<section section-type="section-one" id="H1F975B79E34541F68504645EF4722ECE"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Servant Protection Act of 2022</short-title></quote>.</text></section> <section id="H604A287BED9A461B8B1243DAC7FF40A7"><enum>2.</enum><header>Privacy of personal information of government officials</header> <subsection id="HCECFB8392D344B5588941D60CD7D9AB3"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H9A524CC2D8404F6C8B3F8A00B302F227"><enum>(1)</enum><header>Government official</header><text>The term <term>government official</term> means—</text> <subparagraph id="HD1C54EB4934845329B5E776CEBDF0EE4"><enum>(A)</enum><text>any officer or employee described in section 1114 of title 18 United States Code; and</text></subparagraph>
<subparagraph id="H4B6DF5BC1FEC48C195A8BEDB0DFD8860"><enum>(B)</enum><text>any officer or employee of a State, a political subdivision of a State, or a Tribal government. </text></subparagraph></paragraph> <paragraph id="H4B7252EC4ACB4CA6992D04AC378A39E6"><enum>(2)</enum><header>Immediate family member</header><text>The term <term>immediate family member</term> has the meaning given the term in section 115 of title 18, United States Code.</text></paragraph>
<paragraph id="HB9475AFF5ED54D3BABD6F4016000144F"><enum>(3)</enum><header>Interactive computer service</header><text>The term <term>interactive computer service</term> has the meaning given the term in section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>).</text></paragraph> <paragraph id="H2FFB59582BA74D348E23E899876A60CC"><enum>(4)</enum><header>Personal information</header><text>The term <term>personal information</term> means—</text>
<subparagraph id="HC176993F00A84F529AE6DA711986BC9C"><enum>(A)</enum><text>a home address; or</text></subparagraph> <subparagraph id="HBCF671C9F9A14E009CCFF2F618250FF7" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>a home phone number. </text></subparagraph></paragraph>
<paragraph commented="no" id="H8225F2E285B94A54BA4E326430704D9D"><enum>(5)</enum><header>State</header><text>The term <term>State</term> means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and any possession of the United States.</text></paragraph> <paragraph commented="no" id="H4A8074D6358843B283C172E27C53EB72"><enum>(6)</enum><header>Tribal government</header><text>The term <term>Tribal government</term> has the meaning given the term <term>Indian tribal government</term> in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>). </text></paragraph></subsection>
<subsection id="H9E2BFB14C7B24B00A06E0C51BD0508C1"><enum>(b)</enum><header>Written demand to persons</header>
<paragraph id="HFF04EEF557CA490C99A5AA4D2DA2118F"><enum>(1)</enum><header>In general</header><text>A government official may directly, or through an agent designated by the government official, make a written demand to a person to refrain from publicly displaying on the internet the personal information of the government official or an immediate family member of the government official.</text></paragraph> <paragraph id="H65485C8C8F6A43459DAB2711D8034E65"><enum>(2)</enum><header>Effect of written demand</header><text>If a government official makes a written demand to a person under paragraph (1), the person—</text>
<subparagraph id="H1B7534FA0A6B49E8B010E685D9E4A95C"><enum>(A)</enum><text>shall, not later than 48 hours after the receipt of the written demand, remove any personal information of the government official or an immediate family member of the government official displayed on the internet by the person; and</text></subparagraph> <subparagraph id="H33EAC59E66BE45F994D1CC7C8A63D608"><enum>(B)</enum><text>during the 4-year period following the date of the receipt of the written demand, may not publicly display on the internet the personal information of the government official or an immediate family member of the government official. </text></subparagraph></paragraph></subsection>
<subsection id="H1746A07E4A7448FF882E58ACE8587C28"><enum>(c)</enum><header>Written demand to interactive computer service providers</header>
<paragraph id="HBECC4506B43747F691C5D0975B9B23A4"><enum>(1)</enum><header>In general</header><text>A government official may directly, or through an agent designated by the government official, make a written demand to the provider of an interactive computer service to remove the personal information of the government official or an immediate family member of the government official that is publicly displayed on the interactive computer service.</text></paragraph> <paragraph id="H62F9C9218C644B6BB5B759AEF49A7928"><enum>(2)</enum><header>Effect of written demand</header><text>If a government official makes a written demand to the provider of an interactive computer service under paragraph (1), the provider shall, not later than 48 hours after the receipt of the written demand, remove from the interactive computer service any personal information of the government official or an immediate family member of the government official that is publicly displayed on the interactive computer service.</text></paragraph></subsection>
<subsection id="H3C16C2A1CC2C473B99A2A449BE21D4FA"><enum>(d)</enum><header>Cause of action</header>
<paragraph id="H9F1BF421055E499480C4060AF974E90C"><enum>(1)</enum><header>In general</header><text>A government official who is aggrieved by a violation of subsection (b)(2) or (c)(2) may bring a civil action against the person or the provider of an interactive computer service, respectively, that violated that subsection in an appropriate district court of the United States.</text></paragraph> <paragraph id="HAEDFB90FEFE2418D9FDF3AC0D1A579EB"><enum>(2)</enum><header>Relief</header><text>In an action under paragraph (1), the court may award—</text>
<subparagraph id="H6A1AC9346CA043659BB0A3CC780BF58F"><enum>(A)</enum><text>injunctive relief;</text></subparagraph> <subparagraph id="H764984FFCE114A169E92F4EDFFC522D5"><enum>(B)</enum><text>if injury or damage results from the violation of paragraph subsection (b)(2) or (c)(2), the greater of—</text>
<clause id="H0576AEB73C8645809ED36DFAB5C61F08"><enum>(i)</enum><text>actual damages; or</text></clause> <clause commented="no" display-inline="no-display-inline" id="H2FB1C1CB899E4AB48A9BEA4E384D6C97"><enum>(ii)</enum><text>$1,000; and</text></clause></subparagraph>
<subparagraph id="HA8E32CF688814E1EA2938C1B9B618184"><enum>(C)</enum><text>reasonable costs and attorney's fees.</text></subparagraph></paragraph></subsection></section> </legis-body></bill>
