which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a commission to develop a helicopter usage management plan for certain airspace, and for other purposes.</official-title></form><legis-body id="H61CE4F29B507470AAFE3C348F0E0A1F5" style="OLC"><section id="H9EFF9DCC6F2841B8B8050988A318BE85" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helicopter Safety and Noise Management Act</short-title></quote>.</text></section><section id="H8F704712EEC04ADF9EA75E40C1DD4F7F"><enum>2.</enum><header>Helicopter usage management plan</header><subsection id="H0FE8F11CE4F94232B5BEBE51FCFCF095"><enum>(a)</enum><header>Commission for development of rotocraft management plan</header><text display-inline="yes-display-inline">At least 2 Governors and 1 Mayor with jurisdiction over covered airspace shall—</text><paragraph id="H4389B7011D52477AB4B5B1029C65B5EC"><enum>(1)</enum><text>jointly establish a commission to develop the helicopter usage management plan required under subsection (b);</text></paragraph><paragraph id="H589E025A9B82477E8A2AB66357439A99"><enum>(2)</enum><text>serve as Co-Chairs of such commission; </text></paragraph><paragraph id="H8FC4B8DFC9164D27A17C1EBA8F115C2B"><enum>(3)</enum><text display-inline="yes-display-inline">include the Administrator of the Federal Aviation Administration on the commission; and</text></paragraph><paragraph id="H77343820A49343A3B2463A56E2ABF9E1"><enum>(4)</enum><text display-inline="yes-display-inline">each appoint 3 additional Members to serve on the commission who are helicopter noise and safety advocates that reside in the covered airspace and are negatively impacted by nonessential helicopter flights.</text></paragraph></subsection><subsection id="H56450848E262433D93B218A1608F76EA"><enum>(b)</enum><header>Development of plan</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the commission established under subsection (a) shall develop a helicopter usage management plan for covered airspace that—</text><paragraph id="H447F032EF4E64B41BA7D2335112AE7D8"><enum>(1)</enum><text display-inline="yes-display-inline">prohibits the operation of a nonessential civil rotorcraft in covered airspace without a permit described under subsection (c) from the Federal Aviation Administration;</text></paragraph><paragraph id="HD0A09ABFEB23445882007E75239CEACB"><enum>(2)</enum><text display-inline="yes-display-inline">establishes a system for substantially reducing the number of nonessential civil rotorcraft that can operate in covered airspace at any given time; and</text></paragraph><paragraph id="HCFB32C5B758645D48B875FF9D90B820F"><enum>(3)</enum><text>establishes a competitive bidding program for civil nonessential rotocrafts to operate in such airspace.</text></paragraph></subsection><subsection id="HA9D124282F714BA7AEA193EFF6D119AD"><enum>(c)</enum><header>Number of nonessential rotorcrafts authorized</header><text display-inline="yes-display-inline">In determining the number of nonessential rotorcrafts authorized under the competitive bidding program established under subsection (b)(3), the commission shall take into consideration—</text><paragraph id="HDCB27EAC97704605B59384A860D8A1D5"><enum>(1)</enum><text>the safety record of the person submitting the proposal or pilots employed by the person; </text></paragraph><paragraph id="HC6F6930EC6584264901D1837BC382D59"><enum>(2)</enum><text>any quiet aircraft technology to be used by the person submitting the proposal; </text></paragraph><paragraph id="H3FB4D7C6118B44FDAB08C8907687416B"><enum>(3)</enum><text>the experience of the person submitting the proposal with operating in such airspace;</text></paragraph><paragraph id="HB6F7C14CC9DC4953A92414171E48FDF1"><enum>(4)</enum><text>the financial capability of the person submitting the proposal; </text></paragraph><paragraph id="HC2D3A78BB0ED412C8A10A35E7BB9C6EB"><enum>(5)</enum><text>any training programs for pilots provided by the person submitting the proposal; and </text></paragraph><paragraph id="H048A4E620F7949A19D04E91643AC3CD6"><enum>(6)</enum><text>the number of existing nonessential rotorcrafts authorized and the current level of service and equipment provided by any such operators.