<section section-type="section-one" id="H37EE7794CD3146A3A063E483F1372635"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Water Efficiency, Conservation, and Sustainability Act of 2022</short-title></quote>.</text></section> <section id="H16186C26C3724B23B9B7DE5FA625D842"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H5C9B7BDCB1F342B09DDACD3AE114B995"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph> <paragraph commented="no" id="H5EAFD59AA0B74C7EBCEA436ECD21CE04"><enum>(2)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means any of the following:</text>
<subparagraph commented="no" id="H763526A83AF942CAAC1C3A0833E18D27"><enum>(A)</enum><text>A State, local, or Tribal government, or any special-purpose unit of such a government (including a municipal water authority).</text></subparagraph> <subparagraph commented="no" id="H620EE500D858485D82EB72A040572C44"><enum>(B)</enum><text>A public water system.</text></subparagraph>
<subparagraph commented="no" id="H02C0CFA0640747E48B0DBB380ED375BC"><enum>(C)</enum><text>A nonprofit organization.</text></subparagraph></paragraph> <paragraph commented="no" id="HF3082679A7B047E99A6F00D9992254F4"><enum>(3)</enum><header>Energy Star program</header><text>The term <term>Energy Star program</term> means the Energy Star program established by section 324A of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6294a">42 U.S.C. 6294a</external-xref>).</text></paragraph>
<paragraph id="HAE4BD4D0CAF04F50BE5FC63287683EDA"><enum>(4)</enum><header>Low-income household</header><text>The term <term>low-income household</term> includes a household that is—</text> <subparagraph id="HBC024157FD4143C8B500718E10C81B18"><enum>(A)</enum><text>eligible to receive payments under—</text>
<clause id="HB8511CA6962B42A989D0372654A1D9A8"><enum>(i)</enum><text>section 2605(b)(2) of the Low-Income Home Energy Assistance Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/8624">42 U.S.C. 8624(b)(2)</external-xref>); or</text></clause> <clause id="HAA90FFF85F4B4F7E946A35523A930AFC"><enum>(ii)</enum><text>the Low-Income Household Drinking Water and Wastewater Emergency Assistance Program authorized by section 533 of division H of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; 134 Stat. 1627); or</text></clause></subparagraph>
<subparagraph id="H8BD6051A0AC9470482154606ADF46ED8"><enum>(B)</enum><text>within a disadvantaged community (as defined in section 1452(d)(3) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(d)(3)</external-xref>)).</text></subparagraph></paragraph> <paragraph commented="no" id="H148F6F8588DC4FA3B2CE6A46E3ACCE80"><enum>(5)</enum><header>Public water system</header><text>The term <term>public water system</term> has the meaning given the term in section 1401 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref>).</text></paragraph>
<paragraph commented="no" id="H904FDFA44EFE4FBBAB0E5638BC126A84"><enum>(6)</enum><header>Water efficiency incentive program</header><text>The term <term>water efficiency incentive program</term> means a program for providing incentives, including direct installation services, to residential, commercial, or industrial customers of a public water system for the purchase, lease, installation, use, or implementation, as applicable, of water-efficient upgrades.</text></paragraph> <paragraph commented="no" id="H353FCE1A527E4FD989B17AD1E7BAC846"><enum>(7)</enum><header>Water-efficient upgrade</header> <subparagraph commented="no" id="HC6056A66EFEE4E37A0B9BF398D90FEEF"><enum>(A)</enum><header>In general</header><text>The term <term>water-efficient upgrade</term> means a product, landscape, label, process, or service for a residential, commercial, or industrial building, or the landscape of such a building, that is—</text>
<clause commented="no" id="H427A44181DFC468CA878217AC4605A90"><enum>(i)</enum><text>rated for water efficiency and performance under the WaterSense program, the Energy Star program, or such other methodology as determined to be appropriate by the Administrator; or</text></clause> <clause commented="no" id="H6217DA384AD447109F080AE26B6F33D7"><enum>(ii)</enum><text>otherwise determined by the Administrator to improve water-use efficiency.</text></clause></subparagraph>
