which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Help America Vote Act of 2002 to require States to provide secured drop boxes for voted absentee ballots in an election for Federal office, and for other purposes.</official-title></form><legis-body id="H7EED4B1AF5C6434FAD0147C4925C77C1" style="OLC"><section id="HCA40A7696C094B35BA57A20E7EEF0E98" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Dropbox Access Act</short-title></quote>. </text></section><section id="H8C3155B3AFC54D299670007B681F1305" section-type="subsequent-section"><enum>2.</enum><header>Requiring States to provide secured drop boxes for voted absentee ballots in elections for Federal office</header><subsection id="HDFB928893160409CB846BED4F0FBD357"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Subtitle A of title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081</external-xref> et seq.) is amended—</text><paragraph id="HFF11D54E6CE14377A6A099C0106EC577"><enum>(1)</enum><text>by redesignating sections 304 and 305 as sections 305 and 306, respectively; and</text></paragraph><paragraph id="H5818DCD009EA478C90302E9D34B7A8E6"><enum>(2)</enum><text>by inserting after section 303 the following new section:</text><quoted-block style="OLC" id="H516F503E20654950822E1A0857E54743" display-inline="no-display-inline"><section id="H42BCC09CB9AD4519B95A6122949CD8CB"><enum>304.</enum><header>Use of secured drop boxes for voted absentee ballots</header><subsection id="H26B37938AB694826A2742DA21256F157"><enum>(a)</enum><header>Requiring use of drop boxes</header><text display-inline="yes-display-inline">In each county in the State, each State shall provide in-person, secured, and clearly labeled drop boxes at which individuals may, at any time during the period described in subsection (b), drop off voted absentee ballots in an election for Federal office.</text></subsection><subsection id="H014FACA2F697464D8344B88A4F381F20"><enum>(b)</enum><header>Minimum period for availability of drop boxes</header><text>The period described in this subsection is, with respect to an election, the period which begins 45 days before the date of the election and which ends at the time the polls close for the election in the county involved.</text></subsection><subsection id="HC9837575EC2F4DDA8CDE04EC1F47B5EA"><enum>(c)</enum><header>Accessibility</header><paragraph id="H3E8FE13AF4154DB9837DD550473328A1"><enum>(1)</enum><header>In general</header><text>Each State shall ensure that the drop boxes provided under this section are accessible for use—</text><subparagraph id="H7AADB6A0552D44E8A176DB33E39C882C"><enum>(A)</enum><text display-inline="yes-display-inline">by individuals with disabilities, as determined in consultation with the protection and advocacy systems (as defined in section 102 of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/15002">42 U.S.C. 15002</external-xref>)) of the State; and</text></subparagraph><subparagraph id="HB699521313B7452DA9EE5C168BC1F1CB"><enum>(B)</enum><text>by individuals with limited proficiency in the English language.</text></subparagraph></paragraph><paragraph id="H0F9D7972E06241F2A6A8947EB55E462E"><enum>(2)</enum><header>Determination of accessibility for individuals with disabilities</header><text>For purposes of this subsection, drop boxes shall be considered to be accessible for use by individuals with disabilities if the drop boxes meet such criteria as the Attorney General may establish for such purposes.</text></paragraph><paragraph id="H04912CF7EF864CE19EB37CA72050819B"><enum>(3)</enum><header>Rule of construction</header><text>If a State provides a drop box under this section on the grounds of or inside a building or facility which serves as a polling place for an election during the period described in subsection (b), nothing in this subsection may be construed to waive any requirements regarding the accessibility of such polling place for the use of individuals with disabilities or individuals with limited proficiency in the English language.</text></paragraph></subsection><subsection id="HEABB5E1D62144373AAEC7670BBB356FD"><enum>(d)</enum><header>Number of drop boxes</header><paragraph id="H876259C41BA140A3A6F797F575F40F79"><enum>(1)</enum><header>Formula for determination of number</header><text>The number of drop boxes provided under this section in a county with respect to an election shall be determined as follows:</text><subparagraph id="H07E77F0DF49D4782BF82804C64804ADB"><enum>(A)</enum><text>In the case of a county in which the number of individuals who are residents of the county and who are registered to vote in the election is equal to or greater than 20,000, the number of drop boxes shall be a number equal to or greater than the number of such individuals divided by 20,000 (rounded to the nearest whole number).