E744"><enum>(2)</enum><text>Any part or combination of parts that is designed and functions to eliminate the need for the operator of a semiautomatic weapon to make a separate movement for each individual function of the trigger and—</text><subparagraph id="HF79B9B4692D44A439756D67336985958"><enum>(A)</enum><text>materially increases the rate of fire of a semiautomatic weapon, or</text></subparagraph><subparagraph id="H7AED1A3934AC4331B02FD6C047AA445B"><enum>(B)</enum><text>approximates the action or rate of fire of a machinegun.</text></subparagraph></paragraph><paragraph id="HE2FA0528CAF7438DAB0435BE3DD72F32"><enum>(3)</enum><text>Any semiautomatic weapon that has been modified in any way that eliminates the need for the operator of the semiautomatic weapon to make a separate movement for each individual function of the trigger and—</text><subparagraph id="H94FB53F3C08D44EAAD812AB3B0FE0044"><enum>(A)</enum><text>materially increases the rate of fire of the semiautomatic weapon, or</text></subparagraph><subparagraph id="H6311AB79683C4B5F882F12BB609D5E7C"><enum>(B)</enum><text>approximates the action or rate of fire of a machinegun.</text></subparagraph></paragraph></subsection><subsection id="HED5138D6FD1946BE86534A90EFF76369"><enum>(o)</enum><header>Semiautomatic weapon</header><text>The term <term>semiautomatic weapon</term> means any repeating weapon that—</text><paragraph id="H8F262973F34344368756A91685783769"><enum>(1)</enum><text>utilizes a portion of the energy of a firing cartridge or shell to extract the fired cartridge case or shell casing and chamber the next round, and</text></paragraph><paragraph id="H7A243523CB8B40518A1F47B0A1C1F030"><enum>(2)</enum><text>requires a separate function of the trigger to fire each cartridge or shell.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE04CC7654C6549179ED8CE447F14F3A2"><enum>(b)</enum><header>Amendments to title <enum-in-header>18</enum-in-header>, United States Code</header><paragraph id="H7F5EAC5D3C834BA4A4B2102EA6F66F49"><enum>(1)</enum><text>Section 921(a) of title 18, United States Code, as amended by this Act, is further amended—</text><subparagraph id="H362251E858794BFCB4A9EFE2BB8F060C"><enum>(A)</enum><text>in paragraph (3), by striking <quote>muffler or firearm silencer</quote> and inserting <quote>muffler, firearm silencer, or bump stock</quote>; and</text></subparagraph><subparagraph id="HAFAFB0F0904A404CBBA49885115F7A17"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block id="H9BB241284D724B83A06C191727F128D4" style="OLC"><paragraph id="H001B1CE6577A4169B02FFEEAB4E9D95B" indent="up1"><enum>(41)</enum><text>The term <term>bump stock</term> has the meaning given such term in section 5845(n) of the National Firearms Act (<external-xref legal-doc="usc" parsable-cite="usc/26/5845">26 U.S.C. 5845(n)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H5AFE4E4449534D509C44A56D7A8539C9"><enum>(2)</enum><text>Section 922 of title 18, United States Code, is amended—</text><subparagraph id="HF7500A0F31F3490FA734A92B142DAB98"><enum>(A)</enum><text>in each of subsections (a)(4) and (b)(4), by inserting <quote>bump stock,</quote> before <quote>machinegun</quote>; and</text></subparagraph><subparagraph id="HA2B87CAB9AF9461B97689431FD151234"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (o)(1) , by inserting <quote>or bump stock</quote> before the period.</text></subparagraph></paragraph></subsection></section></title><title id="HF652D3D03FDB43F7930A7E0A74ECE3F1"><enum>VI</enum><header>Keep Americans Safe</header><section id="H527916A72D084906A233F41BD04F5DB9" section-type="subsequent-section"><enum>601.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 921(a) of title 18, United States Code, as amended by this Act, is further amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H8C07B7B709FE4225BE560B43CB8E0B3C" style="OLC"><paragraph id="H5126DEC7F9594C92944B84FCC21D6C29" indent="up1"><enum>(42)</enum><text>The term <term>large capacity ammunition feeding device</term>—</text><subparagraph id="H9D40BA8E4D0A489D9B2D090F854D6F30"><enum>(A)</enum><text>means a magazine, belt, drum, feed strip, helical feeding device, or similar device, including any such device joined or coupled with another in any manner, that has an overall capacity of, or that can be readily restored, changed, or converted to accept, more than 15 rounds of ammunition; and</text></subparagraph><subparagraph id="H5B99491B08DB4BAC8E18B3456784500B"><enum>(B)</enum><text>does not include an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.</text></subparagraph></paragraph><paragraph id="H48735DDA68E64D48A4BFA7225E4ACCB9" indent="up1"><enum>(43)</enum><text>The term <term>qualified law enforcement officer</term> has the meaning given the term in section 926B.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HD9137E7095D14988BE350C802CF7CFE2"><enum>602.</enum><header>Restrictions on large capacity ammunition feeding devices</header><subsection id="H164CA5018C514B8CB897496684A7ABB0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 922 of title 18, United States Code, is amended by inserting after subsection (u) the following:</text><quoted-block display-inline="no-display-inline" id="HA3296A78C6594CA3994B1981371E1E4F" style="OLC"><subsection id="H78896B596B0B45AEA13844A3E0751D4B"><enum>(v)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H4C125A191CCD4D42A58F2953D19EDEC0"><enum>(1)</enum><text>It shall be unlawful for a person to import, sell, manufacture, transfer, or possess, in or affecting interstate or foreign commerce, a large capacity ammunition feeding device.</text></paragraph><paragraph id="H515CA364A6164C5EBE23160FD95C30E3" indent="up1"><enum>(2)</enum><text>Paragraph (1) shall not apply to the possession of any large capacity ammunition feeding device otherwise lawfully possessed on or before the date of enactment of this subsection.