<subparagraph commented="no" id="HAB7941C3D05F4CDAA15A7E555A386AE3"><enum>(B)</enum><header>Inclusions</header><text>The term <term>water-efficient upgrade</term> includes—</text> <clause commented="no" id="H472BBFE2C43D4BEB909EA61E0B54C034"><enum>(i)</enum><text>a faucet;</text></clause>
<clause commented="no" id="HFB481DEAE1824ADDA3D8FC8737DBBC1B"><enum>(ii)</enum><text>a showerhead;</text></clause> <clause commented="no" id="HD10240E81EE24A9786A0C139727FDA97"><enum>(iii)</enum><text>a dishwasher;</text></clause>
<clause commented="no" id="H4DA9A86518AD486EA33CA9E550732648"><enum>(iv)</enum><text>a toilet;</text></clause> <clause commented="no" id="HDE6F31613A624899B32EBC576D19779E"><enum>(v)</enum><text>a clothes washer;</text></clause>
<clause commented="no" id="H5B5EE4CDC347477F951347C6C21D7483"><enum>(vi)</enum><text>an irrigation product or service;</text></clause> <clause commented="no" id="H57DC423FD7F347FFAA736F94C1DDBD73"><enum>(vii)</enum><text>advanced metering infrastructure;</text></clause>
<clause commented="no" id="HEB29EAD243174E5CA93B00A0EDF2B986"><enum>(viii)</enum><text>a flow monitoring device;</text></clause> <clause commented="no" id="H81A7AC17487D4400AD8A9BD7A4248C1D"><enum>(ix)</enum><text>a landscaping or gardening product, including moisture control or water-enhancing technology;</text></clause>
<clause commented="no" id="HDB3EAF32F4A14078A312E62CD52849CE"><enum>(x)</enum><text display-inline="yes-display-inline">xeriscaping, turf removal, or another landscape conversion that reduces water use (except for the installation of artificial turf); and</text></clause> <clause commented="no" id="HB7C21495E1E846819F5BD27CFF88CEC1"><enum>(xi)</enum><text>any other product, landscape, process, or service—</text>
<subclause commented="no" id="H9272D8189E144E4CBF41AF3E1B725083"><enum>(I)</enum><text>certified pursuant to the WaterSense program; or</text></subclause> <subclause commented="no" id="HABE6FEA86B774282A7EFB5D909C00EDD"><enum>(II)</enum><text>otherwise determined by the Administrator to reduce water use or water loss, including products rated for water efficiency and performance under the Energy Star program.</text></subclause></clause></subparagraph></paragraph>
<paragraph commented="no" id="HA0E8427374B2483B9A7A0A060CD4F65F"><enum>(8)</enum><header>Water loss control program</header><text>The term <term>water loss control program</term> means a program to identify and quantify water uses and losses, implement controls to reduce or eliminate losses and leaks, and evaluate the effectiveness of such controls.</text></paragraph> <paragraph id="HDC28F2DEDCFF4B3490939728563FDD4A"><enum>(9)</enum><header>WaterSense program</header><text>The term <term>WaterSense program</term> means the program established by section 324B of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6294b">42 U.S.C. 6294b</external-xref>).</text></paragraph></section>
<section id="HAB041DC951804A9BB055A94986A61B37"><enum>3.</enum><header>Water efficiency and conservation grant program</header>
<subsection id="H94CBD56462DD4E2B9F71FC6F3B5CF1A5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall establish a program to award grants to eligible entities that have established water efficiency incentive programs to carry out those water efficiency incentive programs (referred to in this section as the <quote>grant program</quote>).</text></subsection> <subsection id="H56AA2B632D96410480582A4DAF18809E"><enum>(b)</enum><header>Distribution</header><text>In carrying out the grant program, the Administrator shall award not less than 50 percent of the amounts made available to carry out this section in each fiscal year to eligible entities that service an area that—</text>
