<section section-type="section-one" id="H5C784D959C01435697A31227B1FE4448"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>EEOC Transparency and Accountability Act</short-title></quote>.</text></section> <section id="H0CD67E4C34634B548961075645A87835"><enum>2.</enum><header>Approval of EEOC litigation commencement, intervention, or participation</header><text display-inline="no-display-inline">Section 705 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-4">42 U.S.C. 2000e–4</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="traditional" display-inline="no-display-inline" id="H848773D30E0943438C499FE7E5553907"> 
<subsection id="H7F2289D3D45C421CAF775C4B9ACF6184"><enum>(l)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="HB157F7C2340741F4A1BB963E40E1091C"><enum>(1)</enum><text display-inline="yes-display-inline">The Commission shall decide by majority vote—</text> <subparagraph id="HD919C323267A4189BAF1E8FD963A1969" indent="up1"><enum>(A)</enum><text>whether the Commission will commence or intervene in litigation, for—</text> 
<clause id="HA7B24D246981477EABED9120AACF76BF"><enum>(i)</enum><text>each case involving an allegation of systemic discrimination or a pattern or practice of discrimination;</text></clause> <clause id="H9F06D5856FA5440F951A30D5DC791568"><enum>(ii)</enum><text>each case for which the litigation is expected to involve a major expenditure of agency resources, including staffing and staff time, or expenses associated with extensive discovery or expert witnesses;</text></clause> 
<clause id="H72C76A7A8C0E43BD8886C8D4152171A9"><enum>(iii)</enum><text>each case presenting an issue on which the Commission has taken a position contrary to precedent in the Judicial Circuit of the United States in which the case will be or has been filed;</text></clause> <clause id="H0BF2077580CE4E1694E75CF01446C129"><enum>(iv)</enum><text>each case presenting an issue on which the General Counsel proposes to take a position contrary to precedent in the Circuit in which the case will be or has been filed; and</text></clause> 
<clause id="HB6BDE3E647D14529AFD6910DE934D8FF"><enum>(v)</enum><text>each case that the General Counsel reasonably believes to be appropriate for a Commission decision on such commencement or intervention, including—</text> <subclause id="H93D05A4AEB234B08BF28C97311FFD5EA"><enum>(I)</enum><text>cases that implicate areas of the law that are not settled; and</text></subclause> 
<subclause id="H904C7ADB37AC4605B53C1767E119DEFE"><enum>(II)</enum><text>cases that are likely to generate public controversy;</text></subclause></clause></subparagraph> <subparagraph id="H02547BCB132443E281A44382F27D07FD" indent="up1"><enum>(B)</enum><text>for each recommendation regarding whether the Commission will participate as amicus curiae in a case, whether the Commission will so participate; and</text></subparagraph> 
<subparagraph id="HCDD87883CE8C4D20A73B81ED3E91414E" indent="up1"><enum>(C)</enum><text>in considering at least 1 litigation recommendation from each district office of the Commission each fiscal year, including litigation recommendations for cases described in subparagraph (A), whether the Commission will commence or intervene in the litigation for each case. </text></subparagraph></paragraph> <paragraph id="H34FE215E83834E49AC4E28F1E7C2973A" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A member of the Commission shall have the power to require the Commission to decide by majority vote whether the Commission shall commence, intervene in, or participate in any litigation as described in paragraph (1).</text></paragraph> 
<paragraph id="HD31C89141EB24E8E8A83088D226F9737" indent="up1"><enum>(3)</enum><text>Neither the Commission nor a member of the Commission may delegate the authority provided under paragraph (1) or (2) to any other person.</text></paragraph> <paragraph id="H25A85C02D850469D8A282E3712EE3355" indent="up1"><enum>(4)</enum><text>Not later than 30 days after the Commission commences, intervenes in, or participates in litigation pursuant to approval under this subsection, the Commission shall post and maintain the following information on its public website with respect to the litigation:</text> 
<subparagraph id="H6150A35891194D088B312654891089ED"><enum>(A)</enum><text display-inline="yes-display-inline">The court in which the case was brought.</text></subparagraph> <subparagraph id="H34B106A874C342D1988D403D7F2947AE"><enum>(B)</enum><text>The name and case number of the case.</text></subparagraph> 
<subparagraph id="H61FF9EFC78D8412BB120AB5D8503E785"><enum>(C)</enum><text>The nature of the allegation.</text></subparagraph> <subparagraph id="HC70E3736FDCE4CC59C19EB1C2418774F"><enum>(D)</enum><text>The causes of action for the case brought.</text></subparagraph> 
<subparagraph id="HCEBA3FDCED6F433086A65029E1A7936B"><enum>(E)</enum><text>Each Commissioner’s vote on commencing, intervening in, or participating in the litigation.</text></subparagraph></paragraph> <paragraph id="H59774D8F45DC4A4586F2D4A33CA997EC" indent="up1"><enum>(5)</enum><text>The Commission shall issue, in a manner consistent with section 713, procedural regulations to carry out this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
