Maloney of New York</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XIX of the Social Security Act to remove the exclusion from medical assistance under the Medicaid program of items and services for patients in an institution for mental diseases, and for other purposes.</official-title></form><legis-body id="HEDDF9EFF9B524F8C827694921A0BCB1D" style="OLC"><section id="HC65EDC54D49545A1BA4501067827C26E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Michelle Alyssa Go Act</short-title></quote>.</text></section><section id="H04CC2CB6AEE44C08B5E1BEEA6087DC6E"><enum>2.</enum><header>Removal of age exclusion from medical assistance of items and services for patients in an institution for mental diseases</header><subsection id="HF4B89EBDEF9A42A0B5DF43A977D4EF3A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1905(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended, in the first sentence, in the matter following paragraph (31)—</text><paragraph id="H2163BC6979B54D14816AC16C7C4985B5"><enum>(1)</enum><text>by striking <quote>such term does not include—</quote> and all that follows through <quote><header-in-text level="subparagraph" style="OLC">(A)</header-in-text> any</quote> and inserting <quote>such term does not include any</quote>; </text></paragraph><paragraph id="H6D6983DF4D8B4FF6AB2901412A92E816"><enum>(2)</enum><text>by striking <quote>; or</quote> and inserting a period; and</text></paragraph><paragraph id="H930C71095D5B4919A9630410AC7D7FA3"><enum>(3)</enum><text>by striking subparagraph (B).</text></paragraph></subsection><subsection id="HC608D2601BA948CD8777BEAE78CE6959"><enum>(b)</enum><header>Conforming amendments To permit medical assistance for IMD patients under 65 years of age</header><text display-inline="yes-display-inline">Title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a et seq.</external-xref>) is amended—</text><paragraph id="HBA03510A915442F5A46D650CA0EDF199"><enum>(1)</enum><text>in section 1902(a)—</text><subparagraph id="H6F5B73B2B789475A899ABE07428A3AF0"><enum>(A)</enum><text>in paragraph (20)—</text><clause id="H49E9938308474C8E913B8B900C0C2C1B"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>65 years of age or older</quote>; and</text></clause><clause id="H33B2784A9D0F4E1B8CA790CD23691EE8"><enum>(ii)</enum><text>in subparagraph (C), by striking <quote>65 years of age or older</quote>; and</text></clause></subparagraph><subparagraph id="H61C81D3616384B0F88EAF190D55551BF"><enum>(B)</enum><text>in paragraph (21) by striking <quote>65 years of age or older</quote>;</text></subparagraph></paragraph><paragraph id="H5DB3578A59A24585B9725CE2F7EAFD7B" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">in section 1905(a)(14), by striking <quote>65 years of age or over</quote>; and</text></paragraph><paragraph id="H573031F50BF04456B2C473329ED2CC97"><enum>(3)</enum><text display-inline="yes-display-inline">in section 1919(e)(7)(B)(i)(I), by striking <quote>65 years of age or older</quote>.</text></paragraph></subsection></section><section id="HDA1792ED24D04C7F8A59693ACA7A3107"><enum>3.</enum><header>Required standards for IMDs</header><text display-inline="no-display-inline">Section 1905(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(i)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H8361A29E20B649239DC13C1184C88EC3" display-inline="no-display-inline"><subsection id="H05B09F7063194FBEB33D945055D6F5FE"><enum>(i)</enum><header>Institution for mental diseases</header><text display-inline="yes-display-inline">The term <quote>institution for mental diseases</quote> means a hospital, nursing facility, or other institution that—</text><paragraph id="H3C222D1583E2412CB78753F19AFE205B"><enum>(1)</enum><text display-inline="yes-display-inline">is primarily engaged in providing diagnosis, treatment, or care of persons with mental diseases, including medical attention, nursing care, and related services; and</text></paragraph><paragraph id="HBE8B02DD119049448C5185400BE01283"><enum>(2)</enum><text display-inline="yes-display-inline">meets nationally recognized, evidence-based standards for mental health programs (and, in the case of an institution for mental diseases that provides treatment for substance use disorders, meets nationally recognized, evidence-based standards for substance use disorder programs, such as the latest standards set forth by the American Society of Addiction Medicine), approved by the Secretary, including standards that establish the types of services offered, hours of clinical care, and staffing credentials for such an institution, and any other standards as the Secretary may require.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HED8944DB62804D32887CDD905A5A6BD4"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect 180 days after the date of enactment of this Act and shall apply to State plans beginning on such date.</text></section></legis-body></bill>