</text></paragraph><paragraph id="H2AAB27CA8B894459AB5A621C14872D86" indent="up1"><enum>(3)</enum><text>Paragraph (1) shall not apply to—</text><subparagraph id="HC849D91196854A90B9B459B5AF0FA563"><enum>(A)</enum><text>the importation for, manufacture for, sale to, transfer to, or possession by the United States or a department or agency of the United States or a State or a department, agency, or political subdivision of a State, or a sale or transfer to or possession by a qualified law enforcement officer employed by the United States or a department or agency of the United States or a State or a department, agency, or political subdivision of a State for purposes of law enforcement (whether on or off-duty), or a sale or transfer to or possession by a campus law enforcement officer for purposes of law enforcement (whether on or off-duty);</text></subparagraph><subparagraph id="H56AFE5F5DE664FD8809A0623C9430949"><enum>(B)</enum><text>the importation for, or sale or transfer to a licensee under title I of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011 et seq.</external-xref>) for purposes of establishing and maintaining an on-site physical protection system and security organization required by Federal law, or possession by an employee or contractor of such licensee on-site for such purposes or off-site for purposes of licensee-authorized training or transportation of nuclear materials;</text></subparagraph><subparagraph id="HC5F8681F31FD4DBB8B25F9755ACAAA58"><enum>(C)</enum><text>the possession, by an individual who is retired in good standing from service with a law enforcement agency and is not otherwise prohibited from receiving ammunition, of a large capacity ammunition feeding device—</text><clause id="HCDE5610693D74C91A5F21CA678A05772"><enum>(i)</enum><text>sold or transferred to the individual by the agency upon such retirement; or</text></clause><clause id="HF5D1FAE6A9C44CA0AD43BC7DBEA6905F"><enum>(ii)</enum><text>that the individual purchased, or otherwise obtained, for official use before such retirement; or</text></clause></subparagraph><subparagraph id="HDEED65C895B64D23B11544A6514F6119"><enum>(D)</enum><text>the importation, sale, manufacture, transfer, or possession of any large capacity ammunition feeding device by a licensed manufacturer or licensed importer for the purposes of testing or experimentation authorized by the Attorney General.</text></subparagraph></paragraph><paragraph id="H78D7340A5CE34CC5AD0AD94C21BAEE62" indent="up1"><enum>(4)</enum><text>For purposes of paragraph (3)(A), the term <term>campus law enforcement officer</term> means an individual who is—</text><subparagraph id="H2D73934861794B1DB4096E57BC90728C"><enum>(A)</enum><text>employed by a private institution of higher education that is eligible for funding under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070 et seq.</external-xref>);</text></subparagraph><subparagraph id="H356A48F7F7364E30A2459B6D7D56F60A"><enum>(B)</enum><text>responsible for the prevention or investigation of crime involving injury to persons or property, including apprehension or detention of persons for such crimes;</text></subparagraph><subparagraph id="H5E5307C22ED9410694E99B273586D4CB"><enum>(C)</enum><text>authorized by Federal, State, or local law to carry a firearm, execute search warrants, and make arrests; and</text></subparagraph><subparagraph id="HAC95BDA922CD4B73BC0EFC4BEB137F86"><enum>(D)</enum><text>recognized, commissioned, or certified by a government entity as a law enforcement officer.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H671341A4ACCD491E9DAFED124F512C6D"><enum>(b)</enum><header>Identification markings for large capacity ammunition feeding devices</header><text display-inline="yes-display-inline">Section 923(i) of title 18, United States Code, as amended by this Act, is further amended by inserting after subparagraph (A) of paragraph (1) the following:</text><quoted-block style="USC" id="HEE2C0993E8364A20984901D3CA3D53AA" display-inline="no-display-inline"><subparagraph id="HEB37599D5EE946DE8C0002101B8BA4AE"><enum>(B)</enum><text display-inline="yes-display-inline">A large capacity ammunition feeding device manufactured after the date of enactment of this subparagraph shall be identified by a serial number and the date on which the device was manufactured or made, legibly and conspicuously engraved or cast on the device, and such other identification as the Attorney General shall by regulations prescribe.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HDC75537B87124951B0007783DD94820C"><enum>(c)</enum><header>Seizure and forfeiture of large capacity ammunition feeding devices</header><text>Section 924(d) of title 18, United States Code, as amended by this Act, is further amended—</text><paragraph id="HB2EDFE3C5AE6492BA4C55C7CE9B72A88"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="H563F0F6071494B1C8112C79EB8CF895E"><enum>(A)</enum><text>in the first sentence—</text><clause feeding devices</header><text display-inline="no-display-inline">Section 501(a)(1) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10152">34 U.S.C. 10152(a)(1)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HAC7C4E7F182444E1AEB9C5DB31AE7B94" style="OLC"><subparagraph commented="no" id="H47192D1845DF44B38C4F3B215AEF19F9"><enum>(I)</enum><text display-inline="yes-display-inline">Compensation for surrendered large capacity ammunition feeding devices, as that term is defined in section 921 of title 18, United States Code, under buy-back programs for large capacity ammunition feeding id="H286ABB84300349EB93EE2CBCC045F8AC"><enum>VII</enum><header>Miscellaneous</header><section id="HE6DE06FE9BEF48B596E1261C1CF4F6A9"><enum>701.</enum><header>NICS Report</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Attorney General shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report that includes, with respect to the preceding year, the demographic data of persons who were determined to be ineligible to purchase a firearm based on a background check performed by the National Instant Criminal Background Check System, including race, ethnicity, national origin, sex, gender, age,