<paragraph id="HE78EFCA7BBD245BAB2BECEC23EB46FAE"><enum>(1)</enum><text>has been designated as D2 (severe drought) or greater according to the United States Drought Monitor for a minimum of 4 weeks during any of the 3 years preceding the date of the grant award; or</text></paragraph> <paragraph id="H7BCE849A208A499B8D92467ABD967A52"><enum>(2)</enum><text>is within a county for which a drought emergency has been declared by the applicable Governor at any time during the 3-year period preceding the date of the grant award.</text></paragraph></subsection>
<subsection id="H3E0C822F610F49F2AD25FE74912EB5DC"><enum>(c)</enum><header>Grant amount</header>
<paragraph id="H9953172E6810489D99E6ACDDE966B41F"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), a grant awarded under the grant program shall be in an amount that is not less than $250,000.</text></paragraph> <paragraph id="H243189F7468E49DF9132E4A6204434A8"><enum>(2)</enum><header>Small public water systems</header><text>The Administrator may award a grant in an amount that is less than $250,000 if the grant is awarded to, or for the benefit of, a public water system that serves fewer than 10,000 customers.</text></paragraph></subsection>
<subsection commented="no" id="H052505C5A32A4448B3FAD02DD5A0B978"><enum>(d)</enum><header>Use of funds</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under the grant program shall—</text> <paragraph commented="no" id="HC24D45830E714C2286D7397A9C78C5F2"><enum>(1)</enum><text display-inline="yes-display-inline">use grant funds to carry out a water efficiency incentive program for customers of a public water system; or</text></paragraph>
<paragraph commented="no" id="H9E48A96533CA41A8AE2215F162E36BB0"><enum>(2)</enum><text display-inline="yes-display-inline">provide grant funds to another eligible entity to carry out a water efficiency incentive program described in paragraph (1).</text></paragraph></subsection> <subsection commented="no" id="HAE7B2EFA551C458D9379EB383A477A93"><enum>(e)</enum><header>Minimum requirement</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under the grant program shall use not less than 40 percent of the amount of the grant to provide water-efficient upgrades to low-income households.</text></subsection>
<subsection commented="no" id="H182BB305BDF04ED486376D897A63AE68"><enum>(f)</enum><header>Cost share</header>
<paragraph commented="no" id="H540F9E992DEA4067A4EAB90CE2AA3E07"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the Federal share of the cost of carrying out a water efficiency incentive program using a grant awarded under the grant program shall not exceed 80 percent.</text></paragraph> <paragraph commented="no" id="H0D4210F8351048A2B3039B7D494199EE"><enum>(2)</enum><header>Waiver</header><text>The Administrator may increase the Federal share under paragraph (1) to 100 percent if the Administrator determines that an eligible entity is unable to pay, or would experience significant financial hardship if required to pay, the non-Federal share.</text></paragraph></subsection>
<subsection commented="no" id="HD6C93FD2AD914A6EB41F8E2ACB28084D"><enum>(g)</enum><header>Supplement, not supplant</header><text display-inline="yes-display-inline">Amounts provided under a grant under the grant program shall be used to supplement, and not supplant, other Federal, State, local, or Tribal funds made available to carry out water efficiency incentive programs.</text></subsection> <subsection id="H717620281236477383CDC55F8765351C"><enum>(h)</enum><header>Authorization of appropriations</header> <paragraph id="H2F68851C2B5E415D81FAF6E42C06F5BC"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this section $50,000,000 for each of fiscal years 2023 through 2028.</text></paragraph>
<paragraph id="H0B70068826D84F068757698F8E600EAF"><enum>(2)</enum><header>Administrative costs</header><text>Of the amounts made available under paragraph (1) for grants under the grant program each fiscal year, the Administrator may use not more than 4 percent to pay the administrative costs of the Administrator.</text></paragraph></subsection></section> <section id="H718AE47663E24AF78A79D8169BC5E9B1"><enum>4.</enum><header>Sustainable water loss control program</header> <subsection commented="no" id="H7E0A04837C5544E5AA187209A0264CF8"><enum>(a)</enum><header>Technical assistance and grant program</header><text>The Administrator shall establish and carry out a program (referred to in this section as the <quote>program</quote>)—</text>
