name-id="L000593">Mr. Levin of California</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Credit Reporting Act to institute a 1-year waiting period before medical debt will be reported on a consumer’s credit report and to remove paid-off and settled medical debts from credit reports that have been fully paid or settled, to amend the Fair Debt Collection Practices Act to provide a timetable for verification of medical debt and to increase the efficiency of credit markets with more perfect information, and for other purposes.</official-title></form><legis-body id="HF7C35C53C5B347E2AC5141DAFA72A43A" style="OLC"><section id="H5AD3107739B342539EC1B6B18E2B9147" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medical Debt Relief Act of 2021</short-title></quote>.</text></section><section id="H754DA0A634174A6786770257328EFD5F"><enum>2.</enum><header>Amendments to Fair Credit Reporting Act</header><subsection id="H98493136D94340B2B6702FCC3713FD90"><enum>(a)</enum><header>Medical debt defined</header><text>Section 603 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H47FB355225114EE4A00BBD9D4018B299" style="OLC"><subsection id="H4D44A0F9DBDA4F90B96F3D1B62859253"><enum>(bb)</enum><header>Medical debt</header><text>The term <term>medical debt</term> means a debt described in section 604(g)(1)(C).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8D0518DCEF134A82938A6F106C555E83"><enum>(b)</enum><header>Exclusion for paid or settled medical debt</header><text>Section 605(a) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681c">15 U.S.C. 1681c(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H935A6FE44DC14C52B83317E77B93292C" style="OLC"><paragraph id="HD1516A8F80084782B58910693D059081" indent="up1"><enum>(9)</enum><text display-inline="yes-display-inline">Any information relating to a medical debt if the date on which the debt was placed for collection, charged to profit or loss, or subjected to any similar action antedates the report by less than 1 year.</text></paragraph><paragraph id="H4E80BF1B3FD64DA5AEE96E7CC8432D5F" indent="up1"><enum>(10)</enum><text>Any information relating to a fully paid or settled medical debt that had been characterized as delinquent, charged off, or in collection which, from the date of payment or settlement, antedates the report by more than 45 days.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section display-inline="no-display-inline" id="H453A344A1D784A5E9E17DE022C82C64E" section-type="subsequent-section"><enum>3.</enum><header>Amendments to the Fair Debt Collection Practices Act</header><subsection id="H6D76E409411B45A9A00EE9D0EA93AC45"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 809 of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692g">15 U.S.C. 1692g</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H1727F9F4E4A9472A9B926267DF7906FB" style="OLC"><subsection id="HBD3FD44C0E924113AC4FEE6DFF871411"><enum>(f)</enum><header>Additional notice requirements for medical debt</header><paragraph id="HC6948DB8BC044171BE391169603E034D"><enum>(1)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph id="HAE21520088CF4A53AD9312EBD16EA20A"><enum>(A)</enum><header>Consumer reporting agency</header><text>The term <term>consumer reporting agency</term> has the meaning given the term in section 603(f) of the Fair Credit Reporting Act.</text></subparagraph><subparagraph id="H95B0327D345C44018AD0DCAC0B4E7201"><enum>(B)</enum><header>Medical debt</header><text display-inline="yes-display-inline">The term <term>medical debt</term> means a debt arising from the receipt of medical services, products, or devices.</text></subparagraph></paragraph><paragraph id="H6E01B1BDC0494DA992736CE69439080A"><enum>(2)</enum><header>Notice about credit reporting</header><text display-inline="yes-display-inline">Before furnishing information regarding a medical debt of a consumer to a consumer reporting agency, the person furnishing the information shall send a statement to the consumer that includes the following:</text><subparagraph id="H89DF8F449D2E44229F3627F0305235E2"><enum>(A)</enum><text display-inline="yes-display-inline">A notification that the medical debt may not be reported to a consumer reporting agency until the end of the 1-year period beginning on the date on which the person sends the statement.</text></subparagraph><subparagraph id="HA7526A8D70734F34A265315DB0BBDD05"><enum>(B)</enum><text display-inline="yes-display-inline">The specific date that is the end of the 1-year period beginning on the date on which the person sends the statement.</text></subparagraph><subparagraph id="H93C99D1ACB204ED7A61938047B99576C"><enum>(C)</enum><text>A notification that, if the debt is settled or paid by the consumer or an insurance company during the 1-year period beginning on the date on which the person sends the statement—</text><clause id="H58DF0889C7BE4916B485F2533C21D34B"><enum>(i)</enum><text>the debt may not be reported to a consumer reporting agency; and</text></clause><clause id="H3A4FFC92524048BA9D1A4309E62F696F"><enum>(ii)</enum><text>the consumer may, during that 1-year period—</text><subclause id="H50B478F137224E4BA5D11A2D561599F4"><enum>(I)</enum><text>communicate with an insurance company to determine coverage for the debt; or</text></subclause><subclause id="H0140373EC7344842A18AF940F54A86C2"><enum>(II)</enum><text>apply for financial assistance.</text></subclause></clause></subparagraph></paragraph><paragraph id="H340B5F5E3E0D42609B2FB1F35F2B8DAA"><enum>(3)</enum><header>No reporting during 1-year period</header><subparagraph id="H4CACB99965F84805B1783F059ED384BE"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">During the 1-year period described in paragraph (2), no person may communicate with, or report any information to, any consumer reporting agency regarding a debt described in that paragraph.</text></subparagraph><subparagraph id="HA6123C4692764FE7A8C87E96AFA4397B"><enum>(B)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in subparagraph (A) may be construed to affect when a debt collector may engage in activities to collect or attempt to collect any debt owed or due or asserted to be owed.</text></subparagraph></paragraph><paragraph id="H761F27C8408E43758786F91774B1A2C1"><enum>(4)</enum><header>Reporting after the 1-year period</header><text display-inline="yes-display-inline">Nothing in this subsection shall prohibit a person from communicating with, or reporting any information to, a consumer reporting agency regarding a medical debt of a consumer after the end of the 1-year period described in paragraph (2) with respect to the debt.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