</text></paragraph></subsection><subsection id="HEC5A2F627D2F46DBA46706A616A2E943"><enum>(d)</enum><header>Public comment period</header><paragraph id="HD1026AEAAC934EB4980AC4794A0961ED"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The commission established under subsection (a) shall provide notice of, and an opportunity for, at least 60 days of public comment.</text></paragraph><paragraph id="H76120C3107B040579C4976E0648F4828"><enum>(2)</enum><header>Timing</header><text>The notice required under paragraph (1) shall occur at least 60 days before the public comment period.</text></paragraph><paragraph id="H7B02695200F44ECB89C5EBDDA6E06310"><enum>(3)</enum><header>Public hearings</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the commission shall hold at least 4 public hearings in the communities impacted by the plan described in subsection (b) to solicit feedback with respect to the helicopter usage management plan.</text></paragraph></subsection><subsection id="HD0EC608432DF4FF2B800D3E5173E7B23"><enum>(e)</enum><header>Establishment of plan and permit</header><text display-inline="yes-display-inline">The Administrator shall—</text><paragraph id="HAAC8A28794994C319661C2383C7A9753"><enum>(1)</enum><text display-inline="yes-display-inline">implement the helicopter usage management plan established under subsection (b); and</text></paragraph><paragraph id="HA1C42EC352264AB8BB390DA61B9B356D"><enum>(2)</enum><text>establish a permit system referred to in subsection (b)(1) under which owners or operators of nonessential civil rotorcraft are required to hold a valid permit from the Administrator to operate such rotocraft in covered airspace.</text></paragraph></subsection><subsection id="H207A2C958D90419DBAE43DA6CCFBB617"><enum>(f)</enum><header>Essential use</header><paragraph id="HBD969E2A2183483A9EE0B468D79F9CFF"><enum>(1)</enum><header>Public health and safety</header><text>The plan developed under subsection (b) shall not apply any limitation or requirement to the operation of a civil rotorcraft for purposes of public health and safety, including—</text><subparagraph id="H79C5D920C02546A3B5B4FD0D2E4F0C81"><enum>(A)</enum><text display-inline="yes-display-inline">law enforcement;</text></subparagraph><subparagraph id="H3A7ED200DEF7473583F29662F1D3B196"><enum>(B)</enum><text>emergency response;</text></subparagraph><subparagraph id="HE5CB1E9047584FE2AAEA6950D7B3DF7D"><enum>(C)</enum><text>disaster response;</text></subparagraph><subparagraph id="H3591A0F0D00F44F8BF80CDD12A484FF5"><enum>(D)</enum><text>the provision of medical services;</text></subparagraph><subparagraph id="HC98372F9A632452A82B16999EEFAF32F"><enum>(E)</enum><text>scientific research; and</text></subparagraph><subparagraph id="H92DF859B74D14A9DA0BB4F5329A4365D"><enum>(F)</enum><text>official purposes by a news organization.</text></subparagraph></paragraph><paragraph id="H30E67990D25944A7BF9DE91D1C9D1C0A"><enum>(2)</enum><header>Infrastructure maintenance</header><text display-inline="yes-display-inline">The plan developed under subsection (b) shall not apply any limitation or requirement to the operation of a civil rotorcraft for purposes of heavy-lift operations in support of construction and infrastructure maintenance.</text></paragraph></subsection><subsection id="HD666F539973B44299EECE283497A101E"><enum>(g)</enum><header>Covered airspace defined</header><text>In this section, the term <quote>covered airspace</quote> means the airspace directly over any city with a population over 7 million people and with a population density of over 25,000 people per square mile, including the airspace over any waterways considered within the limits of such city. </text></subsection></section></legis-body></bill>