<paragraph commented="no" id="HB7745287841A45DCA54E16966D06171C"><enum>(1)</enum><text>to make grants and provide technical assistance to eligible entities to perform annual audits of public water systems that are—</text> <subparagraph commented="no" id="H7F89A3961D6D464BB83BAC31540547BE"><enum>(A)</enum><text>conducted in accordance with the procedures contained in the manual published by the American Water Works Association entitled <quote>M36 Water Audits and Loss Control Programs, Fourth Edition</quote> (or any successor manual determined appropriate by the Administrator); and</text></subparagraph>
<subparagraph commented="no" id="HB35951FB3B7A460CA70CBCCDA80365FA"><enum>(B)</enum><text>validated under such criteria as may be specified by the Administrator; and</text></subparagraph></paragraph> <paragraph commented="no" id="HFBC5116F8AFB451B8D5CA8317FD61612"><enum>(2)</enum><text>to make grants and provide technical assistance to eligible entities—</text>
<subparagraph commented="no" id="H98B1692E671843A5B8C416918067C899"><enum>(A)</enum><text>to implement controls to address real losses, apparent losses, or a combination of real and apparent losses that are identified in an audit conducted and validated in accordance with the procedures and criteria described in paragraph (1); and</text></subparagraph> <subparagraph commented="no" id="H20CEE6A3A07B4C219FFAAA92BE240201"><enum>(B)</enum><text>to help public water systems that have conducted and validated such an audit establish water loss control programs.</text></subparagraph></paragraph></subsection>
<subsection id="H7907C6952076466AA93B5737BA620E99"><enum>(b)</enum><header>Criteria</header><text>In selecting eligible entities to receive grants and technical assistance under the program, the Administrator shall consider—</text> <paragraph id="H1C9AF8062E444FDBB16A5A718162736C"><enum>(1)</enum><text>the percentage of customers of the public water system that would be served by the grants or technical assistance that are low-income households; and</text></paragraph>
<paragraph id="HF1AD220BA8434580BBC1CAEC7C39F4BA"><enum>(2)</enum><text>the ability of the public water system that would be served by the grants or technical assistance, on completion of an audit conducted and validated in accordance with the procedures and criteria described in subsection (a)(1)—</text> <subparagraph id="HEF59C3EDC7B442A6B4F0E2CEFE523E4F"><enum>(A)</enum><text>to successfully sustain a water loss control program; and</text></subparagraph>
<subparagraph id="H9E0B145E874E48D68356047E2A1F9BF8"><enum>(B)</enum><text>to demonstrate that the water loss control program will reduce real losses, apparent losses, or a combination of real and apparent losses in the public water system.</text></subparagraph></paragraph></subsection> <subsection commented="no" id="HDEF1A496C5144861B29568FCC46B9DD9"><enum>(c)</enum><header>Annual water savings</header><text>The Administrator shall—</text>
<paragraph commented="no" id="H51C6C609E0334CA3B80B25A266A899E7"><enum>(1)</enum><text>annually compile, by Environmental Protection Agency region, information on the amount of water savings achieved pursuant to this section; and</text></paragraph> <paragraph commented="no" id="H7D2890B6980D4AD0AA302C09649AB5FF"><enum>(2)</enum><text>publish on the website of the Administrator the information compiled under paragraph (1).</text></paragraph></subsection>
<subsection commented="no" id="HC8465FE4828A4F58A48F595FF22A2311"><enum>(d)</enum><header>Authorization of appropriations</header>
<paragraph commented="no" id="H2FA53D4B0BB8403DB38CB19C293461E1"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this section $40,000,000 for each of fiscal years 2023 through 2028, of which—</text> <subparagraph commented="no" id="H8F2D27E707124742B062210BEE174B83"><enum>(A)</enum><text>$20,000,000 each fiscal year shall be used to carry out subsection (a)(1); and</text></subparagraph>
