which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Elementary and Secondary Education Act of 1965 to improve mental health services for students, and for other purposes.</official-title></form><legis-body id="HF0DA2AC1E0874013ACE67FEC3A662D64" style="OLC"><section id="H86303BF6C57C45B588A7998F7AB327B3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Student Access to Mental Health Services Act</short-title></quote>.</text></section><section id="H615A89F1879B4393AA82926D7CF1CF45"><enum>2.</enum><header>Supporting mental health</header><subsection id="H4548FAC37BF9443FA5E23B556718D467"><enum>(a)</enum><header>State use of funds</header><text>Section 4104(b)(3)(B) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7114">20 U.S.C. 7114(b)(3)(B)</external-xref>) is amended—</text><paragraph id="H4CF364A12BE04A21A0BF056FEF340C1F"><enum>(1)</enum><text>in clause (iii), by striking <quote>and</quote> at the end; and</text></paragraph><paragraph id="H5CA0A15DE54541609DD261B54B89FA5E"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="HBA7A2693A2184F4C8208A47C0101892B" style="OLC"><clause id="H26FA9909523B4AEBA1A6623FCEAAEF86"><enum>(v)</enum><text>improving the mental health services available to students, which may include—</text><subclause id="HBE36A82523034032A449A27A405F5252"><enum>(I)</enum><text>identifying and disseminating best practices for mental health first aid;</text></subclause><subclause id="HFA511E54E0994FE7A57C26C029CED90F"><enum>(II)</enum><text>assisting in the establishment or implementation of emergency planning, which may include emergency response teams to address emergencies at schools;</text></subclause><subclause id="H55DE4A51A45A4C29BF7D5B1AA38EC6F7"><enum>(III)</enum><text>establishing or identifying agreements with local health agencies, including nonprofit, public, and private mental health agencies and institutions, to improve coordination of services; and</text></subclause><subclause id="H21E889D8C12649E2856D9A726870C7F0"><enum>(IV)</enum><text>telehealth services; and</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H9EACA0EF4B1645F2AE708C62C133E9D5"><enum>(b)</enum><header>Local educational agency applications</header><text display-inline="yes-display-inline">Section 4106(e)(1) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7116">20 U.S.C. 7116(e)(1)</external-xref>) is amended—</text><paragraph id="H8A0C8D8B71064BCFAB76610B4E0DD3F6"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H5851B1808EBC413994D4A037EF073562"><enum>(2)</enum><text>by redesignating subparagraph (E) as subparagraph (F); and</text></paragraph><paragraph id="HCF31B3BF6A8D435CB8EE81AE1B6210E7"><enum>(3)</enum><text>by inserting after subparagraph (D), the following:</text><quoted-block id="HEFE1B4902B2846D0A48C69EA60716CC4" style="OLC"><subparagraph id="H4275FF76CF9A483EA2F7DF051E773164"><enum>(E)</enum><text>if applicable, how funds will be used for activities related to providing mental health services under section 4108; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H59CBABB22303426B8CDCF30077BD6244"><enum>(c)</enum><header>Activities To support the effective use of technology</header><text>Section 4109 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7119">20 U.S.C. 7119</external-xref>) is amended—</text><paragraph id="H0AB8971FA9514D3B87A0C87467BE94E0"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HDAB61C7524F044A39ECF2544C4B44856"><enum>(A)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H878A724D5C344907B006889F17D0D165"><enum>(B)</enum><text>in paragraph (6), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HDE4B791F2F1147769E26F1D965CE9CE4"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="HB2ADB6107842424FB60F8308757DD183" style="OLC"><paragraph id="H6CC240C2731E4729AC042817DD2477A7"><enum>(7)</enum><text>providing technology to improve mental health services.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE019FBE48FD64343834809A0EEE99876"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H89A19B029D954D6687D7FDA1CE87D786"><enum>(A)</enum><text>by striking <quote>A local</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HC04BBCA80B8A4D49A4E7429CC6EBDD65" style="OLC"><paragraph id="HEC8CB1B29BDA44948D49E1D4FA4564E4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A local</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H49C9441F46824CA78F8875C0F92C50F0"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H9C5EAF5D989447A28F04DE4C3A6406EE" style="OLC"><paragraph id="HBBFC53EA3C1C41358E96B04FD7F32873"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The limitation described in paragraph (1) shall not apply to technology infrastructure that is also used for mental health services.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section></legis-body></bill>
