which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the National Labor Relations Act to adjust the dollar thresholds for National Labor Relations Board jurisdiction over certain labor disputes, and for other purposes.</official-title></form><legis-body id="H0650C10B1AE647D8AF4C70D5AF670B00" style="OLC"><section id="H4DF0D31F03FD4FFFB205C57A649A046B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Businesses before Bureaucrats Act</short-title></quote>. </text></section><section id="H4E39043335994CC6A4151F3692319441"><enum>2.</enum><header>Increase of dollar threshold for National Labor Relations Board jurisdiction over certain labor disputes</header><subsection id="H6ECB3A8447D9472D8B6E8384CEE7BD59"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 14(c) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/164">29 U.S.C. 164(c)</external-xref>) is amended—</text><paragraph id="HDE02198DA90C456B9531B53811CE93E2"><enum>(1)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></paragraph><paragraph id="H2870BC0235FF4714BE73FED4AD4C1FF2"><enum>(2)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" id="H7B9BD060D14B43B4A2D1F9D1189DE412" display-inline="no-display-inline"><paragraph id="H88DB2A44D5B74D5AB8629173F1C26833"><enum>(2)</enum><text display-inline="yes-display-inline">In establishing by rule any dollar threshold with respect to a class or category of employers for the purposes of declining to assert jurisdiction over certain labor disputes involving such class or category of employers, the Board shall establish such dollar threshold at an amount—</text><subparagraph id="H98BD411DA70349E0B90CB52883AEBE71"><enum>(A)</enum><text>for calendar year 2022, equal to the product of—</text><clause id="H2271BBF7630D450D8E31578AFEAC8A57" display-inline="no-display-inline"><enum>(i)</enum><text>the dollar threshold applicable to such class or category as of the day prior to the date of enactment of this paragraph, multiplied by</text></clause><clause id="H7B8B82DEF1B44C338B6BD06E8CBFC95A" display-inline="no-display-inline"><enum>(ii)</enum><text>ten; and</text></clause></subparagraph><subparagraph id="H2A447C6C6D3C40E2A08B74D66BB69FF4"><enum>(B)</enum><text>for any calendar year after 2022, equal to the product of—</text><clause id="H6203262CE7434FE895BE66211D81CF8A"><enum>(i)</enum><text>the dollar threshold applicable to such class or category for calendar year 2022 (after the date of enactment of this paragraph), multiplied by</text></clause><clause id="H6C360DB382A3485194C2F743E49F7B8D"><enum>(ii)</enum><text>the quotient obtained by dividing—</text><subclause id="HE102A8C6D2314E13BF205F24BF44124E"><enum>(I)</enum><text display-inline="yes-display-inline">the Personal Consumption Expenditure Per Capita Index (as published by the Bureau of Economic Analysis) for such calendar year after 2022; by</text></subclause><subclause id="H41E8EFBF074F45C5B86BA28C126D9C7B"><enum>(II)</enum><text display-inline="yes-display-inline">the Personal Consumption Expenditure Per Capita Index for calendar year 2022.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H05F6E650741D41FCA8948EF835A37C77"><enum>(b)</enum><header>Personal consumption expenditure per capita index</header><text display-inline="yes-display-inline">The Bureau of Economic Analysis of the Department of Commerce shall prepare and publish an index reflecting expenditures for personal consumption by Americans on a per capita basis for each year, beginning calendar year 2023, and such index shall be known as the <quote>Personal Consumption Expenditure Per Capita Index</quote>. </text></subsection><subsection id="HBD6D304B7445479EA2456384B5AACE1C"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to any decision of the National Labor Relations Board relating to the assertion of its jurisdiction over a labor dispute made after the date of enactment of this section.</text></subsection></section></legis-body></bill>