</text></subparagraph><subparagraph id="HFF6EC13F0DBF4DD08AA244A66869B5FA"><enum>(B)</enum><text>In the case of any other county, the number of drop boxes shall be equal to or greater than one.</text></subparagraph></paragraph><paragraph id="H0EDACE9D8FCA4AFE8CA8DBE6958D4ED5"><enum>(2)</enum><header>Timing</header><text>For purposes of this subsection, the number of individuals who reside in a county and who are registered to vote in the election shall be determined as of the 90th day before the date of the election.</text></paragraph></subsection><subsection id="H337816E6365C449BB89BAD2AC32FF821"><enum>(e)</enum><header>Location of drop boxes</header><text>The State shall determine the location of drop boxes provided under this section in a county on the basis of criteria which ensure that the drop boxes are—</text><paragraph id="HA672956B26614B73AFEC50D7E9CD1725"><enum>(1)</enum><text display-inline="yes-display-inline">available to all voters on a non-discriminatory basis;</text></paragraph><paragraph id="HD20C41B2AF654FE895B796648071C556"><enum>(2)</enum><text>accessible to voters with disabilities (in accordance with subsection (c));</text></paragraph><paragraph id="H77A48B2A72A8479A82B13957C0FE09B5"><enum>(3)</enum><text>accessible by public transportation to the greatest extent possible;</text></paragraph><paragraph id="H8767DCF27CC8447D92CE3D926CA3CA28"><enum>(4)</enum><text>available during all hours of the day; and</text></paragraph><paragraph id="HD4444B01498E45D7996815DFB1E306F5"><enum>(5)</enum><text>sufficiently available in all communities in the county, including rural communities and on Tribal lands within the county (subject to subsection (f)).</text></paragraph></subsection><subsection id="HD065858E19D04A96978BC6B34226F31F"><enum>(f)</enum><header>Rules for drop boxes on Tribal lands</header><text display-inline="yes-display-inline">In making a determination of the number and location of drop boxes provided under this section on Tribal lands in a county, the appropriate State and local election officials shall—</text><paragraph id="H6EE768E06F364A54827C6904877D2F0A"><enum>(1)</enum><text>consult with Tribal leaders prior to making the determination; and</text></paragraph><paragraph id="H8817498A39CE4A7A8737578B875DB3D9"><enum>(2)</enum><text>take into account criteria such as the availability of direct-to-door residential mail delivery, the distance and time necessary to travel to the drop box locations (including in inclement weather), modes of transportation available, conditions of roads, and the availability (if any) of public transportation.</text></paragraph></subsection><subsection id="H41514957D993473C8D1832865136E475"><enum>(g)</enum><header>Posting of information</header><text>On or adjacent to each drop box provided under this section, the State shall post information on the requirements that voted absentee ballots must meet in order to be counted and tabulated in the election.</text></subsection><subsection id="H326CDED940DB472495A72F1ACC69754E"><enum>(h)</enum><header>Effective date</header><text>This section shall apply with respect to the regularly scheduled general election for Federal office held in November 2022 and each succeeding election for Federal office.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1CCEF8539BE54006AF8B83F70B6DDBF2"><enum>(b)</enum><header>Conforming amendment relating to enforcement</header><text display-inline="yes-display-inline">Section 401 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21111">52 U.S.C. 21111</external-xref>) is amended by striking <quote>and 303</quote> and inserting <quote>303, and 304</quote>. </text></subsection><subsection id="H87BB549CB0654CA7A472414144C72090"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents of such Act is amended—</text><paragraph id="HEC94C6FEA33E49C2B01B5BF44D93312D"><enum>(1)</enum><text>by redesignating the items relating to sections 304 and 305 as relating to sections 305 and 306, respectively; and</text></paragraph><paragraph id="H9E2D2B13AB3E4DEB818644C113D62DF4"><enum>(2)</enum><text>by inserting after the item relating to section 303 the following new item:</text><quoted-block style="OLC" id="H6A4D8EF60E81467397E5958654D5D5DD" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 304.
