Maloney of New York</cosponsor>, <cosponsor name-id="S001168">Mr. Sarbanes</cosponsor>, <cosponsor name-id="P000617">Ms. Pressley</cosponsor>, <cosponsor name-id="V000081">Ms. Velázquez</cosponsor>, <cosponsor name-id="H001081">Mrs. Hayes</cosponsor>, and <cosponsor name-id="O000173">Ms. Omar</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name>, and in addition to the Committee on <committee-name committee-id="HBA00">Financial Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Student Loan Ombudsman of the Department of Education to provide student loan data to the Bureau of Consumer Financial Protection, and for other purposes.</official-title></form><legis-body id="HA0B64F732BFB4B42AAB3B906E9E005AC" style="OLC"><section id="H1E30EC924B824C8CA90F8A97834E8633" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>CFPB Student Loan Integrity and Transparency Act of 2022</short-title></quote>.</text></section><section id="H564E527FDD6A4CD6B367AF2D9A57F95A"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HE430EB480FD1426E89439CB5178096DF"><enum>(1)</enum><text>The total amount of outstanding student loans just surpassed $1,500,000,000,000.</text></paragraph><paragraph id="HEEC9FE7A69C1430CA858E78F8859C18E"><enum>(2)</enum><text>Student loans are the biggest category of consumer borrowing after mortgages.</text></paragraph><paragraph id="H054CD20562F14EC1B1F26DB5549777A7"><enum>(3)</enum><text>Since the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5481">12 U.S.C. 5481 et seq.</external-xref>) established the Consumer Financial Protection Bureau, the Bureau has fought to ensure families receive a fair shake as they strive for the American Dream.</text></paragraph><paragraph id="H27075A1137DE4FBDB21029B15C1B93B7"><enum>(4)</enum><text display-inline="yes-display-inline">The Consumer Financial Protection Act of 2010 created a Student Loan Ombudsman at the Consumer Financial Protection Bureau. In 2011, the Consumer Financial Protection Bureau established an Office for Students and Young Consumers, led by the Student Loan Ombudsman, to assist students who are mistreated or misled by predatory lenders.</text></paragraph><paragraph id="H449F7590882F451CA2A89670C263D0BA"><enum>(5)</enum><text>Since its creation, the Office of Students and Young Consumers, led by the Student Loan Ombudsman, has defended military families in the United States from predatory lenders and for-profit colleges, and other unscrupulous businesses.</text></paragraph><paragraph id="HC447E533A8C34821856F16B989AC2DB6"><enum>(6)</enum><text>The Office of Students and Young Consumers helped tens of thousands of active-duty military service members who were being overcharged for student loans, and coordinating with the United States Justice Department, succeeded in returning $60,000,000 to the service members, and required the industry to improve its practices.</text></paragraph><paragraph id="H86B0955F74DC468683380531E83A60AE"><enum>(7)</enum><text>The Office of Students and Young Consumers has collected and analyzed hundreds of thousands of student complaints.</text></paragraph><paragraph id="H44D6121905854622BD8C9E8E7C646573"><enum>(8)</enum><text>The Office of Students and Young Consumers has recovered more than $750,000,000 on behalf of defrauded students.</text></paragraph><paragraph id="H4400CF45A6504C4591A71305AB2E623E"><enum>(9)</enum><text>The Office of Students and Young Consumers has been instrumental in the shutdown of for-profit universities and colleges that had been accused of predatory practices.</text></paragraph><paragraph id="H1F9748709BB343CFAF0DD45EAB7C8E8E"><enum>(10)</enum><text>The Office of Students and Young Consumers collected data and authored a report that showed large banks overcharged college students fees that were higher than many of their competitors. The report remained unpublished by the Administration until a recent FOIA request opened it to the public.</text></paragraph><paragraph id="H26A8D74D99074186B3A57468DBCEF9D1"><enum>(11)</enum><text>The Department of Education Office of Inspector General released a concerning report on February 12, 2019, that highlighted the alarming frequency at which student loan contractors and vendors engaged in noncompliance with Federal requirements for servicing student loans.</text></paragraph></section><section id="HA4C701FA800D4753BD91497B8AB12B7A"><enum>3.</enum><header>Department of Education student loan information</header><text display-inline="no-display-inline">Section 141(f)(3) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1018">20 U.S.C. 1018(f)(3)</external-xref>) is amended—</text><paragraph id="H0536CDC963E34D9AB1D3266AF15CD1EC"><enum>(1)</enum><text>by redesignating subparagraphs (A) and (B) as subparagraphs (B) and (C), respectively; and</text></paragraph><paragraph id="H8D04C4AF1CBE4033999AF47F306C0736"><enum>(2)</enum><text>by inserting before subparagraph (B) the following:</text><quoted-block display-inline="no-display-inline" id="HCCC49ED6F4E84646A94A860F68CE3E88" style="OLC"><subparagraph id="H3F1E74B86DF04E3F849701A954411E94"><enum>(A)</enum><text>provide information relating to student loans to the Director of the Consumer Financial Protection Bureau or the ombudsman of the Consumer Financial Protection Bureau designated under section 1035 of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5535">12 U.S.C. 5535</external-xref>) as requested by the Director of the Consumer Financial Protection Bureau or that ombudsman;</text></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section><section id="HB7A9430E7C4147B598B70A1B5335D4B8"><enum>4.</enum><header>Student loan contractor and vendor agreements</header><text display-inline="no-display-inline">Part G of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1088">20 U.S.C. 1088 et seq.