<subparagraph commented="no" id="HF95E1AAC4F88400AAF38C1D2658584F4"><enum>(B)</enum><text>$20,000,000 each fiscal year shall be used to carry out subsection (a)(2).</text></subparagraph></paragraph> <paragraph id="H7F58DF147A5C40D2A5DCCFB2D4A5AA35"><enum>(2)</enum><header>Administrative costs</header><text>Of the amounts made available under paragraph (1) for grants under the program each fiscal year, the Administrator may use not more than 4 percent to pay the administrative costs of the Administrator. </text></paragraph></subsection></section>
<section id="H627A06684F9C466D9AD6F29ACD410FE4"><enum>5.</enum><header>Assistance for water efficient plumbing code adoption</header>
<subsection id="H8EC7A3801AB5441B91158F4445284917"><enum>(a)</enum><header>Water efficient plumbing codes</header><text>The Administrator shall establish a program to make grants to States, Tribal governments, and units of local government that have authority to adopt plumbing codes—</text> <paragraph id="H75CE9861817B40E8865F82FCE0AB7439"><enum>(1)</enum><text>to adopt plumbing codes that meet or exceed—</text>
<subparagraph id="HD73B8A405B904E33B75BB65FB8FF69F5"><enum>(A)</enum><text>the latest American National Standard published as the <quote>Water Efficiency and Sanitation Standard for the Built Environment</quote> or <quote>WE–Stand</quote> (or any successor American National Standard); or</text></subparagraph> <subparagraph commented="no" id="H8485A4B06D4E4AD8B210C8D4EF817DDA"><enum>(B)</enum><text>the requirements described in Chapter 6 (Water Use Efficiency) of the code published by the International Code Council entitled <quote>2018 International Green Construction Code (IGCC)</quote> (or any successor requirements described in a code published by the International Code Council); and</text></subparagraph></paragraph>
<paragraph commented="no" id="HFE7B837EBB58474EAE1262969117C6E9"><enum>(2)</enum><text>to implement a plan for the jurisdiction to achieve, within 5 years of the date on which the jurisdiction receives the grant, compliance with a plumbing code described in paragraph (1) in at least 90 percent of new and renovated residential, commercial, and industrial buildings, as applicable, which shall include—</text> <subparagraph commented="no" id="HBD2FE0871410402397004BD20C8B29BE"><enum>(A)</enum><text>workforce training;</text></subparagraph>
<subparagraph commented="no" id="H69419AB9986D41B3B9C8912E88905403"><enum>(B)</enum><text>an enforcement program; and</text></subparagraph> <subparagraph commented="no" id="H6DB4BA0098814EF39D85F1EBCEEC6B1F"><enum>(C)</enum><text>a compliance measurement program.</text></subparagraph></paragraph></subsection>
<subsection commented="no" id="H8CF52ACF4CA84BC69FCC308948DA009A"><enum>(b)</enum><header>Subgrant authority</header><text>A State that has adopted a plumbing code described in subsection (a)(1) may use funds from a grant under this section to make subgrants to relevant Tribal or local agencies to implement the plumbing code through 1 or more of the following:</text> <paragraph commented="no" id="HEC0A0092637E4E72A7A873486324B9DB"><enum>(1)</enum><text>Workforce training.</text></paragraph>
<paragraph commented="no" id="H3D023718B3AA4472A26A3AA546C3F8FE"><enum>(2)</enum><text>An enforcement program.</text></paragraph> <paragraph commented="no" id="H237EB3966FD6495EABD93E2F57FD05E1"><enum>(3)</enum><text>A compliance measurement program.</text></paragraph></subsection>
<subsection id="H4EF95DF9A5824A869CA507D820089AAF"><enum>(c)</enum><header>Authorization of appropriations</header>
<paragraph id="H3E155C8B9D6E44108B71716D69B72A29"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this section $20,000,000 for each of fiscal years 2023 through 2028.</text></paragraph> <paragraph id="H8F2C064F0C9048E2B0C9059AEA40183E"><enum>(2)</enum><header>Administrative costs</header><text>Of the amounts made available under paragraph (1) for grants under this section each fiscal year, the Administrator may use not more than 4 percent to pay the administrative costs of the Administrator. </text></paragraph></subsection></section>
