which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title IV of the Higher Education Act of 1965 to prohibit the provision of funds under such title to institutions of higher education that violate the immigration laws, and for other purposes.</official-title></form><legis-body id="H5BCA843017454D198BAA4F15315E9079" style="OLC"><section id="HFDD7B85A886348F1BD84888BF006B2E9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Funding for Sanctuary Campuses Act</short-title></quote>.</text></section><section id="H18F2C061CF5E43FE9AC1E454F91DB533"><enum>2.</enum><header>Treatment of sanctuary campuses</header><subsection id="H01193B3EA8094B5C9E907EF2BD66FAF3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part G of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1088">20 U.S.C. 1088 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HC5C35A0C40B14149B5365B4893B618F5" style="OLC"><section id="H05FB77FDBAC845218A92599F7C8494BD"><enum>493E.</enum><header>Treatment of sanctuary campuses</header><subsection id="H854BD5ABFD4E4BB5A4D33DEC6CFDBE72"><enum>(a)</enum><header>Definition</header><paragraph id="H0DB9977DDBB24FF6A2E14901D0A48669"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>sanctuary campus</quote> means any institution of higher education (as defined in section 102) that—</text><subparagraph id="H388B320125ED46FBACC685D45C07355C"><enum>(A)</enum><text display-inline="yes-display-inline">has in effect an ordinance, policy, or practice that prohibits or restricts any institutional entity, official, or personnel from—</text><clause id="H42FA2BAD6CB64455B9F4E454C8023F09"><enum>(i)</enum><text display-inline="yes-display-inline">sending, receiving, maintaining, or exchanging with any Federal, State, or local government entity information regarding the citizenship or immigration status (lawful or unlawful) of any individual;</text></clause><clause id="H319A2773CDF944DEAE1FB8B2A6CF606C"><enum>(ii)</enum><text display-inline="yes-display-inline">complying with a request lawfully made by the Secretary of Homeland Security under section 236 or 287 of the Immigration and Nationality Act (8 U.S.C. 1226 or 1357) to comply with a detainer for, or notify about the release of, an individual; or</text></clause><clause id="HA4AA97CA145C4CD4B8A9601D1CC3EF7D"><enum>(iii)</enum><text display-inline="yes-display-inline">otherwise complying with section 642 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1373">8 U.S.C. 1373</external-xref>);</text></clause></subparagraph><subparagraph id="H05375497270F4B57AEC702DD5C7F1CE2"><enum>(B)</enum><text>brings in, or harbors, an alien in violation of section 274(a)(1)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324(a)(1)(A)</external-xref>);</text></subparagraph><subparagraph id="H8D9B681AB08C499AB15034B6FE67D18C"><enum>(C)</enum><text display-inline="yes-display-inline">renders an alien who lacks a lawful immigration status in the United States eligible for any postsecondary education benefit provided on the basis of residence within a State (or a political subdivision of a State) to the same extent as a citizen or national of the United States is eligible for such benefit; or</text></subparagraph><subparagraph id="H699CC5ABF9104A7FB54041F6C2D78E8D"><enum>(D)</enum><text display-inline="yes-display-inline">has in effect a policy or practice that either prohibits, or in effect prevents, the Secretary of Homeland Security from gaining access to campuses or access to students (who are 17 years of age or older) on campuses, for purposes of Department of Homeland Security recruiting in a manner that is at least equal in quality and scope to the access to campuses and to students that is provided to any other employer.</text></subparagraph></paragraph><paragraph id="H4CD7113E1938455597B61291E2CA44D4"><enum>(2)</enum><header>Exceptions</header><text display-inline="yes-display-inline">An institution of higher education shall not be considered a sanctuary campus for purposes of this section based solely on the institution having a policy under which its officials, with respect to an individual who comes forward as a victim or a witness to a criminal offense, will not—</text><subparagraph id="H6AE9AA39862E46939287443896F8360D"><enum>(A)</enum><text display-inline="yes-display-inline">send, receive, maintain, or exchange with any Federal, State, or local government entity information regarding the citizenship or immigration status (lawful or unlawful) of the individual; or</text></subparagraph><subparagraph id="HB04F20E2BEB548CDA6B0F4F653B41F0B"><enum>(B)</enum><text display-inline="yes-display-inline">comply with a request made by the Secretary of Homeland Security under section 236 or 287 of the Immigration and Nationality Act (8 U.S.C. 1226 or 1357) to comply with a detainer for, or notify about the release of, the individual.</text></subparagraph></paragraph></subsection><subsection id="HA27A9BC9799C4B5A9F026CCB3C15AB43"><enum>(b)</enum><header>Determination by Secretary of Homeland Security</header><text display-inline="yes-display-inline">Whenever the Secretary of Homeland Security makes a determination that an institution of higher education is a sanctuary campus, the Secretary—</text><paragraph id="HBC7E50410E6840BF91BF15C26441F0FC"><enum>(1)</enum><text>shall transmit a notice of the determination to the Secretary of Education; and</text></paragraph><paragraph id="H0BEC4BA1973F450684E7C4B53BF96AAC"><enum>(2)</enum><text display-inline="yes-display-inline">shall publish in the Federal Register a notice of the determination and the effect of the determination on the eligibility of the institution for funding under this title.</text></paragraph></subsection><subsection id="H99650845E8F14ED28EAE3836F8715920"><enum>(c)</enum><header>Effect of determination</header><text>An institution determined under subsection (b) to be a sanctuary campus is ineligible to receive funds under this title.</text></subsection><subsection id="H851B82BB16334DF49964705012429A75"><enum>(d)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of the Congress that providing the public benefit of in-State tuition to an alien who lacks lawful immigration status in the United States creates an incentive for illegal immigration and encourages and induces aliens to come to, enter, or reside in the United States, as described in section 274(a)(1)(A)(iv) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324(a)(1)(A)(iv)</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H86291284F2D74B3CBCAE0CF6C2934B29"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall take effect on the date that is 90 days after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