</external-xref>) is amended by inserting after section 486A the following:</text><quoted-block display-inline="no-display-inline" id="H422375FEF5C84ADD8A67EEF27E2163B0" style="OLC"><section id="H7A04EA5A6A974D7FA14575AF053EF07E"><enum>486B.</enum><header>Contractor and vendor agreements</header><text display-inline="no-display-inline">The Secretary shall not enter into an agreement with a contractor or vendor that services loans under this title unless, as part of that agreement, such contractor or vendor asserts that the contractor or vendor will provide information to the Director of the Consumer Financial Protection Bureau or the ombudsman of the Consumer Financial Protection Bureau designated under section 1035 of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5535">12 U.S.C. 5535</external-xref>) as requested by the Director of the Consumer Financial Protection Bureau or that ombudsman.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H5C1133DB647842F1ABE6312D5A0634B4"><enum>5.</enum><header>Duty to provide adequate staffing; memoranda of understanding</header><subsection commented="no" id="H38FF8EA031E348D0BA5A11AE4123BE3B"><enum>(a)</enum><header>Duty To provide adequate staffing</header><text>Section 1013(a)(1) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5493">12 U.S.C. 5493(a)(1)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H1CEC47A7034841F78C163263940AE46D" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="HD223BAD0C5D543A39CDEDCC409120E0E"><enum>(D)</enum><header>Duty to provide adequate staffing</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A), the Director shall ensure that each specific functional unit and office described under subsections (b), (c), (d), (e), and (g) and any other unit and office with supervisory and enforcement duties, is provided with sufficient staff to carry out the functions, duties, and coordination of that unit or office, as applicable.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H343E5859D0B84CC781940C96F0B70FD3"><enum>(b)</enum><header>Memoranda of understanding</header><paragraph id="H380A6F9EDB5D46ACBEA81AC48A6BBEA7"><enum>(1)</enum><header>Reestablishment of memoranda of understanding</header><text>The memoranda of understanding between the Bureau of Consumer Financial Protection and the Department of Education entitled <quote>Memorandum of Understanding Between the Bureau of Consumer Financial Protection and the U.S. Department of Education Concerning the Sharing of Information</quote> (October 19, 2011) and <quote>Memorandum of Understanding Concerning Supervisory and Oversight Cooperation and Related Information Sharing Between the U.S. Department of Education and the Consumer Financial Protection Bureau</quote> (January 9, 2014)—</text><subparagraph id="HAF517CB8E7644F58A33973D7DB57F54E"><enum>(A)</enum><text>shall remain in effect and may not be terminated by any party to such memoranda; and</text></subparagraph><subparagraph id="H6E0F3811259E40F3883DE2079A89F06A"><enum>(B)</enum><text display-inline="yes-display-inline">may only be amended or revised if the parties to the memoranda determine that such amendment or revision would promote better interagency coordination to the benefit of consumers.</text></subparagraph></paragraph><paragraph id="HC1069D5C1E714EC39CBFC2810CE7AF2F"><enum>(2)</enum><header>Report on current MOUs</header><text display-inline="yes-display-inline">Not later than the end of the 30-day period beginning on the date of enactment of this Act, the Director of the Bureau of Consumer Financial Protection shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives a report listing—</text><subparagraph id="H38EEA22137EC47958DD97ADF33001FAC"><enum>(A)</enum><text>each memorandum of understanding in effect on November 24, 2017, to which the Bureau of Consumer Financial Protection was a party;</text></subparagraph><subparagraph id="HA734FA7C479E4FCD81B9E73D5620E863"><enum>(B)</enum><text display-inline="yes-display-inline">any changes made to a memorandum described in subparagraph (A) after November 24, 2017, including any memorandum of understanding rescinded since that date; and</text></subparagraph><subparagraph id="HFC04F8E56C124E92B428BD43C2ACAF47"><enum>(C)</enum><text>a justification for each change or rescission described in subparagraph (B).</text></subparagraph></paragraph><paragraph id="H3C01F3EFEE194F55BC2109FC0B1B30A9"><enum>(3)</enum><header>Semi-annual report on MOUs</header><text display-inline="yes-display-inline">Section 1016(c) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5496">12 U.S.C. 5496(c)</external-xref>) is amended—</text><subparagraph id="H467927E59BFB4F9BB632526EE563C216"><enum>(A)</enum><text>in paragraph (8), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H1B084F7415B84349B2CE63003D784C1C"><enum>(B)</enum><text>in paragraph (9), by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="HE4712FE3AF2945CC8F8C4CC1E63C5792"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H1A90F370DFBA44B1B317646F12526B84" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="H702C082F39F74836868AE37D8B2C6E4F"><enum>(10)</enum><text display-inline="yes-display-inline">a list of each memorandum of understanding in effect, as of the date on which the report is submitted, to which the Bureau is a party;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5073EDCF60434A7791D0488B21F5DAE6"><enum>(11)</enum><text display-inline="yes-display-inline">any changes made to a memorandum of understanding to which the Bureau is a party after the date on which the previous report required under subsection (b) was submitted; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6B3359E9110E43CF87FA07D7ABE202D0"><enum>(12)</enum><text display-inline="yes-display-inline">a justification for each change described in paragraph (11).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section></legis-body></bill>
